CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, August 8, 1995, at
1:00 p.rn. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman;
Harley Windels, Virginia Partmann, Andy Lindquist and Malcolm Lee present.
APPROVAL OF MINUTES
Motion by Windels, seconded Partmann and unanimously carried to approve the August 1,
1995, minutes as presented.
ABATEMENT OF PENALTY
Citizen, Mike Lange, appeared to request abatement of penalty. Mr. Lange explained that
he purchased a new home on Rush Lake, applied for homestead classification and gave his
new address to the county. He received his tax statement late because it was sent to
the previous owner, therefore, his payment was late and penalties were assessed. Motion
by Lee, seconded Partmann and unanimously carried to abate penalties of $72.72 because
of county error in sending the tax statement to the incorrect owner/address.
BID AWARD -FOUR SNOWPLOWING DUMP TRUCKS
Motion by Lee, seconded Lindquist and unanimously carried to approve the recommendation
of the Highway Engineer to award the low bid for Four (4) New Heavy Duty Tandem Axle
Snowplowing Dump Trucks to Boyer Ford, in the amount of $l5l,239.60 plus the Vis,ibility
Window Option.
PROJECT AUTHORIZATION RESOLUTION -CSAH NO. 88
S.A.P. 56-688-01 TB & S.A.P. 126-10~-02 TB
OTTER TAIL COUNTY RESOLUTION NO. 95-40
Upon a motion by Lindquist, seconded Partmann and unanimously carried, the following
resolution was adopted:
WHEREAS, The Minnesota Department
portion of Trunk Highway No.

Falls by turnback agreements, AND
of Transportation has transferred jurisdiction of the
59 from Fergus Falls North and West to the North
I-94 to Otter Tail County and the City of Fergus
WHEREAS, the above mentioned portion of Trunk Highway No. 59 is now designated as County
state Aid Highway No. 88 and is eligible for reconstruction using Trunk Highway Turnback
Funds, AND
WHEREAS, Otter Tail County and the City of Fergus Falls are proceeding with the
reconstruction of County State Aid Highway No. 88 with Otter Tail County serving as the
lead agency for the project.
NOW, THEREFORE, BE IT RESOLVED THAT, the Otter Tail County Board of Commissioners hereby
authorizes this project to proceed to construction and more specifically authorizes the
Otter Tail County Highway Department to take the actions required to complete this
project including the acquisition of the necessary additional temporary and permanent
highway right-of-way from landowners along the project including the Sate of Minnesota.

APPROVAL OF FINAL PAYMENT -S.A.P. 56-608-19
Motion by Windels, seconded Lee and unanimously carried to approve final payment, in the
amount of $18,703.05, payable to Sherbrooke Asphalt, Inc. for S.A.P. 56-608-19, City of
Perham as recommended by the Highway Engineer.
MN SCENIC BYWAYS
County Attorney, Wally Senyk, reviewed materials received from Convention & Visitors
Bureau Director, Judy Stringer, regarding the MN Scenic Byways bylaws and outdoor
advertising control in Minnesota. Senyk informed board members that the outdoor
advertising controls do not apply to County State Aid or County Highway System and
that county highway design standards are not affected by the MN Scenic Byway
designation. Motion by Partmann, seconded Windels and carried, with Lindquist opposed,
to proceed with support of the MN Scenic Byways Program.
PLANNING COMMISSION RECOMMENDATIONS
Motion by Lee, seconded Partmann and unanimously carried to approve the following
Preliminary Plats as recommended by the Planning Commission:
Lonesome Trail, Robert Wagner, Head Lake
St. Lawrence Estates/Helen Boedigheimer Trust, Rush Lake
Silent Shores North, John Vogt, East Silent Lake
Motion by Lee, seconded Windels and unanimously carried to approve the following
Conditional Use Applications as recommended by the Planning Commission:
Vance D. Sherman, Long Lake
Woodland Park Resort, Donald Bistodeau, East Battle Lake
James Donald Johnson, Dead Lake
Amory K. Anderson, Marion Lake
Michael J. Brauch, Big Pine Lake

TRAIL ASSISTANCE MAINTENANCE AGREEMENTS
Motion by Lee, seconded Windels and unanimously carried to authorize the Chair's
signature on two Trail Assistance Maintenance Agreements between Otter Tail County and
the Minnesota Department of Natural Resources subject to the approval of the County
Attorney.

DETENTION FACILITY FOOD SERVICE CONTRACT
After the County Attorney's review of the Food Service Contract, a motion was offered by
Windels, seconded Lee and unanimously carried to approve the Chair's signature to
execute the Detention Facility Food Service Contract with Best, Inc.
RECYCLABLES PROCESSING SYSTEM AGREEMENT
Motion by Partmann, seconded Windels and unanimously carried to authorize the Chair's
signature on the Recyclable Processing System Agreement with Storage Systems,
Incorporated as recommended by the Solid Waste Director. Hanan reported the guaranteed
recycling system price as $442,742.05 and that a payment and performance bond was
received. Motion by Windels, seconded Lindquist and unanimously carried to approve a
deposit of 25% of the total system price, in the amount of $110,685.51, payable to
Storage Systems, Incorporated for the recycling equipment. Hanan reported that the
payment schedule agreed upon is 25% down when ordering the recycling equipment, 25% when
the equipment arrives, 45% when the equipment is installed and operating and the
remaining 5% withheld until satisfactory performance of the system is obtained.
4-H COMMUNICATIONS CONTEST
Extension Educators, Steve Handegard and Donna Geiser, and Barnhard 4-H member,
Jessica Sedivy, appeared to update the board regarding recent 4-H activities,
specifically Ms. Sedivy's personal accomplishments in 4-H. Jessica won a 10-day all
expenses paid trip to Israel as a result of winning the MN 4-H creative writing contest.
In a question and answer format, Jessica related her Israel experience as well as her
role in dog training leadership and teaching. Commissioners commended Jessica for her
accomplishments, excellent speaking abilities, and wished her well in her future goals.
WEST CENTRAL MINNESOTA HOUSING PARTNERSHIP
Joe Merz of the West Central Minnesota Housing Partnership provided a production
activity map for 1995 and an update of the new developments emerging through the Housing
Partnership.
COPS FAST GRANT
Sheriff, Gary Nelson, and Chief Deputy, Mark Morris, requested approval of the COPS FAST
grant. Morris reported that this is a three year grant and recommended that an
additional officer be hired as a result of these grant monies. Commissioners stressed
that the continuation of this additional position would be contingent upon receiving
grant funds. Motion by Partmann, seconded Lindquist and carried, with Lee opposed, to
authorize the Chair's signature to execute the COPS FAST Award Grant Agreement.
ADJOURNMENT
At 3:05 p.m., Chairman Stone declared the Otter Tail County Board of Commissioners'
meeting adjourned until 9:30 a.m. Tuesday, August 15, 1995.
