Approval of Agenda :Motion by Stone, seconded Lee, and unanimously carried to approve the agenda of November 5, 1996 as presented. Motion by Lee, seconded Windels, and ,9ctober 22, 1996 as submitted. · .s·,, . . ; .:, ·;r - Approval of Minutes unanimously carried to ., t·' approve the County Board minutes of ,. . -Minnesota Extension Service Agriculture Update .'Minnesota Extension Educators, Denzil Cooper-and'·Bob Stommes, appeared to update board members ··relative to current agricultural activities. Chair Portmann introduced Educator, Bob Stommes, to the ,commissioners, Mr. Stommes gave ·a brief overview of his Ag and Economic background which brought 'lhim to the Extension Service in· Otter Tail County on July 15, 1996. Bob·provided handouts and requested :,:the: commissioner's opinions regarding a 1996 t..:and Rental Survey.-· : Lengthy discussion took place 'regarding fair rental offaim land.' Commissioners agreed that fair rent depends on crop prices and yield and current data and computer'programs:are-useful tools to provide fair rent information; and further, that ,the· survey may not be ·a -usefui'tool at this ·time.-Educator, Denzil Cooper, reviewed a new Dairy Farm -AdvisoryTeam Project with farmers in Otter Tail and Becker:counties funded by a grant of $25,000. Request for Fo'rgiveness of Penalty and Interest Property Owner, Leona Zimmerman, informed board members that she recently became aware that taxes on property previously'sold by. herJon a contract for'deed had not been paid. Leona reviewed her options and requested forgiveness·of'penalty•and interest, in the amount of $581.29. Discussion followed. The County Attorney outlined the policy of the board regarding situations whereby the purchaser of a contract for deed does not fulfill the terms of their contract. The county could loose financially in some cases if the property is forfeited, however, the board does-not review -'each individual case in determination. The violation is with the contract: :chair Portmarin entertained a ri'lotion. ·· ,Motion ,by Lindquist; :secorided' Wiridels, and unanimously, carried, although acknowledging empathy with 'Ms'•Zimmerman's situation, to deny the request of forgiveness and penalty, in the amount of $581.29, as is · consistent-with Otter Tail·County policy'as outlined by Mr. Senyk. Otter Tail County Board of Commissioners November 5, 1996 Page 2 Chippe~a River Watershed Chair Partmann reviewed a letter from the· Chippewa River, Stewardship Partnership and their funding request. Chair Partmann will respond by letter< Conditional Use P~rinit Bill Kalar, Land & Resource Administrator, appeared, with' a request from Douglas Dunker for a Conditional Use Permit to allow a large earth moving project this fall. Mr. Kalar explained that Mr. Dunker received a Conditional Use Permit for the project, however, ncit to be done this time of the year: Standard language of the rules allows for earth moving between April 15 and September 1. There is no opportunity to stabilize the land during the late fall/early winter.season. Motion by Stone, seconded Lindquist, and unanimously carried to deny. the. Conditional Use Permit request of Douglas Dunker as discussed above because the project would be past the allowable cut-off date for earth moving. OCTA Bill Kalar brought forward a request from Duane Rose, representative of OCTA, regarding the purchasing of cellular phones through Otter Tail County.· Chair Partmann ~eferred the issue to the County Attorney. Letter -Minnesota River Basin Joint Powers B.oard . Bill Kalar presented a request from Steve Hansen, delegate of the Minnesota River Basin Joint Powers Board, to meet with the County Board to discuss the activities of the Minnesota River Basin Board. The Chair directed agenda. time to be set up on the first or third meeting in December. Request,toVacate a.Dedicated Road • 0 Property owner, Brent Jenkins, and seasonal property.owner, Joe Costello; explained that.they live on the r'\ south side of Pelican Lake by the Public Access (Lake View Beach), . They, presented an Application for ~ Vacation of Dedicated Road in "Lake View.Beach:'.; a ·plat of record in Otter-Tail County. Nine property owners have signed the petition. and the request will· be taken to Distri_ct Court . Mr. Jenkins stated that the road is not used (private roads are used .presently) and none· of. the property. owners want this road to remain. Further, the road cannot be used because·of sewers and the slope .of the road. Mr. Jenkins and Mr. Costello requested a statement that Otter Tail County does not object to the. vacation or plan to make this a county road. County Attorney, Wally Senyk, noted that with the vacation of this road, there would not be public access to the lots in "Lake View Beach"·for fire trucks, school buses; and/or emergency vehicles. Motion by Lee, seconded Windels, . and unanimously ,i::arried to convey that Otter Tail County· has no objection to the vacation of the dedicated· road in "Lake View Beach" and that Otter Tail County has no plans to make this a county road. CSA!i No. 1 & Brenvei. Driv_e. ,;;, .. Rick West, Highway Engineer, presented, for the record; a petitiom.of concern for. safety that was sent to the City of Fergus Falls and Otter Tail County regarding the area of CSAH No. 1 and Brenvei Drive. The City of Fergus Falls will be the lead agency_ studyjng the safety concern.and proposing recommendations for remedy of the potential problems. Mr. West's recommendation is,that if the pedestrian/bike crossing .or path is relocated, the costs incurred will be.the responsibility of-the.City b_ecause·this area is within the limits of the City of Fergus Falls. Board members agreed with this recommendaiion. Request for Approval of Agreements . ,:.