CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, February 6 1 1996, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Partmann,
Chair; Harley Windels, Malcolm Lee, and Andy Lindquist present. Commissioner Bill Stone
was absent.
APPROVAL OF AGENDA
Motion by Lee, seconded Windels and unanimously carried to approve the agenda of
February 6, 19961 with changes as outlined by Board Chair.
APPROVAL OF MINUTES
Motion by Windels, seconded Lindquist and unanimously carried to approve the minutes of
January 23 1 19961 as submitted.
BID AWARD: RECYCLING TRUCKS
Motion by Lindquist, seconded Lee and unanimously carried to award the bid for two
single axle class 8 diesel trucks to the lowest responsible bidder, W.W. Wallwork, Inc.,
Fargo, ND, in the amount of $91,156.
1996 SOLID WASTE FEE SCHEDULE
Motion by Lee1 seconded Windels and unanimously carried to adopt the following Solid
Waste Fee Schedule and a $7.50 per point service fee, effective April 1, 1996. This
represents the same fees as the prior year and complies with the State's mandate of
solid waste fee assessments.

UNPROTECTED LOADS:
Board of Commissioners
DOUBLE ALL RATES
DELINQUENT SOLID WASTE ACCOUNTS
Motion by Lindquist, seconded Lee and unanimously carried to attach the balances of
delinquent solid waste accounts of Jeffrey Dewar, Steven Milette and Michael Patron,
including interest, to their real estate property taxes.
Motion by Lindquist, seconded Windels and unanimously carried to accept the agreement of
Melvin McGowan to pay delinquent solid waste account by July 1, 1996. If not paid, the
Solid Waste Director is authorized to proceed through the County Attorney's office.
Motion by Windels, seconded Lindquist and unanimously carried to accept monthly payments
from Duane Zuehlke in amount of $100 or more, until the debt is retired.
The Solid Waste Director will explore options with the County Attorney to collect on the
delinquent accounts of Daniel Hanson Excavating and Rick Odenbrett.
NSF CHECK POLICY
Motion by Windels, seconded Lindquist and unanimously carried to adopt the NSF Check
Policy presented by Steve Andrews, Treasurer. The intent of the policy is to ensure
timely collection of required funds while eliminating opportunity for incorrect
information to be given to the public. The policy reads:
Checks are automatically sent through the bank twice, giving the check writer notice
from the bank that it was returned once, and a final notice that it was refused a second o time.

Upon receipt of the check, the treasurer will cancel payment, notify the check writer by
mail that the check was returned, and will reverse the payment, penalty and interest
that would have accrued. An additional charge of $20 will apply for the NSF check.
FINAL PLATS
Motion by Lee, seconded Lindquist and unanimously carried to approve the final plat of
Berger Shores -Berger & Big McDonald Lake, as recommended by the Planning Commission.
Motion by Lee, seconded Windels and unanimously carried to approve the final plat of
Wildwing Acres -Mud & Big McDonald Lake, as recommended by the Planning Commission.
Motion by Windels, seconded Lee and unanimously carried to approve the final plat
of Ridgewood Country Estates -Sybil Lake, as recommended by the Planning Commission.
PLANNING COMMISSION APPOINTMENT
Motion by Partmann, seconded Lee and unanimously carried to appoint Linda Bergerud,
Fergus Falls, to the Planning Commission replacing the vacancy of Diane Prischmann. The
term for this appointment will expire December 31, 1998.
LEGISLATIVE ISSUES
Motion by Lindquist 1 seconded Lee and unanimously carried to send letters of opposition
to local legislative representatives and AMC opposing H.F. 1998-Hottinger/H.F. 2512
Rest. -Annexation and Joint Planning Legislation, as summarized by Commissioner
Lindquist who expressed concern in that the annexation and joint planning legislation
fails to adequately represent the townships affected.

