Call to Order
. The Otter Tail County Board of Commissioners convened Tuesday, December 10, 1996 at 9:32 a.m. at the
Otter Tail County Courthouse with Commissioners Malcolm Lee, Chair; Andy Lindquist, Bill Stone,
Harley Windels, and Virginia Portmann present.
Approval of Agenda
Motion by Stone, seconded Windels, and unanimously carried to approve the Human Services agenda of
December 10, 1996 as amended.
Approval of Minutes
Motion by Lindquist, seconded Portmann, and unanimously carried to approve the Human Services
minutes of November 26, 1996 as submitted.
Vehicle Proposals -Court Services
Chuck Kitzman, Court Services Director, provided quotations from area car dealers for the purchase of two
cars. The proposal allowed for consid.eration of used vehicles as well as new vehicles. Mr. Kitzman
.reported that the state bid has been delayed. General consensus of the Board is to wait until after the price
of.vehicles through the state contract is known before a decision is made on the quotations provided by the
· Court Services Director.
Otter Tail County Court Services Advisory Board Reappointment
Motion by Stone, seconded Windels, and unanimously carried to reappoint Ed Snyder of Henning, MN, to
the Otter Tail County Court Services Advisory Board effective January 1, 1997 for a three year term.
Approval of Annual Public Health Contracts
Diane Thorson, Public Health Director, requested approval of the following annual 1997 contracts.
Environmental Health Services Agreement, $47,865, (food, beverage, & lodging licensing)
Immunization Action Plan Grant, $13,597
Medica Self-Insured Public Health Agency Participation Agreement
Medica Public Health Agency Participation Agreement
Motion by Lindquist, seconded Portmann, to approve the above contracts contingent upon the approval of
the County Attorney. Discussion took place regarding the Environmental Health Services Contract. Motion
withdrawn.
Motion by Stone, seconded Portmann, and unanimously carried to approve the above contracts subject to
the approval of the County Attorney.
Discussion followed regarding discontinuation of licensing and inspection services for food, beverage, and
lodging beginning January 1, 1998 by Otter Tail County. Potential liability and possible loss of revenue
were discussed.

Motion by Lindquist, seconded Windels, and carried, with Stone opposed, to put the State of Minnesota on
notice that Otter Tail County will drop the licensing and inspection program for food, beverage, and lodging/\
facilities effective January 1, 1998. 'w
1997 Public Health Fees
The Public Health Director reviewed recommended fees for the Public Health Department for 1997. Motion
by Lindquist, seconded Portmann, and unanimously carried to approve the 1997 Public Health Fees as
designated per Attachment A of these minutes.
Lakeland Mental Health Center Quarterly Report and Update
Lakeland Mental Health Center CEO, Marilyn Moen, and COO, Rick Paul, provided a quarterly handout
detailing utilization of services (July -September, 1996) at Lakeland Mental Health Center in Fergus Falls.
Discussion followed regarding various programs, how success is measured, and the financial status of the
health center.
Bills & Claims
Motion by Lindquist, seconded Portmann, and unanimously carried to approve the bills and claims as
presented.
Mental Health Pilot Project Award
Motion by Portmann, seconded Lindquist, and unanimously carried to authorize the signature of the Human
Services Board Chairman to execute the Adult Mental Health Pilot Project Grant Agreement for Calendar
Year 1997 between the Minnesota Department of Human Services and Becker, Clay and Otter Tail
Counties. The Implementation Grant of $325,000 is funding provided by the State of Minnesota.
Minnesota Welfare Reform Update
The Social Services Director provided an update regarding welfare reform.
Approval of Annual Contracts
Motion by Lindquist, seconded Windels, and unanimously carried to authorize the signature of the Human
Services Chairman to renew annual Social Services contracts for 1997 with the following agencies:

Tom Fawcett, Social Services Director, reported that the MA mileage reimbursement rate will be $.31 per
mile effective January 1, 1997. The Otter Tail County mileage reimbursement rate will increase January 1,
1997 according to the state increase based on previous County Board action of April 2, 1996.

Call to Order

Approval of Agenda
Motion by Stone, seconded Windels, and unanimously carried to approve the County Board agenda of
December 10, 1996 as amended.
Approval of Minutes
Motion by Lindquist, seconded Lee, and unanimously carried to approve the County Board minutes of
December 4, 1996 as submitted.
Approval of Bills
Motion by Windels, seconded Lindquist and unanimously carried to approve the bills per Attachment B of
these minutes which include lodging payments as follows:

Solid Waste Service Fees
Service Fee Systems Administrator, Michele Petterson, requested a County Board decision regarding how
non-profit organizations are assessed solid waste service fees. Ms. Petterson explained that previously
points were set at three for rural churches and six service points for the churches within city limits. Another
option would be to assess fees based on the volume of garbage generated which is the way other
businesses are assessed. The county now has current information of the garbage generated by non-profit
organizations.
Motion by Stone, seconded Windels, and unanimously carried to assess solid waste service fees in the
same manner (volume based) to non-profit organizations as other businesses have been assessed. The
solid waste fees are payment for a service, not a tax.
Performance Evaluation Summary
Motion by Lindquist, seconded Windels and unanimously carried to approve the favorable performance
evaluation summary for Highway Engineer, Rick West, as submitted and to place the summary in his
personnel file.