• ,. .. Motion by Lindquist, seconded Lee, and unanimously carried to.authorize.the-County Engineer to enter into the following agreements with Braun lntertec of St. Cloud, MN: Geotechnical Evaluation for the Proposed lmprovements·to,GSAH.No. 74, Geotechnical Evaluation for the Proposed Improvements to Sverdrup Township Road Geotechnical Evaluation for the Proposed Improvements to CSAH No. 15 0 Updates Otter Tail County Board of Commissioners November 5, 1996 Page 3 The Highway Engineer provided updates on CSAH No. 88 and CSAH No. 3. Approval of Release of Highway Right-of-Way The County Attorney reported that after rebuilding County Road 45, the county retained a portion of ··right-of-way which the County no longer needed. Mr. Ronald Mackenzie-Davies has maintained this property and requested ownership be conveyed back to the current property owners. The Highway Department has accomplished a legal description of this property, therefore, Mr. Senyk requested conveyance of unnecessary right-of-way properties. ,.Motion by Lindquist, seconded Stone, and unanimously carried to authorize the Chair's signature on two . quit claim deeds for the release of highway easements to Ronald and Marjorie Mackenzie-Davies; and Howard and Gladys Krohn and Arnold Lofthus. Meeting Recessed At 11:22 a.m., Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners . recessed for a committee meeting anddunch break. · • Reconvene Approval to Pay Bills •At 1: 15 p.m., Chair Portmann reconvened the meeting of the Otter Tail County Board of Commissioners. ·;Motion by Lee, seconded Lindquist, and unanimously carried to approve the bills per attachment A of ;these minutes including lodging payments as follows: Cragun's Lodge & Conference Madden's on Gull Lake Super 8 Motel Solid Waste Director, Mike Hanan Assistant County Attorney, Kurt Mortenson Detention Officer, Judy Siggerud Elected Officials Benefits Commissioner Lindquist, read for the record, a resolution adopted on December 12, 1990. The resolution adopted a policy authorized by M,S. 471.61 Subd. 2(2) of providing medical and hospitalization insurance coverage under the Otter Tail County group health insurance plan to elected officials following termination of service with Otter Tail County, in the following manner: ·' Terminated elected officials entitled to benefits under any public employees retirement act shall receive payment of current insurance premiums in a total amount equal to a portion of the official's most recent base salary determined in accordance with the following schedule: Years of Service four eight twelve or more Percent of Base Salary 14% 28% 35% Any official serving other than a full-term shall receive a pro-rated percentage of base salary. Motion by Lindquist, seconded Lee and unanimously carried to increase the percentage by 10% for extended health coverage for elected officials as outlined in the December 12, 1990 resolution. The monies for extended health insurance will stay in a county fund. The increased percentages are as follows: Years of Service four eight twelve or more Percent of Base Salary 24% 38% 45% Closed to the Public Otter Tail County Board of Commissioners November 5, 1996 Page 4 At 1 :35 p.m., Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners closed to the public for purposes of discussing labor negotiation strategies with the Minnesota Teamsters Public and Law Enforcement Employees· Union,. Local No. 320, Human Services Professional Unit and Social Services Support Specialist Unit. All commissioners were present. The closed session adjourned at 2:42 p.m. Open to the Public First State Bank Acquisition At 2:43 p.m., Chair Portmann declared the Otter Tail County Board of Commissioners' meeting open to the public. County Attorney, Wally Senyk, introduced Attorney, Bob Sefkow, to the commissioners. Mr. Sefkow will be representing Otter Tail County in the proposed acquisition of the First Bank Building. Attorney Sefkow reviewed the non-binding Letter of Intent, purchase agreement, and terms and conditions of the proposed transaction. Motion by Lindquist, seconded Windels, and carried, with Lee abstaining (to avoid potential conflict of interest with individuals working on behalf of First Bank in the disposition of their out0state properties) to authorize Attorney Sefkow, on behalf of Otter Tail County, to proceed with the Letter of Intent to purchase the First State Bank building and to authorize the Chair's signature on said document. • Closed to the Public ··· Adjournment · 0 At 3:40 p.m., with all commissioners present, Chair Portmann declared the Otter Tail County Board of Commissioners' meeting closed to the public for purposes of continued discussion of labor negotiation strategies with the Minnesota Teamsters Public and Law Enforcement Employees Union, Local No. 320, Human Services Professional Unit and Social Services Support Specialist Unit.
