HomeMy WebLinkAboutBoard of Commissioners - Minutes - 02/20/1996Q 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, February 20, 1996 9:30 a.m. Call To Order The Otter Tail County Board of Commissioners convened Tuesday, February 20, 1996, at 9:31 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair; Harley Windels, Malcolm Lee, Andy Lindquist, and Bill Stone present. Approval of Agenda Motion by Lindquist, seconded Windels and unanimously carried to approve the agenda of February 20, 1996, as presented. Approval of Minutes Motion by Stone, seconded Lee and unanimously carried to approve the minutes of February 13, 1996, with the following corrections: 1) (Page 7) Bid opening date for Roadside Mowing was set for March 25, 1996; should have read March 26, 1996. 2) (Page 4) "Blyberg's Point First Addition" -motion to approve is subject to the condition that the road must meet all county design and structure setback specifications. 3) (Page 5) Conditional Use Application Ben Stich/John Rose -motion is to include removing the applicant's responsibility for dust control as well as Mark Sand & Gravel Co. on the township road. The town board is road authority. Premise Permit Otter Tail County Resolution No. 96-09 Upon a motion by Lindquist, seconded Lee and unanimously carried, the following resolution was adopted: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Fergus Falls Hockey Association, Fergus Falls, MN, has made an application to the Gambling Control Board for a premise permit to conduct lawful gambling at the Riverfront Lounge in Sverdrup Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Fergus Falls Hockey Association, Fergus Falls, MN, at the Riverfront Lounge in Sverdrup Township of Otter Tail County. Transfer of Prior Tax Rolls Joyce Albjerg, Auditor's Office, reported that the State Archives Office did not want Otter Tail County's old tax roll records, however, the Otter Tail County Historical Museum will take the old tax records. Discussion followed regarding length of time required to clean and move the records as well as whether the STS crew u 0 Otter Tail County Board of Commissioners February 20, 1996 Page4 or a Scout Troop would be used to accomplish the task. Chair Portmann directed Ms. Albjerg to research the length of time and most efficient way to move prior tax rolls. Sanitation Code Bill Kalar, Land & Resource Director, addressed the board regarding state sanitation rules. Kalar reported that the county has until January 1, 1998, to adopt the new state rules. Wally Senyk, County Attorney, noted that the county may not need to amend the sanitation rules within the shoreland area until January 1, 1998, however, the provisions that apply outside of the shoreland areas had not been reviewed. Commissioner Lee requested funds from the State of Minnesota for enforcement of the sanitation ordinance. Discussion continued regarding the State's responsibility of licensing and enforcement. Bid Awards -Yearly Material Purchases Highway Signing Materials: Motion by Lee, seconded Lindquist and unanimously carried to award Highway Signing Materials to the low bidder, M-R Sign Co. Inc., in the amount of $56,275.13, as recommended by the Highway Engineer. Seasonal Supply of Herbicides: Motion by Windels, seconded Stone and unanimously carried to award Seasonal Supply of Herbicides to the low bidder, Terra Vegetation Management (Andree), in the amount of $18.64/30 gal. barrel as recommended by the Highway Engineer. Seasonal Culvert Supplies: Motion by Stone, seconded Windels and unanimously carried to award Seasonal Culvert Supplies to the low bidder, Fargo Culvert Co., in the amount of $19,735, as recommended by the Highway Engineer. Seasonal Supply of Bituminous Material: Motion by Lee, seconded Lindquist and unanimously carried to award Seasonal Supply of Bituminous Material to the low bidder, Murphy Oil USA, in the amount of $.6470/gallon, (FOB -Otter Tail County) as recommended by the Highway Engineer. Seasonal Supply of Hot Mix Bituminous -North OT: Motion by Windels, seconded Lindquist and unanimously carried to award Seasonal Supply of Hot Mix Bituminous -North OT to Sherbrooke Asphalt Inc, in the amount of $36,940, as recommended by the Highway Engineer. Seasonal Supply of Hot Mix Bituminous -West OT: Motion by Lindquist, seconded by Lee and unanimously carried to award Seasonal Supply of Hot Mix Bituminous -West OT to Mark Sand & Gravel Co., in the amount of $33,600, as recommended by the Highway Engineer. () Q 0 Otter Tail County Board of Commissioners February 20, 1996 Page5 1996 -2001 Highway Improvement Program Otter Tail County Resolution No. 96-12 UPON a motion by Lee, seconded Lindquist and unanimously carried, the following resolution was adopted: WHEREAS, Otter Tail County, did hold a public meeting on January 31, 1996, to consider a long range bridge and highway construction plan, and WHEREAS, the adoption of a future bridge and highway construction plan has been determined beneficial. NOW, THEREFORE, IT IS RESOLVED, that the "1996-2001 Otter Tail County Highway Improvement Program" dated February 12, 1996, as prepared by the County Engineer, is the long range Bridge and Highway Construction Plan for Otter Tail County. BE IT FURTHER RESOLVED, that the proposed construction date on any project can be changed to accommodate the available funding, construction requirements, and project advancement schedules. Motion by Lindquist, seconded