HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/23/1995Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, May 23, 1995 1:00 p.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday/ May 23, 1995, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman; Harley Windels, Malcolm Lee, Virginia P?rtmann and Andy Lindquist present. APPROVAL OF MINUTES Motion by Lee, seconded Partmann and unanimously carried to approve the minutes of May 16, 1995, as submitted. BID OPENING -LOADER, TRACTOR/MOWER At 1:03 p.m., after having previously advertised for bids, the Highway Engineer opened the following bids for one 85 H.P. Loader, Tractor/Mower: Carlson Tractor & Equipment Co. Rosemont, MN Fergus International, Inc. Fergus Falls, MN Gulbranson Equipment Park Rapids, MN Interstate, Inc. Fergus Falls, MN $79,037.91 72,233.63 70,816.11 70,000.32 St. Joseph Equipment 70,077.00 Shakopee, MN The Highway Engineer will review the bids and return to the Board in two weeks with a recommendation for award. BID OPENING -1995 TRAFFIC MARKING After having previously advertised for bids, the Highway Engineer opened the following bids for the 1995 Traffic Marking: A.A.A. Striping Service, Co. Rogers, MN Traffic Marking, Inc. Buffalo, MN $88,248.00 86,035.38 The Highway Engineer will review the bids and return to the Board in two weeks with a recommendation for award. CSAH NO, 84 -NEW YORK MILLS IMPROVEMENTS, S.A.P, 56-684-01 Motion by Partmann, seconded Windels and unanimously carried to authorize the Chair's signature to execute the contract for Construction of Utility and Street Improvements, CSAH No. 84 project, with Mark Sand & Gravel Co. as previously awarded. w 0 0 Otter Tail County Board of Commissioners May 23, 1995 Page 2 SEASONAL SUPPLY OF HOT MIX BITUMINOUS -EAST OTTER TAIL Motion by Lee, seconded Windels and unanimously carried to authorize the Chair's signature to execute the contract for Seasonal Supply of Hot Mix Bituminous (East Otter Tail) with Wadena Asphalt, Inc. as previously awarded. OTTER TAIL COUNTY HALL OF FAME PROPOSAL Historical Society Executive Director, Chris Schuelke, explained the research comple_ted by a committee regarding a county 11Hall of Fame" proposal. One of the main reasons the committee did not recommend the proposal was the potential problems in deciding criteria to be used in determining eligibility for hall of fame status. Schuelke expressed desire in spending time and money towards writing a comprehensive county history book. Commissioner Lee thanked Schuelke for the time spent considering this proposal. FRIENDS OF PHELPS MILL UPDATE Chris Schuelke reported that a self-guided tour brochure for Phelps Mill will soon be complete and that ConAgra has donated a grinding stone which shows how flour was ground. Board members explained that electricity was not adequate at the park for this grinding stone and suggested that Schuelke check on the weight of the stone. Motion by Partmann, seconded Lee and unanimously carried to approve the sale, on special holidays, of tote bags, aprons and other items imprinted with the original mill logo by the 11 Friends of Phelps Mill 11 committee; further, a specific policy stating that all proceeds must be returned to the Phelps Mill park and anyone wishing to sell items at the park must receive prior approval by the Otter Tail County Board of Commissioners. OVERALL ECONOMIC DEVELOPMENT PLAN West Central Initiative Fund Senior Program Specialist, John Molinaro, appeared to request support for the WCIF's update of the region's Overall Economic Development Program (OEDP). Gordon Hydukovich of the City of Fergus Falls appeared to answer the Chair 1s questions relative to Tax Increment Financing districts. General economic development discussion followed. 1995-96 OVERALL ECONOMIC DEVELOPMENT PROGRAM UPDATE RESOLUTION OTTER TAIL COUNTY RESOLUTION #95-31 Upon a motion by Partmann, seconded Lee and unanimously carried, the following resolution was adopted: WHEREAS, in 1991 the West Central Minnesota Initiative Fund prepared an Overall Economic Development Program (OEDP) for the region containing Becker1 Clay, Douglas, Grant, Otter Tail Pope, Stevens, Traverse1 and Wilkin Counties of Minnesota (west central Minnesota), and WHEREAS 1 that OEDP contained background, analysis, economic data goals and objectives for the betterment of the region, and WHEREAS, availability of an approved OEDP and related annual updates are a condition for qualifying for grants for local economic development projects from the Economic Development Administration of the U.S. Department of Commerce, and WHEREAS, the Economic Development District Board of the West Central Minnesota Initiative Fund has prepared and approved an annual update of the regional OEDP for 1995-1996, 0 0 () Otter Tail County Board of Commissioners May 23, 1995 Page 3 NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Otter Tail County, Minnesota, approved the 1995-96 update of the Overall Economic Development Program for west central Minnesota. Dated: ~ 11,Ki fo, I 92-s: Otter Tail County of Commissioners RECREATIONAL TRAIL PERMIT Duane Rose, OCTA, and Jim Schoeneck, MnDOT, appeared relative to the Central Lakes