HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/09/19950 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, May 9, 1995 1:00 p.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, May 9, 1995, at 12:59 p.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman; Harley Windels, Malcolm Lee and Virginia Partmann present. Commissioner Andy Lindquist absent. APPROVAL OF MINUTES Motion by Partmann, seconded Windels and unanimously carried to approve the minutes of May 2, 1995, as submitted. SOLID WASTE ADVISORY BOARD Motion by Lee, seconded Partmann and unanimously carried to appoint Paul Larson, Henning, MN, to the Solid Waste Advisory Board, effective immediately, to replace the current term of Lyle Rosenow. LAND SURVEYORS CERTIFICATE OF CORRECTION TO PLAT NAME OF PLAT: JERRY'S BREEZY BEACH Motion by Lee, seconded Partmann and unanimously carried to accept the following Land Surveyor's Certificate of Correction to the Plat of Jerry's Breezy Beach as prepared by Roy A. Smith, Land Surveyor, Minnesota Registration No. 12004 Pursuant to provision of Chapter 472, Laws of Minnesota, 1995, and Chapter 505.173 through 505.177, Laws of Minnesota, Roy A. Smith, the undersigned, a Registered Land Surveyor in the State of Minnesota declares as follows: (1) The subdivision plat of JERRY'S BREEZY BEACH was prepared by John E. Howard, a Registered Land Surveyor who is now deceased. (2) The subdivision plat of JERRY'S BREEZY BEACH was filed on November 2nd, 1948 in the office of the County Recorder in and for Otter Tail County, Minnesota and was recorded in Book M of Plats on page 84. (3) (4) The subdivision plat of JERRY'S BREEZY BEACH contains an error in that it incorrectly refers to the south line of the Plat as the south line of Government Lot 1 1 Section 14, Township 135, Range 39. The description of the property platted and dedicated as JERRY'S BREEZY BEACH is hereby amended and corrected to plat and dedicate the following described real property situate in Otter Tail County, Minnesota: Beginning at a point on the east line of said Government Lot 1, Two Hundred Sixty-two and Two-tenths (262.2) feet North of meander corner #35; thence S 58 degrees 12 minutes w Two Hundred Seventy and 5/10 (270.5) feet; thence S 49 degrees 42 minutes w, O~e Thousand Thirty-eight and Five-tenths (1038.5} feet; thence s 89 degrees 59 minutes E Three Hundred Sixty and One-tenth (360.1) feet, more or less to the shore of Rush Lake; thence following the shore line northeasterly Eight Hundred and Sixty-two and Nine-tenths feet(862.9) feet to 0 Otter Tail County Board of Commissioners May 9, 1995 Page 2 meander corner #35; thence North on the Section line to the point of beginning, that the roadways shown on the Plat are dedicated to the public use. Heisler Country Store Marvin and Sandy Heisler Vergas, MN Off-Sale Intoxicating Malt Liquor License Subject to the approval of the County Attorney. 0 Otter Tail County Board of Commissioners May 9, 1995 Page 3 APPLICATION FOR AUTHORIZATION F9R EXEMPTION FROM LAWFUL GAMBLING LICENSE No action was taken on an application for Authorization for Exemption from Lawful Gambling License submitted by the St. James Church at Maine, Battle Lake, MN", for an event scheduled on July 23, 1995. DITCH #28, STONY ARCH BRIDGE Ditch Inspector, Tiny Holm, provided photographs of the Stony Arch Bridge in the Ditch #28 Drainage System. Holm explained that the bridge is in disrepair and if the stones from the bridge fall into the creek, Otter Tail County will be responsible to clean it out. County Attorney, Wally Senyk, reported that this is a privately owned bridge constructed before March 25, 1947, therefore, the Ditch Authority may assume responsibility for maintenance. Holm questioned where the money would come from if a clean-out is required. Holm read a letter received from the Dead Lake Property Owners Association informing the Board that the owner is willing to donate the land and another private landowner is willing to donate $50,000 