HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/02/19950 u Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, May 2, 1995 9:30 a.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, May 2, 1995, at 9:31 a.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman; Harley Windels1 Andy Lindquist and Virginia Partmann present. Commissioner Malcolm Lee was absent. APPROVAL OF MINUTES Motion by Partmann, seconded Lindquist and unanimously carried to approve the minutes of April 25, 1995, as submitted. WATER PATROL Chief Deputy, Mark Morris, requested a 3\ salary increase for Water Patrol Officers effective the beginning of the 1995 summer season. Motion by Partmann, seconded Lindquist and unanimously carried to approve a 3\ salary increase for Water Patrol Officers as recommended by Mr. Morris. WETLAND EASEMENT ACQUISITIONS Don Kleven, U.S. Fish and Wildlife Service, met with the board to request acquisition of lands. Motion by Lindquist, seconded Windels and unanimously carried to approve the following waterfowl acquisitions: Donna Johnson T. 131 N., R. 41 W., 5th P.M. Section 17, SWl/4 NEl/4, NWl/4 SEl/4 Kenneth A. Wischnak et al T. 137 N., R. 41 W., 5th P.M. Section B Richard A. Stegeman, T. 137 N. R. 41 W. 5th P.M. Section 17, SWl/4 NWl/4 Section 18, Government Lot 1, NEl/4 SEl/4 ACQUISITION OF BAKKE AND EVENSON TRACTS Mr. Kleven provided Commissioners and Auditor, Wayne Stein, with a handout and graph showing the impact of two proposed acquisitions {Bakke and Evenson) on Otter Tail County revenue. Kleven explained the state aid to schools and the Refuge Revenue Sharing Act. The Revenue Sharing Act provides that shared revenue funds may be distributed to offset any tax loss to local units of government. Motion by Lindquist, seconded Windels and unanimously carried to approve acquisitions of the following two tracts, with Aastad Township receiving the same amount of funds the township would receive under private ownership, Otter Tail County receiving 0 0 0 Otter Tail County Board of Commissioners May 2, 1995 Page 2 the same amount of funds and the extra dollars to be put in savings. The motion further acknowledged that the school district is allowed to go to the State to offset any loss of funds by these two acquisitions: Eugene L. Evenson T. 131 N., R. 43 W., 5th P.M. Section 3, SWl/4 SWl/4, SE1/4SW1/4 except the north 14 chains, SWl/4 SEl/4 except the north 14 chains Burnell T. Bakke T. 131 N. R. 43 W. 5th P.M. Section 3, Wl/2 SWl/4 NWl/4, Wl/2 SEl/4 SWl/4 NWl/4, Wl/2 NWl/4 SWl/4, Wl/2 El/2 NWl/4 SWl/4 APPLICATION FOR ONE-DAY OFF-SITE LAWFUL GAMBLING OTTER TAIL COUNTY RESOLUTION #95-30 Upon a motion by Lindquist, seconded by Portmann and unanimously carried, the following resolution was adopted: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Eagle Lake Sportsman, Ashby, MN, has made an application to the Gambling Control Board for a one-day off-site permit to conduct lawful gambling, on June 25th1 1995, at the Eagle Lake Park in Eagle Lake Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit; and WHEREAS 1 the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling, on June 25th, 1995, by the Eagle Lake Sportsman, Ashby, MN at the Eagle Lake Park in Eagle Lake Township of Otter Tail County. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling, on June 25th, 1995, by the Eagle Lake Sportsman, Ashby, MN, at the Eagle Lake Park in Eagle Lake Township of Otter Tail County1 provided that the application meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Town Board of Eagle Lake Township by sending them a copy of this resolution. Dated: '11'.1"1' 'l /'795 "'""'~4£ Larry Krohn, Clerk Otter By .> County ,- William Stone, Chairman LIQUOR LICENSES f Commissioners Motion by Lindquist 1 seconded Partmann and unanimously carried to approve the following application for license subject to the approval of the Sheriff and County Attorney and w 0 Otter Tail County Board of Commissioners May 2, 1995 Page 3 to the submission of necessary transfer of title and insurance papers: Vacationland Resort Lynn Johnson Battle Lake, MN On-Sale Non-Intoxicating Malt Liquor License PHELPS MILL PARK Highway Engineer, Rick West, and Phelps Mill Festival Chairperson, Teresa Brause, addressed the board regarding several improvements at the Phelps Mill Park. West indicated that there is a need to update the septic system and the well at the caretaker's building. Some painting is also required as well as upgrading the electrical service in the park. Ms. Brause stated that there have been vendors at the annual festival that have had problems with the current electrical service. Motion by Lindquist, seconded Partmann and unanimously