Call to Order , The Otter Tail County Board of Commissioners convened Tuesday, September 17, 1996 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Portmann, Chair; Andy Lindquist, Bill Stone, Malcolm Lee, and Harley Windels present. Approval of Agenda· Motion by Lee, seconded Lindquist, and unanimously carried to approve the agenda of September 17, 1996 as presented with one addition: 2:05 p.m. -Bid Opening Approval of Minutes Motion by Stone, seconded Windels, and unanimously carried to approve the minutes of September 10, 1996 as submitted. Small Cities Development Program -Underwood Joe Merz, owner of Affordable Housing & Community Development Services, informed the board that the City of Underwood has established an HRA and activites include a grant application for two new housing units and rehabilitation of 30 residential homes in which the owners have a low to moderate income level. One requirement of the grant application is an effort to obtain local funds. Underwood's local share will be $30-40,000. Mr. Merz requested a strong letter of support for this grant application and potential project in Underwood. Fergus Falls HRA Director, Jeff Gaffaney, expressed support for this grant application and the .need for housing improvements in the City of Underwood. Motion by Lindquist, seconded Lee, and unanimously carried to direct County Coordinator, Larry Krohn and Mr. Merz to draft a letter of support for the Small Cities Development Program in Underwood and return to the board for approval. 12-Hour Shift Request -Detention Facility Team Leaders, Anne Mueller, Jack Dawkins, Richard Akerman, and Bob Hjelman appeared to request approval of a 12-hour shift schedule for the Detention Facility. The Jail Administrator and Assistant Jail Administrator. were also present. · Board members acknowledged receipt of a handout regarding the 12- hour shift request and a letter of support from the Sheriff asking for a one year trial period. Lengthy discussion took place regarding other facilities using the 12-hour shift schedule, fatigue factors towards the end of a shift, working fewer weekends than is required with the current schedule, and staff requirements to change to the 12-hour shifts. Jail Administrator, John Halvorson, will submit a proposed 12-hour shift . schedule for the first quarter of 1997 for the board's review. This issue will be reviewed and discussed by the Personnel Committee of the County Board. The Personnel Committee will make a recommendation to the County Board in two weeks at the October 1, 1996 meeting. Recycling Center Grand Opening Marie Tysdal, Education and Public Information Officer, reported on the upcoming Grand Opening celebration for the newly remodeled Recycling Center scheduled on September 25, 1996, at 1 :00 p.m. with the facility open to the public from 2:00 -7:00 p.m. Discussion regarding the activities for the day took place. Commissioner Lee requested that an invitation for the ceremony be sent to the Facility Director of Rice County. Approval of Assessment Contract Otter Tail County Board of Commissioners September 17, 1996 Page 2 Motion by Lee, seconded Lindquist, and unanimously carried to authorize the Chair's signature to execute two assessment contracts; 1) between Otter Tail County and Elizabeth Township with compensation to the county for assessment services in the amount of $3,917.20, and 2) between Otter Tail County and Everts 0 Township with compensation to the county for assessment services in the amount of $6,575.20. Sunset Bay Resort Mr. and Mrs. Grabarkewitz appeared before the board to request clarification of last week's decision relative to Sunset Bay Resort. Chair Portmann explained that the action of denial for RV sites took place last week, but the County Board would listen to their concerns. Virginia Grabarkewitz submitted a letter requesting consideration and approval of the seven RV sites the Planning Commission had recommended. The Grabarkewitz's felt that a misunderstanding occurred last week and that the board did not consider the Planning Commission recommendation of seven sites. Mrs. Grabarkewitz stated that they are not asking for reconsideration, rather a clarification of the reason for denial during the meeting of September 10, 1996. Commissioner Lindquist noted that Sunset Bay Resort's currentwater front footage allows seven sites and Sunset Bay Resort currently has eight. The area would allow ten sites-they currently have eight. General consensus of the board clarified that there was no misunderstanding and further, the sites recommended by the Planning Commission were denied for the following reasons: 1) environmental impact-overbuilding (this lake is classified as an' environmental lake by the Commissioner of the DNR) and, 2) the sites are in excess of the sites allowed by the Shoreland Management Ordinance. Recess and Reconvene At 11 :07 a.m., Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 11 :11 a.m. Update-Construction Projects Rick West, Highway Engineer, updated the board regarding the progress of current construction projects O throughout Otter Tail County. The update included CSAH NO. 3 grading and Schmidt's Bridge; CSAH NO. 80, City of Perham; CSAH NO. 88, old Highway 59N; CSAH No. 35; County Highway 111; Stalker Lake; Glendalough; Woodland Heights; CSAH No. 6; and CSAH 11 & 20 projects. Approval of Consultant Contract-CSAH 80 Motion by Windels, seconded Lee, and unanimously carried to authorize the Chair's signature to execute the contract for engineering services for improvements of CSAH No. 80, including the rural portion of CSAH No. 80, with Larson-Peterson and Associates, Inc. of Detroit Lakes. Recess At 11 :30 a.m., Chair Partmann recessed the meeting of the Otter Tail County Board of Commissioners for lunch break. Reconvene Approval to Pay Bills At 1:00 p.m., Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners reconvened. Motion by Lindquist, seconded Windels, and unanimously carried to approve the bills per Attachment A of these minutes. Food Service Agreement Motion by Stone, seconded Lee, and carried, with Lindquist opposed, to authorize the Chair's signature on an amendment to extend the food service agreement with Best, Inc. for the Detention Facility at a 3.1 % increase effective July 1, 1996 through June 30, 1997. · Certificate of Correction to Plat Motion by Stone, seconded by Lee, and unanimously carried to accept the following Certificate of Correction to Plat as prepared by Terry Lee Anderson, Registered Land Surveyor under the laws of the State of Minnesota, Registration No. 14676. 