HomeMy WebLinkAboutBoard of Commissioners - Minutes - 07/15/1997i () Call to Order The Otter Tail County Board of Commissioners convened Tuesday, July 15, 1997 at 9:31 a.m. at _the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson, Bill Stone, and Virginia Portmann present. Commissioner Malcolm Lee was absent. Approval of Agenda Motion by Portmann, second by Nelson, and unanimously carried to approve the agenda of July 8, 1997 as presented with the following addition: · Request for Approval of the Safe & Sober Grant Agreement Approval of Minutes Mot.ion by Nelson, second by Stone, and unanimously carried to approve the County Board minutes of July 8, 1997 as presented. Turkey Feedlot Buzz Lundeen introduced a group of concerned citizens as the Otter Tail County Common Sense Land Use .Coalition. The group opposes the proposed Maplewood turkey feedlot location one- quarter mile west of Maplewood State Park. Mr. Lundeen presented a petition opposing this feedlot with 1,100 signatures as well as several other handouts. Motion by Portmann, second by Nelson, and unanimously carried to accept the petition as presented. Mr. Lundeen summarized a letter dated July 15, 1997 (exhibit B). He expressed outrage that a feedlot could be located so close to a state park and stated that Minnesota must preserve this beautiful park. In the letter, the group requests that the commissioners declare a moratorium on feedlot development in Otter Tail County. Mr. Lundeen explained that the MPCA meets tomorrow night and will likely take action within one week on this issue. The following concerned citizens spoke in opposition of the proposed feedlot with specific concerns regarding water runoff, the MPCA not listening to their concerns, lack of manure management plan, lack of water management plan, lack of air pollution control, and odor problems: Lennart Backstrom, Steve Zimmerman, Joe Merz, Nancy Eisinger, & Elizabeth Merz, . . . Chair Lindquist stated that the MPCA has authority in this feedlot matter. The Chair then called for opinions of the commissioners. Otter Tail County Board of Commissioners July 15, 1997 Page2 Commissioner Nelson expressed empathy with the citizens recognizing the hard work of the people with this difficult issue. · He expressed appreciation that this group is letting the County Board know how they feel. · · · Q Commissioner Stone questioned the reason why the developers don't want to build in a location where there is less opposition? · Commissioner Partmann spoke in favor of planning. This is a golden opportunity with the groundswell of the public and the number of signatures on the petition. The issue is countywide and how we can help the entire county. Our water is valuable. We want to protect the water. This is an opportunity for us to start discussing land use planning; however, there is a big price tag involved with countywide zoning. Ms. Partmann suggested that the County Board write to the MPCA stating that the Otter Tail County Board is opposed to this feedlot because more planning is required on this issue. Motion by Nelson, second by Partmann, and unanimously carried to request that, Assistant County Attorney David Hauser, draft a strongly worded letter to the MPCA opposing the proposed turkey feedlot because of it's location, local citizens being totally opposed, a need for protection of state parks, as well as a need for water and manure management plans. Additionally, the motion included a request to the MPCA via this letter to table approval of any permit(s) for the proposed feedlot so these concerns can be addressed. Application for Authorization for an Exemption from Lawful Gambling The Pelican Rapids Ladyslippers, Ducks Unlimited, have submitted an Application for Q Authorization for an Exemption from Lawful Gambling License for an event scheduled for August 11, 1997 at the Pelican Supper Club. No action was taken to prohibit the activity. Liquor License Applications Motion by Nelson, second by Partmann, and unanimously carried to approve the following applications for license: Big Chief Inc. Melissa Rogers RR 5, Box 222 Fergus Falls, MN Woody's Daniel and Maxine Woody PO Box 37 Richville, MN Off Sale 3.2 Malt Liquor License