CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, June 20, 1995, at 9:30 a.rn. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman; Harley Windels, Malcolm Lee, Andy Lindquist and Virginia Partmann present. APPROVAL OF MINUTES Motion by Lee, seconded Partmann and unanimously Carried to approve the minutes of June 13, 1995, ··as submitted. CONDITIONAL USE APPLICATION Land & Resource Director, Bill Kalar, presented the Conditional Use Application of Lee Roberts, Big Pine Lake, for approval to pull back an ice ridge with the condition that a 6" berm remains as recommended by the Planning Commission. After viewing the property, Commissioner Windels offered a motion, seconded by Lee to approve the Conditional Use Application as recommended by the Planning Board as there is very little drainage to the lake. The motion failed on a roll call vote as follows: Lindquist Lee Windels Partmann Stone Yes No Yes No No APPROVAL OF FINAL PLAT -THALMANN ADDITION Motion by Lee, seconded Partmann and rmanimously carried to approve the final plat of Delbert G/Brunhilde E. Thalmann, Thalmann Addition to South Oaks, Buchanan Lake, (Section 1, Township 134N, Range 39W, Ottertail Township). SUBDIVISION CONTROLS ORDINANCE Kalar provided copies of the Subdivision Controls Ordinance which includes the recent clarifications. Commissioner Lee directed that copies of this ordinance be sent to those people who attended the recent public hearing to discuss the amendments to the Subdivision Controls Ordinance. APPROVAL OF FINAL PLAT -MAR-CAR ACRES Motion by Lee, seconded Partmann and unanimously carried to approve the final plat of Donald F./Carol R. Roubinek and Kenneth M./Mary J. Davis, Mar-Car Acres, (Section 36, Township 133, Range 41). APPROVAL OF RECYCLING FACILITY CONSTRUCTION PROJECT Motion by Lee, seconded Lindquist and unanimously carried to authorize the signature of the Chair and Clerk on the Contract for Construction for the Otter Tail County Recycling Expansion Project between Otter Tail County and C.I. Construction. 0 0 Otter Tail County Board of commissiOners June 20, 1995 Page 2 LAND SURVEYOR'S CERTIFICATE OF CORRECTION TO PLAT NAME OF PLAT: CLEAR BEACH RESORT Upon a motion by Lee, seconded Partmann and unanimously carried, the following Land Surveyor's Certificate of Correction to the Plat of Clear Beach Resort as prepared by David A. Anderson, Registration No. 13620, was accepted. Pursuant to the provision of Chapter 505.175, Laws of Minnesota, 1957, David A. Anderson, Registration No. 13620, the undersigned, a Registered Land Surveyor in and for the State of Minnesota, declares as follows: 1. That the plat of CLEAR BEACH RESORT, dated August 22, 1921, and filed on September 7, 1921, in the office of the County Recorder, Otter Tail County, Minnesota, in Book J of Plats, Page 47, was prepared by 0. G. Molden, County Surveyor, now deceased. 2. That said plat contains the following omissions to wit: The call along said shore of Fish Lake was omitted from the legal description on said plat. The call North 48 1/2 degrees East 410 feet is in error and should be 470 feet. The legal description calls "Beginning at a point on the shore of Fish Lake 643 feet south from the northwest corner of the Southwest Quarter of the Northeast Quarter of said Section 2. The plat shows this dimension to be 645 feet. The correct dimension is 645 feet. The west line of said Southwest Quarter of the Northeast Quarter was omitted from the legal description on said plat. There are various bearings on the plat that are in error. The correct bearing measurements are shown on sheet 2 as attachment B of the official minutes. 