. The Otter Tail County Board of Commissioners convened Tuesday, September 3, 1996 at 9:34 a.m. at the
Otter Tail County Courthouse with Commissioners Andy Lindquist, Vice-Chair, Malcolm Lee, Bill Stone, and
Harley Windels present. Chair Virginia Portmann was absent.
Approval of Agenda
Motion by Lee, seconded Stone, and unanimously carried to approve the agenda of September 3, 1996 as
presented with the following change: Highway Engineer, Rick West -canceled
Approval of Minutes
Motion by Stone, seconded Lee, and unanimously carried to approve the minutes of August 27, 1996 as
submitted.
Approval of Payment
Motion by Lee, seconded Stone, and unanimously carried to approve payment to Riley Bros. Construction,
in the amount of $8,430, for installation of a box culvert to replace a bridge washed out by release of water
from .. a drainage ditch system. Payment has been received by the county from Leona Zimmerman ($840)
. and MCIT ($2,500).

Election Judge Training -Update
the board regarding election judge training sessions, tests on voting
Household Hazardous Waste Program
County Attorney, Wally Senyk, identified issues of liability with the proposed Household Hazardous Waste
contracts between the State of Minnesota and Otter Tail County. The MPCA has the responsibility to assist
local government in the collection and processing of household hazardous waste. _In the proposed contract,
the MPCA accepts liability at the point in which the state takes custody of the HHW at the local facility.
Prior to that point, liability is with the county. The county's insurance carrier, MCIT, does not cover spills or
contamination. While working with participating counties, especially with mobile unit collections, it is
necessary to clarify liability. Regional HHW Coordinator, Lyle Rosenow, provided statistics of four recent
mobile collections.
Mike Hanan, Solid Waste Director, reported that Otter Tail County currently has an agreement with the co-
sponsoring counties. The Solid Waste Director will be clarifying and updating the contracts. Additionally,
Hanan reported that Stevens County is interested in joining and would like to have contract agreement
available by September 17, 1996. The County Board directed that the HHW Regional Program proceed as
planned and directed the County Attorney to draft a letter of explanation for the participating counties to
sign relative to absorbing the risk involved.
Solid Waste Joint Powers Board
Wally Senyk, County Attorney, updated board members regarding the Joint Powers Board. Meetings have
been held regarding the changing circumstances of the Quadrant Facility. Hubbard County intends to bring
waste to a different facility in Thief River Falls. Otter Tail County responded and considers them to be in
breach of their agreement with Otter Tail County. Quadrant representatives identified that they were

interested in going forward and reviewed their options. The current contract with Quadrant is considered to r""\
expire April, 1997. Otter Tail County and Quadrant are negotiating the possibility of reducing tipping fees .,,.;
and ash disposal fees in order to find additional waste to be brought to the facility. Otter Tail County will
bring waste to Quadrant, however, if additional waste is not available and the facility cannot continue in
business, Quadrant will notify the county so alternative arrangements can be made.
Recess and Reconvene
At 10:37 a.m., Vice-Chair Lindquist declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 10:47.
Snowmobile Trail Agreements
Motion by Lee, seconded Windels, and unanimously carried to authorize the Vice-Chair's signature to
execute the 1997 Minnesota Trail Assistance Program Agreement between Otter Tail County and O.C.T.A.
(with a State cost of $15,600) and Otter Tail County and Lake Runners (with a State cost of $3,600).
Approval of Final Plat -"Rush Bay View"
Motion by Windels, seconded Lee, and unanimously carried to approve the final plat of "Rush Bay View"
(Section 21, Township 135, Range 38, Otto Township).
Minnesota River Basin
Bill Kalar, Land & Resource Administrator, reported receipt of correspondence from Rick Hanna of the
Minnesota River Basin regarding the Minnesota River Basin Clean-Up Day scheduled for September 21,
1996. Kalar indicated that the Pomme De Terre River Watershed and the Chippewa River Watershed are
part of the Minnesota River Basin and a small portion of these watersheds are located within Otter Tail
County. Motion by Lee, seconded Windels, and unanimously carried to direct the Land & Resource Q
Administrator to arrange for an arial survey of the portions of the watersheds within Otter Tail County and, if
necessary, arrange for clean-up.
Recess and Reconvene
Approval to Pay Bills
At 11 :35 a.m., Vice-Chair Lindquist declared the meeting of the Otter Tail County Board of Commissioners
recessed until 11 :55 a.m. Upon reconvening the meeting, motion by Lee, seconded Windels, and
unanimously carried to approve the bills per Attachment A and B of these minutes.
Adjournment
At 11 :57 a.m., the Vice-Chair declared the Otter Tail County Board of Commissioners' meeting adjourned
until 1:00 p.m. Tuesday, Septembe'r 10, 1996.
