Approval of Agenda Motion by Lee, second by Stone, and unanimously carried to approve the County Board agenda of April 15, 1997 as amended with the following additions: Land & Resource Administrator -Discussion: CUP Previously Tabled Approval of Minutes Motion by Partmann, second by Nelson, and unanimously carried to approve the County Board minutes of April 8, 1997 as presented. Presentation of "Years of Service" Certificates Peg Meissner, Chair of Employees' Committee, and members, Michele Petterson and LeAnn Sudbeck, presented "Years of Service" certificates to individuals with 5, 10, 15, 20, 25, 30, and 40 years of service. Chair Lindquist expressed appreciation for employee's work efforts. Administrative Contract with Fergus Falls HRA Dennis Christenson, HRA, requested the Chair's signature to execute the Administrative Contact with Fergus Falls HRA to allow comme·ncement of the housing rehabilitation program. Mr. Christenson reviewed two minor changes in the final agreement. Motion by Lee, second by Partmann, and unanimously carried to authorize the Chair's signature to execute the Administrative Contract between the County of Otter Tail and the Fergus Falls Housing and Redevelopment Authority for the period beginning 2/19/97 through 09/30/99 subject to the approval of the County Attorney. $25,000 is appropriated for general administration of the Small Cities Development Program Funds. Small Cities Development Grant Agreement Motion by Stone, second by Nelson, and unanimously carried to authorize the Chair's signature to execute the Small Cities Development Program Grant Agreement (CDAP-96-0003-O-FY97) between the State of Minnesota and Otter Tail County. $554,700 shall be federal funds appropriated to the State of Minnesota under the Community Development Block Grant Program. Phelps Mill Festival Plaque Presented Teresa Brause, Phelps Mill Festival Manager, presented a plaque (overhead picture of the Phelps Mill Festival) to the County Commissioners and expressed appreciation with the county's support of the annual festival. Approval of Payment Otter Tail County Board of Commissioners April 15, 1997 Page2 Motion by Partmann, second by Lee, and unanimously carried to approve payment, in the amount of $970.08, from the Commissioners' Contingency Fund for the "Employee of the Month" program and "Years of Service" certificate frames. 0 Capital Expenditure Fund & Capital Improvement Committee Otter Tail County Resolution No. 97-23 Upon a motion by Partmann, second by Lee, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the following facts support this resolution: 1. The Otter Tail County Board of Commissioners has established a Capital Expenditure Fund and a Capital Improvement Committee to oversee its administration. 2. The County Board requires county Department Heads to budget annually for capital expenditures. 3. The Minnesota Municipal Contracting Law, Minnesota Statute 471.345, requires that if the amount of a contract is estimated to exceed $25,000, then sealed bids must be solicited by public notice, with limited exceptions. 4. In accordance with Minnesota Statute 384.13, the Otter Tail County Board of Commissioners reviews on a semi-monthly basis the bills and claims filed against the County and approves them for payment. NOW, THEREFORE, BE IT RESOLVED by the Otter Tail County Board of Commissioners: 1. That the Capital Improvement Committee of the County Board shall review and recommend for approval all capital expenditures of up to $25,000.00. 2. That those capital expenditures recommended for payment by the Capital Improvement Committee shall be submitted to the County Board for approval, along with other semi-monthly bills and claims. 3. That all capital expenditures of over $25,000.00 shall be presented to the full County Board of Commissioners for approval following public solicitation of sealed bids, if required. Dated: _.{_;¼=,"4-.,,--'-+~__,_,/1__,_f_,_7_ OTTER TAIL COUN Attest: ~ ~ Larry Krohn,/Clerk 0 Approval of Social Services Support Specialist Unit Contract County Attorney, Wally Senyk, reported that the Personnel Committee of the County Board negotiated a Q contract with the Support Specialist Unit which has been ratified and signed by the collective bargaining representatives and union stewards. 0 Q 0 Otter Tail County Board of Commissioners April 15, 1997 Page 3 Motion by Portmann, second by Lindquist, and unanimously carried to authorize the Chair's signature to execute a Labor Agreement between the Minnesota Teamsters Public and Law Enforcement Employees Union, Local No. 320, Social Services Support Specialist Unit, and the County of Otter Tail for the period of January 1, 1997 through December 31, 1999, as presented and recommended by the Personnel Committee. Resolution Requesting Presidential Declaration, Flood of 1997 Otter Tail County Resolution No. 97-24 Upon a motion by Nelson, second by Stone, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the rains and snow of the Winter of 1996-1997 were unusually great; and WHEREAS, the thawing of this extraordinary amount of snow and ice caused heretofore unheard of amounts of upland flooding due to ice jams in culverts and the filling of both roadway and drainage ditches; and WHEREAS, the upland flooding has caused hardship to the infrastructure and budgets of the townships and towns of Otter Tail County because of the washout of roads and culverts; and WHEREAS, many citizens of the county suffered heretofore unheard of damage to structures, driveways, and personal property as a result of the unusual upland