Motion by Lee, seconded Lindquist and unanimously carried to also notify local
legislative representatives of the county's opposition to H.F. 2005 Tax Penalty citing
that the effort is put forth by the county for only a 25% return, while schools would,
if passed1 receive 50% and cities 25% for no effort.
EXEMPTION FROM LAWFUL GAMBLING LICENSE
No opposition was indicated by the Board relative to an Application for Authorization
for an Exemption from Lawful Gambling License for an event scheduled for March 21, 1996,
by the Otter Tail Lakes National Wild Turkey Federation at the Blue Horizon Ballroom.
FORGIVENESS OF PENALTY & INTEREST
Motion by Lindquist, seconded Lee and unanimously carried to deny the request of Robert
and Sheryl Bay for forgiveness of penalty and interest in the amount of $22.96. The
denial was based on lack of evidence of support for the claim.
AUDITOR'S REPORTS
Wayne Stein, Auditor, reported information to the Board regarding the Motor Vehicle
Department's productivity for the year 1995.
The Auditor also provided Board members with an overview of the annual conference held
for auditors and treasurers held by the Minnesota Association of County Officers in
Minneapolis on January 30 through February 1 1 1996.
HIGHWAY IMPROVEMENT PROGRAM
Rick West, Highway Engineer, outlined an earlier public information meeting on the
Otter Tail County Highway Improvement Program held in the City of Ottertail on
January 30, 1996.
The Engineer provided Board members with an overview of the proposed projects indicated
in the highway improvement plan for the years 1996-2001. West indicated he will return
to the Board for formal approval of the plan at the February 20 meeting.
SPEED ZONE STUDY
Otter Tail County Resolution No. 96-05
Motion by Windels, seconded Lee and unanimously carried to adopt the following
resolution:
WHEREAS, the City of New York Mills has requested that the County of Otter Tail take
such action as may be necessary in order to pursue a reduced speed limit on the segment
of County State Aid Highway No. 67 from Trunk Highway No. 10 North approximately
1,700 feet, and
WHEREAS, the County of Otter Tail also believes that a speed zone would be beneficial in
this area.
NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that the area
be studied by the Minnesota Department of Transportation to determine the need for a
reduced speed zone, if any.
BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with
establishing a legal speed zone if the findings of the traffic study are supportive.

RECONSTRUCTION OF BRIDGE NO. 56526
MINNESOTA STATE TRANSPORTATION FUND GRANT
Project No. S.P. 56-603-04
Otter Tail County Resolution No. 96-06
Motion by Lindquist, seconded Windels and unanimously carried to adopt the following
resolution:
WHEREAS, the County of Otter Tail has applied to the Commissioner of Transportation for
a grant from the Minnesota State Transportation Fund for the reconstruction of County
Bridge No. 56526 (new bridge no.) over the Otter Tail River, and
WHEREAS, the amount of the grant has been determined to be $100,000.00 by reason of the
lowest responsible bid.
NOW, THEREFORE, BE IT RESOLVED, that the County of Otter Tail does hereby affirm that
any cost of the bridge in excess of the gant will be appropriated from the funds
available to the County of Otter Tail, and that any grant monies appropriated for the
bridge but not required, based on the final estimate, shall be returned to the Minnesota
State Transportation Fund.
BE IT FURTHER RESOLVED, that whereas Federal monies are being used to participate in the
cost of the bridge, grant monies as matching funds shall be transferred directly to the
agency account and that the records of the County of Otter Tail shall so state.

I do hereby certify that the foregoing resolution is a true and correct copy of a
resolution presented to and adopted by the County of Otter Tail at a duly authorized
meeting thereof held on the 6th day of February, l996.

FINAL PAYMENTS
Motion by Lindquist, seconded Lee and unanimously carried to approve final payment for
'95 Traffic Marking as awarded to Traffic Marking Service, Inc., for Final Estimate
No. 2 in the amount of $4,107.51 as previously awarded.
Motion by Windels, seconded Lindquist and unanimously carried to approve final payment
for S.A.P. 56-675-22, Estimate No. 9 in the amount of $42,911.40 payable to Starry
Construction Co., Inc. as previously awarded.
DRUG & ALCOHOL POLICY
Motion by Lee, seconded Windels and unanimously carried to accept the recommendation of
the Teamsters union representative for inclusion of the word 11 controlled substances 11 in
the table on page nine and agree for said inclusion in the Otter Tail County Drug &
Alcohol Policy as presented by Tim Hunt, Safety & Emergency Services Director.
APPROVAL TO PAY BILLS
Motion by Windels, seconded Lee and unanimously carried to approve the payment of bills
per Attachment A of these minutes.
OTTER TAIL COUNTY
WEATHER CLOSING POLICY
Larry Krohn, Coordinator, discussed a proposed weather closing policy with Board
members. There was discussion about the use of sick leave for inclement weather and the
matter was affirmed that sick leave is not to be substituted for lost time due to o weather conditions unless the employee is actually ill.

FERGUS FALLS AREA TELECOMMUNICATION STRATEGIC PLANNING COMMISSION
Motion by Lindquist, seconded Lee and unanimously carried to appoint Larry Krohn, County
Coordinator, to serve as the county representative on the Fergus Falls Area
Telecommunication Strategic Planning Commission Committee.
FACILITY FOR TRAINING REQUEST
Motion by Windels, seconded Lee and unanimously carried to authorize the Special
Responder Team to use the Courthouse facility for training on Saturday, March 16, 1996.
JUVENILE DETENTION FACILITY MEETING
Larry Krohn, Coordinator, reported on a meeting held in Moorhead relative to the Clay
County Juvenile Detention Facility.
