HomeMy WebLinkAboutBoard of Commissioners - Minutes - 12/20/1994Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Tuesday, December 20, 1994 9:30 p.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, December 20, 1994, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Harley Windels, Chairman; Bill Stone, Malcolm Lee, Virginia Partmann and Andy Lindquist present. APPROVAL OF MINUTES Motion by Lee, seconded Partmann and unanimously carried, to approve the minutes of December 13, 1994, as submitted. PLANNING COMMISSION APPOINTMENTS Motion by Lindquist, seconded Lee and unanimously carried to reappoint Les Estes for a three (3) year term and Bert Olson for a four (4) year term to the Planning Commission effective January 1, 1995. Motion by Lee, seconded Lindquist and unanimously carried to appoint 0 , Pelican Rapids, to the Planning Commission for a three year January 1, 1995, to replace the term of Merle Miller . ...... Robert Ronningen, term effective Motion by Portmann, seconded Stone and unanimously carried to reappoint Leona Zimmerman to the Planning Commission for a three (3) year term effective January 1, 1995. PURCHASE -LASER LEVELS Motion by Lee, seconded by Partmann and unanimously carried to authorize the Land & Resource Director to purchase two laser levels and one grade rod at a cost of $1,150 each and $180 respectively. Monies will be paid from the Wetland Grant and Water Plan Grant funds. WASTE EDUCATION GRANT Public Information Officer, Marie Tysdal, updated the board on a Waste Education Grant available at a 75% (State) contribution and 25% (county) portion. Ms. Tysdal provided a handout of the project plan with specific deadlines for sampling recyclable waste and corresponding newsletters to educate the public of the correct way to recycle. Commissioner Partmann stressed the importance of shortening the newsletters or providing an insert people can retain with the most important information. Commissioner Stone stressed targeting recycling education in the schools. Motion by Lindquist, seconded Partmann and unanimously carried to authorize the Public Information Officer to proceed with the application for the Waste Education Grant while incorporating education in the schools into the project plan. OTTER TRAIL RIDERS SNOWMOBILE CLUB AGREEMENT Motion by Stone, seconded Lee and unanimously carried to authorize the Highway Engineer to proceed with an agreement with the Otter Trail Riders Snowmobile Club with the same process as has been used with other snowmobile clubs in Otter Tail County. 0 Q 0 OSter Tail County December 20, 1994 Page 2 Board of Commissioners FINAL PAYMENT APPROVED -S.A.P. 56-599-43 Motion by Lee, seconded Stone and unanimously carried to authorize final payment for Project S.A.P. 56-599-43, Elizabeth Township Bridge No. 97438, to Landwehr Construction, Inc. of St. Cloud, MN in the amount of $7,018.81 as recommended by the Highway Engineer. FINAL PAYMENT APPROVED -S.A.P. 56-599-25 Motion by Lindquist, seconded Lee and unanimously carried to authorize final payment for Project S.A.P. 56-599-25, Fergus Falls Township Bridge No. 95087, to Landwehr Construction Inc. of St. Cloud, MN, in the amount of $6,048.14 as recommended by the Highway Engineer. OLD CSAH 35 Motion by Partmann, seconded Stone and unanimously carried to proceed with negotiations with Edna Township for the purpose of turning old CSAH 35 back to the township. GRANT'S MECHANICAL, INC. -CHANGE ORDER NO. M-2 Motion by Lee, seconded Partmann and unanimously carried to approve Change Order No. M-2 from Grant's Mechanical, Inc. of Fargo, ND, in the amount of $619 for relocation of duct work requested by the Otter Tail County Maintenance Department at the New York Mills building. PER DIEM SET Motion by Partmann, seconded Lee and unanimously carried to clarify the Commissioner 1 s per diem allowances as $30 per day maximum for all day meetings and $20 per day for half day meetings. COMPUTER EQUIPMENT -EXTENSION OFFICES County Coordinator, Larry Krohn, updated the board regarding the need for new computer hardware equipment for both East and West County Extension Offices (approximate cost of $3,000 for each office). The software is supplied by the University of Minnesota. Motion by Lindquist, seconded Stone and unanimously carried to approve purchase of computer equipment for the extension