HomeMy WebLinkAboutBoard of Commissioners - Minutes - 08/01/19950 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, August 1, 1995 9:30 a.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, August 1, 1995, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman; Harley Windels, Virginia Portmann, Andy Lindquist and Malcolm Lee present. APPROVAL OF MINUTES Motion by Partmann, seconded Lee and unanimously carried to approve the July 25, 1995, minutes as submitted. SERVICE FEE MINIMUM VALUE Service Fee Systems Administrator, Michele Petterson, made the following recommendations to board members: To reduce the solid waste service fee minimum value from 6 points to 3 points for businesses the Solid Waste Department has waste hauler information indicating the business generates .60 tons (3 points) or less of waste. The minimum value for businesses the Solid Waste Department does not have waste hauler information for will remain at 6 points until the business can provide the Solid Waste Department with information showing their service fee should be reduced. When information is provided, the service fee will be reduced to the appropriate amount (no lower than 3 points) to reflect their lower waste generation. Motion by Partmann, seconded Lee and unanimously carried to approve the above policy change as recommended by the Solid Waste Advisory Committee and Michele Petterson, Service Fee Systems Administrator. PALLET JACK Recycling Center Manager, Bob Williams, reported that More-4 Company is willing to give Otter Tail County a used industrial pallet jack to be used in the county's recycling center. The pallet jack has been certified as a safe piece of equipment for county employees to operate, no payment is required, and Otter Tail County can use and dispose of the pallet jack at the county's discretion. Williams stated that this is a result of the good rapport between recycling center employee, Chuck Ehrenberg, and More-4 people. Williams will send a letter of "thanks". Motion by Windels, seconded Lindquist and unanimously carried to accept this pallet jack from More-4 as described above. SKID STEER LOADER 0 Motion by Partmann, seconded Lindquist and unanimously carried to proceed with the 1 proposal to obtain quotes for a skid steer loader as recommended by Recycling Center Manager, Bob Williams. The County Attorney indicated that the proposal to suppliers include that Otter Tail County is limited to acceptance of quotations of less than $25,000. Otter Tail County Board of Commissioners August 1, 1995 Page 2 APPROVAL OF FINAL PLAT -JEWETT LAKE SOUTHSIDE SHORES Motion by Lee, seconded Lindquist and unanimously carried to approve the Jewett Lake Southside Shores Final Plat of James G./Geraldine L. Drechsel, (Section 23, Township 134 North, Range 43 West). APPROVAL OF FINAL PLAT -RAINBOW POINT Land & Resource Director, Bill Kalar, reported that conditions regarding the approval of the Final Plat of Rainbow Point had been met. These conditions included the clean-up of the solid waste dump and obtaining a storm water management permit from the MPCA. Motion by Lee, seconded Partmann and unanimously carried to approve a change to the Final Plat of Rainbow Point such that Out lot A would be subdivided and attached to lots 1 through 9 in an appropriate manner. Motion by Partmann, seconded Windels and unanimously carried to approve the Final Plat of Rainbow Point with the designated change with the understanding that the developer will submit the revised final plat to the Land & Resource Office. HANDOUT Auditor, Wayne Stein, provided board members with copies of the 1993 Guide to City and County Fund Balances. CAPITAL IMPROVEMENT FUND Upon recommendation of Accountant, Mitzi Pederson, a motion was offered by Lee, seconded Partmann, and unanimously carried to approve the establishment of a (Special Revenue Fund) Capital Improvement Fund, and to transfer to this fund from the County Building Special Revenue Fund and from the Capital Expenditure Reserve Special Revenue Fund the July 31, 1995, balances. This transfer will result in the closure of the County Building and Capital Expenditure Reserve Special Revenue Funds. The motion further approved the expansion of the existing Building Committee to include but not limited to a representative from Road and Bridge, Human Services, Auditor's and Treasurer's Office. This committee will be responsible to set-up and maintain a Capital Improvement Plan, to review alternative methods of financing and to make recommendations to the Budget Committee and County Board. MN SCENIC BYWAYS PROGRAM Convention & Visitors Bureau Executive Director, Judy Stringer, updated the board, at their request, on the progress of the Scenic Byways Program. Stringer reported that the byways route will be approximately 150 miles in Otter Tail Cormty and a meeting is set for August 8 with the West Central Lakes