CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, February 21, 19951 at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman;
Harley Windels, Virginia Partmann, and Andy Lindquist present. Commissioner Malcolm Lee
was absent due to his attendance at an Association of Minnesota Counties (AMC} meeting
in St. Paul./
APPROVAL OF MINUTES
Motion by Windels, seconded Partmann and unanimously carried to approve the minutes of
February 14, 1995, with clarification on Ditch No. 21, page 3, paragraphs four & five to
read as follows:
Motion by Lee, seconded Stone to assess the cost of the culvert replacement on the town
line road between Friberg and Maine Townships against the Ditch 21 drainage system
because the Ditch Authority had ordered work on the culvert in 1917. This action
reverses the county's earlier order that the townships repair the culvert as a result of
having caus8d obstruction.

include that determination of
and unanimously carried to amend the above motion to
proper assessment of cost of culvert replacement will be
made on a case-by-case basis in the future, due to particular requirements of drainage
law regarding culverts.
WETLAND EASEMENT ACQUISITIONS
Don Kleven1 U.S. Fish and Wildlife Service, met with the board to request acquisition of
lands. Motion by Lindquist, seconded Partmann and unanimously carried to approve the
following waterfowl acquisitions:

Osolid Waste Director,
that work over thirty
per week during the
BENEFIT ELIGIBILITY
Mike Hanan, met with the board to discuss benefits for employee(s)
hours per week during the summer months and less than thirty hours
winter months. In this case, total hours would average thirty or
more hours per week on an annual basis.

County Attorney, Wally Senyk, explained that after attending a seminar on employment law
February 17th, he has learned that federal law exists for the area of determining
benefit eligibility when an employee's hours fluctuate. The board directed the County
Attorney to review the law in order to make a determination on this issue at the next
regular board meeting.
1995 ASSESSMENT UPDATE
County Assessor 1 Bob Moe, provided a 1995 Assessment Update handout and reviewed the
value changes for various classifications of property.
VEHICLE REQUEST
County Assessor 1 Bob Moe, requested purchase of a 1995 Escort to replace a 1986 Ford
Escort with high mileage.
Motion by Windels, seconded Lindquist and unanimously carried to approve the purchase of
a 1995 Ford Escort, in the amount of $10 1 924 plus tax and license, through the Minnesota
Cooperative Purchasing Venture, subject to receipt of comparable value quotations from
local car dealers.
WATER TESTING
Motion by Lindquist, seconded Partmann and unanimously carried to direct Bill Kalar,
Land & Resource Director, to develop a data base from specific well water testing sites,
and further, to direct the County Attorney to draw up a release form agreement to be
used with private property owners.
CLOSED TO THE PUBLIC
At 11:00 a.m., Chairman Stone declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for the purpose of evaluating the performance of
Mike Hanan, Solid Waste Director, and Bill Kalar, Land & Resource Director, pursuant to
M. S. 471. 705, Subd. ld {d). Summary reports of conclusions regarding the evaluations
will be provided at the February 28, 1995, County Board meeting.
RECONVENED
At 1:00 p.m., the Otter Tail County Board of Commissioners reconvened after concluding
the closed session at 11:50 a.m. and taking a lunch break.

Motion by Lindquist, seconded Windels and unanimously carried to approve payment of
bills per Attachment A of these minutes.

February 28, 1995, board meeting.
✓ FINAL PAYMENT -RADIO SYSTEM UPGRADING
Motion by Lindquist, seconded Portmann and unanimously carried to approve Purchase Order
No. 55367, in the amount of $23 1 795.04, payable to Midland International Corporation for
radio communications systems upgrading and Purchase Order No. 55368, in the amount of
$889.90, payable to John R. DuBois for consulting services for the radio system
upgrade.
CULVERT REPLACEMENTS
Motion by Lindquist, seconded Windels and unanimously carried to authorize the
Highway Engineer to proceed with culvert replacements at the following locations:
Mustinka River on CSAH No. 26, 3.1 miles West of T.H. 59, and
CSAH No. 3 near Anderson Lake approximately 1.5 miles South of CSAH No. 24.

