HomeMy WebLinkAboutBoard of Commissioners - Minutes - 03/21/1995Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, March 21, 1995 9:30 a.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, March 21, 1995, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman; Harley Windels, Malcolm Lee, and Virginia Partmann present. Commissioner Andy Lindquist was absent. APPROVAL OF MINUTES Motion by windels, seconded Lee and unanimously carried to approve the minutes of March 14, 1995, as submitted. FINAL PLAT Motion by Lee, seconded Partmann and unanimously carried to approve the final plat of star Point Estates Second Addition, Star Lake, (Sec. 12, Twp 135, Range 41, Star Lake Twp). APPLICATION FOR SEWAGE DISPOSAL INSTALLERS LICENSE Motion by Partmann, seconded Windels and unanimously carried to approve the Sewage Disposal Installers License renewal application as follows: Peter Paul Excavating, Perham, MN, Peter Ziolkowski PROJECT NO. S.A.P. 56-631-04, CRYSTAL LAKE OUTLET RESOLUTION OTTER TAIL COUNTY RESOLUTION NO. 95-2l Upon a motion by Lee, seconded Partmann and unanimously carried, the following resolution was adopted: WHEREAS, the County of Otter Tail has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for the Construction/Reconstruction of County Bridge No. 97957 (Project No. S.A.P. 56-63l-04) over the Crystal Lake Outlet, and; WHEREAS, the amount of the grant has been determined to be $ll8,5l9.50 by reason of the lowest responsible bid. NOW, THEREFORE, BE IT RESOLVED, that the County of Otter Tail does hereby affirm that any cost of the bridge in excess of the grant will be appropriated from the funds available to the County of Otter Tail, and that any grant monies appropriated for the bridge but not required, based on the final estimate, shall be returned to the Minnesota State Transportation Fund. RIGHT-OF-WAY, CSAH 31 PROJECT Motion by Lee, seconded Windels and unanimously carried to authorize the Highway Engineer to use Eminent Domain in securing right-of-way for the CSAH 31 project as allowed by M.S. 163.12. OTTER TAIL COUNTY HALL OF FAME Motion by Lee, seconded Partmann and unanimously carried to request the Otter Tail County Historical Society to evaluate and report back to this Board, within sixty days, the possibility and feasibility of establishing an Otter Tail County 11 Hall of Fame 11 for famous Otter Tail County people; the report should suggest the criteria needed for selecting "Hall of Fame 11 people; who or what body should make the selection; outline duties of a perpetual governing board; consider if the north entrance to the courthouse could serve as the Hall for the 11 Hall of Fame 11 ; or, any other ideas, suggestions or information needed to organize and establish an Otter Tail County People 11Hall of Fame". NEW YORK MILLS OPEN HOUSE Motion by Windels, seconded Lee and unanimously carried to express sincere thanks and appreciation to the New York Mills Civic and Commerce Department for their participation in the East Otter Tail County Open House and further, to thank county employees who took the time to attend, showing their interest and support, at the open house on March 11th. The motion further directed a 11 letter of thanks 11 to be sent to the aforementioned people. GIS/ADDRESSING DATABASE UPDATE Dick Howe, Spatial Management Group, presented the GIS database highways, trees, etc.) built within the fifty square mile test City area. The hard copy map of the test area was provided to the Geographical Information Systems (GIS) presentation included: 1) MnDOT County-Wide Quadrangles Database 2) Horizon's Aerial Photobase Test Area 3) The Comparison of MnDOT and Horizon's Database (rivers, buildings, area in the Ottertail commissioners. The 4) Soils Database with Colored Legend (each color representing a different soil type) Howe explained that Horizon's will be adding residential roads (i.e., driveways leading to cabins) to the database of the test area. Howe reported that it would take approximately three years to acquire the data for all of Otter Tail County. coordinator, Larry Krohn, pointed out the need for property lines and township lines to be GIS referenced to the Horizon's database in order to identify specific parcels. GIS COORDINATOR POSITION Motion by Partmann, seconded Lee and unanimously carried to authorize the Coordinator to proceed with advertising and recruitment for the GIS Coordinator position with the salary set at a Range 19. 