HomeMy WebLinkAboutBoard of Commissioners - Minutes - 02/18/19970 Call to Order The Otter Tail County Board of Commissioners convened Tuesday, February 18, 1997 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson, Malcolm Lee, Bill Stone, and Virginia Portmann present. Approval of Agenda Motion by Portmann, seconded Lee and unanimously carried to approve the agenda of February 18, 1997 as amended: Discussion of Jail Contract and County Coordinator issues -tabled to February 25th agenda Approval of Minutes Motion by Nelson, seconded Stone and unanimously carried to approve the minutes of February 11, 1997 as submitted. Proposed Emergency Services & Operations Ordinance Emergency Services Director, Tim Hunt, reported that the proposed Emergency Services & Operations Ordinance language has been amended to allow for authority of the County Board in making emergency decisions. Absent notification and/or communication with the Chair and other board members, the proposed language allows for the, County Sheriff and County Engineer to make advisories relative to disaster situations. The Public Hearing regarding the proposed ordinance will be held Tuesday March 18, 1997 at a regular board meeting. County Attorney, Wally Senyk, stated that action cannot be taken until after the public hearing. The County Attorney and Emergency Services Director will work together to finalize the proposed language based on state statute. Utility Legislation Update Bob Moe, Assessor, updated the board regarding utility legislation proposals. Discussion followed regarding bonding capabilities relative to a reduction of the tax base and the process of reimbursing the user fee to Local Government Units. Proposed Utility Legislation Otter Tail County Resolution No. 97-12 Motion by Portmann, seconded Stone, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, otter Tail County is the host to the power plant known as Otter Tail Power; WHEREAS, Otter Tail County derives revenue from the energy facility located at Fergus Falls, MN, in the < 1 • form of personal property taxes on machinery which accounts for $1,336,266.00 in tax dollars for the year 't" 1996; WHEREAS, a study conducted by the Minnesota Department of Revenue in conjunction with the Public · Utilities Commission and the Department of Public Service has issued a study dated January 15, 1997 Otter Tail County Board of Commissioners February 18, 1997 Page 2 entitled "Analysis of Utility Taxation in Minnesota" and has presented such information before the Senate Subcommittee for Property Tax and Local Government Budget Division, .Senator Sandra L. Pappas, Chair Q. · on February 5, 1997; WHEREAS, investor owned utilities (IOU's) have proposed legislation which would remove personal property tax from the available tax capacities of the affected jurisdictions; WHEREAS, jurisdictions who lose tax capacity could see significant increases in the property taxes at the local level as a result of such legislation without replacement revenues; WHEREAS, the replacement revenues of a utility or "meter'' tax or other such remedies do not provide the same assurance of cash flow and leaves affected jurisdictions with an inability to deal adequately with financial concerns; WHEREAS, the replacement revenues would also be subject to collection and "tinkering" by the state giving affected jurisdictions inadequate security in receipt of revenues both now and in the future with the added possibility of sunsetting the revenue stream completely; WHEREAS, with the loss of the personal property taxes, the affected jurisdictions will experience an adverse impact in its ability to bond, its ratings, its long term debt, and will experience problems with outstanding bonds including disclosure requirements; and; . WHEREAS, the above-referenced study by the Department of Revenue has in fact recommended the decreased use or elimination of the personal property tax as a source of revenue for local entities. NOW, THEREFORE, Otter Tail County hereby makes the following: 1. . Otter Tail County shall appoint Otter Tail County Assessor, Bob Moe, as a liaison to work with other similarly affected governmental entities as a representative of this governing board;· 2. This representative is directed to work with the committee for the purpose of establishing a budget and a funding formula to bring back to this body for review and comment. Dated: rraJ~ dQ) 1917 OTTER TAIL COUN OARD OF COMMISSIONERS Attest: /4~~ ~ LafryKrn ~ Cler Proposed Septic System Inspection Mandates Chairman Lindquist read a letter, for the record, from Clearwater County regarding H.F. No. 244 and S.F. No. 389. Approval to Transfer Funds 0 Motion by Lee, seconded by Partmann, and unanimously carried to approve the transfer of $343,718.12 from the Capital Improvement Fund to General Fund for repayment of cash used by the MIS Department n which should have been coded to the Capital Improvement Fund in 1996. The motion further approved the,...,, establishment of a GIS Department in the General Fund and a budget for that department in the amount of $216,320.00 and a budget of $12,000.00 in the Capital Improvement Fund. As $120,000.00 has previously been approved for GIS and E911 expenditures, an additional $96,320.00 is also approved for the 1997 year expenditures. Also approved is the transfer of $52,150.34 from General Fund to the Capital Improvement 0 0 Otter Tail County Board of