Call To Order
The Otter Tail County Board of Commissioners convened Tuesday, May 7, 1996, at 9:35 a.m. at the
Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair; Malcolm Lee,
Harley Windels, Bill Stone, and Andy Lindquist present.
Approval of Agenda
Motion by Lindquist, seconded Lee and unanimously carried to approve the agenda of May 7, 1996, with
the following addition: u.s: Fish & Wildlife Approval of Easements request at 9:45 a.m.
Approval of Minutes
Motion by Lindquist, seconded Windels and unanimously carried to approve the minutes of April 23,
1996, as submitted.
U.S. Fish & Wildlife Easements
Don Kleven, U.S. Fish & Wildlife, requested approval of waterfowl easements. Motion by Lee, seconded
Lindquist and unanimously carried to approve certification for acquisition of the following lands by the
U.S Fish & Wildlife for waterfowl easements to restore wetlands and wildlife:

Payment Approval
Motion by Stone, seconded Windels and unanimously carried to approve payment to Best, Inc., in the
amount of $25.85, for coffee and cookies from the Commissioners Contingency Fund.
Otter Tail County HRA Update
Otter Tail County Housing & Redevelopment Executive Director, Jeffrey Gaffaney, introduced other staff
members as well as members of the OTCo. HRA Board. An HRA informational handout was provided.
Mr. Gaffaney explained that there is clear separation of responsibility and authority between the Fergus
Falls HRA and the OTCo. HRA. County Attorney, Wally Senyk, and board member, Oscar Sorlie,
concurred that there is no problem with the current operation of the HRA. Staff members Dennis
Christenson and Penny Sanden reviewed the grant process and Section 8 and low rent public housing.
Discussion regarding the West Central Minnesota Housing Partnership revolved around the proposed
change in the organization's by-laws. Mr. Gaffaney informed the board of a meeting dealing with this
issue scheduled on May 14, 1996. Commissioner Lindquist expressed concern that Otter Tail County
has given over 50% of the total dollars from the nine counties benefiting from the WCMHP. Lengthy

discussion continued regarding options and corresponding risks involved. Chair Portmann appointed
Commissioner Lindquist to form an HRA Board Committee with OTCo. HRA Board Chair, Nelvin 0
Thormodson, member Oscar Sorlie, and others as required to bring a recommendation back to the -....,
county board.
Premise Permit
Otter Tail County Resolution No. 96-25
Upon a motion by Lee, seconded Lindquist and unanimously carried, the Otter Tail County Board of
Commissioners adopts the following resolution: ·
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and
permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and
WHEREAS, the Pelican Rapids Fire Relief Association, Pelican Rapids, MN, has made an application to
the Gambling Control Board for a premise permit to conduct lawful gambling at the Pelican Supper Club
in Pelican Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a
permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving
the permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct
of lawful gambling by the Pelican Rapids Fire Relief Association, Pelican Rapids, MN, at the Pelican
Supper Club in Pelican Township of Otter Tail County.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
approves the conduct of lawful gambling by the Pelican Rapids Fire Relief Association, Pelican Rapids,
MN, at the Pelican Supper Club in Pelican Township of Otter Tail County, provided the applicant meets
all the necessary criteria for the licenses and permits as required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Town
Board of Pelican Lake Township by sending them a copy of this resolution.

Local Performance Aid
Auditor Wayne Stein, provided information regarding certification of local performance measures for
Local Performance Aid payable in 1997. Stein indicated that the certification form for aid must be
received by the Minnesota Department of Revenue by June 30, 1996, in order for Otter Tail County to be
eligible to receive the '97 performance aid.