offices. Funds for the equipment will come from the money currently budgeted for a new vehicle. A used vehicle from the Sheriff's Department will be provided to the County Extension Office. COMPREHENSIVE AND COLLISION INSURANCE Motion by Lee, seconded Partmann and unanimously carried to authorize the County Coordinator to remove comprehensive and collision insurance on several older county vehicles. GIS STEERING COMMITTEE RECOMMENDATIONS Motion by Partmann, seconded Lee and unanimously carried to authorize formation of a GIS (Geographic Information System) Technical Sub-committee consisting of four (4) members: one from Management Information Systems, one from Dispatch, the County Coordinator, and the Highway Engineer. 0 0 0 Ot,ter Tail County Board of Commissioners December 20, 1994 Page 3 GIS MANAGER POSITION Motion by Lee, seconded Fortmann and unanimously carried to approve a draft GIS Manager position job description written by Spatial Management Group with a change in education requirements to read 11 bachelors degree or equivalent experience". Motion by Lee, seconded Partmann and unanimously carried to authorize the County Coordinator to proceed with recruitment for the GIS Manager position. CLOSED TO PUBLIC At 11:10 a.m., Chairman Windels declared the meeting of the Otter Tail County Board of Commissioners closed to the public for the purpose of evaluating the performance of Richard West, Highway Engineer, subject to its authority pursuant to M.S. 471.705, Subd. ld (d). A summary report of conclusions regarding the evaluation will be provided at the December 27, 1994, County Board meeting. RECONVENED At 1:08 p.m., the Otter Tail County Board reconvened after concluding the closed session at 11:55 a.m. and taking a lunch break. When the meeting reconvened all members were present. APPROVAL TO PAY BILLS Motion by Partmann, seconded Lee and unanimously carried to approve payment of bills per Attachment A of these minutes. RESOLUTION TO UPDATE THE COUNTY COMPREHENSIVE WATER MANAGEMENT PLAN Upon motion by Lee, seconded by Partmann and unanimously carried, the Otter Tail County Board of Commissioners adopted the following resolution: WHEREAS, Minnesota Statutes, Chapter 103B.301, Comprehensive Local Water Management Act, authorizes Minnesota counties to develop and implement a Comprehensive Local Water Management Plan; and WHEREAS, the act requires that the county update and revise their Comprehensive Local Water Management Plan on a periodic basis; and WHEREAS, recent amendments to the act require all comprehensive local water plans to add three mandatory provisions, relating to well head protection, surface water runoff and high priority wetlands; and WHEREAS, the act requires that plans and official controls of other local government units be consistent with the Comprehensive Local Water Management Plan; and WHEREAS, Otter Tail County has determined that the revision and continued implementation of a Comprehensive Local Water Management Plan by the addition of the three new mandatory provisions will keep the county plan in compliance with the requirements of state law and will help promote the health and welfare of the citizens of Otter Tail County. 0 0 0 Otter Tail County Board of Commissioners December 20, l994 Page 4 NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners resolve to revise and update its current Comprehensive Local Water Management Plan by the addition of the three new mandatory provisions relating to well head protection, surface water runoff and high priority wetlands. BE IT FURTHER RESOLVED that Otter Tail County will coordinate its efforts in the revision and update of its plan with all local government units within the county and will incorporate, where required by law, any existing plans and rules which have been developed and adopted by watershed districts having jurisdiction wholly or partly within Otter Tail County into its Comprehensive Local Water Management Plan. BE IT FURTHER RESOLVED that the Otter Tail County Board of Commissioners delegates to the county Department of Land and Resource Management the responsibility of coordinating, assembling, and writing the revised Comprehensive Local Water Management Plan by adding the three new mandatory provisions and other changes required by law. Dated, Oren-, N!D ~Ji /7'11/ OTTER TAIL COUNTY BOARD