CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, January 16, 1996, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Virginia Partmann,
Chair; Bill Stone, Harley Windels, and Andy Lindquist present. Commissioner
Malcolm Lee was absent.
APPROVAL OF AGENDA
Motion by Windels, seconded Stone and unanimously carried to approve the agenda of
January 16, 1996, as presented.
APPROVAL OF MINUTES
Motion by Stone, seconded Windels and unanimously carried to approve the minutes of
January 9, 1996, as submitted.
APPROVAL OF FINAL PLAT -MARQUARDT VILLA
Motion by Windels, seconded Stone and unanimously carried to approve the final plat of
Marquardt Villa, (Section 17 & 20, Township 137, Range 42, Fish Lake)
ODOROUS EMISSIONS RULES
Bill Kalar, Land & Resource Administrator, provided correspondence from the Pollution
Control Agency regarding air quality rules relative to odor emissions. Mr. Kalar will
research the issue further and return to the board at the next regular meeting.
APPROVAL OF SENTENCE-TO-SERVICE VEHICLE
Motion by Windels 1 seconded Lindquist and unanimously carried to approve the purchase of
a 1986 42-passenger school bus, in the amount of $5,000, payable to Hoglund Bus Co. Inc.
for the Sentence-To-Service program.
DELINQUENT TAXES
Wayne Stein, Auditor, informed the board of a delinquent tax situation regarding two
parcels whereby the first half of 1995 taxes paid by check came back to the county as
non-sufficient funds. Stein indicated that a transaction was taking place during this
time, and after settlement of sale of the property, it was discovered that the first
half of taxes for 1995 was still outstanding. Mr. Stein outlined several options to
rectify this delinquent tax matter. Steve Andrews, Treasurer, reported that a new NSF
check policy would be developed and brought to the board for consideration at an
upcoming board meeting. V Motion by Windels,

0 liability for one-half of the first half taxes due plus penalty and interest accrued
during the transaction period, in the amount of $756.67, and the buyer will pay for
one-half of the first half taxes, in the amount of $582.50. The Auditor indicated that
correspondence will be sent to the buyer indicating this decision and allowing fourteen
days for receipt of one-half of the outstanding 1995 taxes as described above.
DELINQUENT TAXES
The Auditor reported a delinquent tax situation relative to two parcels in Dunn
township. Payable 1994 tax is delinquent, however, some time has elapsed since receipt
of the NSF check and correspondence with owner{s). Motion by windels, seconded
Lindquist to approve the Auditor's recommendation to send a certified letter to the
owner(s) to allow fourteen days to pay the delinquent tax and if payment not received,
the parcels would be forfeited under the delinquent tax rules. Motion was rescinded.
*Motion by Lindquist, seconded Windels and unanimously carried to allow the owner{s) of
the following properties a final opportunity to pay the delinquent tax due and Otter
Tail County will forgive the additional interest and penalty that has accrued since the
NSF checks were received because of the time elapsed:

Upon a motion by Lindquist, seconded Stone and unanimously carried,
Certificate of Correction to Plat was approved:

Pursuant to the provision of Chapter 505.175, Laws of Minnesota, 1957, David A.
Anderson, the undersigned, a Registered Land Surveyor in and for the State of Minnesota,
declares as follows:
1. That the plat of ANDERSON'S BEACH dated October 2, 1965, and filed on November 16,
1965, in the office of the County Recorder, Otter Tail County, Minnesota, in Book P
of Plats, Page 11, was prepared by John Rebar, Registered Land Surveyor No. 2650,
deceased.
2. That said plat contains the following omissions to wit:
The call along said shore line of Otter Tail Lake was omitted from the legal
description on said plat.
3. That the legal description on said plat is hereby corrected as follows, to wit:
Beginning at the point where the south line of said Government Lot l crosses the west
right of way line of Trunk Highway No. 78, the said point of beginning being 2089.5 feet
west of the southeast corner of the Northeast Quarter of the Northeast Quarter of
Section 31 in said Township and Range; thence from said point of beginning run West
along the south side of said Government Lot 1 a distance of 803.23 feet to an iron stake
on the shore line of Otter Tail Lake; North 20 degrees 30 minutes East along this shore
line, a distance of 630.0 feet; thence North 23 degrees 30 minutes East along said shore
line of Otter Tail Lake, a distance of 300.0 feet; thence North 35 degrees 12 minutes
East along said shore line of Otter Tail Lake, a distance of 150.0 feet to an iron

stake; thence South 78 degrees 41 minutes East a distance of 380.78 feet; thence South
17 degrees 05 minutes West a distance of 210.0 feet; thence South 27 degrees 40 minutes
West 210.0 feet; thence South 24 degrees 40 minutes West a distance of 210.00 feet;
thence South 06 degrees 55 minutes West a distance of 272.6 feet to an iron stake;
thence East parallel with the south line of said Government Lot 1, a distance of 367.17
feet to the said west right of way line of Trunk Highway No. 78; thence South 36 degrees
00 minutes West along this right of way line a distance of 81.58 feet to the point of
beginning.

LIQUOR LICENSE REFUND REQUEST
The Auditor presented a request for a liquor license refund in a situation of the
business changing ownership. Motion by Lindquist, seconded Windels and carried, with
Stone opposed to deny this liquor license refund request. Permission to refund money to
businesses in this situation has not been granted in the past.
RECOMMENDATION FOR AWARD -S.P. 56-603-04
The bid of Mark Sand & Gravel Co. in the amount of $2,667,039.63 appeared to be the
lowest bid received, subject to final audit, and on motion by Commissioner Stone,
seconded by Windels and unanimously carried, it was voted by the Otter Tail County Board
of Commissioners to recommend to the Commissioner of Transportation, as Agent for
Otter Tail County, that S.P. No. 56-603-04 be awarded to the lowest responsible bidder.
RECESS AND RECONVENE
Chair Partmann declared the Otter Tail County Board of Commissioners' meeting recessed
for lunch break. The meeting was reconvened at 1:30 p.m. for the afternoon session.
APPROVAL OF BILLS
Motion by Windels, seconded Lindquist and unanimously carried to approve the following
bills per Attachment A of these minutes.
GRIEVANCE SETTLEMENT
Wally Senyk, County Attorney, reviewed a grievance filed by a member of the Teamsters
Human Services Professional Unit, relative to compensation for mileage traveled and time
spent working at the Fergus Falls Public Health clinic instead of the EOT office
location. Motion by Windels, seconded Lindquist and unanimously carried to approve a
reduced settlement of $1,000 for the above described grievance as recommended by the
Personnel Committee.
0 STIPULATION FOR ENTRY OF JUDGMENT
The County Attorney reviewed a tax appeal matter relative to the Westridge Mall. After
discussion a motion was offered by Lindquist, seconded Windels and unanimously carried
, to approve Stipulations for Entry of Judgment in two tax appeal matters; 1) Westridge
Mall vs Otter Tail County and 2) Northwest Properties vs Otter Tail County.

ADJOURNMENT
At 1:58 p.m., Chair Partmann declared the meeting of the Otter Tail County Board of
Commissioners adjourned to view the Prepaid Medical Assistance Program satellite
scheduled for 2:00 p.m. The next regular board meeting is scheduled for 1:00 p.m.
