CALL TO ORDER
The Otter Tail County Board of Commissioners convened Wednesday, December 6, l995, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman;
Harley Windels, Malcolm Lee, and Andy Lindquist present.
APPROVAL OF MINUTES
Motion by Lee, seconded Lindquist and unanimously carried to approve the minutes of
November 28, 1995, as submitted.
CENTRAL LAKES TRAIL
Bill Kalar, Land & Resource Director, and Duane Rose, OCTA Trail Coordinator, appeared
at the board's request relative to the Central Lakes Snowmobile Trail. Mr. Rose
presented a snowmobile trails '95-96 map and requested that Otter Tail County sponsor
two trails; 1) the Central Lakes Railbank Trail and 2) a trail traveling from Ashby to
Inspiration Peak. Mr. Rose presented an insurance certificate to Mr. Kalar for proof of
liability insurance OCTA has purchased for snowmobiling on the trails. Property owners
Jerry Hess and Dan Lee expressed concerns regarding the Central Lakes Trail. Concerns
included specific covenants which appear on some property owners' deeds, liability,
littering on the trail, enforcement of rules. Discussion followed. Commissioner
Lindquist requested that the property owners and OCTA meet and discuss concerns and
possible solutions.
Motion by Lindquist, seconded Lee and unanimously carried to designate the Central Lakes
Trail and the trail from Ashby to Inspiration Peak for one year to the Otter Country
Trail Association for snowmobiling only.
COMPUTER BUDGET CARRYOVER REQUEST
Tim Brand, MIS Manager, requested carryover of MIS computer funds into 1996. Motion by
Windels, seconded Lee and unanimously carried to authorize the transfer of funds
allocated for the new computer system into the Capital Improvement Fund subject to the
approval of the County Auditor.

AMC DISTRICT IV TRANSPORTATION MEETING
Commissioner Lee reported on a recent District IV transportation meeting. Lee reviewed
the committee membership, planning dollars available, and made available a
transportation plan brochure.
STS VEHICLE
Joe Peloquin, Captain, reported that the Sentence-To-Service bus needs to be replaced.
Al Keller, STS Coordinator, informed the board that the State of Minnesota will pay for
approximately 50% of the cost of a replacement vehicle, however, that money will not be
available until the next budget is prepared, July 1 1 1997. Discussion followed.
Motion by Windels, seconded Portmann and unanimously carried to direct Mr. Keller and
Mr. Peloquin to meet with the Capital Improvement Committee regarding budgeting for an
STS vehicle. The Capital Improvement Committee will return to the board with a
recommendation.
OUTSTANDING CHECK POLICY
Motion by Partmann, seconded Lindquist and unanimously carried to adopt an Outstanding
Check Policy per State Statute to authorize follow-up of checks of $25 or more and
write-off of checks less than $25 as presented by Treasurer, Steve Andrews.
LAND SURVEYOR'S CERTIFICATE OF CORRECTION TO PLAT
Name of Plat: PLEASANT GROVE
Upon a motion by Stone, seconded by Lindquist, and unanimously carried, the following
Land Surveyor's Certificate of Correction to the Plat of PLEASANT GROVE as prepared by
David A. Anderson, Registration No. 13620, was accepted.
Pursuant to the provision of Chapter 505.175, Laws of Minnesota, 1957, David A.
Anderson, the undersigned, a Registered Land Surveyor in and for the State of Minnesota,
declares as follows:
l. That the plat of PLEASANT GROVE dated September 25, 1919, and filed on
October 6, 1919 in the office of the County Recorder, Otter Tail County, Minnesota,
in Book J of Plats, Page 19_, was prepared by O.G. Molden, Civil Engineer and
Surveyor, deceased.
2. That said plat contains the following errors and omissions to wit:
The legal description begins at the northeast corner of Government Lot 2, which is
at the lake shore.
A land tie to a section corner of Section 32, Township 134, Range 40, was omitted
from the legal description on said plat.
The north line of PLEASANT GROVE is not on the north line of Government Lot 2.
3. That the legal description on said plat is hereby corrected as follows, to wit:

a distance of 1527.90 feet to Meander Corner No. 1 of said Township 134, Range 40;
thence North 04 degrees 12 minutes 49 seconds West a distance of 2674.88 feet to the
point of beginning of the land to be described; thence on a bearing of North a distance
of 1265.00 feet; thence South 87 degrees 30 minutes 40 seconds East a distance of 176.46
feet; thence South 87 degrees 35 minutes 10 seconds East a distance of 188 feet more or
less to the shoreline of Otter Tail Lake; thence southerly along said shoreline to the
intersection with a line which bears South 87 degrees 30 minutes 40 seconds East from
the point of beginning; thence North 87 degrees 30 minutes 40 seconds West a distance of
120 feet more or less to the point of beginning.

