HomeMy WebLinkAboutBoard of Commissioners - Minutes - 01/07/1997w 0 0 Statutory Meeting -Call to Order :Pursuant to Minnesota Statute, the Otter Tail County Board of Commissioners convened Tuesday, January 7, 1997 at 9:31 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Portmann :chair; Andy Lindquist, Bill Stone, and Sydney Nelson present. Commissioner Malcolm Lee was absent due to inclement weather conditions. Oath of Office Judge Thomas Stringer administered the Oath of Office to Commissioners Virgini.a Partmann,-Fifth District, Andy Lindquist, Third District and Commissioner Sydney Nelson, First District. · Chair Selected County Board Clerk and Coordinator, Larry Krohn, requested nominations for the selection of a Chairman of the County Board for the year 1997. Motion by Portmann, seconded Stone, and carried, with Lindquist abstaining to elect Commissioner Andy Lindquist as the Otter Tail County Board Chairman for 1997. Vice-Chair Selected :County Board Clerk and Coordinator, Larry Krohn, called for nominations for the selection of a Vice-Chair -for the County Board for the year 1997. Motion by Partmann, seconded Nelson, and carried to elect ;commissioner Malcolm Lee as the Otter Tail County Vice-Chairman for 1997. Approval of Agenda ·1997 County Board Chairman, Andy Lindquist, assumed the chair and entertained a motion for approval of Jhe agenda. Motion by Partmann, seconded Nelson, and unanimously carried to approve the agenda of January 7, 1996 as amended: Tiny Holm, Ag & Ditch at 1 :30 p.m. Discussion -Day Care Issue Section 457 Custodial Account Agreement and Plan Amendment County Coordinator Larry Krohn, requested approval of amendment #1 to the Deferred Compensation plan ;document to modify Otter Tail County's 457 Deferred Compensation Retirement Plan. The amendment will modify qualifications for the 457 plan and bring the Deferred Compensation plan into compliance based upon recent legislation. Establishment of Custodial Account and Life Insurance Transfer Authorization Otter Tail County Resolution No. 97-01 Motion by Stone, seconded Partmann and unanimously carried to accept the 457 Deferred Compensation amendment and to adopt the following resolution: WHEREAS, the undersigned Employer is the owner of one or more life insurance policies issued to it by Commonwealth Life Insurance Company, Kentucky Commonwealth Life Insurance Company, Peoples Security Life Insurance Company, or Providian Life and Health Insurance Company (the "Policies") in connection with the deferred compensation plan it maintains for its employees (the "Plan") pursuant to Section 457 of the Internal Revenue Code of 1986, as amended (the "Code"); and Otter Tail County Board of Commissioners January 7, 1997 Page 2 WHEREAS, as a result of an amendment to the Code, all assets and income of the Plan must be held in a trust, custodial account or annuity contract; and WHEREAS, the Plan has been amended to reflect the changes required by the amendment to the Code; 0 and WHEREAS, the Employer desires to adopt the Code Custodial Account (the "Custodial Account") to hold assets, other than annuity contracts, which will provide benefits for the participants and beneficiaries; and WHEREAS, as a result of the amendment to the Code, the Employer desires to transfer ownership of the Policies to Bank One Trust Company, N.A. (the "Custodian") for the exclusive benefit of the Plan's participants and beneficiaries; NOW, THEREFORE, the undersigned Employer hereby accepts the Code Custodial Account Agreement, adopts the Custodial Account, authorizes transfer of ownership to the Policies to the Custodian, and designates the Custodian as the beneficiary to the Policies. Mr. Krohn reported that Q the fee increase is .15 per participant per month (approximately a 3% increase) over the 1996 fees. Commissioner Lindquist expressed dissatisfaction with the processing of flexible spending account claims. Motion by Stone, seconded Portmann to approve the Otter Tail County Flexible Spending Account Fee Schedule for Administrative Services for 1997, in the amount of $5.60 per participant per month. Discussion followed regarding complaints with DCA relative to the administration of the flexible spending accounts. Mr. Krohn reported some complaints, however, minimal when considering the volume of flex claims processed. The motion was amended to include communication to DCA, Inc. regarding dissatisfaction with flex claims processing. Motion carried. 