0 0 0 Otter Tail County Board of Commissioners September 17, 1996 Page3 Name of Plat -"Blue Heron Beach" Pursuant to Chapter 472, Laws of Minnesota, 1955, and Chapter 505.173 through 505.177, Laws of Minnesota, Terry Lee Anderson, the undersigned, a Registered Land Surveyor in the State of Minnesota declares as follows: (1) The subdivision plat of "Blue Heron Beach" was prepared by H. R. Grove a Registered Land Surveyor of whom is retired from surveying practice. His whereabouts is unknown and he may be deceased. (2) The subdivision plat of "Blue Heron Beach" was filed for record in the office of the County Recorder in and for Otter Tail County, Minnesota on August 9, 1949 and was recorded in Book J of Plats-on page 96 (3) That the subdivision plat of "Blue Heron Beach" contains errors, omissions or defects in the following particulars to wit: The legal description for the outside boundary lines of the plat states that it is following along the northerly shoreline of Otter Tail Lake and also along a line approximately 20 feet northerly of said shoreline. This error inadvertently eliminates a small sliver of land between the surveyors survey line and the actual shoreline. (4) The following legal description is to be permanently attached to the plat of "Blue Heron Beach" describing the aforementioned sliver of land. That part of Section 7, Township 134 North, Range 39 West, Otter Tail County, Minnesota described as follows: Beginning at the Most Southerly Corner of Lot 1 of "Blue Heron Beach" on file and of record in the office of the County Recorder in and for Otter Tail County, Minnesota; thence northeasterly along the southerly lines of Lots 1 through 16 of said "Blue Heron Beach: to the Southeast Corner of said Lot 16; thence southerly along the southerly extension of the easterly line of said Lot 16 to the shoreline -of Otter Tail Lake; thence westerly and southwesterly along said shoreline to the southerly extension of the Westerly Line of said Lot 1; thence northerly along the southerly extension of the Westerly Line of said Lot 1 to the point of beginning. (5) That the sidelines of Lots 1 through 16 are to be extended to intersect the shoreline of Otter Tail Lake. The above certificate of Correction to the plat of "Blue Heron Beach" had been approved by the Board of Coun f Otter Tail County, Minnesota this 17th day of September, 1996 A.D. of County Commissioners, Otter Tail County '-l-1- Liquor License Applications Motion by Lee, seconded by Stone, and unanimously carried to approve the following applications for license: Dave and Louises Dave and Louise Trana Perry's Timothy Hamilton Setup License -April 1 to March 31 On/Off Sale Non-Intoxicating Malt Liquor, and Setup License. (Part Year) Subject to the approval of the County Attorney and to the approval of the County Sheriff. Election Update Otter Tail County Board of Commissioners September 17, 1996 Page4 Wayne Stein, Auditor, updated board members regarding the primary election. Discussion followed. Stony Arch Bridge Tiny Holm, Ditch Inspector, reported that the Restoration Committee for the proposed Stony Arch Bridge project cannot complete this project if the temporary 8' x 32' culvert must be removed by November 1, 1996. The Restoration Committee is requesting a one year extension to November 1, 1997 to remove the culvert. Mr. Holm read a letter from Terry Lejcher of the DNR accepting the Committee's one year extension request as long as adjustments can be made based on the level of Dead Lake. Motion by Windels, seconded Stone, and unanimously carried to extend the agreement for the repair of the Stony Arch Bridge from November 1, 1996, to November 1, 1997 conditioned upon agreement by the restoration workers to make adjustments if required by the DNR; to install the culvert(s) at the elevation determined appropriate by Terry Lejcher, area hydrologist; to provide proof of a million dollar liability insurance policy; and, previous requirements set forth on August 20, 1996. Otter Tail County must be listed as an additional insured on the liability insurance policy. Ditch 21 Tiny Holm, Ditch Inspector, reported that an old culvert on an old township road (Sverdrup Township) in the original ditch 21 system has collapsed. Mr. Holm reported that the least costly way to provide access is to replace the culvert where it has been dug out. Sverdrup Township has spent $125 on removing the culvert. The County Attorney informed the board that the · Ditch Authority may take care of this situation. Commissioner Lindquist recommended that Mr. Holm obtain a culvert (size must meet hydraulic capacity need) and negotiate with the township to complete the installation. 0 Bid Opening -Sale of Property Q At 2:01 p.m., after previously advertising for bids, Wayne Stein, County Auditor, opened the following bid for property (approximately 5 acres) as described below: Ronald/Audra Heinonen $1,800 Motion by Stone, seconded Windels, and unanimously carried to accept the bid of $1,800 from Ronald/Audra Heinonen for the following described property: That part of the Southeast Quarter of the Southeast Quarter (SE1/4 SE1/4) of Section 19, Township 134, Range 37, described as follows: Beginning at a point on the East line of said Southeast Quarter of the Southeast Quarter of said Section 19, located 8 rods north of the Southeast corner thereof; thence west 20 rods; thence North 40 rods; thence East 20 rods; thence South 40 rods along the east line of the Southeast Quarter of the Southeast Quarter to point of beginning. All mineral rights to the property shall be reserved to the County of Otter Tail, Minnesota.
