CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, January 23, 1996, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Virginia Portmann 1 Chair; Harley Windels, Malcolm Lee, and Andy Lindquist present. Commissioner Bill Stone was absent. APPROVAL OF AGENDA Motion by Windels, seconded Lindquist and unanimously carried to approve the agenda of January 23, 1996, as presented. APPROVAL OF MINUTES Motion by Windels, seconded Lindquist and unanimously carried to approve the minutes of January 16, 1996, with one correction as follows: P~ge 2, paragraph 3, motion reads 11Motion by Lindquist, seconded Windels and unanimously carried ... the time elapsed: 11 Commissioner Stone was opposed to this motion, therefore, motion was not unanimous. BID OPENING -TWO (2) SINGLE AXLE CLASS 8 DIESEL TRUCKS At 1:00 p.rn., after advertising for bids, Mike Hanan, Solid Waste Director, opened the following bids: Fargo Freightliner Freightliner/FL 112 $ll0, 036. 00 Fargo, ND Option l 399.75 ea. Nelson International International/8100 100,252.00 Fargo, ND Option l 649.00 ea. The Solid Waste Director will review the bids and return for recommendation for award at the February 6, 1996, board meeting. TRANSFER OF FUNDS FOR SOLID WASTE LOAN Mike Hanan1 Solid Waste Director, provided board members with a synopsis of costs for the construction of the Recycling Facility. Based on the Minnesota Capital Assistance 0 0 0 Otter Tail County Board of Commissioners January 23, 1996 Page 2 Grant Agreement and all current additions or grant ineligible items, the total balance is $1,354,226. Mr. Hanan and Treasurer, Steve Andrews, recommended borrowing $1,300,000 at 7% interest for 9 years from the Otter Tail County General Revenue Fund. Monthly payment of $16,258.16 will be made to the General Revenue Fund from the Solid Waste Department budget. The remaining $54,226 will be paid from the 1995 capital improvement dollars in the Solid Waste Department budget. Motion by Lindquist, seconded Lee and unanimously carried to approve a loan of $1,3001 000 at 7% interest from the General Revenue Fund to the Solid Waste Department as described above for the Recycling Center Facility. EMPTY PESTICIDE CONTAINER COLLECTION Marie Tysdal, Public Information Officer, informed the board that Otter Tail County must notify the MN Department of Ag by February 1, 1996, of the county's intentions in conducting empty pesticide container collections. Tysdal reported that Cenex/Land O'Lakes in Moorhead is willing to conduct the empty pesticide container collections for Otter Tail County with assistance from the county since the program is currently in existence. Motion by Lindquist, seconded Lee and unanimously carried to continue to assist in the empty pesticide container collections along with Cenex/Land O'Lakes for collections in Otter Tail County. Otter Tail County will continue with radio advertising as in previous years and in inspection of empty containers. Additionally, Tysdal informed the board of two scheduled Waste Chemical Collections on April 1 and April 5, 1996, through the Department of Ag. 1996 ANNUAL INSURANCE PREMIUMS Motion by Lindquist, seconded Windels and unanimously carried to approve payment to Minnesota Counties Insurance Trust, in the amount of $491,421, as follows: ($256,966 for '96 errors/omissions, liability and property/casualty coverage; $235,064 for '96 workers compensation coverage, and; credit of $609 for returned marine equipment premium) Motion by Windels, Removal Equipment to as recommended by the BID AWARD -SNOW REMOVAL EQUIPMENT seconded Lee and unanimously carried to award the bid for Snow low bidder, J-Craft, Inc., Kimball, MN, in the amount of $51,314.47 Highway Engineer. BID OPENING DATE SET -TRACTOR/LOADER/MOWER Motion by Windels, seconded Lee and unanimously carried to set bid opening date on March 5, 1996, at 1:00 p.m. for Tractor/Loader/Mower. FINAL PAYMENT -S.A.P. 56-600-14 Motion by Lindquist, seconded Windels and unanimously carried in the amount of $15,270.36, to Central Specialties, Glendalough State Park project, S.A.P. 56-600-14. HIGHWAY SIGN REPLACEMENT to approve final payment, Inc. for Estimate No. 6, Motion by Windels, seconded Lindquist and carried, with Lee opposed, to approve payment of $688.50 to MnDOT for replacement of a highway sign on Trunk Highway 10, CSAH 53, Big Pine Lake Road. 0 0 Otter Tail County Board of Commissioners January 23, 1996 Page 3 PROPOSED DNR BRIDGE & CULVERT GENERAL PERMITS Rick West1 Highway Engineer, discussed statutory changes made in 1995 under M.S. 103G which allow the DNR to issue a general permit to counties for bridge and culvert replacement projects having minimal impact upon public waters. West explained that the DNR is in the early steps of developing this permit process. It appears at this time that this proposal will streamline and reduce the costs of the DNR permitting process. PETITION FOR EMERGENCY STATUS FOR THE STATE OF MINNESOTA Citizen, Don Richter, Everett Gilbertson and others presented a lengthy Common Law document/petition. Mr. Richter explained the group's 11 emergency status 11 views relative to President Clinton's authority to send American troops to Bosnia. He read several sections of the document. Mr. Gilbertson reviewed the 11 Findings of Fact", page 5. Mr. Richter requested the board to review the document. ODOROUS EMISSIONS RULES DISCUSSION FEEDLOT PROGRAM Bill Kalar, Land & Resource Administrator, briefed the board regarding the state's proposed odorous emissions rules. Kalar outlined the responsibilities of a Local Government Unit in receiving and documenting complaints. Additionally, Mr. Kalar reported on the MPCA rules relative to a County Feedlot Program. The county could adopt a County Feedlot Ordinance compliant with state feedlot standards. If so, the MPCA would be responsible for training of county staff and the county would be responsible for permitting and inspections. General consensus of the board showed no interest in a County Feedlot Program. ON-SITE SEWAGE SYSTEMS Discussion took place regarding the proposed on-Site Sewage System rules, Chapter 7080. Mr. Kalar has informed county septic system installers and cleaners that the licensing procedure has been changed by new state rules. APPROVAL TO PAY BILLS Motion by Windels, seconded Lindquist and unanimously carried to approve payment of bills per Attachment A of these minutes. STORM DAY POLICY Larry Krohn, County Coordinator, discussed 11 Storm Day11 policy with board members. After discussion, the following basic policy was developed in case of inclement weather: 1. The courthouse may be closed to the public for business purposes by the Board Chair or designated personnel. This may be announced over the radio and means that there will be no business conducted at courthouse buildings during the specified time. 2. Even though the courthouse is closed to the public, it is a regular work day for county employees. 3. Employees using their own discretion, may report to work as usual or if employees cannot report to work, they will be compensated by using vacation time, compensatory time, or with supervisor approval, make up the time within the same pay period. 0 0 0 Otter Tail County Board of Commissioners January 23, 1996 Page 4 Motion by Lee, seconded Windels and unanimously carried to approve the intent of Otter Tail County's 11 Storm Day11 policy as described above which follows the current personnel policy. A written 11 Storm Day11 policy will be drafted by the County Attorney and distributed based on above intent.
