CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, March 28, 1995, at
1:00 p.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman;
Harley Windels, Malcolm Lee, Andy Lindquist, and Virginia Partmann present.
APPROVAL OF MINUTES
Motion by Partmann, seconded Windels and unanimously carried to approve the minutes of
March 21, 1995, as submitted.
U.S. FISH AND WILDLIFE SERVICE
Don Kleven, U.S. Fish and Wildlife Service, requested certification of purchase of two
tracts of land, 55 acres from Burnell T. Bakke and 64.19 acres from Eugene L. Evenson,
to complete a Waterfowl Program Area in Aastad Township. Kleven provided a handout
detailing the impact of the proposed acquisitions on Otter Tail County revenue.
Motion by Lindquist, seconded Windels and unanimously carried to table these
acquisitions to allow more time for the U.S. Fish and Wildlife to increase the shared
revenue payments to Otter Tail County.
PURCHASE -3/4 TON PICK-UP
Highway Engineer, Rick West, provided the following quotations for a 3/4 ton pick-up:

Motion by Lindquist, seconded Partmann and unanimously carried to authorize the Highway
Engineer to purchase a 3/4 ton pick-up, in the amount of $15,337 (FOB, Fergus Falls)
payable to Nelson Ford, Fergus Falls.
JOINT MNDOT/OTTER TAIL COUNTY MAINTENANCE GARAGE
Rick West, Highway Engineer, informed board members of preliminary studies for a joint
MnDOT/Otter Tail County maintenance garage. The Board supported a study of the
joint proposal.
TRANSPORTATION ENHANCEMENT FUNDS RESOLUTION
OTTER TAIL COUNTY RESOLUTION NO. 95-22
Upon a motion by Lindquist, seconded Partmann and unanimously carried, the following
resolution was adopted:

WHEREAS, the Minnesota Department of Transportation District 4 Area Transportation
Partnership is currently soliciting proposed projects for funding with Transportation
Enhancement Funds available through the Intermodal Surface Transportation Efficiency Act
( IS TEA) , and
WHEREAS, projects selected under this program may be funded with up to 80% Enhancement
Funds with the remainder to be funded locally, and
WHEREAS, there is a joint effort by trail associations1 businesses and individuals in
Otter Tail and Douglas Counties to convert the former Burlington Northern Railroad
corridor into an all-season pedestrian, bicycle and snowmobile trail extending from the
City of Osakis to the City of Fergus Falls, and
WHEREAS, application for these Transportation Enhancement Funds are to be made by a
local governmental agency.
NOW, THEREFORE, BE IT RESOLVED, by the Otter Tail County Board of Commissioners, that
Otter Tail County hereby agrees to become a joint co-sponsor with Douglas County and
will make application for Transportation Enhancement Funds for improvement of the former
Burlington Northern Railroad corridor in Douglas and Otter Tail Counties as a
recreational trail.
BE IT FURTHER RESOLVED, that agreement to co-sponsor this project does not include a
commitment to provide county funds as a part of the local share funding.

the amount of $97,514.87, to Sherbrooke Asphalt, Inc, Pelican Rapids, MN, for completion
of S.A.P. 56-641-08, Bituminous Overlay and Aggregate Shouldering.
SEASONAL SUPPLY OF HOT MIX BITUMINOUS, WEST OTTER TAIL COUNTY
Motion by Lee, seconded Lindquist and unanimously carried to authorize the Chairman's
signature on the following Highway Department contract as previously authorized:

FRIENDS OF PHELPS MILL CORRESPONDENCE
Chairman Stone acknowledged receipt of correspondence from the Friends of Phelps Mill
informing the County Board that their committee is now a stand-alone committee under the
direction of the Historical Society. Further, the correspondence updated the Board on
the committee's progress.