On/Off Sale 3.2 Malt Liquor License 1998 Overall Levy Limitation Auditor Wayne Stein, provided Otter Tail County's estimated payable 1998 overall levy limitation. Mr. Stein noted that these figures are estimated, not certified dollars. Discussion followed. Bid Award -S.A.P. 56-646-05 After previously advertising for bids, Rick West opened the following bids on July 9, 1997 at 1 :00 p.m. for S.A.P. 56-645-05, Bituminous Overlay and Aggregate Shouldering: Central Specialties, Inc. Alexandria, MN Mark Sand & Gravel Acquisition Company Fergus Falls; MN Anderson Bros. Construction of Brainerd . Brainerd, MN $190,746.45 $192,090.25 $204,215.51 The Highway Engineer noted that Mark Sand & Gravel's bid was read as $190,090.25, however, there was an error in addition in the bid and the correct bid amount is $192,090.25. Motion by Stone, second by Partmann, and unanimously carried to award S.A.P. 56-646-05 to Central Specialties, Inc. in the amount of $190,746.45 as recommended by the Highway Engineer. Used Highway Equipment Sale Mr. West reported that, per the board'i; direction, he re-bid the sale of used equipment in the form of oral quotations. Otter Tail County will receive $9,736 for infrastructure repairs. Otter Tail County Board of Commissioners July 15, 1997 Page4 Sub-Grant Agreement for Federal Assistance Under the Infrastructure Program for Sub-Grantees Q Otter Tail County Resolution No. 97-35 Upon a motion by Stone, second by Nelson, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: Be it. resolved that Otter Tail County enter into a Sub-grant Agreement with the Division of Emergency Management in the Minnesota Department of Public Safety for the program entitled Infrastructure Program for FEMA 1175-DR-MINNESOTA. . Richard West, County Engineer, is hereby authorized to execute and sign such Sub-grant Agreements and amendments as are necessary to implement the project on behalf of Otter Tail County. OTTER TAIL COUNTY BOA OFCOMMISS~ .... ~--- Attest:~ a_ B / ndy Lindquist( / Larry Krohn, Clerk -' Parkers Prairie Transfer Site Solid Waste Director Mike Hanan, reported that the Parkers Prairie Transfer Site is currently open · on Tuesdays and Thursdays for four hours each day. The county spends approximately $9,000 per year on site operation costs with revenue generating $2,375 annually; however, the site does provide a service for people in this area. Motion by Stone, second by Partmann, and unanimously carried to reduce the hours the Parkers Prairie Transfer Site facility will be open from eight hours per week (Tuesdays & Thursdays) to four hours per week on Saturdays effective September 1, 1997 with a review of cost and revenues at the facility in 90 days: Resolution Authorizing Execution of Agreement For the Safe and Sober Program Otter Tail County Resolution No. 97-36 Upon a motion by Stone, second by Partmann, and carried with Commissioner Nelson temporarily absent from the room, the Otter Tail County Board of Commissioners adopts the following resolution: Be it resolved that the Otter Tail County Sheriff's Department enter into a grant agreement with the Minnesota Department of Public Safety, Office of Traffic Safety, for the project entitled SAFE AND SOBER COMMUNITIES during the period from October 1, 1997 through September 30, 1998. Gary A. Fudge: Motion by Nelson, second by Partmann, and unanimously carried to approve the Conditional Use Permit of Rodney D. Fudge, (Sec. 15, Twp. 136, R. 40, Paul Lake & Rusch Lake) with conditions as recommended by the Planning Commission. Conditional Use Permit William H. Barber: Land & Resource Director, Bill Kalar, noted that the Planning Commission approved plan A conditional use request of William Barber. Mr. Kalar's opinion is that plan A should not be approved. This is a classic example of a plan whereby the building is not designed for the type of lot, but rather, the lot is being changed to accommodate the building. Mr. Kalar presented plan A and plan B to the commissioners and noted that plan B was the more desirable plan (less fill}. The Chair called for comments from the audience. John Madison representing the COLA and, in the interest of conserving wetlands, is in favor of plan 8 for this