CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, January 10, 1995, at
1:00 p.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman;
Harley Windels, Malcolm Lee, Virginia Fortmann and Andy Lindquist present.
APPROVAL OF MINUTES
Motion by Partmann, seconded Windels and unanimously carried to approve the minutes of
January 3, 1995, as submitted.
TAX STATEMENT INSERT
Public Information Officer, Marie Tysdal, recommended a tax statement insert accompany
the tax statements as in previous years to educate the public of the following issues:
The new state imposed solid waste assessment.
The solid waste service fee being listed as "Service Fee" on the tax statements
rather than lumped in with other fees on the statement.
Legislation effective January 1, 1995, regarding the disposal of oil filters.
Explanation of the tax payment deadlines.
Motion by Windels, seconded Partmann and unanimously carried to approve the tax
statement insert as recommended by Ms. Tysdal and to direct the Coordinator's Office to
contact department heads for other topics that tax payers need to be educated on that
could be included in the insert.
PESTICIDE CONTAINERS/COLLECTION
Public Information Officer, Marie Tysdal, provided a handout to the Board members from
the Minnesota Department of Agriculture which detailed the 1994 Otter Tail County empty
pesticide container collection. Solid Waste Director, Mike Hanan, pointed out the
concerns of the Minnesota Department of Agriculture regarding the 1994 collection in
Fergus Falls.
After further discussion, a motion was offered by Windels, seconded Fortmann and
unanimously carried to continue the empty pesticide container collection in 1995 in the
same manner as last year, however, if there is a continued lack of participation and
cooperation by the sixteen licensed pesticide dealers in Otter Tail County, the program
will be discontinued. Further, the motion directed Ms. Tysdal to phone the pesticide
dealers in the county to request their participation. The Board directed the Solid
Waste Director to write a letter to the Minnesota Department of Agriculture to inform
them that Otter Tail County doesn't have an indoor facility for empty pesticide
container collection, therefore, if the state is uncomfortable with the county's
operation, the program will be discontinued.

OTTER TAIL COUNTY RESOLUTION 95-03
Motion by Windels, seconded Lee and unanimously carried, the following resolution was
adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, all financial institutions in Otter Tail County, including state and federal
banks and savings and loan associations, be and are hereby designated as depositories of
County funds.

AUTHORITY TO INVEST COUNTY FUNDS
OTTER TAIL COUNTY RESOLUTION 95-04
Motion by Partmann, seconded Lindquist and unanimously carried, the following resolution
was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, Otter Tail County Treasurer, Steve Andrews, be and is hereby given authority to
invest County funds as available.

PLANNING COMMISSION RECOMMENDATIONS
Motion by Lee, seconded Lindquist and unanimously carried to approve the conditional use
application of Robert Floyd Severson, East Spirit Lake, (Lot 41, Block 1, Section 9,
Dora Township) with conditions as recommended by the Planning Commission. The motion
did not include the portion of the permit application that reads 11 and that the Land &
Resource Office approved the project {including the slope}. Approval is subject to
confirmation that an easement is not available from the neighbor {an easement would
minimize the earthmoving that would take place with this proposed road) . 11

APPROVAL OF FINAL PLAT
Motion by Lee, seconded Lindquist and unanimously carried to approve the final plat of
Robert D. Wilson, Leek Lake Heights, {Section 16, Range 41, Candor Township).
NATURAL RESOURCES BLOCK GRANT
Land & Resource Director, Bill Kalar, discussed the application process for the
Natural Resources Block Grant. The Challenge Grant will be divided three ways between
Otter Tail County and the East & West Soil Conservation Districts. After further
discussion, Otter Tail County Resolution 95-05 was adopted.
RESOLUTION AUTHORIZING SIGNATURE OF BOARD OF WATER AND SOIL RESOURCES
NATURAL RESOURCES BLOCK GRANT DOCUMENTS
OTTER TAIL COUNTY RESOLUTION 95-05
Motion by Partmann, seconded Windels and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, Otter Tail County has a state approved comprehensive local water plan which has
been locally adopted pursuant to Minnesota Statutes, Chapter 103B.311 and 103B.315; and
WHEREAS, the State of Minnesota, acting by and through its Board of Water and Soil
Resources {BWSR), has authority to award natural resources block grants for purposes of
implementing comprehensive programs to local government pursuant to Laws of Minnesota,
1993, Chapter 172, Section 6; and
WHEREAS, the Minnesota Department of Revenue has determined the minimum amount necessary
to be raised by Otter Tail County for the base grant portion of the grant; and
WHEREAS, BWSR has determined that Otter Tail County is eligible for a Natural Resources
Block Grant of up to $80,697.00 upon BWSR acceptance of the local government unit's
application and the execution and delivery of a Grant Agreement.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
approves execution of a grant agreement by Otter Tail County with the State of Minnesota
to receive state funds for the implementation of its comprehensive local water plans,
the administration of the Wetland Conservation Act and administration of the DNR
shoreland program, under the terms of the Grant Agreement and all statutory
requirements; and
that the Otter Tail County Board of Commissioners authorizes the expenditure of
$51,419.67 in cash and in-kind contributions to match the Natural Resources Block Grant
as specified in Laws of Minnesota 1993, Chapter 172, Section 6, and the Grant Agreement.
BE IT FURTHER RESOLVED, that the chairperson of the County Board of Commissioners and
the Clerk of the County Board are authorized to execute the Grant Agreement together
with all related documents.