Chair Portmann acknowledged correspondence from the Minnesota Rural Counties Coalition. Discussion
regarding the coalition followed.
Motion by Lee, seconded Windels and carried, with Stone opposed, to decline participation in the MRCC at
this time, because benefits to participate may be limited since the MRCC is a part of the AMC. Chair
Portmann will write a letter to the MRCC to convey that Otter Tail County is interested in the Rural
Coalition, however, do not wish to participate at this time since the coalition is organized within the AMC.
Temporary Appointment
Vice-Chair Lindquist appointed Commissioner Lee temporarily to the Negotiations Committee (Employee
Relations Committee) until a permanent appointment is made for the upcoming year.
Planning Commission Recommendations
Bill Kalar, Land & Resource Administrator, presented the Planning Commission recommendations.
Conditional Use Application:
Commissioner Lee expressed concern regarding the Conditional Use Permit request of Rolf Sumstad.
Mr. Kalar reported that there was a letter of opposition read at the Planning Commission meeting. The
letter expressed opposition because of the area and the fact that some people have been turned down for
construction of a mound system. Commissioner Lee requested that the Commissioner representing this
area look at this property and report back to the Board. Mr. Kalar reminded the Board of the 60-day rule.
The 60-day rule requires action within 60 days or the CUP would be approved by default.

Following discussion with Mr. Sumstad, motion by Windels, seconded Lee, and unanimously carried to
table this Conditional Use Permit for 60 days following April 1, 1997. Mr. Sumstad is to provide a letter of
agreement for this extension. Q
Preliminary Plat:
Motion by Lee, seconded Lindquist and unanimously carried to approve the following Preliminary Plat with
conditions as recommended by the Planning Commission:
"Prairie Ridge", Charles Egge, Section 11, Pelican Township
Final Plat
Mr. Kalar reported that roads meet county specifications as required for "Blyberg's Point First Addition" plat,
however, question remains regarding the structure requirement. The Shoreland ordinance language states
that roads shall be constructed with setback requirements whenever feasible. Relative to this plat, a
decision was make that it would be less detrimental environmentally the way ii was constructed rather than
putting the road back 75 feet. Additionally, Mr. Kalar reported that the lot configuration (consecutive
numbering system) is off on one lot. The ordinance does state that numbering should be consecutive.
Motion by Lee, seconded Windels, and unanimously carried to approve the following final plat:
"Blyberg's Point First Addition", Section 17, Twp. 137N, R. 42W, Fish Lake
Water Testing Results
Land & Resource Director, Bill Kalar, provided a handout of the 1996 water testing results with a map
showing the various testing sites. Additionally, the handout included 32 sites the COLA monitored and the
corresponding testing results. Q
1996 Minnesota Statutes Books
Motion by Lindquist, seconded Lee, and unanimously carried to approve payment to the State of
Minnesota, in the amount of $555; for the purchase of three sets of the 1996 Minnesota Statutes. The sets
are for the County Assessor's office, County Auditor's office, and the County Commissioners' room.

Motion by · Lee, seconded Lindquist, and unanimously carried to approve payment, in the amount of
$7,876.85, to Faegre and Benson, LLP for legal services provided in connection with the issuance and sale
of our General Obligation Veterans Home Bonds, during the period of August 22, 1993 through April 23,
1996.
Certificate of Correction to Plat
Motion by Lee, seconded Windels, and unanimously carried to table, pending review of the County
Attorney's office, the Certificate of Correction of Road Right-of-Way within "Jacobs Beach" and "First
Addition to• Jacobs Beach", Otter Tail County, Minnesota, as prepared by Robert B. Oslund, Registered
Land Surveyor under the laws of the State of Minnesota, Registration No. 7575.
Historical Society Agreement
Motion by Lindquist, seconded Lee, and unanimously carried to authorize the Chair's signature on the
"Agreement for the Transfer of Tax Lists to the Otter Tail County Historical Society" as reviewed and
modified by Otter Tail County Attorney, Wally Senyk.
Truth in Taxation Public Hearing
Wayne Stein, Auditor, presented a "Truth In Taxation" handout for the Public Hearing at 7:30 p.m. this
evening. The Auditor reviewed the Truth In Taxation process.

The Otter Tail County Board of Commissioners was reconvened by Commissioner Virginia Portmann,
Chair, at 7:31 p.m. on December 10, 1996, for the purpose of conducting the Truth In Taxation Public
,Hearing.
In addition to Commissioner Virginia Partmann, Chair, Commissioners Malcolm Lee, Andy Lindquist,
Bill Stone, and Harley Windels, the following County staff were in attendance:

It should be noted that of the seven people in attendance only four represented private concerns.
Chair Portmann provided the opening statement regarding the order of business for the hearing and the
topics for discussions and consideration. Chair Portmann then called upon Wayne Stein, County Auditor,
for opening comments. Wayne Stein, County Auditor, noted a proposed 1997 budget of $39,323,048 and a
proposed 1997 net tax levy of $11,986,082.
Chair Portmann then requested questions and comments from the audience. Hearing no questions or
comments from the audience Chair Portmann requested a presentation of the overall proposed 1997
budget and tax levy.
Wayne Stein, County Auditor, briefly explained the materials in the Truth In Taxation public hearing
handouts. Historical information and trends were presented. An overview of the proposed budget was
presented with significant changes in revenues and expenditures being noted. The level of HAGA funding
proposed for 1997 was presented and the change in the certified amount from 1996 was also presented.
The County's overall net tax capacity, market value, net tax capacity rates, and information concerning the
long term debt was presented.
Chair Portmann again requested additional public comments and/or questions. Hearing no further
discussion, comments and/or questions from the public regarding the County's proposed 1997 budget and
tax levy, Chair Portmann declared the public hearing closed for public comment at 8:03 p.m.

By the general consent of the Otter Tail County Board of Commissioners, it was stated that the subsequent
hearing would be scheduled for Tuesday, December 17, 1996, at 10:40 a.m. at which time the final budget
and tax levy will be adopted. 0

Hearing no further business, at 8:10 p.m., Chair Portmann declared the public hearing and the meeting of
