Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, November 19, 1996 at 9:31 a.m. at the
Otter Tail County Courthouse with Commissioners Virginia Portmann, Chair; Andy Lindquist, Bill Stone,
Malcolm Lee and Harley Windels present.
Approval of Agenda
Motion by Windels, seconded Stone, and unanimously carried to approve the agenda of November 19,
1996 as presented with the following additions:
10:30 a.m. -Bob Block-Request for Approval of Additional E-911/Addressing Work
2:00 p.m. -Chuck Krekelberg -Request for Recon_sideration of Pawlowski Plat
Approval of Minutes
Motion by Lee, seconded Lindquist, and unanimously carried to approve the County Board minutes of
November 12, 1996 as submitted.
Otter Tail County Housing Survey
Jeff Gaffaney, HRA Director, provided a proposal for an Otter Tail County housing study with five goals and
several options to collect and present relevant housing data. Discussion followed.
Motion by Lindquist, seconded Windels, and unanimously carried to approve Option 1 as recommended by
the Otter Tail County HRA Committee for a county housing survey, in the amount of $11,500, contingent
upon the recommendation of the County Budget Committee.
Commissioner Lindquist, member of the Housing Committee, noted that this survey can be added to,
therefore, this survey is not one whereby the data becomes useless.
Homestead Manual
Bob Moe, Assessor, presented a Homestead Law Manual. The manual is a guideline as to how taxes are
calculated on homesteads, how to determine homestead classification, and clarifications of portions of the
law.
Payment Approval
Motion by Lee, seconded Stone, and unanimously carried to approve payment to Nelson Bros. Printing,
Fergus Falls, in the amount of $10,520.35, for the printing of ballots and sample ballots for the past
elections.
Dunn Township Proceedings
Auditor, Wayne Stein, notified the Board that Dunn Township is proceeding with regular procedures to
detach themselves from the Pelican Valley Hospital District.

Resolution Opposing the 1997-1998 AMC Draft Platform for
Probation, Field Services, and Community Services
Otter Tail County Resolution No. 96-43
UPON a motion by Windels, seconded Lee, and unanimously carried on a roll call vote as follows, the
Otter Tail County Board of Commissioners adopts the following resolution:

WHEREAS, the Otter Tail County Board of Commissioners has reviewed and discussed the Association of
Minnesota Counties 1997 -1998 Draft Platform as it relates to Probation, Field Services, and Community
Services; and
WHEREAS, the Otter Tail County Board of Commissioners supports the continued effective delivery of
Corrections services in Otter Tail County and throughout the State of Minnesota; and
WHEREAS, the Otter Tail County Board of Commissioners supports each individual county's current option
of selecting the Corrections Delivery System that best serves the citizens of their county; and
WHEREAS, the Otter Tail County Board of Commissioners has specific concerns for the Association of
Minnesota County's proposal to repeal all Minnesota statutes related to the current Field Services delivery Q
system. The impact of such an action in terms of financial costs and quality of corrections services on
Otter Tail County are unclear.
NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Otter Tail County Board of Commissioners
opposes the adoption of the Association of Minnesota Counties 1997-1998 Draft Platform section identified
as Probation, Field Services, and Community Services.

ARD OF COMMISSIONERS
Approval of Additional GIS Pilot Project Area
Bob Block, Rural Addressing Coordinator, provided a handout from Pro-West and Assoc., Inc. detailing the
difference between capturing data and producing GIS map products for one township versus a four
township area.
Motion by Lee, seconded Windels, and unanimously carried to approve the extension of this pilot project to
include a four township area through Pro-West & Assoc., Inc. not to_exceed $9,200. The County Attorney('\
will formalize an addendum to the ong1nal Pro-West agreement for this work. W
Mr. Block provided an updated Otter Tail County Rural Addressing Flow Chart. Lengthy discussion
followed.

Purchase of Cellular Phones
Otter Tail County Board of Commissioners

Wally Senyk, County Attorney, reported on a recent request of Duane Rose, representing the OCTA
snowmobile club. The request is to acquire cellular phone(s) for use by snowmobile club groomers when
out on the trail by sending the phone billings to the county. A less costly rate can be obtained by the clubs
if the bill is sent to a government entity. The cellular phone expense if used for purposes of groomer and
emergency access is a reimbursable expense under the DNR grant moneys.
Motion by Stone, seconded Lindquist, and carried, with Lee & Portmann opposed, to approve a policy that
authorizes Snowmobile Associations to purchase cellular phone(s) and have the bill sent to the county to
provide less expensive rates contingent upon review of this policy in one year.
Pelican Lake Property
Wally Senyk requested approval of the conveyance of properties of the previous Pelican Lake Public
Access area.
Motion by Lee, seconded Windels and unanimously carried to authorize the signatures of the Chair and
Clerk on the following quit claim deeds to execute conveyance of properties as requested by the DNR to
complete the county's authorized transfer to the State of Minnesota: R. A Kost, Susan Helen Swanick,
Lorelei Systems, Inc., Larry J. and Todd C. Kohler, and State of Minnesota
First Bank Building
Wally Senyk reviewed possible changes to documents that Attorney, Bob Sefkow delivered relative to the
First Bank building proposed purchase. Mr. Senyk reviewed proposed changes in the option and lease
agreement and discussed additional comments addressing economic issues. Mr. Senyk noted that
Rick Sytsma, Maintenance Supervisor, and Architect, David Shultz, provided a summary condition report of
the First Bank Building. The County Board referred additional discussion regarding the First Bank Building
to the Building Committee.
Approval for Use of the Courthouse for Candlelight Vigil
Motion by Lindquist, seconded Lee, and unanimously carried to approve the use of the courthouse building
by Mothers Against Drunk Drivers for a candlelight vigil on December 1, 1996 at 7:00 p.m.