Commissioners February 18, 1997 Page 3 Fund which is the balance of GIS and E911 monies accumulated since 1994. This would allow these : monies to be carried forward for use in future years. Certificate of Correction to Plat . Motion by Lee, seconded by Portmann, and unanimously carried to accept the attached Land Surveyor's Certificate of Correction to the Plat of Jacobs Beach per Attachment A of these minutes as prepared by Robert S. Oslund, Registered Land Surveyor, pursuant to the provision of Minnesota Statute Chapter 505.175. Otter Tail County Committee Members' Code of Conduct Otter Tail County Resolution No. 97-13 Upon a motion by Portmann, seconded Lee, and unanimously carried, to encourage an environment of exchanging ideas based on comments from area residents, the Otter Tail County Board of Commissioners • adopts the following resolution encompassing principles for committee members duly appointed by the Board:· WHEREAS, the Board of Commissioners for Otter Tail County believes that citizen participation in county government is essential and valuable, and wishes to receive the advice of citizens in the areas of policy, legislation, planning and services; and WHEREAS, the Otter Tail County Board of Commissioners is committed to the sensible and effective use of .. advisory committees and boards, which serve at the will of and as an adjunct to the Board of Commissioners; and WHEREAS, preserving a respectful environment in the meeting of boards and committees is a shared responsibility of both committee members and associated individuals of the general public who appear before them. · NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners adopts the following Code of Conduct: 1. It is the policy of Otter Tail County to maintain a respectful work and public service environment free from violence, discrimination and other offensive or degrading remarks or conduct. 2. All members of committees and boards appointed by the Commissioners. shall act in a courteous manner at all times while performing their duties. 3. The Otter Tail County Board of Commissioners will not tolerate disrespectful behavior by or towards any constituents or members of the public who present their concerns to Board-appointed committees and/or advisory boards. 4. Any appointed committee or board member found by the Board of Commissioners to have acted in violation of this Code of Conduct shall be dismissed from further service. NOW, THEREFORE BE IT FURTHER RESOLVED, upon a motion by Lee, seconded Portmann, and unanimously carried, that this Code of Conduct includes the following policy statements: 1. Committee members of Otter Tail County in their course or in relation to their official duties, shall not directly or indirectly receive or agree to receive any payment of expense, compensation, gift, reward, gratuity, favor, service or promise of future employment or other future benefit from any source, except the County, for any activity related to the duties of the respective committee or advisory board unless otherwise provided by law. · 2. · A committee or advisory board member of Otter Tail County shall not use confidential information to . further the member's private interest, and shall not accept outside employment or involvement in a business or activity that will require the member to disclose or use confidential information. Any appointed committee or advisory board member of Otter Tail County shall not use or allow the use Q. · of County time, supplies, or County owned or leased property and equipment for the member's private interest or any other use not in the interest of the County, except as provided by law. All five seated commissioners were present as well as the Recording Secretary and County Attorney. At 10:53 a.m., upon the conclusion of the closed session, Chairman Lindquist declared the . meeting of the Otter Tail County Board of Commissioners recessed for lunch break. Reconvene Approval to Pay Bills Q At 1 :00 p.m., Chairman Lindquist reconvened the County Board meeting. Motion by Lee, seconded Stone, ·. · and unanimously carried to approve the bills per Attachment B of these minutes which includes payment of lodging as follows: Canal Park Inn Commissioner Harley Windels Red River Inn & Conference Ag & Ditch Inspector, Sheldon Holm Adjournment . Oslund, the undersigned, a Registered Land Surveyor in and for the State of Minnesota, declares as follows: 1. That the plat of "Jacobs Beach" as recorded in Book N of Plats, page 140 was prepared by Kermit Bjorgum, land surveyor, now deceased. 2. That the plat contains the following error: The bearing shown on the plat of "Jacobs Beach'' on the North side of the dedicated entrance road has a bearing of N 730-23' West and on the South side the record map shows N 730-16' West. The corrected measured bearing to the North and South sides of the dedicated constructed and existing roadway is N 780-12'-54" West. 3. That the corrected measured bearing datum stated correlates to the measured and existing bearing datum within the platted lot.area of "Jacobs Beach." 4. That the purpose of filing this Certificate of Correction is to establish the corrected location to the entrance portion of the dedicated roadway to correlate to the occupied and constructed location which has existed since the filing of the plat. has been prepared and is attached to better s eye .the intent of the correction datum stated.
