The Otter Tail County Board of Commissioners convened Tuesday, May 6, 1997 at 9:30 a.m. at the
Otter Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson, Malcolm Lee,
Bill Stone, and Virginia Partmann present.
Approval of Agenda
Motion by Stone, second by Partmann, and unanimously carried to approve the County Board agenda of
May 6, 1997 as amended with the following addition:

Joint Otter Tail/Wilkin Ditch No. 2
Auditor, Wayne Stein, reported that officials of Wilkin County have notified Otter Tail County that work will
be required on Joint Ditch No. 2. Wilkin County officials hope to have most of the costs paid for with FEMA
monies.
Pelican Valley Hospital District
Mr. Stein presented a letter received from Dunn Township regarding the Pelican Valley Hospital District.
Dunn Township has decided to delay action to withdraw from the district pending a decision from the
Hospital District. The Auditor reported that Otter Tail County does not have authority to act relative to this
district's levies. Commissioner Lee questioned how the district was set-up and if there is a different way to
set-up these types of districts to allow county authority. The County Board referred this issue to the County
Attorney for review and directed the Auditor to respond to Dunn Township relative to the County Attorney's
research.

Board of Equalization -Flood Victims
Commissioner Portmann read, for the record, a letter received from a constituent explaining that he had
missed the local town board of review meeting because of helping a relative in a flood situation. The letter
requested that the county allow appearance at the County Board of Equalization meeting, even though he Q
missed the local meeting, because of the extenuating circumstances. Chairman Lindquist requested that
Assessor, Bob Moe, appear this afternoon to discuss this matter.
Minnesota Law Enforcement Block Grant Agreement
Sheriff, Gary Nelson, and Chief Deputy, Mark Morris, requested approval of the MN Law Enforcement
Block Grant Agreement, in the amount of $10,000, with a county requirement of $1,100.
Motion by Portmann, second by Lee, and unanimously carried to authorize the appropriate county official's
signature(s) to execute the MN Law Enforcement Block Grant Agreement with the county funds of $1,100
to be paid from the Contingency Fund and to further authorize the County Auditor to act as fiscal agent for
this grant agreement.
Sewage System Abatement List
Bill Kalar, Land & Resource Administrator, presented a letter from the president of the Lake Six Lakeshore
Association which requested that the shoreland property around Lake Six in Otter Tail County be placed on
the sewage system abatement list in the Land & Resource Office.
Motion by Lee, second by Partmann, and unanimously carried to approve the placement of the Lake Six
properties in Otter Tail County on the sewage system abatement list as described above.
Mound Systems
By request, Mr. Kalar reviewed past CUP approvals for fill to meet the requirement to install a mound
system. Mr. Kalar reported seven examples of requests that varied up to one foot of fill material. One
request allowed fill for the entire lot, however, that was not just for installation of a mound system.
Discussion continued regarding information from the University of Minnesota that concludes that the fill
under a mound system is more important than the distance from the lake. , Bill Kalar stated that, by county
ordinance, there must be at least 2 feet of original soil above the ordinary high water level and there have
been some approvals to raise lots to obtain this required separation. County Attorney, Wally Senyk, stated
that a past pattern of approving these CUP requests does not mean you must continue errors if there is a
conclusion that the decisions were errors. New facts and exploration of the new findings of the University
of Minnesota on individual sewage treatment systems can be compiled and action taken based on the new
facts.
Motion by Portmann, second by Lee, to direct the Land & Resource Administrator to research and compile
information relative to mound systems and to place a moratorium on approval of Conditional Use Permits
which require fill material to meet the 2 foot separation requirement to install a mound sewer system.
Discussion continued. Chairman Lindquist called for a vote. The motion passed with 3 commissioners
voting for the motion and 2 opposed.
Ditch No. 41

Ditch Inspector, Tiny Holm, introduced discussion relative to Ditch No. 41 and the City of New York Mills.
Dave Grinaker of Larson-Peterson and Associates, informed the board that on the north side of highway
10, there is a wetland about 10 acres in size. The culvert under highway 1 O that drains an area of the City
of New York Mills is backing up into the culvert and city street on the south side of highway 10. The City of
New York Mills is contemplating grading the north or south ditch of highway 10 to allow the water to
overflow west into Ditch No. 41. Mr. Grinaker and the Public Works Director of New York Mills requested
the county's opinion on this issue before pursuing it further. Chairman Lindquist explained that the City of Q
NYM would need to petition the county and a public hearing would be required. Additionally, the Chairman
suggested the opinion of an hydrologist. The County Attorney read the Minnesota statute governing this
issue and provided a copy of the statute to Mr. Grinaker.
Proposed Enhanced 911 Ordinance