1995 OUTDOOR RECREATION GRANT PROGRAM APPLICATION
Highway Engineer, Rick West, reported that Otter Tail County's Outdoor Recreation Grant
Program Application for restrooms at Phelps Mill Park was not accepted for funding in
1995. Twenty-six out of one-hundred applications were recommended. Mr. West reported
that he would apply again next year.
TANK REMOVAL -VERGAS
Highway Engineer, Rick West, reported that phase I of the tank removal process at the
county garage in Vergas has been completed. Mr. West will be implementing Phase II by
contacting the Minnesota Pollution Control Agency (MPCA) as it appears leakage has been
detected.
MINNESOTA COOPERATIVE PURCHASING AGREEMENT
Motion by Lee, seconded Lindquist and unanimously carried to approve payment, in the
amount of $350, to the State of Minnesota for the annual membership fee for the
Minnesota Cooperative Purchasing Venture.

1995 HERBICIDE APPLICATOR'S LICENSE
Motion by Lindquist, seconded Windels and unanimously carried to approve purchase of 1 95
Herbicide Applicator's License for seven Highway Department personnel at a cost of $10
each for a total cost of $70.
COUNTY BOARD AUTHORIZATION POLICY
The Board directed the County Attorney to prepare a resolution to clarify the policy for
determining when County Board expenditure approval is necessary.
COUNTY BOARD DATE CHANGED
Motion by Lee, seconded Partmann and unanimously carried to hold the regular County
Board meeting the first week of July on Wednesday, July 5, 1995. The purpose for the
change is that the first Tuesday of July is the July 4th holiday.

DENTAL PLAN FEE INCREASE
Motion by Partmann, seconded Windels and unanimously carried to approve an increase for
administrative services for the Otter Tail County Dental Plan by DCA, Inc. from $2.55
per participating employee to $2.60 per employee effective February 1, 1995.

OTTER TAIL COUNTY RESOLUTION 95-06
Upon motion by Windels, seconded by Fortmann and unanimously carried, the Otter Tail
County Board of Commissioners adopts the following resolution:
WHEREAS, the Minnesota State Legislature has encouraged the development of alternative
forms of delivery of government services by local units of government; and
WHEREAS, the traditional state method of authorizing the administrative rule making
process to detail the criteria for the delivery of services by local governments results
in excessive restrictions on the ability of local governments to adapt their programs to
local needs; and
WHEREAS, the detailed format and content of programs and services mandated by the State
of Minnesota do not allow sufficient flexibility for local governments to make
innovations to improve the delivery of government services; and
WHEREAS, county governments have the trained and experienced personnel necessary to
determine the most cost effective means to achieve program goals within the unique
circumstances of each individual county.
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby
requests that the state legislature remove the detailed legislative and regulatory
mandates which burden local governments and replace them with broadly stated goals and
objectives for the delivery of services to state residents.
BE IT FURTHER RESOLVED that the State Legislature allow counties to develop
individualized procedures and programs for the delivery of services within their county,
in a manner which will encourage cost effective innovations.
BE IT FURTHER RESOLVED that a copy of this resolution shall be provided to each state
legislator representing residents of Otter Tail County, along with a request for
support.

OTTER TAIL COUNTY BOARD
WETLANDS CONSERVATION ACT
OTTER TAIL COUNTY RESOLUTION 95-07
Upon motion by Lindquist, seconded by Lee and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, the Minnesota Wetlands Conservation Act currently places a disproportionate
burden on counties such as Otter Tail, which have retained the majority of their
historic wetlands; and
WHEREAS, the Wetlands Conservation Act unduly restricts the rights of private
landowners; and
WHEREAS, there remain unresolved constitutional issues regarding liability for the
11 taking11 of private land under the Wetlands Conservation Act; and
WHEREAS, the Association of Minnesota Counties has proposed amendments to the Wetlands
Conservation Act recommended by the Association of Minnesota Counties.
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby
declares its support for the proposed amendments to the Wetlands Conservation Act
recommended by the Association of Minnesota Counties.
BE IT FURTHER RESOLVED that a copy of this resolution and of the proposed amendments to
the Wetlands conservation Act be sent to each of the state legislators representing
residents of Otter Tail County.

TANGLEWOOD -PELICAN LAKE
Motion by Lee, seconded Windels and unanimously carried to authorize the Chairman's
signature on a quit claim deed from Otter Tail County to the current property owners
releasing restrictions placed on the property in 1974. The property has been replatted
since 1979 and complies with current ordinances.
