Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, January 9, 1996 ~ '°': 1:00 p.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, January 9, 1996, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Virginia Partmann, Chair; Bill Stone, Harley Windels, and Malcolm Lee present. Commissioner Lindquist was absent. APPROVAL OF MINUTES Motion by Windels, seconded Lee and unanimously carried to approve the minutes of January 2, 1996, as submitted. BID OPENING -S.P. 56-603-04 At 1:00 p.m., after having previously advertised for bids, Rick West, Highway Engineer1 opened the following bids and Tallack Johnson, MnDOT District State Aid Engineer announced the bids for the Reconstruction & Bridge Replacement on CSAH No. 3, State 0 _ Project 56-603-04. County Attorney present at 1,15 p.m. BID OPENING -SNOW REMOVAL EQUIPMENT After having previously advertised for bids, the Highway Engineer opened the following bids for Snow Removal Equipment: Bert's Truck Equipment Moorhead, MN Crysteel Truck Equipment Fridley, MN J-Craft Kimball, MN $52,063.14 65,001.49 51,314.47 The Highway Engineer will return with a recommendation for award in two weeks. STREET LIGHTING ON COUNTY STATE AID HIGHWAY SYSTEM COST PARTICIPATION POLICY Upon a motion by Lee, seconded Stone and unanimously carried, the following policy is adopted, INTRODUCTION: Otter Tail County as a past practice has not participated in the cost of replacing or upgrading street lighting while reconstructing a roadway through a municipality. While the practice has been adhered to, it is a non-written policy of the Otter Tail County Highway Department. The Otter Tail County Highway Department does not participate in the cost of the replacement/upgrade of street lighting because of insufficient funding to maintain the current highway system. PURPOSE: The purpose is to provide a written departmental policy statement concerning this issue which has been reviewed and approved by the County Board of Commissioners. POLICY STATEMENT, Otter Tail County does not participate in the cost of street lighting replacement and/or upgrade during the reconstruction of a roadway through a municipality. Otter Tail County will participate in the costs associated with the replacement of the existing light standard foundation(s) if new foundation(s) are required because of changes in the vertical and horizontal alignment of the new roadway. This policy supersedes all previously written documents and unwritten policies on this subject of cost participation with regards to street lighting in municipalities. This policy adopted by the Otter Tail County Board of Commissioners this 9th day of January, 1 OTT COUNTY D OF COMMISSIONERS 0 Otter Tail County Board of Commissioners January 9, 1996 Page 3 APPROVAL OF RETAINAGE REDUCTION -S.A.P. 56-631-04 & 56-684-01 Motion by Stone, seconded Windels and unanimously carried to approve reduction of retained money from 5% to 1% for S.P. 56-631-04 as recommended by the Highway Engineer. Motion by Lee, seconded Windels and unanimously carried to approve reduction of retained money from 5% to 2% for S.A.P. 56-684-01 as recommended by the Highway Engineer. UNFUNDED MANDATES Rick West provided board members with a handout entitled 11Minnesota County Engineers Association 1995 List of Unfunded Mandates". SIXTY-DAY TIMELINE Bill Kalar, Land & Resource Administrator, discussed with board members the new sixty- day timeline on permit applications. PLANNING COMMISSION REAPPOINTMENTS Motion by Windels, seconded Stone and unanimously carried to reappoint Fred Harker, Frazee, MN, and Robert Schwartz, Wadena, MN, to the Otter Tail County Planning Commission for a three year term effective January 1, 1996. AGENDA Wally Senyk, County Attorney, clarified Resolution No. 96-01 relative to when the agenda is considered final. The board's general consensus is that the agenda is final when sent to the media except for any emergency topics that create an urgent need to address a matter without advance notice. The Chair requested 11Approval of Agenda" to appear as