CALL TO ORDER
The Otter Tail County Board of Commissioners convened Wednesday, December 7, 1994, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Harley Windels,
Chairman; Bill Stone, Malcolm.Lee and Andy Lindquist present.
APPROVAL OF MINUTES
Motion by Lee, seconded Lindquist and unanimously carried, to approve the minutes of
November 22, 1994, as submitted.
DITCH NO. 23
Ditch Inspector, Tiny Holm, reported having received a phone call on November 21 from
Ken Prehm, Chairman of the Star Lake/Dead Lake Association, follo~ing use of the 11 cookie
cutter 11 • He indicated everything is working the way they hoped it would. They
requested the Board to make a decision on whether or not to deny their previously
presented petition to repair Ditch No. 23.
OJllowing discussion, Stone motioned, seconded Lee and unanimously ,carried to deny
repair of Ditch 23 because the creek has been cleared and is flowing at increased
capacity. (
DITCH NO. 70
Holm also reported that repair of Ditch 70 was completed November 26. Twelve feet of
old drain tile and tree roots, not on the ditch system, were removed and replaced by
plastic. Total cost of $350 will be paid by the affected property owners. Holm
suggested that the previous motion of November 22, to use up to $500 from the Ditch 70
fund to pay for the repair should be rescinded.
Follwoing discussion, Lindquist motioned, seconded Lee and unanimously carried, to
rescind the previous motion and retain the $500 in the Ditch 70 fund.
DITCH NO. 55
Following earlier authorization from the Board, Inspector Holm contacted Rick West in
regard to removal of a beaver dam on Ditch 55 {which comes into Dead Lake at the corner
of CSAH 35 & 41}. West contacted Game Warden Lonnie Shieffert who indicated he
will remove the dam.
SPRING WEED MEETING
Holm announced that March 16, 1995 is the scheduled date for the Spring Weed Meeting to
/--i held in conjunction with the East Otter Tail County Township Officers Annual Meeting.

0 LOCAL WATER PLAN UPDATE '95
Bill Kalar, Land & Resource Director, having noted that action on the Local Water Plan
Update had been previously tabled pending a meeting with the Pollution Control Agency
which was attended by him and Commissioner Windels. Kalar provided a brochure
distributed at that meeting, describing a low interest loan program funded by the
Minnesota State Revolving Fund. Property owners receiving the loans would be encouraged
to use the funds toward water quality improvement projects.
Counties which become involved would be responsible and guarantee that the loans be
repaid to the Department of Agriculture in ten years. Possible alternatives
are that either Soil Cons~rvation Districts or landowners themselves may go the
Department of Agriculture directly, eliminating_all responsibility of the county.
Motion by Windels, seconded Lee and unanimously carried that Otter Tail County not
become involved at this time. A suggestion, however, should be made to the East and
West Otter Tail Soil Conservation Districts that their involvement in the program would
be viewed as favorable by the County Board.

BOARD OF WATER AND SOIL RESOURCES LETTER
Copies of the November 7, 1994 letter from BWSR in regard to the Wetlands Conservation
Act were distributed by Kalar. County Attorney Senyk will review and report any
concerns to the Board at a later date.
LAKE RUNNERS TRAIL ASSOCIATION REQUEST
Motion by Lee, seconded Lindquist and unanimously carried to authorize the Lake Runners
Trail Association to execute the Limited Use Agreement with the State of Minnesota Dept.
of Natural Resources.
CONTRACT APPROVED
Motion by Windels, seconded Lindquist and unanimously carried to approve the design
contract for CSAH No. BO with Larson, Peterson & Associates as presented by County
Highway Engineer Rick West.

