Call to Order
The Otter Jail County Board of Commissioners convened Tuesday, October 1, 1996 at 9:30 a.m. at the
Otter Tail County Courthouse with Commissioners Virginia Portmann, Chair; Andy Lindquist, Bill Stone,
Malcolm Lee, and Harley Windels present.
Motion ·by

Approval of Minutes
Motion by Lindquist, seconded Windels, and unanimously carried to approve the minutes of September 24,
1996 as submitted.
Presentation of Appreciation Plaque
Highway Engineer, Rick West, introduced Highway Team Leader, Dale Fiskum, and spoke of Dale's
twenty-nine years with Otter Tail County and his commendable work ethics. Chair Portmann presented a
. plaque to Mr. Fiskum in appreciation of his service to Otter Tail County and wished him well in his
retirement.
Seating Capacity -Liquor License
. Wayne Stein, Auditor, informed board members of a request to reduce the minimum seating capacity for
restaurant owners to be eligible. to purchase a liquor license. Mr. Stein reported that the State uses a
formula of 16 square feet per person in determining seating capacity. Mr. Stein stated that law
enforcement did not identify potential problems relative to the reduction of the minimum seating capacity.
Motion by Lee, seconded Stone, and unanimously carried to reduce the minimum seating capacity from
100 to 50 (with a minimum space requirement of 16 square feet per person) for eligibility to purchase a . .
liquor license by restaurant owners for the balance of the 1996-97 license period. Additionally, the policy is
to be reviewed at the ·end of th_e 1996-97 licensing period.
Local Government Aid
. The County Auditor provided board members with LGA information. Discussion followed involving HACA,
. ag credit aid, school aid, and levies.
Discussion -Recent Meeting and Issues
Commissioner Wind.els reported on a recent AMC meeting. Mr. Windels reported that discussion revolved
around the concept of organizing a rural coalition within the AMC. Commissioner Windels conveyed Otter
Tail County's position that the county would like to have a designated AMC staff member to deal strictly
with rural issues. Discussion followed.
State of Minnesota Agriculture Update
Agriculture Development Specialist, Harold Stanislawski, introduced Mr. Gene Hugoson, State
.Commissioner of Agriculture. Mr. Hugoson updated the board regarding agricultural developments and the
economic importance of agriculture in the State of Minnesota. Lengthy discussion followed regarding
livestock and the pressures of farming in today's society. Chair Portmann stressed that this may be a good
time for the Governor to "speak out" in support of Minnesota's vital agricultural industry. Assessor,

Bob Moe, questioned the effect of new CRP land rules relative to the tax system. Mr. Hugoson provided a • I

Approval to Pay Bills
Motion by Lindquist, seconded Windels, and unanimously carried to approve the bills per Attachment A of
these minutes which includes payment for lodging as follows:
Buckhead Hotel Management Co. Barbara Molter, Assessor's Office
Grand View Lodge Chester Toso & Jourdan Sullivan, Veterans Service Officers
Discussion -International Coalition
Chair Portmann acknowledged receipt of a letter from the Budget Committee Chair of the Red River Basin
Water Planning Group. A financial commitment of $100 per 1000 population for 1997 and 1998 and a
response was requested from Otter Tail County by the Red River Basin Board. Chair Portmann will draft a
letter to convey the views of the County Board regarding this request. Board members agreed that Otter
Tail County does not wish to participate in the RRBC, the budget for Otter Tail County has been set and did
not include funds for the RRB, and Otter Tail County already has a very active water plan.
Recess and Reconvene
At 10:45 a.m., Chair Portmann declared the meeting of the Otter Tail_ County Board of Commissioners
recessed for a five minute break. The meeting reconvened at 11 :50 a.m.
12-Hour Shift
Personnel Committee member, Commissioner Windels, reviewed the 12 hour shift request of the Detention
Facility Officers. Motion by Windels, seconded Lindquist, and unanimously carried to implement the 12-
hour shift schedule in the Detention Facility with the following conditions: 1) the 12-hour shift schedule is O
experimental and will be renegotiated when the new labor contract takes effect, 2) a potential savings··of
$2,550 will be tracked under the new shift proposal and the savings will result in a budget reduction in
1997, 3) new hires will not be approved relative to the new 12-hour shift schedule, and 4) a waiver of
overtime pay after 40 hours per week and 8 hours per day is required from employees. Team Leader,
Bob Hjelman, will return to the board to follow-up on how the 12-hour shift schedule is working.
Solid Waste Issues
Wally Senyk, County Attorney, noted that the Solid Waste Committee of the County Board expressed
concern regarding a meeting whereby the Fergus Falls Public Works & Safety Committee discussed
proposed modifications of the incineration equipment owned and operated by the city and the continuation
of county waste being hauled to the incinerator. The city meeting followed a Joint Powers Board meeting
on September 10, 1996, at which the grant application and a commitment to deliver waste to the Fergus
Falls incinerator and other issues were discussed. A decision was made at the September 10th meeting to
meet again in November when more information would be available. The County Attorney read a letter for
the record to communicate the need for a meeting with city and county officials. The letter confirmed that
Otter Tail County has not agreed on a ten year commitment to deliver waste and that more information and
improved cost projections are necessary before meaningful discussion can take place. A decision to
modify equipment can only be made after further discussion and the county and Joint Powers Board need
to participate in an approval to modify the facility.
Motion by Lindquist, seconded Lee, and unanimously carried to approve the Letter to the City of Fergus
Falls as stated above and read by the County Attorney.
Approval of Household Hazardous Waste Program Q
Motion by Lindquist, seconded Lee and unanimously carried to approve the Chair's signature to execute
the contract and amendment between Otter Tail County and Steven's County for the operation of a local
Household Hazardous Waste Management Program.

At 11 :25 a.m., Chair Partmann declared the meeting of the Otter Tail County Board of Commissioners
closed to the public for the purpose of evaluating the performance of Public Health Director, Diane Thorson,
and Veterans Service Officer, Che!Toso, pursuant to M.S 471.705 Subd. 1d(d). All Commissioners were
present at 11 :25 a.m. for the performance evaluation of the Veterans Service Officer. Commissioner
Lindquist was absent at noon during the evaluation of the Public Health Director. A summary report of
performance conclusions will be provided at the next regular board meeting. The Chair concluded the
closed session at 12:20 p.m. and recessed the meeting for lunch break.
Meeting Reconvened and Closed to the Public
Adjournment
At 1 :08 p.m. with all Commissioners present, Chair Partmann declared the meeting reconvened and closed
to the public for the purpose of discussing pending litigation relating to construction disputes in tardy
completion of the recycling facility project. Attorney-client privilege is authorized pursuant to M.S. 471.705
Subd. 1d. At 1:55 p.m., Chair Portmann concluded the closed session and declared the meeting of the
Otter Tail County Board of Commissioners adjourned until 9:30 a.m. Tuesday, October 8, 1996.