toward the preservation of the bridge as an 11 Historic Landmark11 • Holm explained that preservation of the bridge would cost more than $50,000 and the message that Otter Tail County did not have funds available for this use was conveyed to the Historical Society. Holm asked if an assessment to each ditch to provide money for beaver clean-out and ditch maintenance would be a possibility? The Board directed the Ditch Inspector and the County Attorney to work on a plan to provide funds for beaver control and ditch maintenance without redetermination of benefits and return to the Board. Hanson/Ambrose Klinnert, Little Long and Round Lakes, Star Lake Township as recommended by the Planning Commission. ~tter Tail County Board of Commissioners May 9, 1995 Page 4 Motion by Lee, seconded Windels and unanimously carried to approve the following preliminary plats with conditions as recommended by the Planning Commission: W Preliminary Plats: 0 0 Doug Haugen, Blyberg's Point, Bass Lake, (Sec. 17, Twp. 137, Range 42) Land & Resource Director, Bill Kalar, reported that lots 6, 7, & 8 have been viewed as requested by the Planning Commission and finds that they are adequate to support a small building site and a sewage system as required by the Ordinance. Thomas & Margith Meis, Homestead Development, Deer Lake, (Sec. 6, Twp. 1331 Range 40) Metes & Bounds Subdivision: Motion by Portmann 1 seconded Windels and unanimously carried to approve the metes and bonds subdivision of Douglas Kramer/Lyle J. Kachelmyer with conditions as recommended by the Planning Commission and to place a restrictive covenant stating 11 access to the lake is to be limited to wooden walkways11 is placed on the deed of tracts H1 I, J & K. PATROL VEHICLE PURCHASE Chief Deputy, Mark Morris, and Captain, Joe Peloquin, met with the Board regarding purchase of patrol vehicles. Captain Peloquin explained to the Board that the five Chevrolet Caprice patrol cars purchased this year through the State Contract would not be available this year. A letter from Chevrolet promised to honor the purchase agreement when the cars were built at the initial purchase price. Morris explained that this helps them for next year, however, they still have a dilemma this year. Generally, there are five patrol cars replaced each year. Motion by Windels 1 seconded Portmann1 and carried, with Lee abstaining to authorize purchase of five patrol vehicles, at an approximate cost of $400 over the State Contract Bid, from Superior Ford in Plymouth, MN, after verifying by computer network at a Ford dealership that a similar patrol package on a comparable purchase basis is not available. The motion further authorized to hold the State Contract bid for 1996 patrol vehicles. PAYMENT APPROVAL OF COMPUTER COMMUNICATION DESIGN Motion by Partmann, seconded Lee and unanimously carried to approve payment, in the amount of $47,200, to Business Records Corporation (BRC) for network implementation professional services as recommended by MIS Director, Tim Brand. This provides for Phase I of a multi-phase building block computer project. RECESS & RECONVENE Chairman Stone declared a recess of the Otter Tail County Board of Commissioners at 2:31 p.m. and reconvened the board meeting at 2:45 p.m. HIGHWAY DEPARTMENT CONTRACT Motion by Portmann, seconded Windels and carried, with Lee abstaining, to authorize the Chairrnan 1 s signature on the following Highway Department contract as previously approved: SEASONAL SUPPLY OF HOT MIX BITUMINOUS -NORTH OTTER TAIL Sherbrooke Asphalt, Inc. \,A "Otter Tail County Board of Commissioners II May 9, 1995 Page 5 0 0 VETERANS SERVICE OFFICE Veterans Service Officer, Chet Toso, appeared before the Board regarding possible disciplinary action in response to allegations filed by an employee. The Board heard Mr. Toso's response to the allegations and tabled any action for one week. ADJOURNMENT At 4:35 p.m., Chairman Stone declared the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. Tuesday, May 16, 1995.