project. Applicant Bill Barber, commented that plan A is for a basement for a storm shelter, not a walkout. He prefers plan A, however, could live with plan 8. This proposal lies within a wetland area. Motion by Stone, second by Partmann, and unanimously carried to approve a Conditional Use Permit for Plan B for William Barber (Sec. 8, Twp, 134N, R. 3911\1, Ottertail Lake) as presented by the applicant subject to the applicant receiving Wetland Conservation Act approval. Commissioner Partmann requested that the Land & Resource Director talk to the Planning Commission regarding the need for housing/buildings to conform to the lot, not changing the lot to conform to a specific building. Conditional Use Permit Lyle Kachelmver/Douqlas Kramer: Mr. Kalar reported that the applicant did not appear at last week's Planning Commission meeting. The Chair called for audience comments relative to this CUP request. Mel Klein, representing the Marion Lake Association, reviewed some statistics regarding this property and voiced concern regarding the buildable area within lots 3, 4, & 5. Many letters of concern for development of this land have been received. Motion by Partmann, second by Nelson, and unanimously carried to deny the Conditional Use Permit request of Lyle Kachelmyer/Douglas Kramer (Sec. 8, Twp. 135N, R. 39W, Marion Lake} as recommended by the Planning Commission. Otter Tail County Board of Commissioners July 15, 1997 Page6 Conditional Use Permit-Patrick & Louise Tower: Motion by Stone, second by Partmann, and unanimously carried to approve the Conditional Use Permit request of Patrick & Louise Tower & Diane Herbert (Sec. 15, Twp. 136, R. 38, Big Pine Q Lake) with conditions as recommended by the Planning Commission. Conditional Use Permit-James & Jennifer Caliandro: Motion by Partmann, second by Stone, and unanimously carried to approve the Conditional Use Permit request of James & Jennifer Ca/iandro (Sec. 30, Twp. 133, R. 40, North Turtle Lake) with conditions as recommended by the Planning Commission. Conditional Use Permit -Erwin C. Brutlag: Motion by Stone, second by Nelson, and unanimously carried to approve the Conditional Use Permit of Erwin Brutlag (Sec. 32, Twp. 131, R. 42, Ten Mile Lake) as recommended by the Planning Commission. Conditional Use Permit -P. Luverne Foster: Mr. Kalar stated that this request is to fill a wetland area in a resort where campers are inadvertently driving and getting stuck. Applicant, Mr. Foster, stated that the area to be filled is about the size of a football field and would be covered with approximately 2 ½ feet of fill. Motion by Stone, second by Nelson, to approve the Conditional Use Permit of P. Luverne Foster (Sec. 18, Twp. 134, R. 40, Twin Lake) subject to compliance with the Wetland Conservation Act. Commissioner Partmann questioned why the area couldn't be staked so the first step (avoidance) O of the WCA is being followed rather than the third step (replacement). Hovey: Yea X X X X Motion by Partmann, second by Nelson, and unanimously carried to approve the Conditional Use Permit of Ivan M. Hovey (Sec. 15, Twp. 137, R. 42, Bass Lake) with conditions as recommended by the Planning Commission. Conditional Use Permit -Diane J. Aasen: Motion by Nelson, second by Partmann, and unanimously carried to approve the Conditional Use Permit of Diane J. Aasen (Sec. 15, Twp. 131, R. 40, Eagle Lake) as recommended by the Planning Commission. Conditional Use Permit-Walter J. Seifert: Mr. Kalar reported that the Board of Adjustment denied the variance request of Walter J. Seifert Q because the area is too fragile. No action taken by the County Board: 0 0 0 Water Plan Update Otter Tail County Board of Commissioners July 15, 1997 Page 7 Land & Resource Director, Bill Kalar, informed the County Board that BWSR approved the revised Comprehensive Local Water Plan of Otter Tail County. Payment Approval Motion by Partmann, second by Stone, and unanimously carried to reimburse the Employee's Committee for the "Employee of the Month" display frame for the Cavour Avenue building from the Commissioners' Contingency Fund in the amount of $31.57. Recess & Reconvene At 11 :31 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The Chairman declared