CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, December 19, 1995 at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman:
Harley Windels, Malcolm Lee, Virginia Partmann and Andy Lindquist present.
APPROVAL OF MINUTES
Motion by Partmann, seconded Lindquist and unanimously carried to approve the minutes of
December 12, 1995, as submitted.
PAYABLE 1996 TAX LEVY AND BUDGET RESOLUTION
OTTER TAIL COUNTY RESOLUTION NO. 95-67
The following resolution was offered by Commissioner Lindquist, who moved for the
adoption of the 1996 budget for the General Fund, for the budgeted Special Revenue
Funds, for the Debt Service Fund and for the adoption of the payable 1996 Gross and Net
Tax Levy:
WHEREAS, The Otter Tail County Board of Commissioners held the required public hearing
on December 12, 1995, at 7:30 p.m, in the Otter Tail County Commissioners' Room for the
purpose of discussing and receiving public input regarding the 1996 budget proposed for
the General Fund, proposed for the budgeted Special Revenue Funds, proposed for the Debt
Service Fund and for the purpose of discussing and receiving public input regarding the
proposed payable 1996 Gross and Net Tax Levy.
WHEREAS, Public discussion and comment regarding the County Budget and Tax Levy was
received, on December 12, 1995, and all interested individuals in attendance were
provided an opportunity to address the Otter Tail County Board of Commissioners with
their concerns.
WHEREAS, The Otter Tail County Board of Commissioners having received public discussion
and input from all interested individuals in attendance declared the public hearing
adjourned and stated that final action adopting the 1996 Budget and Tax Levy would take
place on December 19, 1995, at 9:30 a.m. in the Otter Tail County Commissioners' Room.
THEREFORE< BE IT RESOLVED, That the Otter Tail County Board of Commissioners adopts the
amount of $39,305,870 as the County's 1996 budget for the General Fund, for the budgeted
Special Revenue Funds and for the Debt Service Funds, as detailed in the attached
documents.
BE IT FURTHER RESOLVED, That the Otter Tail County Board of Commissioners levies for the
payable year 1996, upon the taxable property of Otter Tail County the following amounts
as detailed:

OTTER TAIL COUNTY RESOLUTION NO. 95-68
A motion was offered by Commissioner Lindquist and seconded by Commissioners
with the members of the Otter Tail County Commissioners voting as follows to adopt the

BE IT RESOLVED: That the Sum of $189,380 be set apart form the General Fund and
appropriated subject to the order of the Dean and Director of the Minnesota Extension
Service of the University of Minnesota for the support of count extension work in Otter
Tail County for the year beginning January 1, 1996 in accordance with Minnesota Statute,
Section 38.33 -38.38, 1990.

FINAL PLAT: SULLIVAN ADDITION
Motion by Lee, seconded Lindquist and unanimously carried to approve the final plat of
Sullivan Addition, Pickeral Lake, with stipulations as outlined by the Planning
Commission.
The County Attorney was present at 9:55 a.m.
FINAL PLAT: LONESOME TRAIL
Motion by Lee, seconded Windels and unanimously carried to waive the two week filing
requirement {Sec. III, 3, A of the Subdivision Controls Ordinance) regarding the final
plat of Lonesome Trail, Head Lake, to accommodate the Land & Resource Management Office
as requested by Bill Kalar, Administrator.
Motion by Windels, seconded Partmann and unanimously carried to approve the final plat
of Lonesome Trail, Head Lake, as recommended by the Planning Commission.
POSITIVE PARENTING CURRICULUM UPDATE
Extension Educator, Angela Berge, along with Lutheran Social Services Family Resource
Worker, Jan Johnson, updated the board relative to the positive parenting curriculum now
in use.
BID OPENING SET
Motion by Lindquist, seconded Partmann and unanimously carried to approve the
recommendation of the Highway Engineer, Rick West, to set the bid opening for 1:00 p.m.,
February 13, 1996 of 1996 Yearly Material Bids for Bituminous Materials, Culverts,
Herbicides, Highway Signs & Posts and Hot Mix Patching Materials (North, East & West}.

