Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, March 18, 1997 at 9:30 a.m. at the
Otter Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson, Malcolm Lee,
Bill Stone, and Virginia Portmann present.

Tail County Board of Commissioners and the County Auditor to sign the Annual County Boat and Water
Safety Agreement for 1997 per Attachment B of these minutes:

Otter Tail County Resolution No. 97-15
Upon a motion by Nelson, seconded by ·stone, and unanimously carried, the following resolution was
adopted: · ·
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits
for the conduct of lawful gambling lies with the Minneso.ta Gambling Control Board; and
WHEREAS, the Perham Eagles Auxiliary "4224", Perham, MN, ·has made an application to the Gambling
Control Board for a premise permit to conduct lawful gambling: at Stroms Steakhouse Inc. in Perham
Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board' may not issue a permit
unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit;
and
WHEREAS, The Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of
lawful gambling by the Perham Eagles Auxiliary "4224", Perham, MN, at Stroms Steakhouse Inc. in Perham
Township of Otter Tail County.

NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
approves the conduct of lawful gambling by the Perham Eagles Auxiliary "4224", Perham·, MN, at Stroms
Steakhouse Inc. in Perham Township of Otter Tail County, provided the applicant meets all the necessary
criteria for the licenses and permits as required by the Gambling Control Board. Q
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township
of Perham by sending them a copy of this resolution.

Exemption from Lawful Gambling License
The Pelican Rapids Chapter of Ducks Unlimited has submitted an Application for Authorization for
Exemption from Lawful Gambling License for an event scheduled for April 17, 1997 at the Pelican Supper
Club. No action was taken to prohibit the activity.
Chapter 13 of the Minnesota Finnish American Historical Society has submitted an Application for
Authorization for Exemption from Lawful Gambling License for an event scheduled for August 24, 1997 at
the Finn Creek Museum. No action was taken to prohibit the activity.
Request for Forgiveness of Penalty and Interest
-Motion by Nelson, second by Portmann, and unanimously carried to deny the request of Arnold Ruther for
~the forgiveness of penalty, interest and costs, in the amount of $223.81., as the existing court action and
ithe funds that the court has required from Mr. Ruther does not relieve his obligation for the timely payment
of the 1996 property taxes.
Motion by Stone, seconded by Lee, and unanimously carried to deny the request of Richard Thompson for
,the forgiveness of penalty, interest and costs, in the amount of $120.72, as failure to receive a property tax
:statement does not relieve the obligation for timely payment of property taxes.
Payment Approval
Motion by Lee, second by Portmann, and unanimously carried to authorize payment to the Minnesota
(Counties Insurance Trust, in the amount of $2,683.00, for the West Otter Tail Soil and Water Conservation
'.District's 1997 Property/Casualty Insurance.
Final Payment -Phase 1 Mechanical Improvements -OTC Courthouse
Motion by Portmann, second by Nelson, and unanimously carried to approve final payment, in the amount
of $24,051.37, to FM Plumbing & Heating, Inc., per request #7 from Yeater, Hennings, Ruff, Shultz, Rokke,
and Welch. This will complete Project #9538, in the amount of $314,893.37, which is Phase 1 Mechanical
Improvements, Otter Tail County Courthouse.
Transfer of Funds
Motion by Lee, second by Partmann, and unanimously carried to approve an increase in Sheriff's
Department Capital Outlay Budget of $14,877.92 and a decrease in Boat and Water's Capital Outlay
,Budget of $8,098.40 for a total carry forward budget increase of $6,779.52. This would correct a coding
error by Boat and Water for 1996 expenditures and correct Boat and Water's carry forward amount to
balance with their state report.
Authorization to Recruit Volunteer Assistance
Auditor, Wayne Stein, requested permission to recruit volunteers to assist in the moving of old tax rolls to
the Otter Tail County Historical Society. The County Board directed the County Auditor to proceed with his O plans to complete this project with volunteer assistance.

