Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, August 20, 1996 at 9:38 a.m. at the
Otter Tail County Courthouse with Commissioners Virginia Portmann, Chair; Bill Stone, Harley Windels,
Malcolm Lee and Andy Lindquist present.
Approval of Agenda
Motion by Windels, seconded Lee, and unanimously carried to approve the agenda of August 20, 1996
with the following addition: Solid Waste Committee meeting after Board Meeting -(approx. 11:15 a.m.)
Approval of Minutes
Motion by Stone, seconded Lee, and unanimously carried to approve the minutes of August 13, 1996 as
submitted.
Overweight Vehicle Violations
County Attorney, Wally Senyk, Highway Engineer, Rick West, and Patrol Officer, Al Frank, discussed
repeat overweight vehicle violations. The County Engineer explained the reason for weight restrictions and
the potential damage to roads if weight restrictions are violated. Al Frank, responsible for weight
monitoring, explained that Northern Waste has been cited six times for weight violations, one incident
being overweight for a 10 ton road. Solid Waste Director, Mike Hanan, stated that sanitation trucks have
difficulty meeting weight restrictions in the spring because the trucks themselves are very heavy, however,
there hasn't been known repeat violations by other waste haulers. General consensus of the board is that
revocation of Northern Waste's hauling license may be a consequence of continued violations.
Motion by Stone, seconded Lindquist, and unanimously carried to provide notice under administrative
actions of Otter Tail County and schedule a public hearing to give Northern Waste an opportunity to speak
with the board.
Mr. Hanan requested an opportunity for county officials to meet with a group of waste haulers to assist the
haulers with meeting weight restrictions.
Request for Grant Application
Chet Toso, Veteran Service Officer, requested approval to proceed with a grant application for computer
equipment. Motion by Lindquist, seconded Windels, and unanimously carried to approve the request to
proceed with a Veterans Service grant application for computer equipment as outlined and presented by
Mr. Toso.
Ditch 28, Stony Arch Bridge
Tiny Holm, Ditch Inspector, requested direction from the board regarding Ditch 28, Stony Arch Bridge.
Holm explained that the Restoration Committee proposal is to place two 8x16 foot culverts temporarily so
the south side of the bridge can be torn down in order to redo the bridge for historical purposes. DNR
representative, Terry Lejcher, has no problems with the proposal as long as the temporary culverts are
removed by Nov. 15, 1996. Discussion followed. Chair Partmann entertained a motion.
Motion by Lindquist, seconded Windels, and unanimously carried to allow the project to go forward per the
recommendations of Mr. Lejcher subject to direction by a licensed engineer, proof of liability insurance (by

the engineer in-charge as well as the Restoration Committee), and acceptance of a hold harmless clause to
be drafted by County Attorney, Wally Senyk.
Violence in the Workplace
Extension Educator, Angela Berge, and Chief of Public Safety, John Wagner, updated the board regarding
a "Violence in the Workplace" seminar scheduled for September 16, 1996.
Assessment Contract
Motion by Windels, seconded Lindquist, and unanimously carried to authorize the Chair's signature to
execute an Assessment Agreement with the City of New York Mills in the amount of $3,478.60.
Request for Full-Time Appraiser Position
Bob Moe, Assessor, reviewed the parcels Otter Tail County is currently assessing and requested an
additional full-time appraiser position. Motion by Lee, seconded Lindquist, and unanimously carried to
approve the addition of one full-time appraiser position. Commissioner Lee directed the Assessor to submit
a summary report of the taxing districts that Otter Tail County is currently assessing.
Co-payment for Inmate Medical Costs
Wally Senyk, County Attorney, reported that effective July 1, 1996 the law provides that if a county
correctional facility provides medical assistance to prisoners, prisoners shall incur copayment obligations
for health care services. The County Board shall determine the amount of copayment charged in each
county. Motion by Lindquist, seconded Lee, and unanimously carried to adopt $5 as the copayment
obligation for inmate over-the-counter medication, medical, dental, and mental health care services that are
inmate initiated effective September 1, 1996 as recommended by the Jail Administrator.
Certificate of Correction to Plat
Motion by Windels, seconded by Lee, and unanimously carried to accept the following Certificate of
Correction to plat as prepared by Terry Lee Anderson, Registered Land Surveyor under the laws of the
State of Minnesota, Registration No. 14676.
Name of Plat: First Addition to Lindon Shore Park
Pursuant to Chapter 472, Laws of Minnesota, 1955, and Chapter 505.173 through 505.177, Laws of
Minnesota, Terry Lee Anderson, the undersigned, a Registered Land Surveyor in the State of Minnesota
declares as follows:
(1) The subdivision plat of FIRST ADDITION TO LINDON SHORE PARK was prepared by W.J. Buckley a
Registered Land Surveyor of whom is retired from surveying practice. His whereabouts is unknown and he
may be deceased.
(2) The subdivision plat of FIRST ADDITION TO LINDON SHORE PARK was filed for record in the office
of the County Recorder in and for Otter Tail County, Minnesota on August 12, 1947 and was recorded in
Book N of Plats on page 38.
(3) That the subdivision plat of FIRST ADDITION TO LINDON SHORE PARK contains errors, omissions or
defects in the following particulars to wit:
Line 2 of Legal description on the dedication portion of the plat areas as follows:
of Lot 12 of Gov'! Lot 1, Sec. 20, T. 136 N., R. 42W.
This line is in error.