Discussion -Sponsorship of Transportation Enhancement Grant
Rick West, Highway Engineer, reported that Mr. Blaha is interested in applying for Transportation Q
Enhancement Grant Project moneys with Otter Tail County sponsorship for a private museum (to be ··
opened to the public) and a bikeway from the City of Ottertail west to the old Carr's Marine area on TH 78.
In the past, Otter Tail County has acted as sponsor only on county roads. The museum and bikeway
proposals are being constructed on private not public property, therefore, grant moneys cannot be used. At
this time, the MnDOT has written a letter to Mr. Blaha explaining that as long as this project is to be
constructed on private property, the application cannot be considered. No action was taken.
Waterfowl Easements
Don Kleven, U.S. Fish & Wildlife, requested approval of waterfowl easements. Motion by Lindquist,
seconded Lee and unanimously carried to approve certification for acquisition of the following lands for
waterfowl easements:

Section 9, as described below
The Northwest Quarter of Northeast Quarter (NW 1/4 NE 1/4), Lot One (1), and a tract of land in the
Southwest Quarter of Northeast Quarter (SW 1/4 NE 1/4), described as follows:
Commencing at the Northwest corner of the Sough Half of Northeast Quarter (S 1/2 of NE 1/4), thence
South Six (6) rods, thence East Twenty (20) rods to the place of beginning, all said lands being in Section
Nine (9), Township One Hundred Thirty-one (131) Range Forty-one (41), containing 67 acres more or less.

Water Plan Update
Bill Kalar, Land & Resource Administrator, provided a schedule for the process of updating the Otter Tail
County Water Plan and the members of the Water Plan Revision Committee.
Planning Commission Recommendations
Bill Kalar presented the Planning Commission minutes of November 13, 1996. Discussion took place
regarding the application for Conditional Use Permit of Roger Shelstad, Pickerel Lake. Chair Portmann
questioned whether or not this was the same application that was previously denied. Mr. Kalar reported
that while the application format had been changed, the Planning Commission's recommendation remained
the same.
Conditional Use Permit:
Motion by Stone, seconded Portmann (for discussion purposes), to deny the application for a Conditional
Use Permit for Roger Shelstad on Pickerel Lake. Discussion continued. Chair Portmann called for a roll
call vote as follows:

Conditional Use Permits with conditions as recommended by the Planning Commission:

Water Funding Grant Application
The Land & Resource Administrator received notification from BWSR that the county has an opportunity for
grant funding for the SMO, Water Plan, and WCA.
Motion by Stone, seconded Windels, and carried, with Lindquist and Lee abstaining, to authorize the Land
& Resource Administrator to proceed with application for grant funds.
Request to Refer Preliminary Plat Back to Planning Commission
Attorney Chuck Krekelberg, appeared on behalf of Robert Pawlowski relative to property on Little McDonald
Lake. Mr. Krekelberg explained that because his client is located in Florida which may have resulted in a
breakdown of communication, his client was not present when the Preliminary Plat was prepared and
presented to the Planning Commission. Attorney Krekelberg stated that the Planning Commission had
concern regarding the plat and recommended that the plat be approved with two conditions; Lots in Block 2
will not provide access to the lake and are to be maintained in their existing natural state.
Mr. Krekelberg explained that significant changes have been implemented in the way the Supreme Court
handles decisions of the County Board. Because the review process is now very difficult, Mr. Krekelberg
requested that the approval of the Preliminary Plat application for "McDonald Bay" be rescinded and that
the plat be remanded back to the Planning Commission so the plat can be reviewed again. The request is
made to avoid the expense of going to the Court of Appeals.
Wally Senyk, County Attorney, learned of Mr. Pawlowski's concern after the County Board had acted on the
Preliminary Plat. Mr. Senyk stated that the Board need not reconsider the application unless there is a
substantial change in the application. Under the current laws, however, sufficient time and energy may be
saved by avoiding the Court of Appeals procedures.
Bill Kalar, Land & Resource Director, informed the Board that considerable time was spent by the Planning
Commission regarding this plat. The prime concern was that the bay on which this plat is located,
(according to the Little McDonald Lake Association) is a spawning area. The Planning Commission's
concern is if access is allowed from this bay, it would be detrimental to the lake. One option the Planning
Commission considered was approval of lots on the west side of the road on the condition that the lots on
the east side be left as a preservation area. However, small strips of land sometimes become unattended
and can become a nuisance. Therefore, in a compromise situation recommended limiting access to the
small bay on the lake and to keep the vegetation intact as much as possible. Discussion followed.
Commissioner Windels noted that the individual had two opportunities to convey concerns (Planning
Commission meeting and the County Board meeting). There is no record of anyone opposing the Planning
Commission recommendations. No action taken.
Approval to Pay Bills
Motion by Windels, seconded Stone, and unanimously carried to approve the bills per Attachment A of
these minutes.
Closed to the Public
At 2:55 p.m., Chair Portmann declared the balance of the Otter Tail County Board of Commissioners'
meeting closed to the public for purposes of labor negotiation strategy discussions with four collective
bargaining units; AFSCME, Local Union No. 1830, Highway Maintenance Unit; Minnesota Teamsters Public
and Law Enforcement, Local Union No. 320, Human Services Professional Unit; Sheriffs Department -
Otter Tail County Board of Commissioners

Essential Unit; and the Social Services Support Specialists Unit All commissioners were present during n,,