Utility Tax Update ,
Assessor, Bob Moe, informed the board that five counties have joined together as a coalition relative to the
utility tax issue. Sherburne County's request is for the five counties to share in the cost of lobbyist services.
Motion by Lee, second by Nelson, and unanimously carried to approve payment, in the amount of $483, for Q
Otter Tail County's share of the cost of lobbyist services a~· recommended by the Assessor.
Project Schedule Changes -1996 -2001.
Rick West, Highway Engineer, reviewed proposed changes in the Highway Improvement Program.
Handouts and maps were provided.
Motion by Stone, second by Nelson, and unanimously carried to approve the proposed schedule changes
in the 1996-2001 five year Highway Plan as follows:

The Highway Engineer reported that an additional three years will be added to the five year highway plan Q
along with a public hearing in 1998.
Approval to Purchase a Pickup
The Highway Engineer requested approval to purchase a pick up through the State Contract (#41403).
General consensus of the board was to approve the purchase as budgeted in the Capital Improvement
Fund and recommended by the Capital Improvement Committee.
FEMA Update
The Highway Engineer reported on the FEMA application process. The next step is for FEMA to send the
formalized reports back to the county.
Bid Opening Date Set -C.P. 97:117 & S.A.P. 56-600-17
Motion by Lee, second by Nelson, and unanimously carried to establish April 22, 1997 at 1:00 p.m. as the
bid opening date for County Highway 117 Overlay (C.P. 97: 117) and the Stalker Lake Road Paving project
(S.A.P. 56c600-17), and the West Courthouse Parking Lot. Additionally, the motion authorized the Highway
Engineer to proceed, in the .future, by establishing bid opening dates without separate County Board
approval and to keep the board apprised of the dates.
Contract Approval -Seasonal Supply of Hot Mix Bituminous
Motion by Lee, second by Nelson, and unanimously carried to authorize the Chair's signature to execute a
highway construction contract with Sherbrooke Asphalt, Inc. for the 1997 Seasonal Supply of Hot Mix
Bituminous (North O.T.).
Approval of Final Payment-S.A.P. 56-611-12 & Etc.
Motion by Lee, second by Portmann, and unanimously carried to approve final payment to Sherbrooke
Asphalt, Inc., in the amount of $47,352.32, for Bituminous Overlay, Aggregate Shouldering, Aggregate
Base & Bituminous Surfacing (S.A.P. 56-611-12 & Etc.) as recommended by the Highway Engineer.

Approval of Contract -DMG Classification
Wally Senyk, County Attorney, reviewed a proposed Job Classification System Maintenance Agreement.
Motion by Partmann, second .by Lee, and unanimously carried to accept the Job Classification System
Maintenance Agreement between Otter Tail County and David M. Griffith & Associates for ongoing
professional services.
Central Lakes Trail Project -Phase II
Steve Emerson, Executive Director of the Fergus Falls Chamber of Commerce, Ron Spangler and
B.K. Soby, Committee Members, and Al Leiffort, Douglas County Park Superintendent, appeared to discuss
plans for Phase II of the Central Lakes Trail Project. The Central Lakes Trail traverses part of Douglas,
Otter Tail, and Grant counties. Mr. Leiffort reported that the project is scheduled for funding in 1998. Local
government units are required to provide 20% of the funding. Mr. Leiffort provided a Project Description
handout, requested a commitment for Otter Tail County's 20% local share of $21,019, and opened
discussion regarding the corridor's use in the future. He is working on a grant through the Minnesota DNR
for 50% of the local share. The local share needs to be deposited in the Rails to Trails account by August
of 1997. Mr. Emerson stated that his office will formulate plans for the fund raising. Discussion followed
regarding unresolved issues of maintenance, liability, abutting land owners, and law enforcement. OCTA
representative, Duane Rose, reported that OCTA does not have the resources to maintain and manage
summer use of the trail system. Chairman Lindquist suggested that a public meeting be held to inform the
abutting land owners and the general public of the facts relative to the Central Lakes Trail. Mr. Emerson
will contact the county to establish a time for the public meeting after research is complete.
Closed to the Public
At 11 :03 a.m., Chair Lindquist declared the meeting of the Otter Tail County Board of Commissioners
closed to the public for the purpose of evaluating the performance of Bill Kalar, Land & Resource
Administrator, and Mike Hanan, Solid Waste Director, pursuant to M.S. 471.705 Subd. 1d (d). A summary
report of performance conclusions will be provided at the next regular board meeting. The Chair declared
the closed session adjourned at 11 :35 a.m. and recessed the board meeting for lunch break.