RESOLUTION #95-14
OMotion by Partmann,
resolution:
seconded Windels and unanimously carried to adopt the following
BE IT RESOLVED, that the County of Otter Tail enter into an agreement with the
Burlington Northern Railroad Company and the Commissioner of Transportation for the
installation and maintenance of railroad crossing signals at the intersection of CSAH 77
with the tracks of the Burlington Northern Railroad Company in Bluffton, Minnesota, and
appointing the Commissioner of Transportation agent for the County to supervise said
project and administer available Federal Funds in accordance with Minnesota Statute,
Section 161.36. The County's share of the cost shall be zero percent of the total
signal cost.
BB IT FURTHER RESOLVED, that the Chairperson and Clerk of the Board be and they are
hereby authorized to execute said agreement for and on behalf of the County.

CONSULTANT -GIS MEETING
OMotion by Partmann, seconded Windels and unanimously carried to approve consulting
services of Dane Vose at a Geographical Information Systems meeting to be held Friday,
February 24, 1995.
HUMANE SOCIETY REQUEST
County Coordinator, Larry Krohn, reported that the Humane Society has requested that the
county pay for contagious virus vaccinations for dogs picked up outside of the
Fergus Falls city limits. The cost is $5 per vaccination with approximately 150-200
vaccinations required per year. Commissioner Lindquist was directed to check into this
matter and report back to the board next week with a recommendation.
JUVENILE DETENTION FACILITIES
RESOLUTION #95-12
Upon motion by Partmann, seconded Lindquist and unanimously carried, the Otter Tail
County Board of Commissioners adopted the following resolution:
WHEREAS, in 1994, the Minnesota State Legislature appropriated money to assist in
developing or adding new secure juvenile detention facilities in each of the state's
judicial districts; and
WHEREAS, the West Central Regional Juvenile Center located in the City of Moorhead, Clay
County, Minnesota, has requested support for an expansion of the facility; and
OWHEREAS, Otter Tail County is located in close proximity to Clay County and the Otter
Tail County Department of Court Services has regularly utilized the West Central
Regional Juvenile Center for the secure detention of Otter Tail County juveniles; and
WHEREAS, both Otter Tail and Clay Counties are located in the Seventh Judicial District.
NOW, THEREFORE, BE IT RESOLVED by the Otter Tail County Board of Commissioners that the
County of Otter Tail will join in the grant application of the West Central Regional
Juvenile Center for state moneys to expand the facility and hereby requests that the
funds allocated to the Seventh Judicial District be utilized for the expansion of that
facility.
BE IT FURTHER RESOLVED that any expansion of the West Central Regional Juvenile Center
be conditioned upon an adequate demonstration that, upon completion of the expansion,
the Center will continue to operate at per diem costs to those counties utilizing the
Center which will remain competitive with other juvenile detention facilities in the
region.

SUPPORT IN AMENDING THE LANDFILL CLEANUP PROGRAM
RESOLUTION #95-13

by Partmann, seconded by Lindquist and unanimously carried, the Otter Tail
of Commissioners adopted the following resolution:
WHEREAS, in 1994, the Minnesota State Legislature established the Landfill Cleanup
Program to provide environmental response at qualified facilities, which appropriately
distributed the cost of cleaning up landfills; and
WHEREAS, the definition of a 11 qualified facility" for the program inappropriately
excluded facilities which continue to receive incinerator ash for disposal in an MPCA
permitted monocell, which is separated from the municipal solid waste on the sitei and
WHEREAS, the purposes and goals of the Landfill Cleanup Program are met by reimbursing
part of the expenses of facilities that have stopped accepting solid waste, except
demolition debris or ash, neither of which will cause further difficulties at the site.
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby
supports the attached Bill for an Act, amending the Landfill Cleanup Program to allow
facilities that have stopped accepting solid waste by the appropriate date, but continue
to accept incinerator ash for disposal in an MPCA permitted monocell which meets all
applicable standards and which is separated from the municipal solid waste deposited on
site, to qualify for partial reimbursement of eligible expenses.
BE IT FURTHER RESOLVED that a copy of this resolution shall be provided to all the state
legislators representing residents of Otter Tail County and to the Minnesota Pollution
Control Agency.

LOCAL WATER RESOURCES PROTECTION AND MANAGEMENT PROJECT AGREEMENT
Motion by Windels, seconded Partmann and unanimously carried to authorize the Chairman's
signature on the Local Water Resources Protection and Management Project Agreement for
implementing the Upper Otter Tail River Watershed Improvement Project Challenge Grant as
presented by the County Attorney. The agreement is between Otter Tail County, East
Otter Tail County Soil and Water Conservation District, and Big Pine Lake and Little
Pine Lake Property Owners Associations.