carried to approve the well, septic, and painting needs as previously authorized in the '95 Phelps Mill budget and Phase I (approximately one-half of the project) of a two-year plan to upgrade the electrical service and wiring in the park. The Highway Engineer was further directed to obtain quotations for each separate aspect of improvements at the park. In addition, Ms. Brause received approval to install wiring for a P.A. addressing system when the trenching takes place for the electrical wires. CSAH #31 RIGHT-OF-WAY ACQUISITION Motion by Windels, seconded Lindquist and unanimously carried to change the hearing date for Mr. Lyle Hosterman regarding the CSAH #31 right-of-way acquisition from 1:00 p.m., May 9, 1995, to 1:00 p.m., May 16, 1995. This delay of one week will ensure proper notice requirements. ADVERTISEMENT FOR SALE OF PERHAM BUILDING Motion by Windels, seconded Partmann and unanimously carried to approve publishing the advertisement for the sale of the Perham building (bid opening date set for 1:00 p.m. on June 6, 1995) three times in the Fergus Falls Daily Journal as required by law and three times in the Perham Enterprise as recommended by the County Attorney. RECYCLING CENTER BUILDING CONSTRUCTION Solid Waste Director, Mike Hanan, met with the board regarding the Recycling Center building construction bids. Motion by Partmann, seconded Lindquist and unanimously carried to authorize the Solid Waste Director to proceed with negotiations with the low bidder, C.I. Construction, Inc. of Alexandria, MN, not to exceed the bid amount of $1,336,500 plus $6,800 for explosive proof light fixtures, for the construction of the Recycling Center building as previously designed. CAPITAL ASSISTANCE GRANT AGREEMENT Motion by Windels, seconded Partmann and unanimously carried to authorize the signatures of the Chairman and Clerk on the Capital Assistance Grant Agreement between the Minnesota Office of Environmental Assistance {OEA) and Otter Tail County pertaining to the proposed regional recycling and household hazardous waste facility. VACCINATIONS APPROVED Solid waste Director, Mike Hanan, reported that there are "sharps" being found in the waste stream at the Recycling Center. Hanan stated that the Minnesota Department of Labor and Industry has recommended that anyone 11 at risk" should be vaccinated for Hepatitis. Motion by Partmann, seconded Lindquist and unanimously carried to approve 0 0 0 Otter Tail County Board of Commissioners May 2, 1995 Page 4 vaccinations for Hepatitis for approximately 25 recycling and transfer site workers at an approximate cost of $105 per person. The motion further directed that this expense be paid for from the Safety Reserve Fund. ETHANOL PRODUCTION PLANT RESOLUTION Chairman Stone presented a resolution sent to Otter Tail County from the Morrison County Coordinator requesting support for the building of an ethanol production plant. Board members requested that people who live in Otter Tail County who may benefit from the building of this proposed ethanol production plant should contact the board with this request. No action was taken on the resolution. CLOSED TO PUBLIC At 11:24 a.m., the Chairman declared the meeting of the Otter Tail County Board of Commissioners closed to the public for the purposes of discussing pending litigation per Attorney-Client privilege pursuant to M.S. 471.705 Subd. ld in the Marion Lake matter and to discuss employee allegations pursuant to M.S. 471.705 Subd. ld(c) The closed session adjourned at 11:59 a.m. and the board recessed for lunch break. RECONVENE AND APPROVAL TO PAY BILLS Commissioner Lindquist absent. At 1:09 p.m., the Otter Tail ~aunty Board of Commissioners reconvened in open session. Motion by Partmann, seconded Windels and unanimously carried to approve payment of bills per Attachment A of these minutes. PAYMENTS APPROVED Motion by Windels 1 seconded Partmann and unanimously carried to approve payment, in the amount of $2 1 850 1 to Spatial Management Group, Inc. of Alexandria, MN, for Geographic Information Systems Consulting services from 02/21/95 to 04/17/95 as previously authorized. Motion by Partmann, seconded Windels and unanimously carried to approve payment, in the amount of $3,981, to Employer's Resource Int'l. of Crystal, MN, for human resource professional services as previously authorized. COUNTY COORDINATOR PERFORMANCE SUMMARY ADJOURNMENT Motion by Partmann, seconded Windels and unanimously carried to report a positive performance evaluation for County Coordinator, Larry Krohn. At 1:15 p.m., Chairman Stone declared the meeting of the Otter Tail County Board of Commissioners adjourned until 1:00 p.m. Tuesday, May 9, 1995.
