Call To Order
The Otter Tail County Board of Commissioners convened Tuesday, April 16, 1996, at 9:31 a.m. at the
Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair; Harley Windels, Bill Stone,
Malcolm Lee and Andy Lindquist present.
Approval of Agenda
Motion by Stone, seconded Windels and unanimously carried to approve the agenda of April 16, 1996, as
presented with the following additions:
1) 10:45 a.m. -Financial Advisor, Veterans Home Bonding
2) Following Board Meeting -Personnel Committee Meeting
Approval of Minutes
Motion by Lee, seconded Stone and unanimously carried to approve the minutes of April 9, 1996, as
submitted.
Approval of Bid Award -S.A.P. 56-611-12 & Etc.
Motion by Lindquist, seconded Windels and carried, with Lee abstaining, to approve the low bid of
Sherbrooke Asphalt, Inc., in the amount of $896,586.32, for (S.A.P. 56-611-12 & Etc.) bituminous overlay of
CSAH Nos. 11 and 20.
Approval of Agreement -CSAH Nos. 11 & 52
Motion by Lee, seconded Lindquist and unanimously carried to authorize the Chair's signature to execute
an agreement between Wilkin and Otter Tail County for bituminous overlay of CSAH Nos. 11 and 52 as
recommended by the Highway Engineer.
Approval of Agreement -CSAH No. 20
Motion by Lee, seconded Lindquist and unanimously carried to authorize the Chair's signature to execute
an agreement between Becker and Otter Tail County for bituminous overlay of CSAH No. 20 as
recommended by the Highway Engineer.
Approval of Bid Opening Date
Motion by Lindquist, seconded Lee and unanimously carried to establish the bid opening date for S.A.P. 56-
688-01TB and S.A.P. 126-104-02TB at 1:00 p.m., May 21, 1996.
Approval of Consultant Agreement

Motion by Lindquist, seconded Lee and unanimously carried to authorize the Chair's signature to execute
the Consultant Agreement for Construction Services with Interstate Engineering for S.A.P. 56-688-01TB
and 126-104-02TB as recommended by the Highway Engineer.
Bid Award -S.A.P. 56-680-02
Motion by Windels, seconded Stone and unanimously carried to approve the CSAH No. 80 project (S.A.P.
56-680-02) and award the project to the low bidder, R.L. Larson Excavating Inc., St. Cloud, MN, in the
amount of $2,006,662.14.
Approval of Agreement -Otter Tail Power Relocation
Motion by Lee, seconded Windels and unanimously carried to authorize the Chair's signature on an
agreement with Otter Tail Power Company for relocation of power lines for the CSAH No. 3 Schmitz Bridge
project north of Fergus Falls, in the amount of $6,969.28, as recommended by the Highway Engineer.

Otter Tail County State Aid Highway 35 Right-of -Way Acquisition
Negotiation No. 11 and 11-A -S.A.P. No. 56-635-21
Otter Tail County Resolution No. 96-24
Upon a motion by Stone, seconded Windels, and unanimously carried, the Otter Tail County Board of
Commissioners adopts the following resolution:
WHEREAS, Otter Tail County proposes to reconstruct and improve County Highway 35 between County
Highway 44 to the south and the City of Dent to the north consisting of a 1.3 mile section of highway; and

WHEREAS, the reason for the reconstruction of this segment of County Highway 35 is to improve the
condition of the existing highway and widen the existing highway; and
WHEREAS, this improvement is necessary to provide for the safety of the traveling public; and
WHEREAS, Otter Tail County has a right to acquire the right-of-way after an award of damages has
been filed with the County Auditor in accordance with Minnesota Statute, Section 163.12; and
WHEREAS, all necessary additional highway right-of-way has been acquired for reconstruction
except for the following described tract, owned by Harold R. and Dorothy K. Diamond, Skokie, Illinois:
The Westerly Sixty (60.0) feet of the following described tract:
The South Sixteen (16) rods of the North Sixty-four (64) rods of the West Twenty (20)
rods of the Northwest Quarter of the Southwest Quarter (NW 1/4 of the SW 1/4) of
Section Thirty-four (34), Township One Hundred Thirty-six (136) North, Range Forty
(40) West.
Excepting therefrom right-of-way of existing highways.
Containing 0.06 acre, more or less.
Also that all telephone and power lines can be placed on the right-of-way line.
Also a temporary construction easement lying within the following described tract:
The South Sixteen (16) rods of the North Sixty-four (64) rods of the West Twenty (20)
rods of the Northwest Quarter of the Southwest Quarter (NW 1/4 of the SW 1/4) of
Section Thirty-four (34), Township One Hundred Thirty-six (136) North, Range Forty
(40) West.
Strips of land lying adjacent to the existing CSAH No. 35 right-of-way located between the
existing right-of-way and a line lying parallel to and Easterly of the centerline of S.A.P. 56-
635-21 at the following locations and distances:
(Distances measured at right angles to said centerline).
A strip 115.0 feet wide, beginning at Sta. 590+78.51 and ending at Sta. 592+00.00.
A strip 80.0 feet wide, beginning at Sta. 592.00.00 and ending at Sta. 593+42.51.
Excepting therefrom right-of-way of existing highways.
Containing 0.22 acre, more or less.
Said Temporary construction easement shall expire on December 31, 1998.
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby
authorizes the acquisition of the requested right-of-way as described above pursuant to Minnesota
Statute, Section 163.12, and to take title and possession of that land after an award of damages has
been filed with the County Auditor in accordance with Minnesota Statute, Section 163.12.

