Call To Order
The Otter Tail County Board of Commissioners convened Tuesday, April 2, 1996, at 9:30 a.m. at the
Otter Tail County Courthouse with Commissioners Virginia Portmann, Chair; Harley Windels, Bill Stone
and Andy Lindquist present.
Approval of Agenda
Motion by Lindquist, seconded Windels and unanimously carried to approve the agenda of April 2,
1996, as presented with the following additions:
1) Resolution Declaring Reimbursement Intent and Agreement with Veterans Home Board
2) County Attorney's Report --Veterans Home Board
3) Discussion -Minnesota River Basin JointPowers Letter
Approval of Minutes
Motion by Lindquist, seconded Stone and unanimously carried to approve the minutes of March 26,
1996, as submitted.
Commissioner Malcolm Lee present at 9:33 a.m.
WOT Soil and Water Conservation District Annual Report & Plan Update
Richard Viger, WOTSWCD Board Chairman, presented the 1995 Annual Report and reviewed activities
including school presentations, water sampling, and tree planting projects. Mr. Viger introduced Board
members Julian Sjostrom, Rod Wenstrom, and Cliff Keller, as well as district staff, Brad Mergens, Paul
Weyrens and Kathy Truax. Mr. Weyrens briefly reviewed the 1996 Plan Update noting that the main
change from last year is reevaluation and prioritizing projects.
Grant Discussion
Public Information and Education Officer Marie Tysdal, reviewed upcoming grants and eligible projects
with application deadline October 15, 1996. Ms. Tysdal expressed several areas of need for waste
education. One area would be to develop a handbook with a list of items an individual would like to
"dispose of' and information on what to do with these items. This project could be a regional effort, to
include disposal information from the joint powers counties. A sample Recyclopedia from the City of
Plymouth was distributed. The second area of education is to inform about on-site disposal and
backyard burning. Motion by Lindquist, seconded Lee and unanimously carried to endorse the Public
Information and Education Officer's suggestions for preliminary plans for grant application(s) to develop
a handbook and other forms of information to educate the public on what to do with items they want to
throw away and backyard burning regulations.
Veterans Home Activities
Mayor Kelly Ferber, invited board members to a noon luncheon and presentation of $5.2 million in
federal funding for the Veterans Home Wednesday, April 3, 1996. Mr. Ferber extended an additional
invitation for the groundbreaking ceremony at the proposed Veterans Home site April 18, 1996.
County Attorney Wally Senyk, reviewed events relative to the financing and bonding requirements of
the county's commitment for the Home.

Resolution Declaring Reimbursement Intent
Relating to Veterans Home and
Authorizing Execution of Memorandum of Agreement
Otter Tail County Resolution No. 96-22
Upon motion by Lee, seconded by Lindquist and unanimously carried, the Otter Tail County Board of
Commissioners adopts the following resolution:
BE IT RESOLVED:
1. The County has heretofore deposited $750,000 with the State of Minnesota as part of its
$1,500,000 commitment to provide part of the funds for the construction of a veterans nursing home in
Fergus Falls (the "Project''). A deposit of the amount necessary to bring the total on deposit with the
state to $1,500,000 is to be made by April 15, 1996. The State shall provide County with a Gift
Acceptance document acknowledging receipt of the funds and the conditions of their deposit. The
County expects that all of its share of the costs of the Project will be financed in the future through the
issuance of bonds in the principal amount of up to $1,500,000 (the "Bonds").
2. The County reasonably expects that all expenditures for its share of the costs of the Project
made prior to the issuance of the Bonds (including those maK'e prior to the date hereof) will be
reimbursed from the proceeds of the Bonds. The funds to be reimbursed are the funds from which any
original expenditures for such purposes are paid, including the general Fund. This resolution is
intended to be a declaration of official intent pursuant to Treas. Reg. Section 1.150-2 under Section
103 and 141 to 150 of the Internal Revenue Code of 1986.
3. There has been presented to this Board a Veterans Home Memorandum of Agreement (the
"Memorandum of Agreement") setting forth approvecj and shall be executed by the Chair of the County
Board and the Clerk of the Board in substantially the 'form on file.