At 11 :06 a.m., Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break with the meeting to be reconvened in closed session at 11 :20 a.m. for the
purpose of evaluating the performance of Veterans Service Officer, Chet Toso, pursuant to M.S.
471.705 Subd. 1d(d). A summary report of performance conclusions will be provided at the next regular
board meeting. The closed session concluded at noon and the board recessed for lunch break.
Approval to Pay Bills
At 1 :01 p.m., Chair Portmann reconvened the meeting in open session. Motion by Stone, seconded
Windels and unanimously carried to approve the attached bills per Attachment A of these minutes which
includes lodging payments as follows:

Bid Award --1996 Traffic Marking Contract
Motion by Lindquist, seconded Lee and unanimously carried to award the low bid to Traffic Marking
Services, Inc. Buffalo, MN, in the amount of $148,036.23, for the 1996 Otter Tail County/Wilkin
County/City of Fergus Falls Traffic Marking Contract.
Glendalough State Park Agreement
Motion by Lee, seconded Lindquist and unanimously carried to approve the Chair's signature to execute
the Agreement for Engineering Service for Glendalough State Park.
CSAH 35 Project --Viewing Date Changed
Highway Engineer, Rick West, requested a new date to view the property for eminent domain
procedures on the CSAH 35 project. The board established June 18, 1996, at 1 :30 p.m. as the new time
and date for viewing the property.
Sale Approval
Motion by Windels, seconded Stone and unanimously carried to approve the sale of the following items
at the County/City Auction on May 30, 1996, as recommended by the Highway Engineer:

Speed Zone Recommendation
Motion by Stone, seconded Windels and unanimously carried to approve the MnDoT speed
recommendation based on a previous speed zone study on CSAH 67 north of Henning, Middle Leaf
Lake Public Access road, at the present rural statutory 55 mph.
Bid Opening Date --CSAH No. 35 Etc.
Highway Engineer, Rick West, requested a bid opening date for reconstruction of CSAH 35 south of
Dent (1.2 miles); bituminous surfacing, Glendalough State Park (1 1/2 miles); bituminous surfacing,
Tordenskjold Township, Stalker/Long Lake Road; bituminous overlay, County 111 (6 miles); and Fergus
Falls Township, Woodland Heights (yet to be determined).
Motion by Lindquist, seconded Lee and unanimously carried to establish bid opening date for 1 :00 p.m.
June 11, 1996, for the above listed projects.
Correspondence Acknowledged
Chair Portmann read a letter received from Koochiching County regarding the AMC representation
process. Koochiching County requested a letter of support for a regional counties' association. No
action was taken. Chair Portmann acknowledged a letter from Tom Worth, President of the Boundary
Waters Treaty Coalition. The letter urged support for the enforcement of the 1909 Boundary Waters
Treaty. No action was taken.
Planning Commission Recommendations
Motion by Lee, seconded Windels and unanimously carried to approve the following Preliminary Plats

Sewer Inspections
Commissioner Lee requested the Land & Resource Administrator to send a letter to Wayne Johnson
regarding the county's current sanitation code that does not allow for outside contractors to inspect
sewers inside the shoreland zone.

At 2:00 p.m., Chair Portmann reconvened the meeting of the Otter Tail County Board of Commissioners
for the purpose of conducting the Ditch 21 Public Hearing with Commissioners Lindquist, Lee, Windels
and Stone present. Staff members present included:

Land & Resource Administrator, Bill Kalar
County officials reviewed the historical background, repair petition and process of the distribution of
benefits for Ditch 21. Tiny Hom, Ditch Inspector, reported that Ditch 21 is 30% effective and the total
repair cost of the ditch is $43,637. County Attorney Wally Senyk, stated that this is the final hearing on
redetermination of benefits for Ditch 21. The final notice, description of the ditch, owners report and
calculations of cost of all properties have been distributed. At 2:23 p.m., Chair Portmann opened the
Public Hearing to the public in attendance. The following individuals addressed concerns regarding their
assessments and/or Ditch 21.

Chair Partmann closed the Ditch 21 Public Hearing at 3:43 p.m.
Approval to Purchase Software
Motion by Windels, seconded Stone and carried, with Lee and Lindquist abstaining, to approve a
License Agreement and Services Maintenance Agreement with Jalan, Spokane, WA, which provides for
the purchase of "The Prosecutor System" software, at a cost of $10,945, and a one year maintenance
charge of $1,641.75. Additionally, the motion granted permission to advance payment for the software.

At 4:02 p.m., Chair Partmann declared the meeting of the Otter Tail County Board of Commissioners