Extension Program Update

Angela Berge, Extension Program Educator, reported the completion of a six week women's financial Q
class as well as involvement with Positive Parenting, Hospice speaking engagement, and the
Homemakers Spring Fling.
GIS and Enhanced 9-1-1 Coordinator
Bob Block, GIS and Enhanced 9-1-1 Coordinator, presented a draft letter introducing himself to the
residents of Otter Tail County. Mr. Block reviewed the county's long range plans regarding
addressing and enhanced 9-1-1 and the need to proceed with appropriate committees to obtain
representation from all areas of the county.
Veterans Home Bonding
Motion by Lindquist, seconded Lee and unanimously carried to authorize the County Coordinator and
County Attorney to negotiate a fee with Springsted, Inc. for Financial Adviser relative to the Veterans
Home Bonds.
Assistant Detention Facility Administrator Salary Range
Motion by Lee, seconded Windels and unanimously carried to approve a salary range of $2,757 per
month to a maximum of $2,896 per month for the Assistant Detention Facility Administrator position.
Recess and Reconvene
Approval to Pay Bills
At 10:50 a.m., Chair Partmann declared the meeting of the Otter Tail County Board of
Commissioners recessed. At 1 :00 p.m., the Chair reconvened the meeting. Motion by Stone,
seconded Windels and unanimously carried to approve the attached bills per Attachment A of these
minutes.
Payment Approval
Motion by Lee, seconded Lindquist and unanimously carried to approve payment to David M. Griffith
& Associates, St. Paul, MN, in the amount of $1,708.05, (Project # G1-156-94) for professional
services.
Consumption and Display Permits
Motion by Lindquist, seconded Lee and unanimously carried to approve the following applications:

Bid Award -Hoist Hooks \
Mike Hanan, Solid Waste Director, presented a comparison bid sheet for Hoist Hooks for the
Recycling Center. Motion by Lindquist, seconded Stone and unanimously carried to authorize the
purchase of two (2) Hoist Hooks from Sanitation Products, Inc., in the amount of $25,910, which is
the lowest bid meeting minimum bid specifications.

At 1 :43 p.m., Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners
recessed for a fifteen minute break. The Chair reconvened the meeting at 2:00 p.m.
Brendefur/Kramer Conditional Use Application
Land & Resource Administrator Bill Kalar, reviewed the sequence of events relative to the Conditional
Use Permit request of Lisa/Rance Brendefur and Douglas Kramer. Mr. Kalar read the application
request. The Planning Commission recommended approval of the application with the condition that
Lots G-K have deed restrictions, prohibiting the removal of any near shore aquatic vegetation, filed
with the County Recorder so as to notify prospective purchasers of the restriction. County Attorney
Wally Senyk, reviewed the decision that an EAW was not required and the delay provided to allow the
developers and the East Battle Lake Watershed Association to negotiate an agreement. Applicant
Doug Kramer, stated, that at the meeting of the developers and Watershed Association, he agreed to
restrictive covenants on the deeds, however, they did not talk about the conservation easement now
requested by the Watershed Association. Arlen Shalekamp of the DNR reviewed the enforcement
procedures of the DNR relative to restrictive covenants. EBL Watershed Association Secretary
Virginia Zachmann, stated that the association's concern is enforcement of the restrictions. Attorney
Dennis Hagstrom, representing the developers, spoke in favor of the permit and stated that, in his
opinion, a conservation easement is a conveyance of valuable interest of real property. Discussion
continued.
Motion by Windels, seconded Lindquist and carried, with Stone opposed, to approve the issuance of
a Conditional Use Permit to Lisa S./Rance W Brendefur/Ooug/as H. Kramer conditioned upon the
placement of the following restrictive covenants upon land to be recorded with the County Recorder
and placed upon the deeds for conveyance of said property:

That part of Lots F-K of Bayshore Acres Metes & Bounds bounded by the Ordinary High Water
Level line, as defined in Section II. 44. of the Shoreland Management Ordinance of Otter Tail
County, of East Battle Lake, Otter Tail County, Minnesota, and a line parallel thereto fifty (50)
feet inland, and the boundaries of said lots shall be restricted as follows .....
A. This area shall be preserved in its natural condition, no trees, shrubs, or other vegetation
shall be removed from the conservation area except for dead trees or branches.
B. No building, road, sign, billboard, utility or other human-made structure shall be placed in
this area.
C. No trash, waste or other offensive material, soil or landfill shall be placed upon or within
said area.
D. No change in the general topography of said area landscape, including but not limited to
excavation, dredging, movement or removal of soil, shall be made.
E. No aquatic vegetation shall be removed from the area of East Battle Lake adjacent to
the described area.