TIF Districts and 1996 Tax Calculations
Auditor Wayne Stein, presented a Tax Increment Financing report. Additionally, Mr. Stein provided a
sample copy of 1996 tax statements and stated that the statements are intended to be mailed out next
week.
Minnesota River Basin Joint Powers Correspondence
Chair Virginia Portmann, read a letter received by Stephen C. Hansen, Executive Director of the
Minnesota River Basin Joint Powers Board. The letter requests Otter Tail County to join the Minnesota
River Basin Joint Powers Board. General consensus of board members remains the same as previous
consideration. Chair Portmann will draft a response to Mr. Hansen explaining that Otter Tail County is
not interested in joining the joint powers because Otter Tail County has a water testing plan and
excellent water quality.
Transportation Mileage Reimbursement
Motion by Stone, seconded Lindquist and unanimously carried to align the county mileage rate
reimbursement with the State of Minnesota Medical Assistance mileage reimbursement rates for
volunteer transportation, employees and MA. Effective April 1, 1996, the county mileage
reimbursement rate is $.29 per mile, the same as the Medical Assistance rate. In the future, the county
rate will change when the State of Minnesota MA rate-changes.
Recess and Reconvene
At 11:25 a.m., Chair Portmann recessed the meeting of the Otter Tail County Board of Commissioners
for lunch break. The meeting was reconvened at 1:00 p.m.
Approval to Pay Bills
Motion by Windels, seconded Lindquist and unanimously carried to approve the attached bills per
Attachment A of these minutes.
Bid Opening -S.A.P. 56-611-12 & Etc.
At 1:02 p.m., after previously advertising for bids, Highway Engineer Rick West, opened the following

Contract Approval --Mark Sand & Gravel
Motion by Stone, seconded Lee and unanimously carried to authorize the Chair's signature to execute
the contract for Seasonal Supply of Hot Mix Bituminous Mixture between Otter Tail County and Mark
Sand & Gravel Co.
Contract Approval -Sherbrooke Asphalt
Motion by Windels, seconded Stone and carried, with Lee abstaining, to authorize the Chair's signature
to execute the contract for Seasonal Supply of Hot Mix Bituminous Mixture between Otter Tail County
and Sherbrooke Asphalt.
Bid Opening Date Set -Bituminous Overlay, CSAH No. 6
Motion by Stone, seconded Lee and unanimously carried to establish the bid opening date for
Bituminous Overlay, CSAH No. 6, on May 7, 1996, at 1 :00 p.m.
Transfer of Loader/Tractor
Motion by Lindquist, seconded Lee and unanimously carried to approve the transfer of Unit No. 92, ('65
International Harvester, Model 2404 Loader/Tractor) from the Highway Department to the Solid Waste
Department.
Approval of Solid Waste Hauler Permit
Motion by Lindquist, seconded Lee and unanimously carried to approve the 1996 Solid Waste Hauler
permit application of Jeff Severance for Severance Enterprises, Herman, MN.
Performance Evaluation Summaries
Motion by Lee, seconded Lindquist and unanimously carried to approve a satisfactory performance
evaluation report for Solid Waste Director Mike Hanan, and Assessor Bob Moe, and to direct the report
to be filed in their personnel files.

At 1:38 p.m., Chair Portmann recessed the County Board meeting for a short break and reconvened
the meeting at 1:41 p.m.
Wetland Conservation Issues
Citizen Gary Johnson, reported that he had testified before a state wetland committee on March 6,
1996 and read his letter regarding his views of supporting wetlands. Chair Portmann thanked
Mr. Johnson for sharing his conservation issues with the Board.
Recess & Reconvene
At 2:00 p.m., Chair Portmann recessed the meeting of the Otter Tail County Board of Commissioners.
The meeting was reconvened at 2:05 p.m.
Approval of Easement
Motion by Windels, seconded Lindquist and unanimously carried to approve and grant a transmission
line easement to Cooperative Power Association.
Adjournment
At 2:06 p.m., Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners
adjourned until 1:00 p.m. Tuesday, April 9, 1996.