an additional topic on the agenda. The County Board will take action on the agenda as presented including emergency topics. LICENSED SOLID WASTE HAULERS Motion by Lee, seconded Windels and unanimously carried to approve the following 1996 Solid Waste Hauler applications for license: Motion by Windels, Battle Lake, HoW'ard Advisory Board for a Ballard Sanitation, Pelican Rapids C & J's Lake Service, Pelican Rapids City Dray Sanitation, Wadena City of Fergus Falls Fuchs Sanitation, Glyndon Ken's Garbage 'Service, Clitherall Meyer's Garbage Service, Perham Minn-Kota Recycling, Detroit Lakes Northern Waste Systems, Detroit Lakes Regional Waste Systems, Underwood Pope County Sanitation, Inc., Alexandria Steve's Sanitation, Perham Toutges Sanitation, Henning SOLID WASTE ADVISORY BOARD REAPPOINTMENTS seconded Lee and unanimously carried to reappoint Bert Olson, Goese, Fergus Falls, and Joe Fehrenbach, Perham, to the Solid Waste three year term effective January 1, 1996. Pursuant to Chapter 472, Laws of Minnesota, 1955 and Chapter 505.173 through 505.177, Laws of Minnesota, Terry Lee Anderson, the undersigned, a Registered Land Surveyor in the State of Minnesota declares as follows: 1. The subdivision plat of 11 SILVER SHORES 11 was prepared by John Reber a Land Surveyor of whom is retired from surveying practice. His whereabouts is unknown and he may be deceased. 2. The subdivision plat of 11 SILVER SHORES 11 was filed for record in the office of the County Recorder in and for Otter Tail County, Minnesota on May 12, 1960 and was recorded in Book O of Plats on page 60. 3. That the subdivision plat of 11 SILVER SHORES 11 contains errors, omissions or defects in the following particulars to wit: The legal description for the outside boundary lines of the plat call out the shoreline of Silver Lake as the easterly line of the plat; however, when describing its location, it is obvious from the picture portion of the plat that a line slightly westerly of the shoreline was defined as the boundary of the plat. This error inadvertently eliminates a small sliver of land between the surveyor's survey line and the actual shoreline. 4. The following legal description is to be permanently attached to the plat of 11 SILVER SHORES 11 describing the aforementioned sliver of land. That part of Government Lot 6, Section 28, Township 133 North, Range 40 West Otter Tail County, Minnesota, described as follows: Beginning at the Southeast Corner of Lot 20, 11 SILVER SHORES 11 , on file and of record in the office of the County Recorder in and for Otter Tail County, Minnesota; thence easterly along the easterly extension of the South Line of said Lot 20 to the shoreline Silver Lake; thence northerly along said shoreline to its intersection with the easterly extension of the North line of Lot 1 of said 11 SILVER SHORES", thence westerly along the easterly extension of said Lot 1 to the Northeast Corner of said Lot l; thence southerly along the easterly lines of Lots 1 through 20 of said 11 SILVER SHORES 11 to the point of beginning. 5. That the sidelines of Lots 1 through 20 of said 11 SILVER SHORES 11 are to be extended to intersect the shoreline of Silver Lake. Terry Lee Anderson (Minnesota Registration Number 14676) The above Certificate of Correction to the plat of 11 SILVER SHORES 11 has been approved by the Board County Commissioners of Otter Tail County, Minnesota, this 9th day of 1996. BID OPENING -SALE OF PROPERTY After having previously advertised for bids for the sale of property, the Auditor opened a bid from Cyril & Karen Palubicki in the amount of $478. Motion by Windels, seconded Lee and unanimously carried to accept the bid of Cyril & Karen Palubicki, Perham, MN, in the amount of $478 for the purchase of the following described parcel: The South 55' of the East 448' of the Southwest Quarter of the Southeast Quarter, Section 21, Township 136, Range 40. Subject to the following described easement: The South 55' of the East 50' of the Southwest Quarter of the Southeast Quarter, Section 21 1 Township 136, Range 40.