1997 Solid Waste Haulers License Renewals Motion by Portmann, seconded Stone and unanimously carried to approve the following 1997 Solid Waste Haulers renewal licenses: Ballard Sanitation, Pelican Rapids C & J's Lake Service, Pelican Rapids City Dray Sanitation, Wadena Fuch Sanitation, Glyndon Ken's Garbage Service, Clitherall Meyer's Garbage Service, Perham Minn-Kola Recycling, Detroit Lakes Northern Waste Systems, Detroit Lakes Region Waste Systems, Underwood Pope County Sanitation, Inc., Alexandria Severence Enterprises, Herman Steve's Sanitation, Perham Toutges Sanitation, Henning 0 0 0 0 Otter Tail County Board of Commissioners January 7, 1997 Page 3 1997 Dental Administrative Services Renewal Agreement Motion by Nelson, seconded Stone, and unanimously carried to authorize the Chair's signature to execute ·the Amendment to Administrative Services Agreement with DCA Healthcare Management Group. The administrative fee for 1997 is $2.85 per participant per month, an increase of .10 over the 1996 administrative services. Benefit Plan Amendment .Motion by Partmann, seconded Stone, and unanimously carried to authorize the Chair's signature on an -Amendment to the Benefit Plan to replace the Benefit Plan Section entitled "Continuation of Coverage Under COBRA". This amendment will incorporate changes required by the Portability and Accountability Act of 1996. Snowmobile Club Trail•Agreement County Attorney, Wally Senyk, reported that the Otter Tail County/Snowmobile Club Trail Agreement · between the County of Otter Tail and the Otter Trail Riders Snowmobile Club has been accepted by the snowmobile club. The County Attorney reviewed the terms of the agreement. Motion by Stone, seconded Nelson, and unanimously carried to authorize the_ Chair's signature to execute ··the following agreements: Otter Tail County/ Snowmobile Club Trail Agreement between the County of Otter Tail and the Otter Trail Riders Snowmobile Club State of Minnesota Department of Transportation between the County of Otter Tail and the State of Minnesota for a Limited Use Permit .. Request for Forgiveness of Tax Penalty 1Charles Klinkhammer, owner of the Comfort Inn located in Fergus Falls requested forgiveness of a recent (penalty assessed for late taxes. Mr. Klinkhammer explained the situation and conveyed to Board members -ithat he thought the taxes had been paid on time. The taxes have now been paid and Mr. Klinkhammer requested reimbursement of the penalty. General consensus of Board members was not to take action to forgive the penalty because the current ]:?olicy of Otter Tail County is to forgive penalty and/or interest only when the county has made an error. Refurbishing the Cannon ·chet Toso, Veterans Service Officer, and Perrie Sheldon, DAV Chapter 25 Representative informed Board members of their desire to refurbish the cannon located on the northwest corner of the courthouse property. Volunteers plan to sandblast and repaint the canon. Motion by Partmann, seconded Nelson and unanimously carried to support the project of refurbishing the cannon. GIS Report GIS Coordinator, Bob Block, provided an addressing/GIS progress report for the last quarter of 1996. Mr. Block reviewed the progress of the DVC's as well as the involvement of the Internal and External GIS Committees. A GIS implementation plan outlined future steps required to move ahead with the GIS project. A database has been sent to the municipalities within Otter Tail County. Baseline data within the municipalities is required to develop an addressing base. A draft proposal from Vector Vision for GIS training, support and map conversion duties was provided to commissioners for their review. Transportation Enhancement Project Funding Highway Engineer, Rick West, spoke regarding the proposed Pelican Rapids to Maplewood State Park pedestrian/bicycle trail. The funding for the project has been approved through the Transportation Enhancement Program. The Highway Engineer clarified that a public entity will need to assume responsibility for the maintenance of this project after construction. Mr. West stressed that Otter Tail Otter Tail County Board of Commissioners January 7, 1997 Page 4 County is the sponsoring agent for the project, however, the county does not intend to assume maintenance responsibility for this trail. The Chair directed the Highway Engineer to send a letter to Pelican Rapids to explain the county's position relative to future maintenance of the pedestrian/bicycle trail. O Extreme Weather Conditions -Snow Removal The Highway Engineer reported difficulty with snow removal, sanding roads, etc. because of the large amount of snowfall and stormy conditions experienced in Otter Tail County. Mr. West requested County Board permission to contract for equipment to begin pushing back the banks of snow to keep roads open and allow for space to continue to plow roads when more snow is experienced this year. Motion by Partmann, seconded Stone, and unanimously carried to hire contractors as needed to keep roads open and to extend authority to the Highway Engineer to contract for additional snow removal based on weather conditions and to document the cost of the these additional non-budgeted expenses. The County Attorney stated that the Sheriff's Department was highly complimentary to the County Highway crew for responding quickly and efficiently to emergencies created by the recent storm. Purchase of the First Bank Building County Attorney, Wally Senyk, reported acceptance, by appropriate signature(s) of the closing of the sale and acquisition of the First Bank National Association Property in Fergus