the meeting reconvened at 1:00 p.m. Approval to Pay Bills Motion by Nelson, second by Partmann, and unanimously carried to approve bills per Attachment A of these minutes which include the following lodging payments. Cragun's Lodge & Conference Center The Kahler Hotel County Recorder, Wendy Metcalf MIS, Pat Larum Update -New Tax Laws Assessor Bob Moe provided several handouts relative to the 1997 Property Tax Law changes. He reviewed the class rate changes and how these law changes will affect Otter Tail County, Lengthy discussion followed. Public Hearing -Ditch No. 63 At 1 :30 p.m., Chairman Lindquist declared the Ditch No. 63 public hearing open and called for Ditch Inspector, Tiny Holm's, review of the ditch problem(s). Mr. Holm stated that he looked at Ditch No. 63 on June 12, 1997 upon request. He found a couple of large holes on the Hill property; one in which a small truck could be buried. The petition to repair states that the petitioners want to repair a ½ mile section of the pipe by replacing the 14-inch pipe with 15-inch pipe. There are a number of holes along the whole system. The amount of drainage into the Ditch No. 63 system has not increased over the years. In fact, some drainage has been closed off by the U.S. Fish & Wildlife Service. This is not a large· system as far as number of property owners. The system has deteriorated since last year. Mr. Holm reported that, in his opinion, repair of the system is necessary. Chairman Lindquist called for comments from the public. Orville Carlson questioned if the land where this tile is running is considered meandered land? He; stated that if it is meandered land, it isn't taxable. Additionally, Mr. Carlson did not feel everyone should pay for the repair on this ditch. Donald Grunewald stated that his farm has been split since the original. date of the ditch system and he did not feel that his property would benefit from the ditch repair, as the water from his property cannot reach the ditch system. · Loren Uhlig -Not in favor of paying. Otter Tail County Board of Commissioners July 15, 1997 Page 8 Dennis Zimmerman representing his father, Ervin Zimmerman, questioned how the benefited property owners will be determined and assessed? Chairman Lindquist responded that redetermination of benefits will cost $5,000 -$8,000. Redetermination and engineering study is costly. Chairman Lindquist indicated that the two petitioners were Louis Nordick and Lois Dillon. The Chairman called for petitioners' comments. Mike Dillon commented that he felt everyone who benefits from the ditch system should pay for the system. Assistant County Attorney, David Hauser, outlined the options. 1. The repair can be completed by the landowner. 2. Minor repairs can be completed by the county and would be assessed based on original benefited property owners. 3. A redetermination of benefits can be completed or individuals can petition to require the redetermination. 4. An engineering report can be ordered. Commissioner Partmann stated that the county doesn't own the ditch, the ditch belongs to the benefited property owners. The Ditch Inspector stated that the first option has been taken care of by the petitioners. Should 0 the county repair the system and assess or should a redetermination of benefits be completed? 0 Commissioners agreed that a repair is required. Commissioner Lindquist asked that each property owner contribute some money to the repair because that would be the cheapest way for everyone. The Chair declared the meeting recessed at 1 :57 p. m. to allow the property owners an opportunity to discuss this matter and agree upon a solution. The hearing was reconvened at 2:11 p.m. Upon the decision of the property owners to work out this required repair on their own with the assistance of Mr. Holm, Chairman Lindquist declared the Ditch No. 63 public hearing adjourned at 2:12 p.m. Ditch No. 41 The Ditch Inspector recommended that the City of New York Mills proceed with the Ditch No. 41 project. The County Board agreed with the recommendation and authorized the City of NYM to proceed. Adjournment At 2:16 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners adjourned until 1:00 p.m. on Tuesday, July 22, 1997.