Lee and unanimously carried to approve the roof replacement of the Law Enforcement and Highway annexes of the courthouse, in the amount of $40,000, as recommended by the Maintenance Supervisor. Southwest Regional Development Commission Motion by Lindquist, seconded Windels and unanimously carried to show support to the Southwest Regional Development Committee and southwest counties to allow gradual taxing authority to tax the windmill areas. Recess & Reconvene Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break at 10:35 a.m. The meeting was reconvened at 10:52 a.m. Senate File 2630 Otter Tail County Resolution No. 96-13 UPON motion by Stone, seconded Lindquist and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the Otter Tail County Board of Commissioners finds that the following facts support this resolution: 1. Senate File 2630, a bill authored by Senator Ted Mondale, has been introduced into the Minnesota State Senate and provides for a reduced rate of assessment for unimproved property on public waters in the State of Minnesota. 2. The definition of the proposed new class of unimproved real estate includes real estate bordering public waters that has been in possession of the owner, or the owner's spouse, parent or sibling, or combination thereof, for a period of at least seven years prior to classification under this new provision. 3. The task of obtaining an verifying information necessary to determine eligibility for this classification as defined would be unworkable and cost prohibitive. 4. This proposed legislation would impact an estimated 7,000 parcels in Otter Tail County, with an estimated total market value of over $175,000,000.00, and would reduce the tax rate on these properties to one-fourth or one-half the current tax rate. This legislation represents a move in the wrong direction by further complicating an overly complex real property tax system in the State of Minnesota at a time when reform and simplification are needed and demanded by taxpayers. NOW, THEREFORE, BE IT RESOLVED: 1. That the Otter Tail County Board of Commissioners is strongly opposed to the passage and enactment of the Senate File 2630 provision for a reduced tax rate for certain unimproved real estate bordering public waters. 2. That the Otter Tail County Board of Commissioners hereby encourages all legislators elected to represent residents of Otter Tail County to work diligently to defeat this provision of Senate File 2630. 3. That a copy of this resolution shall be sent to all state legislators representing residents of Otter Tail County and to Senator Ted Mondale. Adopted this 2oth day of February, 1996. '2 D OF COMMISSIONERS By _" ~a Larry Kroii: Clerk Portmann, Chairperson Veterans' Home Bond Presentations Wally Dornfeld representing Springsted Public Finance and Myron Knudson representing Evenson Dodge presented bond presentations. The representatives gave a brief history of their firm and recommended a competitive sale of the Veterans' Home bonds. Springsted's bond work fee was quoted at $8,050. Myron Knudson of Evenson Dodge reported Evenson's fee at $8,400. Chair Portmann indicated that the county will contact them for further discussion regarding the bond sale. Closed to the Public At 11 :41 a.m., Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners closed to the public for the purpose of evaluating the performance of Bill Kalar, Land & Resource Administrator, pursuant to M.S. 471. 705 Subd. 1 d (d). A summary report of performance conclusions will be provided at the next regular board meeting. The Chair declared the closed session adjourned at 12:05 p.m. for lunch break. Approval to Pay Bills At 1 :02 p.m. Chair Portmann declared the Otter Tail County Board of Commissioners meeting reconvened in open session. Motion by Stone, seconded Windels and unanimously carried to approve the attached bills with the following lodging payments: Sheraton Inn Midway -Investigator, Dick Tamke Veterans' Home Bond Presentation According to Treasurer Steve Andrews, Dom & Co. chose not to participate in a bond presentation. Rusty Fifeld of Ehlers and Associates briefed the board relative to the sale of the Veterans' Home bonds. Mr. Fifeld quoted Ehlers and Associate's fee at $8.925. The commissioners directed Coordinator Larry Krohn to check references of the three participating bond firms. Q 0 DNR Facility Otter Tail County Board of Commissioners February 20, 1996 Pages Terry Lejcher of the Fergus Falls DNR Office requested the commissioners' support for a proposed new DNR facility. Motion by Lindquist, seconded Windels and carried, with Lee opposed, to direct the County Attorney to draft a resolution of support for the new facility. House File 2070 County Attorney Wally Senyk reviewed the Highway Engineer's interpretations of H.F. 2070 (transportation funding bill). Motion by Stone, seconded Partmann to give limited support to proposed House File 2070. The motion failed with Stone & Partmann voting Aye and Windels, Lindquist, and Lee voting Nay. Citizen Concern Citizen, Gary Johnson, appeared to address the following concerns: Concern regarding the scratchy P.A. system in the commissioners' room, interim time on the Board Agenda to hear any public concerns and concern that extra agendas are not currently available for the "walk-in" public. The Chair stated that the agenda is posted on the board outside of the room, however, agendas will be made available in the future.