Approval to Pay Bills
At 1 :05 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners
reconvened. Motion by Nelson, second by Partmann, and unanimously carried to approve the bills per
Attachment A of these minutes with the following lodging payments:

Report -AMC Meeting
Commissioner Nelson and Commissioner Lee reported on the recent annual AMC meeting. They updated
the board regarding new house and senate committee leaders The commissioners conveyed local county
government issues and opinions to state leaders. Commissioner Lee reported on the study of the
boundaries of the counties, the proposed Community Justice Act, levy limits, and land use legislation.
Commissioner Nelson reported on an environmental meeting and a welfare reform meeting.
Commissioner Bill Stone absent at 1 :26 p.m. for the remainder of the meeting.
Planning Commission Recommendations
Land & Resource Director, Bill Kalar, handed out proposed Shoreland Management Ordinance rules which
include the recommendations for revisions of the ordinance by the Planning Commission. The
recommended revisions will be discussed on March 25, 1997 at 3:00 p.m. for consideration and enactment.
Proposed revisions to the Subdivision Controls Ordinance were provided and will also be considered on
March 25th.

H.F. 244 -Update
The Land & Resource Director updated the board regarding proposed onsite sewage treatment system
legislation (H.F. 244).
Approval of Natural Resources Block Grant
Motion by Portmann, second by Lee, and unanimously carried to authorize the appropriate officials
signatures to execute the 1997 Natural Resources Block Grant Agreement between Otter Tail County and
the Board of Water and Soil Resources which provides state funds of $77,159 and requires a county in-kind
match of $67,465 for local water planning, WCA, and Shoreland Management.
Minnesota Association of Planning and Zoning Administrators
Motion by Lee, second by Portmann, and unanimously carried to authorize Mr. Bill Kalar to serve as a
member of the Curriculum Committee on the aforementioned organization.
1997 BCBSM Service Agreement
Motion by Lee, second by Nelson, and unanimously carried to authorize the County Coordinator's signature
to execute the 1997 Annual Blue Cross Blue Shield of Minnesota Service Agreement for employee medical
insurance.
Posting Authorized
Motion by Portmann, second by Lee, and unanimously carried to authorize the posting of a work
assignment from the Sheriffs Department to an E-911 position. Funding for the assignment is in the GIS
budget.
Recess
At 2:07 p.m., Chairman Lindquist declared the Otter Tail County Board of Commissioners meeting recessed
for committee meetings.
Reconvene
Emergency Management Ordinance
At 2:44 p.m., Chairman Lindquist declared the Otter Tail County Board of Commissioners meeting
reconvened. The County Attorney outlined the proposed Otter Tail County Emergency Management
Ordinance. Mr. Senyk stated that .the ordinance is consistent with state statute, identifies the authority of
the director, and gives clear direction to local units of government in dealing with emergency situations.
The ordinance will allow Otter Tail County to be eligible for federal funds under certain circumstances.
Media representatives; Sheriff, Gary Nelson; Chief Deputy, Mark Morris; and Director of Emergency
Services, Tim Hunt: were present for the public hearing. There were no public citizens present. Motion by
Lee, second by Portmann, and unanimously carried to enact the Otter Tail County Emergency
Management Ordinance. A summary of the ordinance will be included in the publication of the summary
minutes and the official board minutes.
Resolution to Require People to Pay for Rescue
Otter Tail County Resolution No. 97-16
UPON a motion by Nelson, second by Lee, and unanimously carried, the Otter Tail County Board of
Commissioners adopts the following resolution:
WHEREAS, winter storms and snow can cause imminent threat to the life and health of individuals lost or
stranded; and

WHEREAS, the County Sheriff and Engineer have knowledge and observation of winter weather conditions 0
and the trafficability of public roads; and . .._,

WHEREAS, a County Commissioner has declared a winter storm and snow emergency with warning that
certain or all roads are not safe for travel and are closed, and that citizens should stay at home or in shelter
and not travel, and
WHEREAS, the County Sheriff and Engineer have provided travel advisories and announced that travel is
no longer safe and plows are being pulled off the roads and that people should seek shelter and not travel,
and
WHEREAS, the safety of people involved in rescue become also at risk; and
WHEREAS, snow removal and road clearing operations are hampered or blocked and the safety of snow
plow operators and equipment as well as the vehicle of the citizen are at risk of damage when stranded
and/or buried in snow: and
WHEREAS, said stranded vehicles can block the ability of medical or other emergency vehicles and
equipment from traversing the route thereby jeopardizing the health and safety of other citizens; and
WHEREAS, the cost to the public of rescuing individuals who ignore or have not been attentive to weather
conditions and/or the declaration of an emergency by the County Commissioners or to the advisories of the
,County Sheriff and Engineer, and who have thereby put themselves at extreme risk by not remaining in
shelter and/or becoming_ stranded or having an accident while traveling during such period of adverse
weather,
NOW, THEREFORE, BE IT RESOLVED, that following a declared winter storm and snow emergency, or
an advisory by the Sheriff and Engineer to not travel, all people who should have had reasonable
knowledge or reason to anticipate their danger as determined by the Sheriff and either the County Engineer
or Emergency Manager at the time, and for whom rescue is required because they are out of any shelter
and lost or stranded, or who have become stranded on the roadway 'of any public road and for whom
rescue is required, shall pay the full cost of rescue and recovery, to include: wages of individuals, hourly
cost of vehicles, and equipment required to effect or support the rescue, towing charges, damages to public
equipment, and all other costs as may be incurred in the course of the rescue operation according to the
rates as established ·by the concerned department heads and maintained on file in the office of the County
Director of Safety and Emergency Services;
BE IT FURTHER RESOLVED, that this resolution shall be permanent, shall be advertised annually at the
beginning of each snow season, and shall be affixed as an addendum to the Otter Tail County emergency
operations plan.

