HomeMy WebLinkAboutBoard of Commissioners - Minutes - 02/04/19970 Q Call to Order The Otter Tail County Board of Commissioners convened Tuesday, February 4, 1997 at 9:35 a.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson, Malcolm Lee, Bill Stone, and Virginia Partmann present. Approval of Agenda Motion by Lee, seconded Partmann and unanimously carried to approve the agenda of February 4, 1997 as submitted. Approval of Minutes Motion by Lee, seconded Partmann and unanimously carried to approve the minutes of January 28, 1997 as amended. The Otter Tail County Weather Closing Policy of January 28, 1997 is clarified and amended as follows: Weather Closing Policy UPON motion by Partmann, seconded by Lee, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following Weather Closing Policy: 1. The Chair of the County Board of Commissioners or the Chair's designee is authorized to order closure of the county offices in Fergus Falls when it is not reasonably possible for employees to travel within the City of Fergus Falls. The Commissioners representing Districts 1 and 4 are authorized to determine if weather conditions require closure of the New York Mills county offices. 2. All county employees are encouraged to avoid unnecessary risk to their personal safety when traveling to or from their place of work. Those employees not defined as "essential employees" under the Minnesota Public Employment Labor Relations Act, and not performing highway maintenance duties, may choose not to report to work, or to leave work early, as weather conditions require in the interest of their personal safety. Department heads or supervisors must approve this absence from work, prior to or after the fact. 3. Those employees who are unable to safely report to work, as provided above, whether or not the Courthouse is closed, may select one or more of the following ways to account for their normal work hours missed, subject to the approval of their department head: a. By utilizing a corresponding number of hours of accrued vacation leave; or b. By utilizing a corresponding number of hours of accrued sick leave; or '-•)' c. By utilizing a corresponding number of hours of accrued compensatory time (accrued overtime); or d. By making up the hours within the work week the time was missed, on an hour for hour basis, performing productive work, subject to the approval of the employee's supervisor; or Otter Tail County Board of Commissioners February 4, 1997 Page2 e. By taking a corresponding number of hours without compensation. 4. Employees with questions regarding this policy should contact their immediate supervisor. 1997 Empty Pesticide Container Recycling Program Marie Tysdal, Public Information and Education Officer, reported that the Empty Pesticide Container Collection will soon take place for the upcoming year. Ms. Tysdal reviewed the collection of last year. Dealerships held the pesticide container collections with the county providing advertising and assistance. Motion by Portmann, seconded Lee, and unanimously carried to direct Ms. Tysdal to continue with the county's participation similar to last year relative to the Empty Pesticide Container Collection, with Ms. Tysdal assisting where her time is best used. Solid Waste Advisory Board Appointments Motion by Nelson, seconded Stone, and unanimously carried to reappoint Ray Ziegler and Jim Osterfeld (both of Perham) to the Solid Waste Advisory Board effective January 1, 1997 for a three year term. 1997 Solid Waste Fee Schedule Solid Waste Director, Mike Hanan, reported that the solid waste fees have been the same since April 1, 1995 and additionally, Mr. Hanan recommended no changes for 1997. Mr. Hunt stated that there are 8 or 9 counties that have not adopted an Emergency Services Ordinance and the adoption of this ordinance will give Otter Tail County access to federal funds. Discussion continued. Chairman Lindquist expressed concern that the proposed "Resolution on Declaring Winter Storm & Snow Emergencies" transfers authority to declare emergencies to the County Sheriff and County Engineer. By Statute, as stated in the proposed ordinance, (Section 5, Sub. 1) local emergencies may be declared by the Chair of the County Board or, in the Chair's absence, the next senior member of the Board. Chairman Lindquist directed that the authority to declare emergencies by the governing body be carried throughout the policy and resolutions. Discussion continued regarding payment of potential costs incurred during rescue operations. Motion by Partmann, seconded Lee, and carried, with Stone abstaining, to authorize the County's Intent to Publish Notice to adopt the Otter Tail County Ordinance to Establish Emergency Services and Govern Otter Tail County Board of Commissioners February 4, 1997 Page 4 Emergency Operations During Disasters. The public meeting to hear public input regarding the proposed Q ordinance will be scheduled during the March 4, 1997 regular County Board meeting. · Approval to Certify Easements -U.S. Fish & Wildlife Motion by Lindquist, seconded Lee, and unanimously carried to certify the acquisition of wetland easements by the U.S. Fish & Wildlife Service as follows: Joni L. Snow Removal Report Rick West, Highway Engineer, reported that the contractors hired to push back snow on county roads are 0 soon finished with their work. Emergency Services Director, Tim Hunt, and Assistant Highway Engineer, Damon Devillers are currently giving training seminars to township and city personnel to inform them how to Q .. complete the proper forms to receive reimbursement from FEMA. Electrical Deregulation and Changing of Tax Structure Assessor, Bob Moe, reported a proposed change in the way public utilities are taxed. Mr. Moe explained the potential effect the change could have on Otter Tail County's tax base. Chairman Lindquist requested that Mr. Moe or a designated employee attend a meeting February 6, 1997 in Sherburne County to learn more about the proposed deregulation. Approval to Pay Bills Motion by Portmann, seconded Lee and unanimously carried to approve the bills per Attachment A of these minutes. Appointment of At-Large Member of the 1997 RTC Coalition Motion by Portmann, seconded Lee, and unanimously carried to appoint Gilbert Swenson as an At-Large member of the Regional Treatment Center Coalition for the year of 1997. NYM Building Chairman Lindquist reviewed the sequence of events regarding the search for additional county office space in Perham. Mr. Lindquist explained that the lack of additional space and comparison of cost between a building offered in Perham, MN and the former New York Mills school building led to the purchase of the current NYM county office building which now serves East Otter Tail County. Closed to the Public At 1:53 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners r'\ closed to the public for purposes of discussing pending litigation in a grievance arbitration scheduled for \;,jJ,/ February 6, 1997, and also, to discuss labor negotiation strategies with three County Collective Bargaining Units; AFSCME, Local Union No. 1830, Highway Maintenance Unit; Teamsters Local No. 320, Human Services Professional Unit, and the Social Services Support Specialists Unit. All five seated commissioners 0 0 Otter Tail County Board of Commissioners February 4, 1997 Page 7 were present at the beginning of the closed session as well as the County Coordinator, Recording Secretary and County Attorney. Commissioner Bill Stone was absent at 2:22 p.m. and Social Services Director, Tom Fawcett, entered the room at 2:30 p.m. for the latter portion of the discussion. The closed session concluded at 2:38 p.m. Reconvene in Open Session Grievance Arbitration -Proposed Settlement At 2:38 p.m., Chair Lindquist reconvened in open session for purposes of acting on a proposed settlement of a grievance filed on behalf of three Administrative Process Workers. Motion by Portmann, seconded Lee, and unanimously carried to approve a tentative settlement to offer Administrative Process Workers, effective September 1, 1995, $60 above the Child Support Officer compensation schedule of the '95 and '96 contracts or, in lieu of that, 3% above the '95 and '96 contracts, whichever is higher. Quadrant Update The Chairman updated County Board members on a potential agreement with Quadrant. Discussion followed regarding per ton garbage disposal costs, air quality standards, and the Fergus Falls and Quadrant Incinerators.