CONSULTING SERVICES AGREEMENT
Motion by Windels, seconded Lee and unanimously carried to approve a consulting services
agreement between Otter Tail County and Interstate Engineering, Inc., Fergus Falls, MN,
to prepare plans for bidding purposes for traffic signals on CSAH No. 80 at Perham, MN,
in accordance with the signal warranty study. Said agreement is executed with a cost
not-to-exceed $17,000 and is subject to the review of the County Attorney.
ARCHAEOLOGICAL SURVEY: SAP 56-674-01
Motion by Lee, seconded Portmann and unanimously carried to authorize Bear Creek
Archeology, Inc, New Brighton, MN, to proceed in Phase I Archaeological Survey on
Project No. S.A.P. 56-674-01 in the amount of $3,501.49.
FINAL PAYMENT: INTERSTATE, INC.
Motion by Lindquist, seconded Lee and unanimously carried to approve final payment in
the amount of $71,065.32 to Interstate, Inc., Fergus Falls, MN, for one 85 HP Loader
Tractor, Mechanical Front Wheel Drive and two Rotary Mowers as awarded on June 6, 1995.
SUPPORT OF HR 842 TO TAKE TRUST FUNDS OFF-BUDGET
Motion by Lee, seconded Windels and unanimously carried in support of Representative Bud
Shuster's (R-PA) HR 842 to take the trust funds off-budget to ensure that a trust fund
should be used for what it is intended, thereby relegating funds collected for each to
just another tax. The motion included that a copy of same be sent to Bob Stevenson,
Chairman of Association of Minnesota Counties, Region IV.
SUPPORT OF MCLEOD COUNTY POSITION
Motion by Lee, seconded Lindquist and unanimously carried to send a letter to Senator
Dean Johnson, Senate Minority Leader, supporting the claim of the McLeod County Board
with regard to Ron Harnack, Executive Director of the Board of Water & Soil Resources,
and his monopolization of the policy meetings. The feeling expressed was that policy
should be set by elected officials and constituents.
CHIPPEWA RIVER WATERSHED DISTRICT
Norm Fjestad, WOTSWCD, updated the board relative to a meeting of the Chippewa River
Watershed. A very small portion of the watershed district is in Otter Tail County.
Commissioner Windels stated that the water flowing in and out of Otter Tail County is
monitored. General consensus of the board is that unclean water in areas outside of
Otter Tail County is not the responsibility of Otter Tail County.
MECHANICAL IMPROVEMENT BIDS
David Shultz of Yeater, Hennings, Ruff, Shultz, Rokke, Welch Architects & Planners, and
Building Supervisor, Rick Sytsma, presented bids for Mechanical Improvements opened
December 14, 1995, for Project 9538 as follows:

Motion by Lee, seconded Lindquist and unanimously carried to accept the low bid of
FM Plumbing & Heating, Fargo, ND, for the Base Bid of $312,900 less negotiated changes
of $10,000 due to reductions in the electrical sub-contract for a total of $302,900, for
Mechanical Improvements, Project No. 9538, which includes installation of chiller and
associated HVAC work. Architect, David Shultz assured Commissioner Lee that the
reduction of services, in the amount of $10,0001 was work that can be added at a later
date and would not effect the future capacity of the system. Mr. Sytsma informed the
board that the coal room will be closed-up next April which will save some anticipated
expense in the total courthouse improvement expense project.
REQUESTS FOR FORGIVENESS OF PENALTY
Steve Andrews, Treasurer, requested forgiveness of penalty of $165.12 for parcel no.
17-000-99-0786-000, William Feigum, as one parcel statement had been overlooked and was
not paid by the October 15, 1995, deadline date. The Board did not take action to
forgive the penalty as the oversight was not the fault of the county.
Motion by Windels, seconded Lee and unanimously carried to forgive penalty of $65.28 1
for parcel no. 32-000-16-0122-001, Robert Posch, because of the time involved in
recording the deed for this parcel.
APPROVAL TO PAY BILLS
Motion by Lee, seconded Lindquist and unanimously carried to approve the following bills
per Attachment A of these minutes.
VETERANS SERVICE COMPUTER EQUIPMENT
Chet Toso, VSO, requested approval of purchase of computer equipment for the Veterans
Service itinerant offices. Motion by Windels, seconded Partmann and unanimously carried
to approve purchase of computer equipment for the Veterans Service itinerant offices, in
the amount of $5,184.42. Commissioner Lee directed Mr. Toso to write a letter to the
Minnesota Department of Veterans Affairs to express Otter Tail County's disappointment
in not obtaining the grant available for this computer equipment.

EMPLOYEE ASSISTANCE PROGRAM AGREEMENT
Motion by Lindquist, seconded Partmann and unanimously carried to authorize the County
Coordinator's signature on the Lakeland Mental Health Center EAP Agreement effective
January 1, 1996, through December 31, 1996, with no increase in fees.
CLOSED TO THE PUBLIC
At 2:04 p.m., Chair Stone declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for purposes of discussing labor negotiation
strategies regarding a request filed by the Teamsters Law Enforcement Unit for
compensation for employees who worked on December 8, 1995, when the courthouse was
closed due to blizzard conditions. The closed session adjourned at 2:26 p.m.
OPEN SESSION
COURTHOUSE CLOSED
The Otter Tail County Board of Commissioners' meeting reconvened in open session with
Commissioners Bill Stone, Chairman; Harley Windels, Malcolm Lee, Virginia Partmann and
Andy Lindquist present.
Motion by Partmann, seconded Windels and carried, with Stone opposed and Lindquist
absent for the vote, to compensate employees for December 8, 1995, (storm day) as a
regularly scheduled work day even if the day was interrupted by blizzard
conditions as follows:
1) Employees who could not report to work on December 8, 1995, due to blizzard
conditions or reported to work and were sent home due to blizzard conditions will be
compensated for their regularly scheduled work hours at their regular rate of pay.
2) Employees electing to stay and work will be compensated as a regular work
day at their regular rate of pay based on personnel policy or union contract,
whichever is applicable.
3) Employees with vacation scheduled will use vacation as planned. Employees who
were sick will use sick time relative to the regular sick time policy.
4} Overtime will not be paid unless an employee has actively worked over 40 hours
for the week.
ADJOURNMENT
At 2:30 p.m., Chair Stone declared the Otter Tail County Board of Commissioners' meeting
adjourned until 1:00 p.m. Tuesday, December 26, 1995.
