HomeMy WebLinkAboutBoard of Commissioners - Minutes - 04/18/19950 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, April 18, 1995 9:30 a.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, April 18, 1995, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman; Harley Windels, Malcolm Lee, Andy Lindquist and Virginia Partmann present. APPROVAL OF MINUTES Motion by Lee, seconded Partmann and unanimously carried to approve the minutes of April 11, 1995, as submitted. LOCAL OPTION DISASTER ABATEMENT POLICY Assessor, Bob Moe, provided board members with options for abatement of property not qualifying for disaster credit. Moe stated that current policy deals specifically with primary homestead residence for the following tax payable year. State law provides that the County Board may grant disaster abatement on non-homestead properties. Discussion followed regarding commercial property and the disaster situation in Parkers Prairie. Motion by Lindquist, seconded Windels and unanimously carried to grant non-homestead Local Option Disaster Abatement for Parkers Prairie properties for the 1996 tax payable year as allowed by MN Statute 273.123. This motion refers to the Parkers Prairie situation with future non-homestead disaster relief to be handled on a case-by-case basis. BID AWARD -CSAH NO. 84, NEW YORK MILLS Motion by Partmann, seconded Lindquist and unanimously carried to approve the following recommendation of the Highway Engineer to award the low bid for CSAH No. 84 Improvements, New York Mills: Mark Sand & Gravel Co. Fergus Falls, MN $833,357.25 FINAL PAYMENT -TWO DUMP BOX, UNDERBODY BLADE & HYDRAULIC SYSTEMS Motion by Lindquist, seconded Windels and unanimously carried to approve final payment, in the amount of $24,689.98 1 to Swanston Equipment Corporation of Fargo, ND, for two dump box, underbody blade & hydraulic systems per purchase order no. 55495. County Attorney present at 10:09 a.m. Commissioner Partmann absent at 10:15 a.m. PREMISE PERMIT APPLICATION OTTER TAIL COUNTY RESOLUTION NO. 95-26 Upon a motion by Windels, resolution was adopted: second by Lee and unanimously carried, the following 0 0 Otter Tail County Board of Commissioners April 18, 1995 Page 2 WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Perham Lion's Club, Perham, f','ll\l", has made an application to the Gambling Control Board for a premise permit to conduct lawful gambling at the Mosquito Heights Resort in Pine Lake Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Perham Lion's Club, Perham, MN at the Mosquito Heights Resort in Pine Lake Township of Otter Tail County. NOW, THEREFORE BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Perham Lion's Club, Perham, MN, at the Mosquito Heights Resort in Pine Lake Township of Otter Tail County, provided that the application meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Town Board of Pine Lake Township by sending them a copy of this resolution. The County Board took no action. MANAGEMENT INFORMATION SYSTEMS LAYOUT PLAN MIS Director, Tim Brand, presented, as previously requested by the County Board, the current physical layout of the MIS Department as well as proposed layout options. The approximate cost of Option 1 is $14,000. Changes described by Brand in Option 2 increase the estimate by approximately $2,300. Motion by Lindquist, seconded Lee and unanimously carried to approve Option 2 as recommended by Brand. APPROVAL TO CLEAR DAM Motion by Lee, seconded Lindquist and unanimously carried to approve the trapping of beaver and blasting of a dam on private property in Maine Township, Section 15, as recommended by Tiny Holm, Ditch Inspector. Holm will make application to the Department of Natural Resources for the completion of the work. Commissioner Partmann present at 10:37 a.m. RECESS At 11:07 a.m., the Chairman declared the Otter Tail County Board of Commissioners' meeting recessed until 1:00 p.m. RECONVENE & APPROVAL TO PAY BILLS At 1:00 p.m.1 the Chairman reconvened the Otter Tail County Board of Commissioners' meeting. Motion by Windels, seconded Partmann and unanimously carried to approve payment of bills per Attachment A of these minutes. BID OPENING -RECYCLING CENTER BUILDING EXPANSION AND RENOVATION At 1:03 p.m., after having previously advertised for bids, the Solid Waste Director confirmed with the Auditor that he had received all bids. Mike Hanan, Solid Waste Director, and John Mentor of OSM opened the following bids: CONTRACTOR C.I. Construction, Inc. Alexandria, MN All Building Corp. Fergus Falls, MN BASE BID $1,336,500 1,410,870 ALTERNATE $6,800 (add'n. for explosive proof light fixtures} #1 -$1,400 #2 6,492 (add 1 n. for explosive proof light fixtures} Hanan and Mentor will review the bids and return to the board with a recommendation for award. NEW YORK MILLS BUILDING PAYMENTS APPROVED Motion by Lee, seconded Windels and unanimously carried to approve payment, in the amount of $250, to Dakota Fire Protection, Grand Forks, ND, for sprinkler revisions at the New York Mills (EQT county offices} building. This motion further approved change order no. G-5 for a total deduction from the New York Mills project by Rapp Construction of $766. SPATIAL MANAGEMENT GROUP County Coordinator, Larry Krohn, read a letter received from Spatial Management Group notifying Otter Tail County that effective March 23, 1995, SMG's Workers' Compensation coverage expired. SMG does not have any employees. County Attorney, Wally Senyk, will review Otter Tail County's contract with SMG and advise the board accordingly. RECESS DECLARED At 1:40 p.m, Chairman Stone declared the Otter Tail County Board of Commissioners' meeting recessed for a twenty minute break. I . 