9:30 a.m.
Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, July 16, 1996 at 9:30 a.m. at the
Otter Tail County Courthouse with Commissioners Virginia Portmann, Chair; Bill Stone, Harley Windels,
Malcolm Lee, and Andy Lindquist present.
Approval of Agenda
Motion by Windels, seconded Lee, and unanimously carried to approve the agenda of July 16, 1996 with the
following changes: 1) Purchase Request and GIS Update --canceled, 2) RTC meeting and Phelps Mill
Festival updates, and 3) Street Dance Request Approval.
Approval of Minutes
Motion by Lee, seconded Stone, and unanimously carried to approve the minutes of July 9, 1996 as
submitted.
Phelps Mill Festival
Commissioner Lindquist reported on the Phelps Mill Festival.
RTC Coalition
Chair Portmann discussed the recent Regional Treatment Center meeting.
Approval of Assessment Contracts
Motion by Stone, seconded Windels, and unanimously carried to authorize the Chair's signature to execute
an assessment agreement with Amor Township in the amount of $4,747.20 to be paid to the county for
assessment services.
Motion by Lindquist, seconded Lee, and unanimously carried to authorize the Chair's signature to execute an
assessment agreement with Sverdrup Township in the amount of $3,452.75 for compensation to the county
for assessment services.
County Assessed Parcels
Bob Moe, Assessor, reported that there are 51,552 total parcels in Otter Tail County. Otter Tail County is
contracted to assess 29,399 (57%) of those parcels.
Discussion --Purchase of Vehicles
Assessor, Bob Moe, reported that his budget includes two vehicles and the Assessor's Office will need two
vehicles. Commissioner Lindquist requested that Mr. Moe check with the local dealers for quotations to see
if they can meet the state contract prices. Chair Portmann reported that Tom Fawcett, Social Services, also
needs two vehicles. The Chair directed Mr. Moe to purchase vehicles along with Mr. Fawcett to obtain the
.(;. best possible price.

Performance Evaluation Summary
Motion by Windels, seconded Stone, and carried, with Lindquist abstaining, to amend the evaluation
summary report of Rick Sytsma, Maintenance Supervisor, to exclude the first sentence of the summary as
submitted and to file the report in his personnel file,
West Lost Lake Bridge Obstruction
Gary & Sharon Nelson, owners of West Lost Resort, appeared regarding a collapsed bridge obstruction in
West Lost Lake. Mr. Nelson read a statement to the board. Mr. Nelson stated that this obstruction was to be
removed last fall and the bridge repaired, The Nelsons requested that the obstruction be removed and the
bridge repaired during the month of July, 1996. The Highway Engineer reported that Riley Brothers are
scheduled to begin this project within 30 days. The Commissioners empathized with the Nelsons' situation,
however, the county settled on payment of the repair of the bridge long ago, the culvert is available, and
construction is scheduled. Because the bridge is a private bridge, the county has no jurisdiction over the
situation. The permit holder is responsible to comply with the permit and conditions therein.
Ditch No. 63
Tiny Holm, Ditch Inspector, appeared regarding Ditch No. 63 (Elizabeth Twp, Section 17 & 18). Mr. Holm
presented a request to have the county send notices for an informational meeting to the benefiting property
owners of Ditch No. 63 prior to petitioning for repair, posting bond, or construction. This request is for a Q
straw vote for benefiting property owners before an actual petition to repair is submitted. The commissioners
agreed to a public hearing for this process as long as the individuals requesting the public hearing are willing
to pay the cost of postage for sending the hearing notices, There are approximately 40 property owners on
the ditch system. If an affirmative response for repair is received, the regular procedures for petitioning for
repair would still be required.
Approval for Street Dance
Rick West, Highway Engineer, presented a request from the City of Elizabeth to close one block of County
Highway No, 10 for the annual summer celebration "Hay Days" Street Dance scheduled on July 20, 1996.
Mr. West reported that a copy of the insurance liability certificate has been provided. Motion by Lee,
seconded Lindquist, and unanimously carried to approve the above request.
Approval of Roadside Mowing Contract
Motion by Lee, seconded Windels, and unanimously carried to authorize the Chair's signature to execute the
Roadside Mowing Contract of Area "A" with Steve's Road Maintenance as recommended by the Highway
Engineer,

At 10:40 a.m., Chair Partmann declared the meeting of the Otter Tail County Board of Commissioners

reconvened. Motion by Lee, seconded Stone, and unanimously carried to approve the bills per Attachment A
of these minutes which includes payment oflodging as follows: Sheraton Inn --Patrol Officer, Al Frank.
Stipulation for Entry of Judgment
Motion by Stone, seconded Windels, and unanimously carried to authorize the Chair's signature to execute
the following Stipulations for Entry of Judgment relative to tax appeal matters: I) Charles and Patricia
McGraw vs. State of Minnesota and County of Otter Tail (Court File No. C2-94-851) and Charles McGraw
vs. State of Minnesota and County of Otter Tail (Court File No. CS-95-532, and 2) Michael J. Ebner vs.
State of Minnesota and County of Otter Tail (Court File Nos. C0-94-850 & CS-95-533).
Adjournment
At I :06 p.m., Chair Partmann declared the meeting of the Otter Tail County Board of Commissioners
adjourned until 1:00 p.m. Tuesday, July 23, 1996.