0 0 Otter Tail County Board of Commissioners March 2l, l995 Page 3 CLOSED TO THE PUBLIC At 11:35 a.m., Chairman Stone declared the meeting of the Otter Tail County Board of Commissioners closed to the public for the purpose of evaluating the performance of Bob Moe, Assessor, pursuant to M.S. 471.705, Subd. ld (d). A summary report of conclusions regarding the evaluation will be provided at the March 28, 1995, County Board meeting. RECONVENED At 1:00 p.m., the Otter Tail County Board of Commissioners reconvened with Commissioner Windels absent after concluding the closed session at 12:05 p.m. and taking a lunch break. APPROVAL TO PAY BILLS Motion by Lee, seconded Partmann and unanimously carried to approve payment of bills per Attachment A of these minutes. LIQUOR LICENSES Motion by Portmann, seconded Lee and unanimously carried to approve the following application for licenses: Lakeway Golf Course, Inc. Robert Purdon Dalton, MN Blue Horizon Ballroom Diane Wanner Perham, MN Application for Consumption and and Display (Set-Up) Permit Application for Consumption and Display (Set-Up) Permit PHELPS MILL DAM Motion by Lee, seconded Partmann and unanimously carried to approve reimbursement to the Otter Tail County Highway Department, in the amount of $36,097.66, for costs incurred during the repair and modification of the Phelps Mill Dam. PREMISE PERMIT APPLICATION OTTER TAIL COUNTY RESOLUTION NO. 95-lB Upon a motion by Lee, seconded by Portmann and unanimously carried the following resolution was adopted: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the American Legion Post 30, Fergus Falls, MN, has made an application to the Gambling Control Board for a premise permit to conduct lawful gambling at the Last Resort in Elizabeth Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.2l3 provides that the Gambling Control Board may not issue a permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit; and Otter Tail County Board of Commissioners March 21, 1995 Page 4 WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the American Legion Post 30, Fergus Falls, MN at the o Last Resort in Elizabeth Township of Otter Tail County. 0 NOW, THEREFORE BE IT RESOLVED, that the the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the American Legion Post 30, Fergus Falls, MN at the Last Resort in Elizabeth Township of Otter Tail County, provided that the application meets all the necessary criteria for the licenses and permits required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Town Board of Elizabeth Township by sending them a copy of this resolution. Dated: 'me, uP d£,, l'lro Larry Krohn, Clerk BATTLE LAKE DUCKS UNLIMITED CHAPTER 162 RESOLUTION OTTER TAIL COUNTY RESOLUTION NO. 95-19 Upon motion by Partmann, seconded by Lee and unanimously carried, the following resolution was adopted: WHEREAS, the Battle Lake Ducks Unlimited Chapter 162 has submitted an application for authorization for exemption from lawful gambling license for an event scheduled for March 24th, 1995, at The Pier in Otter Tail Township, and WHEREAS, the Otter Tail County Board of Commissioners has met on March 21, 1995, and has found no reason to pass a resolution to specifically prohibit the scheduled event, and WHEREAS, the Otter Tail County Board of Commissioners has voted to waive the 30 day waiting period. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby waives the 30 day waiting period for the application for authorization for exemption from lawful gambling license submitted by the Battle Lake Ducks Unlimited Chapter 162 and hereby respectfully request that the Minnesota Gambling Control Board allow this application to become effective in time for the scheduled event on March 24, 1995. WHEREAS, the Otter Tail County Board of Commissioners has met on March 21, 1995, and has found no reason to pass a resolution to specifically prohibit the scheduled event, and WHEREAS, the Otter Tail County Board of Commissioners has voted to waive the 30 day waiting period. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby waives the 30 day waiting period for the application for authorization for exemption from lawful gambling license submitted by the Maidens of the Prairie to Lakes Ducks Unlimited Chapter 164 and hereby respectfully request that the Minnesota Gambling Control Board allow this application to become effective in time for the scheduled event on April 25, 1995.