0 0 Otter Tail County Board of Commissioners April 18, 1995 Page 4 BID OPENING -RECYCLABLES PROCESSING SYSTEM At 2:00 p.m., Chairman Stone reconvened the Otter Tail County Board of Commissioners' meeting. After having previously advertised for proposals, the Solid Waste Director and John Mentor of OSM opened the following recyclable system proposals: Karl W. Schmidt & Associates, Inc. Denver, Colorado Daneco, Inc. Memphis, TN Rader Companies Mpls., MN Storage Systems, Inc. Eden Prairie, MN $668,255 776,000 369,251 Hanan and Mentor will review the proposals and return to the board with a recommendation for award. Hanan and Mentor explained that these are proposals for a total system not for specific equipment, therefore, will need to be thoroughly compared. TEMPORARY SUBDIVISION CONTROL OTTER TAIL COUNTY RESOLUTION #95-27 Upon motion by Lindquist, seconded by Partmann and unanimously carried, the Otter Tail County Board of Commissioners adopted the following resolution: WHEREAS, in 1994, the Otter Tail County Board of Commissioners directed the Otter Tail County Planning Commission to review and recommend amendments to the Otter Tail County Subdivision Controls Ordinance in order to better regulate the subdivision of residential lots in Otter Tail County; and WHEREAS, the Otter Tail County Planning Commission will soon be holding public hearings for the purpose of proposing amendments to the Otter Tail County Subdivision Controls Ordinance and Shoreland Management Ordinance, relating to the subdivision of land in Otter Tail County; and WHEREAS, the amendments to the Subdivision Controls Ordinance will be adopted by the Otter Tail County Board in approximately 90 days or less; and WHEREAS, the County Board of Commissioners has learned of recent metes and bounds subdivisions of marginal land that have created residential lots without adequate building sites and subdivisions that are inconsistent with the orderly development of land in the best interests of county residents; and WHEREAS, the County Board desires to protect the public health, safety and general welfare of Otter Tail County residents by assuring the orderly subdivision of land, pursuant to the authority of Minnesota Statute, Section 394.34. NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby adopts, as a temporary interim subdivision control measure, the following provision: No subdivision of any real property of less than ten (10) acres shall be recorded or certified for recording by the County Auditor except by a plat duly approved by the County Board or following review and approval of any other proposed subdivision by the Otter Tail County Planning Commission. For the purpose of review and approval of proposed subdivisions other than by plat, the Otter Tail County Planning Commission shall apply the requirements and standards of orderly development provided in the Otter Tail County Subdivision Controls Ordinance. Dated: ,11po,D JS, 1995 COUNTY D OF COMMISSIONERS By ATTES~"&£ William Stone, Chairman Larry Kro:l: Clerk COUNTY STATE AID HIGHWAY NO. 31 RIGHT-OF-WAY ACQUISITION NEGOTIATION NO. 3 OTTER TAIL COUNTY REVISED RESOLUTION 95-25(R) Upon a motion by Lee, second by Partmann and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution as revised by the County Attorney's office. WHEREAS, Otter Tail County proposes to reconstruct and improve County State Aid Highway No. 31 from the intersection of County State Aid Highway No. 4, North 1.162 miles located in Sections 3, 4, 9 and 10 1 Tl36N-442W; and WHEREAS, the reason for the reconstruction of this segment of County State Aid Highway No. 31 is due to the existing highway1 s poor condition, the unsafe intersection at County State Aid Highway No. 4 and the need for the replacement of culvert between Lake Lizzie and Crystal Lake; and WHEREAS 1 this improvement is necessary to provide for the safety of the traveling public; and WHEREAS, Otter Tail County has a right to acquire the right-of-way after an award of damages has been filed with the County Auditor in accordance with Minnesota Statute, Section 163.12; and WHEREAS, all necessary additional highway right-of-way has been acquired for the reconstruction except for the following described tract 1 owned by Lyle D. Hosterman of Hot Springs, Montana: A strip of land over and across the following described tract: Government Lot One (1), Section Nine (9) 1 Township One Hundred Thirty-six (136) North, Range Forty-two (42) West. Due to the reconstruction and realignment of S.A.P. 56-631-04, said strip being all that part of the above-described tract 1 to be retained for CSAH No. 31 right-of- way, recorded as Parcel No. 2 of Otter Tail County Highway right-of-way Plat l of County State Aid Highway No. 31. Excepting therefrom right-of-way of existing highways. Containing 1.13 acres, more or less. i ' 0 0 0 Otter Tail County Board of Commissioners April 18, 1995 Page 6 Also a temporary easement to construct slopes which will cease on or before December 31, 1996, on the above-described tract and recorded as Parcel No. 2 of Otter Tail County highway right-of-way Plat No. 1 of County State Aid Highway No. 31. Excepting therefrom right-of-way of existing highways. Containing 0.12 acre, more or less. NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby authorizes the acquisition of the requested right-of-way as described above pursuant to Minnesota Statute, Section 163.121 and to take title and possession of that land after an award of damages has been filed with the County Auditor in accordance with Minnesota Statute, Section 163.12.