Falls. A quit claim deed has been recorded and forwarded to the title insurance company. Mr. Senyk reviewed the terms of the Lease of Space for the First Bank building and reported an annual lease amount of $29,443.75 to be paid to the County of Otter Tail on a monthly basis. To conclude required transactions in the acquisition of the First Bank building, motion by Partmann, seconded Stone and unanimously carried to approve payment, in the amount of $1,222.50, payable to Pemberton, Sorlie, Sefkow, Rufer, & Kerschner P.L.L.P. for reimbursement of title insurance and 50% of Q the closing fee. Courthouse Phone System Commissioner Syd Nelson questioned the feasibility of a toll-free phone number for constituents to call into the courthouse. Coordinator, Larry Krohn, is currently researching phone system options. Appointment -Personnel Committee Chair Lindquist appointed Commissioners Partmann and Lee to the County Personnel Committee for 1997. Recess At 11 :00 a.m., Chair Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed until the afternoon session. Meeting Reconvened At 1 :09 p.m., Chair Lindquist declared the meeting of the Otter Tail County Board of Commissioners reconvened with all Commissioners present. Otter Tail County Resolution No. 97-02 ,Upon motion made by Lee, seconded by Partmann, and unanimously carried, the following resolution was -adopted: ,RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that the sum of thirty cents ($.30) be paid out of the General Revenue Fund of Otter Tail for every pocket gopher killed in said County during the year 1997 in cases where the township in which the pocket gophers were so killed shall provide for the payment of at least an additional bounty of forty cents ($.40) for each pocket gopher so killed. ,RESOLVED further that said payment of such County shall be made by the County Auditor upon ·certificates executed by the Chairman and/or the Clerk or the Town Board of said Township setting forth that the township had issued and delivered to each claimant a payment for at least seventy cents ($. 70) for each pocket gopher so killed. Dated: P,44-fYM ~ ol. 1qq7 Otter Tail County Board of Commissioners January 7, 1997 Page 6 Tax Forfeited Land Sale Apportionment Otter Tail County Resolution No. 97-03 Upon motion made by Lee, seconded Portmann, and unanimously carried, the following resolution was 0 adopted: ., RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that WHEREAS, it is provided in Minn. Stat. 282.05 for the apportionment of proceeds from the sale of tax forfeited lands, and WHEREAS, the County Auditor shall apportion the tax sale proceeds to the taxing district pursuant to Minn. Stat. 282.08, and WHEREAS, Minn. Stat. 282.08 (4) (b) provides that the County Board may set aside 20% of the proceeds remaining after the value of public improvements, special assessments and bond issues levied on the property have been paid, for acquisition and maintenance of county parks and recreational areas, and WHEREAS, Otter Tail County has a park and recreational area which would benefit by such an apportionment. NOW, THEREFORE, BE IT RESOLVED, that the County Auditor retain 20% of the proceeds from the sale of tax forfeited lands for acquisition and maintenance of parks and recreational areas from the proceeds to be disbursed according to law. OTTER TAIL COUNTY B B Cost Assessment for Delinquent R al E ate Parcels Motion by Lee, seconded Nelson, and unanimously carried t t the cost assessed to delinquent real estate parcels, published in the Delinquent Tax List, at $22.00 per parcel. The County Board has statutory authority to establish the fee at the greater of $10.00 or a reasonable fee to recover all the cost incurred against each parcel included in the Delinquent Tax List (Minn. Stat. 279.092.) All other 1, appropriations are paid monthly, with the exception of the Viking Library System which receives 50% in July• and 50% in December. 0 Otter Tail County Board of Commissioners January 7, 1997 Page 7 County Board of Equalization Dates Set Motion by Lee, seconded Partmann and unanimously carried to convene the County Board of Equalization ·on Monday, June 16, 1997 at 9:00 a.m. and to reconvene the County Board of Equalization for final action on Friday, June 27, 1997 (Minn. Stat. 274.14) Appropriation of Funds for County Extension Work Otter Tail County Resolution No. 97-04 A motion was offered by Commissioner Partmann, seconded by Commissioner Lee and carried, with Lee opposed, to adopt the following resolution for appropriating for the 1997 budget appropriation for county extension work: Otter Tail County Year Beginning January 1, 1997 BE IT RESOLVED: That the Sum of $191,380 be set apart form the General Revenue Fund and appropriated subject to the order of the Dean and Director of the Minnesota Extension Service of the University of Minnesota for the support of county extension work in O Tail County for the year beginning January 1, 1997 in accordance with Minnesota Statute, Section 38.33 L 3 .38, 1996. These