Area Group and MnDOT for input into the logo and signage to be used on the byways corridor. Commissioner Lindquist questioned whether Otter Tail County would be affected by restrictions in advertising signage on the byways corridor. Stringer stated that some city streets are affected, in Fergus Falls, six downtown blocks need to be re-zoned for the byways to take that route. Highway Engineer, Rick West, requested materials from Ms. Stringer that explains the laws relative to signage along the byways to assist the County Attorney in determining how this may affect Otter Tail County. RECESS & RECONVENE Chairman Stone declared a recess of the Otter Tail County Board of Commissioners at 10:35 a.m. The meeting was reconvened at 10:50 a.m. 0 (J Otter Tail County Board of Commissioners August l, 1995 Page 3 HIGHWAY PROJECT UPDATE The Highway Engineer updated the board on the CSAH 75, 14 and 31 projects as well as the pending Schmidt's Bridge project. TRAFFIC STUDY APPROVED Motion by Windels, seconded Partmann and unanimously carried to proceed with a traffic study at the intersection of CSAH 8 & BO in the City of Perham to determine if traffic signals are warranted and to authorize the Highway Engineer to obtain a consultant to do this study for the County. RESOLUTION REQUESTING A PRESIDENTIAL DECLARATION OF A MAJOR DISASTER AND AN AGRICULTURAL DISASTER DECLARATION OTTER TAIL COUNTY RESOLUTION NO. 95-40 Upon a motion by Lee, seconded Windels and unanimously carried, the following resolution was adopted: WHEREAS, the County of Otter Tail, Minnesota, has sustained severe losses of a major proportion, as a result of high winds on the dates of July 12 and 13, 1995; and, WHEREAS, Otter Tail County is a public entity within the State of Minnesota; and, WHEREAS, numerous farmers in Otter Tail County have been adversely affected by the following losses which they have sustained: and, Oats Barley Corn Sun Flower Wheat Total Acres $8,500 7,000 66,600 10,000 50,000 Affected Acr9s Percent Loss 2,125 5 l,750 5 25,625 10 3,000 10 12,500 5 WHEREAS, the Otter Tail County ASCS has filed a damage assessment report which supports the need for emergency loans to farmers; NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners, for and on behalf of the citizens of Otter Tail County, request the Governor of the State of Minnesota to petition the President of the United States to declare the County of Otter Tail, Minnesota, to be a major disaster area. BE IT FURTHER RESOLVED, that this request for: 1. The Infrastructure Support Program only, as offered through P.L. 93-288; 2. A USDA Agricultural Disaster Declaration; BE IT FURTHER RESOLVED that the County Emergency Management Director is authorized to coordinate the damage survey teams with iocal government and assist in the administration of the disaster recovery process, as needed. Adopted this lst day of August, 1995. 0 Otter Tail County Board of Commissioners August 1, 1995 Page 4 Dated: COUNTY OF COMMISSIONERS •=''fz;.,;;;£ Larry Krohn, Clerk FUEL OIL TANK Safety & Emergency Services Director, Tim Hunt, reported that a fuel oil tank was discovered by a jogger along a road in Maplewood township. The MPCA was contacted, however, the MPCA does not take action on spills of 100 gallons or less. Motion by Lindquist, seconded Windels and unanimously carried to authorize the Highway Engineer, (after receiving permission from the landowner) to remove the fuel oil tank and any apparent surface spillage, and notify the MPCA of this action. Further, the motion directed the Solid Waste Director and Sheriff's Department to investigate the situation to determine who owned the tank. APPROVAL TO PAY BILLS Motion by Windels, seconded Lindquist and unanimously carried to approve payment of bills per Attachment A of these minutes which includes payment for lodging at Cragun's on behalf of Victim/Witness Coordinator, Lori Wood, Computer Programmer, Sherry Leabo, and Computer Systems Administrator, Kevin Newborg. PREPAID MEDICAL ASSISTANCE PROGRAM Motion by Partmann, seconded Lee and unanimously carried to deny any interest in volunteering for the Prepaid Medical Assistance Program (PMAP) and elect to pull out of consideration of the program at this time. STIPULATION FOR ENTRY OF JUDGEMENT Motion by Windels, seconded Lee and unanimously carried to authorize the Chair's signature on a Stipulation for Entry of Judgement agreement to accept a reduced value for payable 1994 tax for the Lakeland Motel (Lowell & Veronica Benson). WATER TESTING Motion by Lindquist, seconded Windels and unanimously carried to direct the Land & Resource Director to expand the development of the water testing data to include the testing of water that flows into Otter Tail County. ADJOURNMENT At 11:50 a.m., Chairman Stone declared the Otter Tail County Board of Commissioners' meeting adjourned until 1:00 p.m. Tuesday, August 8, 1995.