OF.COMMISSIONERS By~~J~~~- Chairman Larry Krohn, Clerk CORRESPONDENCE ACKNOWLEDGED -WEST BATTLE LAKE County Attorney, Wally Senyk, read a letter from the DNR Area Fisheries Supervisor, Arlin Schalekamp, regarding an area on the east end of West Battle Lake (CSAH #5 right- of-way). Because Otter Tail County does not own all of the right-of-way in this area and area landowners are not interested in selling their properties, Mr. Schalekamp recommended that the proposal to establish an Aquatic Management Area be abandoned. LEASE -REGIONAL TREATMENT CENTER County Attorney, Wally Senyk, explained to the board that the lease Regional Treatment Center is a five (5) year term lease subject to in the event that the Regional Treatment Center would be closed. compensation to Otter Tail County for any improvements or remodeling agreement with the a 90 day termination There would be no costs incurred. Chairman Windels directed the County Attorney to draft a letter to Representative Bob Anderson and Senator Cal Larson explaining the county's desire to use existing public buildings rather than building new, however, a 90 day termination restriction creates a potential liability for the county. The building committee will explore other options for space. PAYABLE 1995 TAX LEVY AND BUDGET RESOLUTION The following resolution was offered by Commissioner Lee, who moved for the adoption of the l995 budget for the General Fund, the budgeted Special Revenue Funds, the Debt Service Funds and for the adoption of the payable 1995 Gross and Net Tax Levy: Q 0 0 Otter Tail County Board of Commissioners December 20, 1994 Page 5 WHEREAS, The Otter Tail County Board of Commissioners held the required public hearing on December 13th, 1994, at 7:30 p.m., in the Otter Tail County Commissioners' Room, for the purpose of discussing and receiving public input regarding the 1995 budget proposed for the General Fund, the proposed budgeted Special Revenue Funds, the proposed Debt Service Funds and for the purpose of discussing and receiving public input regarding the proposed payable 1995 Gross and Net Tax Levy. WHEREAS, Public discussion and comment regarding the County Budget and Tax Levy was received, on December 13th, 1994, and all interested individuals in attendance were provided an opportunity to address the Otter Tail County Board of Commissioners with their concerns. WHEREAS, The Otter Tail County Board of Commissioners having received public discussion and input from all interested individuals in attendance declared the public hearing adjourned and stated that final action adopting the 1995 Budget and Tax Levy would take place on December 20th, 1994, at 2:00 p.m. in the Otter Tail County Commissioners' Room. THEREFORE, BE IT RESOLVED, That the Otter Tail County Board of Commissioners adopts the amount of $36,402,671 as the County's 1995 budget for the General Fund, the budgeted Special Revenue Funds and for the Debt Service Funds, as detailed in the attached documents. The culvert was installed by Delzer Construction at the Wayne Shol approach. 0 0 Ot,ter Tail County Board of Commissioners December 20, 1994 Page 7 PAYMENT APPROVED -HOUSE DEMOLITION PROJECT Motion by Lee, seconded by Lindquist and unanimously carried to approve payments, in the amount of $9,280 and $1,700, to Egge Construction, Inc. for the demolition of a structure located on a parcel of tax forfeited property in the City of Pelican Rapids. RESOLUTION FOR NEW COMPUTERIZED PAYROLL/PERSONNEL SYSTEM Upon motion by Lee, seconded by Lindquist and unanimously carried, the following resolution was adopted: WHEREAS, Otter Tail County is in the process of installing a new computerized payroll/personnel system, and WHEREAS, it is in the best interest of Otter Tail County for uniform reporting and efficiency to consolidate various functions of the payroll/personnel system. NOW, THEREFORE BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the consolidation of the responsibility for the maintenance of the records entered into the payroll/personnel system, and BE IT FURTHER RESOLVED, that the responsibility for the maintenance of the payroll/personnel records will be shared by the County Coordinator's office and the County Auditor's office based on discussion between these two office as to the most effective method for maintaining uniform payroll/personnel records.
