HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/16/19950 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, May 16, 1995 9:30 a.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, May 16, 1995, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman; Harley Windels, Malcolm Lee, Virginia Partmann and Andy Lindquist present. APPROVAL OF MINUTES Motion by Partmann, seconded Lee and unanimously carried to approve the minutes of May 9, 1995, as submitted. MINNESOTA RIVER BASIN JOINT POWERS AGREEMENT Chairman Stone presented a resolution to support the adoption of a Joint Powers Agreement to provide for the creation of the Minnesota River Basin Joint Powers. Motion by Lee, seconded Windels and unanimously carried to reject the adoption of this resolution as only a very small portion of the Minnesota River Basin is in Otter Tail County. The Chairman directed the County Coordinator to write a letter to James Mulder, Association of Minnesota Counties, to Convey the decision of the Board. CONSERVATION DAYS 4-H Educators, Donna Geiser and Steve Handegaard, along with Recycling Educator, Marie Tysdal, presented an overview of Conservation Days and provided handouts and photographs of this years program. Ms. Geiser reported approximately 880 fifth grade students participated in Conservation Days held May 1 -4, 1995. The goal is to create student centered events to promote student involvement. Ms. Tysdal explained the topics covered during Conservation Days including soil sampling, learning parts of a tree, water quality, wildlife, and recycling. Handegaard showed the Board an example of how the teachers use Conservation Days topics and incorporate them into other classes; i.e. writing "Thank You11 notes. PROPOSED WADENA AIRPORT Attorney, Mark Hansen, City Administrator, Brad Swenson, and Zoning and Planning Director, Bill Belch, appeared relative to the proposed Wadena Airport which would involve Compton and Bluffton Townships in Otter Tail County. Mr. Belch explained that the City of Wadena is not able to add on to their existing airport, therefore, have selected a different site which has been FAA approved. A Joint Zoning Board has been established. The Joint Zoning Board has voted to utilize the Otter Tail County Board of Adjustment as its Board of Adjustment in case there are any zoning appeals. County Attorney, Wally Senyk, reviewed State Statute relative to this matter. Motion by Lee, seconded Partmann and unanimously carried to authorize the Otter Tail County Board of Adjustment to serve as the Board of Adjustment for the Wadena Municipal Airport Zoning Ordinance subject to the County Attorney's review of case law. Johnson Pelican Rapids, MN Big Pine Resort DeeJon Enterprises Henning, MN Corner Store Thomas Frank Stich Battle Lake, MN Perham Oasis Division of Perham Co-op Creamery Perham, MN 56573 Lakeside Market Jim Vie Battle Lake, MN Off-Sale Non-Intoxicating Malt Liquor License Off-Sale Non-Intoxicating Malt Liquor License On/Off-Sale Non-Intoxicating Malt Liquor License Off-Sale Non-Intoxicating Malt Liquor License Off-Sale Non-Intoxicating Malt Liquor License Off-Sale Non-Intoxicating Malt Liquor License Subject to the approval of the County Attorney and the County Sheriff's Office. PAYMENT APPROVED Motion by Lindquist, seconded Partmann and unanimously carried to approve payment from the Tax Forfeited Land Sale Fund, in the amount of $300.00, to Robertson Well Drilling, Inc., for the sealing of a well located on Lot 14, Block 23 of Lakeview Addition, City of Parkers Prairie. OTTER TAIL WATER MANAGEMENT DISTRICT BOARD APPOINTMENTS Motion by Lindquist, seconded Lee and unanimously carried to appoint Morris Heyen to a vacant position expiring on June 30, 1997, and to reappoint Norman Neset and Warren Stavaas to four year terms commencing July 1, 1995, on the Otter Tail Water Management District Board as recommended. TAX INCREMENT FINANCING DISTRICT PUBLIC HEARING NOTICE REQUIREMENT The Fergus Falls Port Authority and the City Council will conduct a joint public hearing at 7:30 p.m. on Monday, June 5, 1995, to consider the formation of Tax Increment Financing District No. I 1-9. County