Chair Lindquist declared the meeting recessed at 3:10 p.m. At 3:15 p.m., the Chair declared the meeting
closed to the public to discuss pending litigation with counsel (Mr. Robert Sefkow) regarding disputes (----..,
relative to the construction of the Recycling Center as authorized by attorney-client privilege, M.S. 471.705 "wilt,ii,/
Subd 1d. Present were Commissioners Partmann, Lee, Lindquist, and Nelson, Solid Waste Director, Mike
Hanan, the County Attorney, County Coordinator, and Recording Secretary.
At 4:02 p.m., after conclusion of the pending litigation discussion, the closed session continued for
purposes of discussing labor negotiation strategies with counsel (Mr. Morrie Kerschner) relative to the
petition that Teamster's Local 320 Sheriff's Department, Essential Unit has filed with the Bureau of
Mediation Services. Present were Commissioners Partmann, Lee, Lindquist, and Nelson, the County
Attorney, County Coordinator, and Recording Secretary.

At 4:12 p.m., upon conclusion of the closed session, Chairman Lindquist declared the Otter Tail County
Board of Commissioners' meeting reconvened and open to the public for purposes of acting on the
recommendation of counsel relative to the Sheriff's Department, Essential Unit.
Motion by Partmann, second by Lee, and unanimously carried to support the petition filed by Teamsters
Local 320 with the Bureau of Mediation Services to amend the composition of the essential bargaining unit
as follows:

All Essential Non-Licensed Employees of the Otter Tail County Sheriff's Department, Fergus Falls, Q
Minnesota, who are public employees within the meaning of Minnesota Statute 179A.03, Subdivision 14,
excluding Supervisory and Confidential Employees.
Unit #2
All Essential Licensed Employees of the Otter Tail County Sheriff's Department, Fergus Falls, Minnesota,
who are public employees within the meaning of Minnesota Statute 179A.03, Subdivision 14, excluding

WHEREAS, In connection with the Sherif!'• Duties M.S. Section 86B.701 ~ that the County submit to the Ccmmisaiona< of Natural Resources a
budget to carry out the Sherffl'1 Duties; and
WHEREAS, M.S. Section 568.701 and the Minn. Rules pr0Yide fer the allocation of funds by the Commiasione, to the County based on certain criteria and
conclusion& lo assist the funding of the Sherif!'s Duties; and

NOW THEREFORE, I ls agl90d a fallows:
A. (DUTIES) The county shertfT shall perfonn the Sherill's Duties as defined herein.
B. (TERM) This agreement shaD be etrect!ve under Torm of Agreement as slated above. Funds n<.( oxpeoded by the latter date shall be returned to the Slate.
In no case will expenses Incurred outside of this ~ be funded by the Slate.
C. (PAYMENT) The Slate shall advance the County the Amount of Payment as slated aboYe fer the aclivllJes ltlted In Chapter 86B. Further detail on

F. (EQUIPMENT) The tllle to all llema of equipment purchased with funds frcm this grant shan remain with the County. All equipment purchased entirely
with these funds must be used only fer boot and water safety actMtiea.
G. (TERMINATION) The -may tennlnate thlo agreement "with cause•. The term "wtth cause" shall mean that the county and/or the Sheriff has failed lo
carry out the responsibilities mandated by Mlnneaola Slalule Chaplo, 86B and rules promulgated lh«eunder, after submitting a budget. Provided, however,
this agreement may not be tem,inated without 30 days written notice by the State oettlng fcrlh the "cause for termination". If at any time within the :io day
"cause fo, termination", notice period the State determines that the "cause for tennination" is not cured, within the :lO day notice period, the County shall retum
any unused funds advanced as of the date of tennination.