, The County Attorney reported that the proposed Enhanced 911 Ordinance is in preliminary draft form and
0 requested the board to consider setting a date for a public hearing regarding consideration of enactment of
the ordinance. The proposed ordinance will provide procedure(s) to assign addresses to newly constructed
properties once the 911 system is in place. County Board members set the date for the public hearing at a

regular board meeting on June 17, 1997.
Solid Waste Service Fees for Cabins
Service Fee System Administrator, Michele Petterson, opened discussion regarding the development of a
policy/policies for service fee system assessment points to cabins. Ms. Petterson reported that consistency
· is needed in assessing the points and further presented two recommendations from the Solid Waste
Advisory Committee. Additionally, she reported that 3 service fee points is equal to $22.50 and 5 service
fee points is $37.50.
Motion by Lee, second by Portmann, and unanimously carried to approve, as a policy, the assessment of 3
solid waste service fee points to cabins that have electricity and either a well or individual sewage treatment
system, excluding privies as recommended by the Solid Waste Advisory Committee.
Motion by Portmann, second by Lee, to assess a parcel occupied by a primary house and a guest house a
total of 5 solid waste service fee points. A parcel occupied by a primary cabin and a guest cabin will be
assessed a total of 3 solid waste service fee points. If a guest house or guest cabin meets the
qualifications of a cabin listed in the previous motion, and is on an adjoining parcel to the primary house or
cabin parcel, the adjoining parcel will be assessed an additional 3 solid waste service fee points. If the
guest house or guest cabin does not meet the qualifications of a cabin as stated in the previous motion, it
will be assessed O solid waste service fee points. Discussion followed the motion. Commissioner Lee
suggested considering assessment based on the number of bedrooms. Board members tabled the motion
on the floor.until next week to allow further study.
Discussion -Rolf Sumstad Conditional Use Permit Application
Commissioner Stone opened discussion of the previously denied CUP application of Rolf Sumstad.
Mrs. Sumstad was present for the discussion as well as the Land & Resource Administrator. Discussion of
approval of other lots for fill to meet requirements of the mound system took place. The County Attorney
explained that determination of the ordinary high water level used to be estimated. Now, by law, the DNR
sets the ordinary high water level. The board recognized that the issue of separation from the bottom of
mound systems to the ordinary high water level exists and they need to be certain about the current
scientific expertise behind this issue. The County Attorney reported to Mrs. Sumstad that information will
be compiled for the board's review and, hopefully, a determination could be made on Mr./Mrs. Sumstad's
CUP request based on new information by June 1, 1997.
Board of Equalization Schedule
Assessor, Bob Moe, reported that there is some flexibility for an individual unable to attend the local board
of review meeting to appear on the Board of Equalization agenda in special circumstances. Mr. Moe
reported that the state has recommended that individuals affected by the flooding should be given special
consideration.
Upon recommendation by the Assessor, a motion was offered by Portmann, seconded by Stone, and
unanimously carried to allow individuals the flexibility to schedule on the Board of Equalization agenda even
though they have missed the local board of review subject to those individuals affected by the 1997 flooding
· and to require information in writing which states the reason for missing the local board of review meeting.

The Highway Engineer reported that the bid for Tenson Construction, Inc. was read incorrectly at the bid
opening because of addition errors in the bid. The correct bid amount is $85,979.58.
Motion by Lee, second by Nelson, and unanimously carried to award the bid for C.P. 97:Bituminous Crack
Sealing to the low bidder, Northwest Asphalt Maintenance of Goodridge, MN, in the amount of $51,252.35,
as recommended by the Highway Engineer.
Bid Award -S.A.P. 56-600-17 & Etc.
Motion by Partmann, second by Lee, and unanimously carried to award the bid for S.A.P. 56-600-17 & Etc.
(Overlay -County 117, Stalker/Long Lake Road, and Courthouse Parking Lot) to the low bidder, Central
Specialties, Inc., in the amount of $555,991.41.
Transfer of Land Request from Tumuli Township
Mr. West reported a request from Tumuli Township for the transfer of 4 acres of county land located by the
Dalton Garage on the north side of County Road No. 12 to the township. The township would like this
property for the location of construction of a shop for their equipment.
Motion by Lee, second by Partmann, and unanimously carried to approve the transfer of the above
described land to Tumuli Township subject to Tumuli Township paying all cost of the transfer and allowing
Otter Tail County to use this property for temporary stock piling of materials such as asphalt.
FEMA Storm Monies
The Highway Engineer informed the County Board that the winter storm FEMA check, in the amount of
$1,107,673 will be received by Otter Tail County within the next 30 days and will then be distributed to the
townships as previously filed.
Approval of Sale of Used Highway Equipment
Motion by Nelson, second by Lee, and unanimously carried to approve the sale of the following equipment
through a sealed bid process as recommended by the Highway Engineer:
1 model 12 1957 caterpillar grader (serial no. 8T20121)
1 model 12 1958 caterpillar grader (serial no. 7001214)
1 model 12 1961 caterpillar grader (serial no. 99E1263E)
1 1957 model 80 John Deere Tractor (serial no. 801018)
2 1964 John Deere model 1010 utility tractors with side mount (serial no. 50520)
miscellaneous parts to go with graders
2 Heat a Mixer -type 30R with wisconsin gas engines (serial no. 38012 and 38013)
Non-Union Compensation
Motion by Partmann, second by Lee, and unanimously carried to approve an increase in the monthly
employer contribution as follows:

Motion by Lee, second by Portmann, and unanimously carried to freeze salaries that are above the highest
step in the appropriate range until their compensation is increased by future cost-of-living adjustment(s).
Motion by Lee, second by Portmann, and unanimously carried to clarify that the DMG salary schedule does 0
not provide for probationary step increases. All employees on the DMG schedule will be eligible for annual
step increases based on anniversary date.

At 1 :30 p.m., Chair Lindquist declared the meeting of the Otter Tail County Board of Commissioners
adjourned until 1:00 p.m. on Tuesday, May 13, 1997.
