HomeMy WebLinkAboutBoard of Commissioners - Minutes - 07/18/1995CJ Q Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Corcnnissioners' Room, Floor l~B Otter Tail County Courthouse Tuesday, July 18, 1995 9:30 a.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, July 18, 1995, at 9:30 a._m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman; Harley Windels, Virginia Partmann, Andy Lindquist and Malcolm Lee present. STATE OF THE COUNTY INSURANCE REPORT MCIT Director, Mike Rhyner, and Meadowbrook Resident Vice-President, Jeff Bowlby, provided the annual State of the County program manual and a comprehensive update. Rhyner and Bowlby discussed the overall MCIT structure, Otter Tail County's participation, and Employee Benefit and Education Training programs. Rhyner stressed the County's favorable workers' compensation performance and commended County staff for developing a progressive risk loss and safety program. WOMEN'S FINANCIAL INFORMATION PROGRAM Extension Educator, Angela Berge, and Andrea Everts, provided handouts to board members relative to the Women 1 s Financial Information program. Berge explained that five financial workshops have been held in different areas of the County with favorable participation. Discussion followed regarding specific topics covered in the workshops. Berge updated the Board on an upcoming 11 share with your neighbor 11 4-H activity. APPROVAL OF MINUTES Motion by Fortmann, seconded Lee and unanimously carried to approve the July 11, 1995, minutes as mailed. JOINT MAINTENANCE GARAGE Highway Engineer_, Rick West, discussed Otter Tail County's preliminary cost of $800,000 for the proposed MnDOT and Otter Tail County joint maintenance salt/sand facility in the City of Perham. West stated that he would not recommend Otter Tail County's participation in this joint venture at this time because of the cost, however, would be interested in additional acreage if MnDOT proceeds with a facility on their own. ANNUAL PARADE -CITY OF HENNING Motion by Partmann, seconded Windels and unanimously carried to approve an annual parade in the City of Henning on July 21, 1995, at 7 p.m. on CSAH 65 subject to the approval of the Sheriff's Department and that Otter Tail County is held harmless regarding potential liability. MINNESOTA SCENIC BYWAYS Motion by Lindquist, seconded Lee and unanimously carried to put Otter Tail County's participation in the Scenic Byways program within Otter Tail County on hold and further, to direct the County Attorney to research the requirements/restrictions for advertising signs along this route. • 0 0 I Otter Tail County Board of Commissioners July 18, 1995 Page 2 MILLING EQUIPMENT Rick West read a letter from Lake Region Electric Cooperative which stated that the approximate cost to run three-phase electrical power to the mill at the Phelps Mill Park is $200 -$225 per month. This would cover only the cost of running the line. The Highway Engineer recommended that Otter Tail County not proceed with this electrical service because of high cost. CLOSED TO PUBLIC RECESS At 11:20 a.m., Chairman Stone declared the Otter Tail County Board of Commissioners' meeting closed to the public for the purpose of Attorney-Client privilege in discussing a pending grievance in the Social Services Department submitted by employee 1 Pauline Tamke. Attorney-Client Privilege is authorized by M.S. 471.705 Subd. ld. Upon completion of brief discussion regarding this grievance, the Board continued in closed session for the purpose of evaluating the performance of Tom Fawcett, Social Services Director, pursuant to M.S. 471.705 Subd. ld(d). A summary report of performance conclusions will be provided at the next regular Board meeting. The Board recessed for lunch break at 11:55 a.m. APPROVAL TO PAY BILLS Motion by Lindquist, seconded Lee and unanimously carried to approve payment of bills per Attachment A of these minutes which includes payment to Grand View Lodge on behalf of Veterans Service Officers, Chet Toso and Jourdan Sullivan. ICE CREAM SOCIAL/BAND CONCERT Motion by Lindquist, seconded Partmann and unanimously carried to approve an ice-cream social/band concert on August 13 at 2 p.m. at the Phelps Mill Park as requested by Richard Osman of the Friends of Phelps Mill committee. CONDITIONAL USE APPLICATION: LEE ROBERTS Land & Resource Director, Bill Kalar, presented a sketch showing the existing ice ridge on Lee Robert's property on Big Pine Lake, the previous recommendation by the Planning Commission and an alternative to these two conditions. Motion by Lee, seconded Partmann and unanimously carried to reconsider earlier action denying the Conditional Use Permit application of Lee Roberts on Big Pine Lake. Upon reconsideration, motion by Lee, seconded Partmann and unanimously carried to approve the Conditional Use Permit as presented by the Land & Resource Director according to specifications discussed with Mr. Roberts on July 13, 1995. CLOSED TO PUBLIC At 1:26 p.m., Chairman Stone declared the Otter Tail County Board of Commissioners closed to the public for the purpose of Attorney-Client Privilege, as authorized by M.S. 471.705 Subd. 1d, to continue discussion of possible settlement of a grievance in the Support Specialist Unit submitted by Pauline Tamke. The Otter Tail County Board of Commissioners' meeting was reconvened in open session at 1:34 p.m. APPROVAL OF ASSESSMENT CONTRACT Motion by Windels, seconded Lindquist and carried, with Lee opposed, to approve the Chair's signature to execute an Assessment Agreement between Otter Tail County and Leaf Lake Township with total compensation for services, in the amount of $3,696.20, subject to the Township1 s approval of the agreement at their next Town Board meeting. ~ Otter Tail County Board of Commissioners July 18, 1995 Page 3 LIQUOR LICENSES Motion by Lindquist, seconded Partmann and unanimously carried to approve the following applications for license: Mosquito Heights Steven Leonard Lehmann Perham, MN On/Off-Sale Non-Intoxicating Malt Liquor License Subject to the approval of the County Attorney's Office. Four Star Promotions Runestone Amphitheater Dennis W. Anderson, Pres. Parkers Prairie, MN On-Sale Non-Intoxicating Malt Liquor License Subject to the approval of the County Attorney's Office. Big Chief Stewart Fenton Fergus Falls, MN Off-Sale Non-Intoxicating Malt Liquor License Subject to the approval of the County Attorney's Office, the County Sheriff's Office and to the submission of all required forms and certificates. Woodland Park Resort Donald Bistodeau On/Off-Sale Non-Intoxicating Malt Liquor License Henning, MN Subject to the approval of the County Attorney's Office, the County Sheriff's Office and to the submission of all required forms and certificates. AUTHORIZATION FOR EXEMPTION FROM LAWFUL GAMBLING No objection was expressed to an application for authorization for exemption from lawful gambling license received from the Fergus Falls Ducks Unlimited. The event is scheduled for August 30, 1995, at Elks Point. APPROVAL FOR PAYMENT Motion by Lee, seconded Lindquist and unanimously carried to amount of $1,386, to Grant's Mechanical, Inc. of Fargo, ND, thermostats during the remodeling at the New York Mills building LEAF LAKES AREA ASSOCIATION approve payment, in the for replacement of 18 per change order M-4. County Coordinator, Larry Krohn, read a letter received from the Leaf Lakes Area Association regarding concern for out dated septic systems and poor water quality. Motion by Lee, seconded Partmann and unanimously carried to approve the placement of West, Middle and East Leaf Lakes on the abatement list for septic system testing by the Land & Resource Department. CLOSED TO PUBLIC At 2:10 p.m., Chairman Stone declared the Otter Tail County Board of Commissioners' meeting closed to the public for the purpose of evaluating the performance of Rick Sytsma, Maintenance Supervisor, pursuant to M.S. 471.705 Subd. ld(d).