Auditor, Wayne Stein, read a letter received May 12, 1995, from the City of Fergus Falls stating that according to Minnesota Statute a thirty day notification is required to hold this public hearing unless the County Board waives the requirement. Motion by Partmann, seconded Lee and unanimously carried to waive the thirty day requirement as the notice was only one week late. 0 0 Otter Tail County Board of Commissioners May 16, 1995 Page 3 REQUEST FOR FORGIVENESS OF PENALTY AND INTEREST County Auditor, Wayne Stein, discussed with the Board, a request for forgiveness of penalty and interest on parcel #23, Everts Township. Discussion centered around delinquent taxes, title conveyances and property assessment. Motion by Lindquist, seconded Windels and unanimously carried to deny the request for forgiveness of penalty and interest on parcel #23, Everts Township, currently owned by Thomas Brosowski to be transferred to Roland Mann. Otter Tail County did not make an error in this situation. RECESS AND RECONVENE Chairman Stone declared the Otter Tail County Board of Commissioners recessed at 11:00 a.m. for a short break. The Board reconvened at 11:08 a.m. CONTRACTS APPROVED Motion by Partmann, seconded Windels and unanimously carried to authorize the Chairman's signature on the following contracts subject to the approval of the County Attorney: 1) Otter Tail County and Minnesota Department of Corrections for Housing Inmates with a per diem agreement of $50 and 2) Otter Tail County and Minnesota Department of Corrections for Work Release Services with compensation agreement of $50 per day. The contracts are effective from July 1, 1995 through June 30, 1996. APPROVAL TO PAY BILLS At 1:02 p.m., a motion was offered by Lee, seconded Windels and unanimously carried to approve payment of bills per Attachment A of these minutes. CSAH #31 RIGHT-OF-WAY ACQUISITION PUBLIC HEARING After completion of notice requirements, the CSAH #31 right-of-way acquisition public hearing for acquisition of property described as (Government Lot 1, Section 9, Township 136 North, Range 42 West) was held May 16, 1995, at 1:03 p.m. The property is owned by Mr. Lyle Hosterman and has been appraised at $656.25. There was no one in attendance representing Mr. Lyle Hosterman and there was no public representation either for or against this acquisition. A motion was offered by Lee, seconded Lindquist and unanimously carried to authorize the acquisition under M.S. 163.12 of the above described property for right-of-way purposes for the CSAH #31 project contingent upon viewing of the property by the County Board members. The motion further authorized issuance of a check to Mr. Lyle Hosterman, in the amount of $656.25, to be put on deposit in the County Auditor's Office pursuant to M.S. 163.12 upon completion of viewing of the property at the close of regular County Board business today. JULY 4TH PARADE REQUEST Motion by Lindquist, seconded Partmann and unanimously carried to approve the request of Pat Garza for a July 4th parade to be held along a portion of Otter Tail Lake contingent upon approval of the Sheriff's Department. STIPULATION FOR ENTRY OF JUDGEMENT Motion•by Lee, seconded Partmann and unanimously carried to authorize the Chairman's signature to execute a Stipulation for Entry of Judgement in the tax appeal matter of Demetre Nicoloff vs Otter Tail County. 0 0 0 Otter Tail County Board of Commissioners May 16, 1995 Page 4 VETERANS SERVICE OFFICE Veterans Service Officer, Chet Toso, appeared relative to possible disciplinary action tabled at the May 91 1995, County Board meeting. After discussion, a motion was offered by Portmann 1 seconded Windels and unanimously carried to continue the matter for three weeks. MEETING CONVENED VIEWING OF LYLE HOSTERMAN PROPERTY At 1:50 p.m., the Chairman declared the Otter Tail County Board of Commissioners adjourned. The meeting reconvened at the Lyle Hosterman property at 2:40 p.m. with Commissioners Stone1 Lee1 Partmann and Windels present. Upon viewing the property/ the County Board concurred with the value of $656.25 established by the appraisal and authorized the previous motion to stand.