flooding; NOW, THEREFORE, BE IT RESOLVED that the Commissioners of Otter Tail County request the Governor to add Otter Tail County as a flood disaster county for the spring of 1997 for both public infrastructure and private hardship. Mr. West reported that weight restrictions have been lowered on County Road 23 and a portion of County Road 11. Two to three feet of frost is out of the roadways, however, the frost is not progressing downward and that is causing some problems. Approval to Replace an Additional Plow/Truck Motion by Lee, second by Stone, and unanimously carried to authorize the Highway Engineer to purchase an additional plow/truck because of a recent accident which damaged the plow/truck beyond repair. Approval of Final Payment Motion by Stone, second by Lee, and unanimously to carried approve final payment, in the amount of $31,916.89, payable to M-R Sign Co., per Purchase Order No. 57128 for Highway Signing Materials. Otter Tail County Board of Commissioners April 15, 1997 Page4 Recess & Reconvene At 10:36 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The Chairman reconvened the meeting at 10:55 a.m. 1996 Agricultural Inspector's Report Motion by Lee, second by Partmann, and unanimously carried to authorize the Chair's signature to accept the East and West Annual County Agricultural Inspector's Report for 1996. Conditional Use Permit Applications Land & Resource Administrator, Bill Kalar, reviewed two CUP applications that were tabled until spring because of snow conditions. Commissioner Nelson reported that he will look at the Lyle Kachelmeyer property on Marion Lake and report back to the board. The situation relative to Rolf Sumstad's property on West Battle Lake was briefly discussed. Mr. Kalar briefed the board regarding a business (Perry's). The owner wishes to reopen the business, however, has not received a CUP. The owner requested a temporary permit until the application process is complete. Board members directed Mr. Kalar to advise the owner of Perry's that he must send the CUP application request through the Planning Commission and then the County Board which is the usual process. Liquor License Renewal Motion by Stone, second by Nelson, and unanimously carried to approve the following application for license: Balmoral Golf Course, Inc. RR 3 Box 119 Consumption & Display Permit Battle Lake, MN Prepaid Vendor Discounts Motion by Lee, second by Partmann, and unanimously carried to approve the following list of prepaid bills to take advantage of offered discounts: Vendor Amount Co-op Services, Inc. $5,484.99 Bluffton Oil Co. $5,976.84 Battle Lake Farmers Union Oil Co. $5,868.00 Premise Permit Discount $147.98 $225.06 $720.00 Otter Tail County Resolution No. 97-25 Paid $5,337.01 $5,751.78 $5,148.00 UPON a motion by Stone, second by Nelson, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the responsibility for the regulation of lawful gambling and for the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and 0 0 WHEREAS, the Henning Lion Club, Henning, MN, has made an application to the Gambling Control Board for a premise permit to conduct lawful gambling at the Oakwood Supper Club in Henning Township of Otter Tail County; and WHEREAS. Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a permit Q unless they receive a resolution from the Otter Tail County Board of Commissioners approving the application; and • 0 0 0 Otter Tail County Board of Commissioners April 15, 1997 Page5 WHEREAS, The Otter Tail County Board of Commissioners is aware of rio reason to oppose the conduct of lawful gambling by the Henning Lions Club, Henning, MN, at the Oakwood Supper Club in Henning Township of Otter Tail County. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Henning Lions Club, Henning MN, at the Oakwood Supper Club in Henning Township of Otter Tail County, provided the applicant meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township of Henning by sending a copy of this resolution. Adopted this 15th day of April, 1997. Dated: 41 Att~t ~~ ~ Larry Krohn~lerk Closed to the Public Performance Evaluation At 11 :10 a.m., Chair Lindquist declared the meeting of the Otter Tail County Board of Commissioners closed to the public for the purpose of evaluating the performance of Bob Moe, County Assessor, pursuant to M.S. 471.705 Subd. 1d (d). A summary report of performance conclusions will be provided at the next regular board meeting. The Chair declared the closed session adjourned at 11 :40 a.m. and recessed the board meeting for lunch break. Reconvene At 1:02 p.m., Chair Lindquist declared the meeting of the Otter Tail County Board of Commissioners reconvened. Approval of STS Joint Powers Agreement Janice Aaberg, STS Program Coordinator, and Assistant Jail Administrator, Al Keller, requested approval of the STS Joint Powers Agreement which provides $73,000 from the State of Minnesota. Mr. Keller reported an increase of approximately $6,000 from last years STS program budget. Motion by Lee, second by Partmann, and unanimously carried to authorize the appropriate county official's signatures to execute the State of Minnesota Department of Corrections Otter Tail County STS Program Joint Powers Agreement for the period of July 1, 1997 to June 30, 1999 subject to the approval of the County Attorney. Approval to Pay Bills Motion by Nelson, second by Stone, and unanimously carried to approve the bills per Attachment A of these minutes. Adjournment At 1:11 p.m., Chair Lindquist declared the meeting of the Otter Tail County Board of Commissioners adjourned until 1:00 p.m. on Tuesday, April 22, 1997.