Trail permit. Rose pointed out the areas of this recreational trail that are in Otter Tail county. Rose explained that OCTA maintains liability insurance for their trails and the county is acting as a sponsoring agent under the Grant and Aid Trail System. Motion by Lindquist, seconded Partmann and unanimously carried to authorize the Chair's signature on a trail permit for the Central Lakes recreational trail through Otter Tail County within the right-of-way of State Rail Bank Property, project S.P. 5600, issued by MnDOT, contingent upon the review and approval of the County Attorney. AUTHORIZATION FOR EXEMPTION FROM LAWFUL GAMBLING LICENSE No objection was expressed for an application for Authorization for Exemption from Lawful Gambling License submitted by the Holy Cross Church, New York Mills, for an event scheduled September 10, 1995. Cheryl Lynn Strom Perham, MN On-Sale Liquor License and On-Sale Sunday Liquor License PAYMENT APPROVED Motion by Lee, seconded Partmann, and unanimously carried to approve payment from the Tax Forfeited Land Sale Fund, in the amount of $2,006 to John Kamphake Construction, for the following services performed on property legally described as Lot 14, Block 23 of Lakeview Addition, City of Parkers Prairie: Building Demolition Backfill Basement (160 yds@ $2/yd) Fill Well (20 yds@ $3/yd) Demolition Disposal (210 yds@ .60/yd.) $1,500.00 320.00 60.00 126.00 $2,006.00 APPLICATION FOR ONE-DAY OFF-SITE LAWFUL GAMBLING OTTER TAIL COUNTY RESOLUTION #95-32 Upon a motion by Lindquist, seconded Partmann and unanimously carried, the following resolution was adopted: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board/ and WHEREAS, the Eagle Lake Sportsmen Club, Ashby, MN, has made an application to the Gambling Control Board for a one-day off-site permit to conduct lawful gambling, on June 18, 1995 at the Eagle Lake Park in Eagle Lake Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling, on June 18, 1995, by the Eagle Lake Sportsmen Club, Ashby, MN, at the Eagle Lake Park in Eagle Lake Township of Otter Tail County. NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling, on June 18, 1995, by the Eagle Lake Sportsmen Club, Ashby, MN, at the Eagle Lake Park in Eagle Lake Township of Otter Tail County, provided that the application meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Town Board of Eagle Lake Township by sending them a copy of this resolution. Dated: Otter Tail County By w• d of Commissioners Larry Krohn, Clerk 0 0 Otter Tail County Board of Commissioners May 23, 1995 Page 5 REQUEST FOR FORGIVENESS OF PENALTY AND INTEREST Motion by Portmann, seconded Windels and carried with Lee abstaining, to deny a request from Nellavon Chinn Grina for forgiveness of penalty and interest based on current tax payment policy. WETLAND EASEMENT ACQUISITION Don Kleven, U.S. Fish & Wildlife Service, met with the Board to request acquisition of lands. Motion by Lindquist, seconded Windels and unanimously carried to approve a waterfowl easement from Floyd Hanson on the following described lands: T. 131 N., R. 39 W., 5th P.M. Section 31, E 1/2 SE 1/4 BID AWARD -RECYCLING CENTER BUILDING EXPANSION Solid Waste Director, Mike Hanan, reported that county staff have reviewed the bids submitted for the Recycling Center Building Expansion Project. During the review of the bids, it was determined that OSM had omitted from the bid specifications the requirement that contractors must meet the prevailing wage rate according to M.S. Chapter 177.41- 177.43. Hanan provided a memo to Board members explaining the difference between state and federal prevailing wages, Minnesota Statute requirements and several options to proceed with a bid award, and/or an option to consider should the Board not wish to proceed with the bid award at this time. Information had been received from both bidders in response to the question of whether or not their individual bids included a consideration of prevailing wage rate. Motion by Windels, seconded Lindquist and carried, with Stone opposed, to award the Recycling Center Building Construction Expansion project to C.I. Construction of Alexandria, MN, at an additional cost of $66,000 to meet Minnesota Prevailing Wage requirements, listing in the contract the wage rates and benefits specified by the Minnesota Department of Labor and Industry, according to M.S. 177.41-177.43. Total bid award is $1,409,300. The motion further directed that the contract should include a clause stating that Otter Tail County intends to appeal the wage rates established by the Department of Labor and Industry and should the county win its appeal, Otter Tail County would complete the project under the newly established fee schedule. The commissioners directed the appeal to be handled by County Attorney, Wally Senyk. MINNESOTA DEPARTMENT OF CORRECTIONS RESOLUTION AUTHORIZING EXECUTION OF CONTRACTS FOR HOUSING INMATES OTTER TAIL COUNTY RESOLUTION #95-33 Upon a motion by Lee, seconded Partmann and unanimously carried, the follo~ing resolution was adopted: BE IT RESOLVED that on May 9, 1995, the Otter Tail County Sheriff's Department approved a contract with the State of Minnesota for fiscal year 1996.