REIMBURSEMENT OF FUNDS
Motion by Lindquist, seconded Lee and unanimously carried to approve reimbursement from
the County Building Fund to the Otter Tail County Highway Department, in the amount of
$16,597.89, for the following costs:
Garage #8 -Battle Lake (Overhead Door) $2,694.00
(New Furnace) 6,089.00
Garage #10 -Perham (Replace Roof) 4,350.00
Garage #15 -Vergas (New Furnace) 2,318.00
(Utility Assessment) 1,146.89

CLARIFICATION OF USE OF SAFETY PROGRAM FUNDS
County Attorney, Wally Senyk, requested clarification of 11 other county safety programs 11
within a motion approved on January 17, 1995 1 which reads as follows: 11 Motion by
Lindquist, seconded Fortmann and unanimously carried to transfer $25 per full time
employee from the Insurance Reserve Account to the Safety budget for training for Safety
Committee members and other county safety programs.11
Motion by Partmann, seconded Lee and unanimously carried to direct Tim Hunt, Safety &
Emergency Services Director, to draft a plan of how the safety program monies will be
used and to include in this plan CPR training for Otter Tail County employees.
Motion by Windels, seconded Lindquist and unanimously carried to request the Safety &
Emergency Services Director (or a representative of the Employees' Safety Committee) to
present the draft plan at the next regular County Board meeting prior to clarification
of the January 17, 1995, motion.
EAST OTTER TAIL FARMER HOMEMAKER COUPLE
County Agent, Denzil Cooper, presented the 1995 RRV Winter Shows Valley Farmers and
Homemakers Award for East Otter Tail County to Ernest and Althea Deckert of Henning, MN.

Mr. and Mrs. Deckert visited with board members regarding their past and present farming
and homemaking experiences.
DITCH NO. 20 CLEAN-OUT
Motion by Windels, seconded Lee and unanimously carried to allow clean-out of vegetation
only on a ditch in the Ditch No. 20 System by the property owner as requested by Ditch
Inspector, Tiny Holm. Holm was directed by the Board to make future decisions regarding
brush/vegetation clean-out of ditches when such request is received from the property
owner. Commissioner Lee further directed that these authorizations be documented by
letter to the property owner receiving permission for the clean-out.
DITCH NO. 41, WILLOW CREEK
Ditch Inspector, Tiny Holm, reported that a beaver dam had been removed in the Willow
Creek area and caused a culvert to be torn out underneath a residential driveway. The
property owner is requesting permission to refill the dirt so he can use his driveway.
The Board directed Holm to check with the Department of Natural Resources (DNR) because
this may be under the DNR's jurisdiction.
MINNESOTA DEPARTMENT OF CORRECTIONS RESOLUTION
AUTHORIZING EXECUTION OF AGREEMENT
OTTER TAIL COUNTY RESOLUTION #95-23
Upon a motion by Lindquist, seconded Partmann and unanimously carried, the following
resolution was adopted contingent upon the Otter Tail County Attorney's approval of the
Joint Powers Agreement:
Be it resolved that Otter Tail County intends to enter into a Joint Powers Agreement
with the State of Minnesota for the Sentencing to Service Program, to be conducted
during the period from July 1, 1995 to June 30, 1997.
William Stone, Board Chairperson, and Gary A. Nelson, Sheriff, are hereby authorized to
implement the program on behalf of the county.

Commissioners closed to the public for the purpose of exercising Attorney-Client
Privilege in discussing pending litigation of the Marion Lake Association vs County of
Otter Tail Et al. Attorney-Client Privilege is authorized in M.S. 471.705 Subd 1 d.
At 3:21, p.m. 1 Chairman Stone declared the meeting of the Otter Tail County Board of
Commissioners adjourned until 9:30 a.rn Tuesday, April 4, 1995.

Motion by Lee, seconded Partmann and unanimously carried to direct County Attorney,
Wally Senyk, to research and solidify the feasibility of filling a Collections Officer
position.
RESOLUTION TO BE DRAFTED
Motion by Windels, seconded Lee and unanimously carried to direct the County Attorney to
draft a resolution to be sent to the Association of Minnesota Counties and area
legislators expressing that county officials must be allowed to help in setting laws
because the counties are administering 80% of these laws.
PERHAM BUILDING
Commissioner Windels directed that a letter be sent to the City of Perham confirming the
City's decision not to purchase the previous East Otter Tail County office building and
to inform the City of Perham that Otter Tail County will be advertising for the sale of
the building.