PREMISE PERMIT APPLICATION
OTTER TAIL COUNTY RESOLUTION NO. 95-61
Upon a motion by Lee, seconded by Lindquist, and unanimously carried, the following
resolution was adopted:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling
Control Board; and
WHEREAS, the American Legion Post 30, Fergus Falls, MN, has made an application to the
Gambling Control Board for a premise permit to conduct lawful gambling at the Pantry and
Pub in Friberg Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not
issue a permit unless they receive a resolution from the Otter Tail County Board of
Commissioners approving the permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose
the conduct of lawful gambling by the American Legion Post 30, Fergus Falls, MN, at the
Pantry and Pub in Friberg Township of Otter Tail County, provided the application meets
all the necessary criteria for the licenses and permits as required by the Gambling
Control Board.
NOW, THEREFORE BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby
approves the conduct of lawful gambling by the American Legion Post 30, Fergus Falls, MN
at the Pantry and Pub in Friberg Township of Otter Tail County, provided the application

SALE OF PROPERTY
Motion by Windels, seconded by Partmann, and unanimously carried to authorize the sale
of property as follows:
The south 55' of the east 448' of the southwest quarter of the southeast quarter,
Section 21, Township 136, Range 40, containing .57 acre.
The property will be described to the centerline of County Road #35 and the successful
bidder will be required to grant a 50' easement to the Otter Tail County Highway
Department for Highway maintenance purposes.

2000 CENSUS
Motion by Lee, seconded Partmann and unanimously carried to authorize Otter Tail
County1 s participation in the Bureau of Census 1 s 2000 statistical area program.
Otter Tail County would be assisting in the defining and/or updating of the census
tracts and block groups, and census designated places, that will be recognized in our
2000 census data tabulation.
PAYMENT APPROVED -CITY OF PELICAN RAPIDS
Motion by Lee, seconded Lindquist and unanimously carried to authorize payment to the
City of Pelican Rapids for invoice no. 371, in the amount of $SO, invoice dated 7/21/95,
in the amount of $25, and invoice no. 405, in the amount of $25, for the purpose of
mowing tax forfeited property.
STATE AUDITOR MANAGEMENT LETTER
Motion by Lindquist, seconded Lee, and unanimously carried to authorize the Chairman of
the Board, the County Auditor, and the County Coordinator to sign and forward the
management letter to the State Auditor's office.
UPDATE -WEST CENTRAL AREA AGENCY ON AGING
Virginia Smith, West Central AAA Director, provided a handout requesting an additional
$910 assessment from Otter Tail County to the WCAAA for the '96 operating year. This
request is a result of decreased funding by the federal government. In addition,
Ms. Smith provided an area budget plan and 1993-96 goals and objectives for the WCAAA.
One project WCAAA is proud of is their involvement with an Alzheimers wing at the
Bethany Homes in Alexandria. Commissioner Partmann referred the matter to the Budget
Committee. Commissioner Windels, Budget Committee Member, stated the Otter Tail County
budget is completed for 1996 and, if request was met, it would require a supplement to
the budget. The Budget Committee will review the matter and return to the board with a
policy recommendation.
CONDITIONAL USE PERMIT -BRENDEFUR/KRAMER
Bill Kalar, Land & Resource Director, and Doug Kramer, Kramer Realty, appeared regarding
the Kramer property on East Battle Lake. Negotiations between Mr. Kramer and the East
Battle Lake Watershed Association were reviewed. Motion by Windels, seconded Lindquist
and unanimously carried to take no action on the Brendefur/Kramer Conditional Use Permit
until the County Board1 s second meeting in March, 1996, to allow Mr. Kramer to further
explore the possibility of the purchase of lots D-K by the Department of Natural
Resources.
APPROVAL TO PAY BILLS
Motion by Lee, seconded Partmann and unanimously carried to approve the following bills
per Attachment A of these minutes which includes lodging payments on behalf of the
following employees:
Best western Drover's Inn, Court Security Officer, Richard Sheils
Sheraton Inn Midway, Investigator, Mike Boen.

PRESENTATION OF SAFETY PLAQUE
Tim Hunt, Safety Director, and Deb Thormodson, Employee Safety Committee President,
presented a plaque to the Commissioners. The plaque represents an award of excellence
in promoting the safety AWAIR program awarded to Otter Tail County by Minnesota Counties
Insurance Trust.
MINNESOTA DEPARTMENT OF CORRECTIONS
RESOLUTION AUTHORIZING EXECUTION OF CONTRACTS
OTTER TAIL COUNTY RESOLUTION NO. 95-64
Upon a motion by Lindquist, seconded Partmann and unanimously carried, the following
resolution was adopted:
BE IT RESOLVED, that on November 20, 1995, Otter Tail County Sheriff's Department
approved a contract with the State of Minnesota for fiscal year 1996. The following
persons are hereby authorized to sign the contract and any amendments or supplements
that are necessary.