3. That the legal description on said plat is hereby corrected as follows, to wit: Beginning at a point on the west line of said Southwest Quarter of the Northeast Quarter and on the shore of Fish Lake 645 feet south from the northwest corner of the Southwest Quarter of the Northeast Quarter of said Section 2; running thence run North 58 degrees East 360 feet along the shore of said Fish Lake; thence North 48 1/2 degrees East along said shore of Fish Lake 470 feet; thence North 62 degrees East along said shore of Fish Lake 350 feet; thence North 53 1/2 degrees East 148 feet; thence South 64 degrees West 150 feet; thence South 83 degrees West 200 feet; thence South 48 degrees West 460 feet; thence South 57 degrees West 277 feet to the west line of said Southwest Quarter of the Northeast Quarter; thence South along said west line of said Southwest Quarter of the Northeast Quarter 164 feet to place of beginning. The undersigned hereby certifies that he reviewed and approved this Certificate of Correction to Plat. David A. Anderson, Registered Land Surveyor, Minnesota Registration No. 13620 The above Land Surveyors Certificate of Correction to the Plat of CLEAR BEACH RESORT has been approved by the Board County Commissioners of Otter Tail County, Minnesota, this 20th day 9f 1995 Otter Tail County Attest: Tail County Board 0 0 Otter Tail County Board of Commissioners June 20, 1995 Page 3 APPROVAL OF FINAL PAYMENT -RAPP CONSTRUCTION, INC, Motion by Windels, seconded Lindquist and unanimously carried to approve final payment, in the amount of $9,942, to Rapp Construction, Inc. of Alexandria, MN, for completion of their portion of project 9404 (office remodeling at New York Mills). REQUEST FOR ABATEMENT Auditor, Wayne Stein, presented an ,abatement request of Tina Lundeen. Motion by Lindquist, seconded Windels and unanimously carried to deny abatement of accrued penalties, in the amount of $32.50, as there was not an error on the part of the County. MINNESOTA RIVER CLEAN-OP PROJECT Commissioner Lee reviewed material sent to him by the Association of Minnesota Counties regarding the Minnesota River Clean-Up Project. Motion by Lee, seconded Windels and unanimously carried to decline joining the Joint Powers Board Minnesota River Clean-up Project because of the high water quality of the Pomme-de-Terre River and the small area of the County in the watershed. HIGHWAY PROJECT UPDATES Highway Engineer, Rick West, updated Board members regarding several highway projects including CSAH #'s 75, 14, 84, 31 and 3. APPROVAL TO PAY BILLS Motion by Lindquist, seconded Lee and unanimously carried to approve payment of bills per Attachment A of these minutes. REPLACEMENT OF PATROL VEHICLE Chief Deputy, Mark Morris, reported that a patrol vehicle ('93 Crown Victoria) had been totalled-out in an accident. The County will receive $11,600 from the insurance company. Motion by Lindquist, seconded Lee and unanimously carried to authorize the purchase of a replacement vehicle at an approximate cost of $17,000 through the State Contract subject to acquiring bids from local dealers for a comparable vehicle. MEETING SCHEDULED WITH TEAMSTERS REPRESENTATIVE Motion by Lee, seconded Windels and unanimously carried to set a union grievance meeting with a Teamsters Local 320 representative for Friday, June 30, 1995, at 1 p.m. or schedule for the following Friday (July 7) and to designate the Personnel Committee to represent Otter Tail County. The Personnel Committee members are Commissioner Windels and Commissioner Partmann. Commissioner Lindquist will represent Commissioner Partmann if the meeting is held on June 30, 1995. CLOSED TO PUBLIC At 11:25 a.m.1 Chairman Stone declared the meeting of the Otter Tail County Board of Commissioners closed to the public for the purpose of Attorney-Client privilege pursuant to M.S. 471.705 Subd. ld to discuss the following pending employee grievance matters: 1) Human Services Professional Unit regarding an issue of mileage reimbursement, 2) Human Services Support Specialists Unit regarding an issue of pay equity, 3.) Human Services Support Specialists Unit regarding seniority provisions relative to hiring procedures, and 4) Human Services Support Specialists Unit regarding allegations of retaliatory harassment.
