Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, June 17, 1997 at 9:30 a.m. at the Otter
Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson, Malcolm Lee, Bill Stone,
and Virginia Portmann present.
Approval of Agenda
Motion by Lee, second by Portmann, and unanimously carried to approve the County Board agenda of
June 17, 1997 as submitted.
Approval of Minutes
Motion by Nelson, second by Lee, and unanimously carried to approve the amended County Board minutes
of June 10, 1997 as follows:
Page 5, Conditional Use Permit -replace "in accordance with State law which dictates " ... you shall not fill or
excavate material in a Bluff Impact Zone ... ". with "since section IV. 3. B(b) of our Shoreland Management
Ordinance indicates that fill or excavated material must not be placed in bluff impact zones".
1997 Boating Enforcement Supplemental Agreement
Captain, Joe Peloquin, presented an agreement between Otter Tail County and the State of Minnesota
which provides an additional $3,000 for the County's boat and water program.
Motion by Nelson, second by Stone, and unanimously carried to authorize the Chair's signature to execute
the 1997 Boating Enforcement Supplemental Agreement (PWC -CFDA #20.005) as presented.
Joint Powers Agreement
Motion by Portmann, second by Lee, and unanimously carried to authorize the Chair's signature to execute
a Joint Powers Agreement between the Otter Tail County Sheriffs Department and the State DOC for work
release services. The amount of the contract, $12,000, provided from the State of Minnesota to Otter Tail
County is for fiscal year 1998.
Payment Approval
Motion by Portmann, second by Lee, and unanimously carried to approve payment, in the amount of
$75,635, for an update to the AS400 computer system.

Motion by Portmann, second by Stone, and unanimously carried to approve the following applications for

Motion by Lee, second by Portmann, and unanimously carried to approve payment, in the amount of $12,
payable to Central Bi-Products as authorized by Minnesota Statute 343.23 for dead animal removal costs
incurred on behalf of Nick Messer.
Authorization for Exemption from Lawful Gambling License
No action was taken to prohibit an application for Authorization for an Exemption from Lawful Gambling
License for an event scheduled for August 27, 1997 at Elks Point by the Fergus Falls Chapter of Ducks
Unlimited.
Postal Verification Cards
Motion by Lee, second by Nelson, and unanimously carried to enter into an agreement, for the period of

July 1, 1997 through June 30, 1998, with lnterTechnologies Group of the Department of Administration
through the Office of the Secretary of State for the production and mailing of Postal Verification Cards to r'\
those individuals registering to vote in Otter Tail County at a cost to Otter Tail County of 24 cents per card. \;,j;,/
Cemetery Regulations
Commissioner Nelson requested information as to the obligations of cemeteries. Auditor, Wayne Stein,
indicated that reports must be filed with the State Auditor's office relative to cemeteries, however, he was
not apprised of any obligations for abandoned cemeteries. Chairman Lindquist requested the Auditor and
County Attorney to research regulations regarding maintenance, etc. of cemeteries and report back to the
County Board.

Closed to the Public
Recess
At 11 :00 a.m., a motion was offered by Lee, seconded by Portmann, and unanimously carried to declare
the meeting of the Otter Tail County Board of Commissioners closed to the public for purposes of
conducting a performance review evaluation of Larry Krohn, County Coordinator, pursuant to M.S. 471.705
Subd. 1 d (d). A summary report of performance conclusions will be provided at the next regular board
meeting. Chairman Lindquist declared the closed session adjourned at 11 :40 a.m. and recessed the board
meeting for lunch break.
Reconvene
Approval to Pay Bills
At 1:03 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners
reconvened. Q

these minutes which includes lodging payments as follows:

Data Verification Contractor Agreement
County Attorney, Wally Senyk, requested approval of a Data Verification Contractor Agreement for data
collected and/or verified for the E-911/GIS project.
Motion by Lee, second by Nelson, and unanimously carried to authorize the Chair's signature to execute
the. DVC agreement between Otter Tail County and Robert Weatherly as presented.
Recess & Reconvene
Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed at
1 :06 p.m. for a short break. The Chairman reconvened the meeting at 1 :33 p.m.
Preliminary Plat & Conditional Use Application
Marsha Bowman, Land & Resource Office Manager, presented a revised copy of the Preliminary Plat and
Conditional Use Permit request of "Wildlife Lane", Clifford Treinen, Trustee (Sec. 27, Norwegian Grove
Twp., Jacobs Lake). Ms. Bowman indicated that the easterly lot line is closer to being in compliance, the
quit claim deed is not yet recorded, and the buildable area of lots 2 & 3 is marginal. The County Attorney
stated that of the four conditions of the Planning Commission, only one has not been met. Ms. Carol
Schmidt, adjacent property owner to "Wildlife Lane", agreed to the easterly property line as presented with
the exception of the quit claim deed not yet recorded.
Motion by Lee, second by Partmann, and unanimously carried to approve the Preliminary Plat and
Conditional Use Permit of "Wildlife Lane", Clifford Treinen, Trustee (Sec. 27, Norwegian Grove Twp.,
Jacobs Lake) with conditions as recommended by the Planning Commission and subject to the filing of the
quit claim deed to finalize the easterly property line location. Ms. Schmidt, adjacent property owner, is in
agreement with the quit claim deed property description.
E-911 Video
The commissioners viewed a brief Otter Tail County E-911 video.
Ditch No. 63
Tiny Holm, Ditch Inspector, presented a petition for ditch repair for Ditch No. 63 signed by petitioners
interested and affected by this County Ditch which was established in 1917. The ditch lies within Elizabeth
and Oscar Townships. Mr. Holm reported broken and separated tiles starting at Altner Lake running for
approximately one-half mile. The County Attorney reported that the process of repair by petition requires a
public hearing which may be held before or after an engineering survey is ordered.
Motion by Lee, second by Partmann, and unanimously carried to schedule a public hearing for Ditch No. 63
on July 15, 1997 at 1:30 p.m. The Ditch Inspector will send appropriate notices to affected property
owners.
Ditch No. 41
The County Attorney drafted a letter to be sent to New York Mills regarding items missing that are required
by state statute to petition for entry into the Ditch No. 41 system. The commissioners scheduled a Public
Hearing for Ditch No. 41 on July 8, 1997 at 7:00 p.m. in the meeting room at the New York Mills County
Offices.
Annual Parade -Otter Tail Lake
Pat Garza requested the closure of Highway 72 from the Ottertail Nursing Home to the river for a parade on
July 6, 1997.

Motion by Lee, second by Stone, and unanimously carried to approve the closure of Highway 72 as
described above for the annual parade subject to the approval of the Sheriff's Department.
Adjournment
At 2:04 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners
adjourned until 1:00 p.m. Tuesday, June 24, 1997.