beavers were removed from the drainage system in 1995. Payment Approved per Statute Motion was made by Lee, seconded Partmann, and unanimously carried to approve payment to Lake Region Hospital and Nursing Home, in the amount of $770.05, and to the Fergus Falls Medical Group PA, in the amount of $137.00, for the cost of medical examination incurred under Minnesota Statute 609.35. Payment Approved Motion by Partmann, seconded Lee, and unanimously carried to approve payment, in the amount of $2,531.35, to the law firm of Pemberton, Sorlie, Sefkow, Rufer & Kershner, P.L.L.P. for legal costs concerning the purchase of the First Bank Property. Reappointments -Board of Adjustment Motion by Lee, seconded Partmann, arid unanimously carried to reappoint the following representatives to the Otter Tail County Board of Adjustment for a one year term effective January 1, 1997: District 1 District 2 District 3 District 5 George Walter, Perham Cecil Femling, Pelican Rapids John Everts, Battle Lake Randy Mann, Fergus Falls Reappointment -Planning Commission Motion by Stone, seconded Nelson, and unanimously carried to reappoint David Trites, Parkers Prairie to the Otter Tail County Planning Commission for a three year term effective January 1, 1997. CAI Association Otter Tail County Board of Commissioners January 7, 1997 Page 8 Ag & Ditch Inspector, Tiny Holm, questioned the Board's preference in involvement with the County Ag Inspectors Association by serving as secretary/treasurer for that organization. General Board consensus 0 approved Mr. Holm's service with the organization. Approval to Pay Bills Motion by Stone, seconded Partmann and unanimously carried to approve payment of bills per attachment A of these minutes subject to removal of the $35 bill payable to the NRA and a corresponding explanation of the purpose of the payment at the next regular Board meeting. Discussion -Closure of Friendship Day Care Center Commissioner Partmann reported that the Friendship Daycare Center has publicly announced their closure in two weeks. Discussion followed regarding the need for day care placement because the center serviced 102 children. The issue will be discussed at the next Human Services meeting on January 14, 1997. Approval of Minutes Chair Lindquist referred to the. Commissioners' Salary Resolution (No. 96-45) passed during the December 23, 1996 Board meeting. The Chair noted that the new DMG salary schedule approved for non- union employees does not eliminate longevity. The new salary schedule replaces/incorporates longevity. Lengthy discussion followed. Motion by Stone, seconded Nelson, to approve Otter, Tail County Resolution (No. 96-45) as documented in the December 23, 1996 minutes whereby Commissioners receive no longevity, and to approve the minutes of December 23, 1996 as submitted.· Chair Lindquist called for a role call vote: Yea Nay Abstain First District, Commissioner Nelson X Second District, Commissioner Lee X Third District, Commissioner Lindquist X Fourth District, Commissioner Stone X Fifth District, Commissioner Partmann X Motion carried with Commissioner Lindquist voting against the motion stating that he will only accept an annual salary of $15,450.84 ($1,287.57 per month) during the year of 1997 _which represents~ 2% cost-of- living increase over his 1996 base salary. · One-Month Extension for Interest Accrual Wally Senyk, County Attorney, reported a request from the Star Lake Property Owners Association to delay accrual of interest one month until March 1, 1997 for reimbursement to the County for engineering services for Ditch 23. The County Board agreed to accept the one-month extension. Purchase of Minnesota Statute Books Motion by Lee, seconded Partmann, and unanimously carried to approve advance payment, in the amount of $1,112.93, payable to the State of Minnesota for five full sets and miscellaneous copies of current Minnesota Statute books. GIS Budget Approval 0 Budget Committee member, Commissioner Partmann, reviewed proposed expenditures for the GIS project. Motion by Partmann, seconded Lee, and unanimously carried to approve the GIS budgeted expenditure of $228,320 for 1997. Commissioner Lee noted that during the past weekend storm and the number of Q. emergencies, it is evident that the addressing/GIS project is needed. · Tuesdays Established as County Board Meeting Dates for 1997 Motion by Lee, second Partmann, and unanimously carried to establish the following as the dates the Otter Tail County Board of Commissioners will meet during the year 1997 to conduct county business, with the t 0 0 Otter Tail County Board of Commissioners January 7, 1997 Page 9 full day's meetings commencing at 9:30 a.m. and the afternoon meetings of the County Board commencing at 1 :00 p.m. Human Services meetings commence at 9:30 a.m. on the second and fourth Tuesdays of each month. The Otter Tail County Board of Commissioners meet four Tuesdays per month. If there are five Tuesdays in a month, the Otter Tail County Board does not meet on the fifth Tuesday of that month.