Also a small sliver of land was inadvertently omitted from the plat along the shoreline of Lake Lida.
(4) Line 2 of the legal description on the dedication portion of the plat should read as follows:
of Lot 12 LINDON SHORE PARK.

(5) The following legal description is to be permanently attached to the plat of FIRST ADDITION TO
LINDON SHORE PARK describing the aforementioned sliver of land.
That part of Government Lot 1 of Section 20, Township 136 North, Range 42 West, Otter Tail County,
Minnesota described as follows:
Beginning at the Most Easterly Corner of Lot 13 of FIRST ADDITION TO LINDON SHORE PARK; thence
southeasterly along the southeasterly extension of the northeasterly line of said Lot 13 to the shoreline of
Lake Lida; thence southwesterly following along said shoreline to its intersection with the southeasterly
extension of the southwesterly line of Lot 21 of said FIRST ADDITION TO LINDON SHORE PARK; thence
northwesterly along the southeasterly extension of said Lot 21 to the most southerly corner of said Lot 21;
thence northeasterly along the southeasterly lines of lots 13 though 21 of said FIRST ADDITION TO
LINDON SHORE PARK to the point of beginning.
(6) That the sidelines of Lots 13 through 21 are to be extended to intersect the shoreline of Lake Lida.
The above rtificate of Correction to the plat of FIRST ADDITION TO LINDON SHORE PARK has been
approved y the Board of County Commissioners of Otter Tail County, Minnesota this 20th day of August,
1996

Appointment of Election Judges
Motion by Lee, seconded by Stone, and unanimously carried to approve the appointment of the following
individuals as election judges for the September 10, 1996 State Primary Election and for the November 5,
1996 State General Election:

Approval of Compensation for Election Judges
Motion by Lindquist, seconded by Windels, and unanimously carried to establish the compensation for
election judges serving at the State Primary and State General Elections at $6.50 per hour plus mileage at
$.30 per mile.
Appointments to the Canvassing Board
Motion by Windels, seconded by Lindquist, and unanimously carried to appoint Commissioners Lee and
Stone to serve on the canvassing board for the State Primary Election. The canvassing board will convene
at 9:00 a.m. on Friday, September 13, 1996.

Rick West, Highway Engineer, updated the board on the construction status of CSAH Nos. 3, 88, 80, 11,
20, 35, and 6.
Approval to Pay Bills
Motion by Lindquist, seconded Windels, and unanimously carried to approve the following bills per
Attachment A of these minutes.

At 11 :26 a.m., Chair Partmann declared the meeting of the Otter Tail County Board of Commissioners
adjourned until Tuesday, August 27, 1996.