APPROVAL OF FINAL PAYMENT
Motion by Lindquist, seconded Lee and unanimously carried to approve final payment of
$420,324.70 to Mark Sand & Gravel for SAP 56-633-07, bituminous overlay on CSAH 33.
APPROVAL OF FINAL PAYMENT
Motion by Lee, seconded Lindquist and unanimously carried to approve final payment of
$283,858.72 to Mark Sand & Gravel on SAP 56-659-11, bituminous overlay on CSAH 59.
APPROVAL OF FINAL PAYMENT
Moiton by Stone, seconded Lee and unanimously carried to approve final payment of
$751,468.62 to Mark Sand & Gravel, SAP 56-659°09 & Etc. for reconstruction and
bituminous overlay on CSAH 59 in Urbank.
TOWNSHIP ROAD DESIGN AND CONSTRUCTION ENGINEERING
Motion by Lee, seconded Stone and unanimously carried to authorize Highway Engineer Rick
West to advise the townships of the County1 s decision to discontinue providing design
and construction engineering services to Townships on grading projects due to lack of
manpower and the need to compensate for same by using consultants to perform the
County's work. The county will continue for the present time assisting townships with
with surfacing projects and will continue to provide technical assistance and design and
construction engineering services on bridge replacement projects.

Motion by Lee, seconded Stone and unanimously carried to approve payment in the amount
of $37,100.70 to H & L Mesabi for purchase of seasonal supply of steel cutting edges as
previously awarded.
SPATIAL MANAGEMENT GROUP
County Coordinator Larry Krohn has received a request from SMG to meet with the County
Board and the GIS Steering Committee on December 16 at 2:00 p.m.
LONG DISTANCE CARRIER CHANGE
Motion by Lee, seconded Lindquist and unanimously carried to approve the recommendation
of the County Coordinator to sign a contract with Automated Communications, Inc. (ACI)
(ACI) for long distance telephone service under their offered 11 no term 11 rate (which
means the county would not be required to sign a contract for a specific period of
time). The rate offered by ACI, according to Krohn, would result in an approximate
annual savings of 20% over the current US LINK service.

The County Coordinator reported receiving notification of compliance with the Local
Government Pay Equity Act from the Minnesota Department of Employee Relations. The next
report will be due January 31, 1997.

Krohn reported the Employee Benefits Committee met last week to review rates for the
/';orning year. The new rates recommended by DCA, based on information from Blue
~ross/Blue Shield, had to be acted upon quickly to allow time for printing of enrollment
forms. The rates, which will increase by varying amounts depending upon the plan, were
adopted by the committee.
Additionally, the committee recommended raising the specific stop loss point from
$30,000 to $40,000 and the aggregate from 115% to 120%. Lee motioned, seconded
Lindquist and unanimously carried to approve the recommendations.
COMPUTER CONVERSION
The Coordinator provided an updat~ on the computer conversion progress, noting there has
been considerable discussion on where the new computer should be located. Some
suggested that an area in the courthouse would be more convenient, while others favored
the existing Informations Systems area in the Social Services building on Court Street.
The recommendation of the committee is to do the necessary remodeling of the social
Services building, the cost of which will be covered by the computer conversion budget.
Krohn indicated the computer conversion project is is on schedule and should be on line
for January payroll.
M.A.D.D. REQUEST
Commissioner Lindquist, having recieved a call from Mothers Against Drunk Driving, has
agreed to assist them in organizing a vigil on the courthouse lal'ITl for the evening of

separate fund for contributions received toward land acquis.-ition in the Elmo State
Wildlife Area with the stipulation that funds will be returned to the contributors in
the event of payment of taxes by the State of Minnesota.
INMAN TOWNSHIP ASSESSMENT AGREEMENT
Following a recommendation for approval by Robert Moe, Assessor, a motion was offered by
Stone, seconded Lee and unanimously carried to approve the Joint Assessment Agreement
between Inman Township and Otter Tail County, whereby the Assessor of Otter Tail County
will provide contracted assessment duties for the township.

surveyor's Certificate of Correction to the Plat of San Dee Cove Beach as prepared by
David A. Anderson, Land Surveyor, Minnesota Registration No. 13620:
Pursuant to the provision of Chapter 505.175, Laws of Minnesota, 1957, David A.
Anderson, Registration No. 13620, the undersigned, a Registered Land Surveyor in and for
the State of Minnesota, declares as follows:
1. That the plat of SAN DEE.COVE BEACH, dated December 21, 1921, and filed on February
15, 1922 in the office of the County Recorder, Otter Tail County, Minnesota, in
Book J of Plats, Page 53, was prepared by martin Aalberg, Civil Engineer and
Surveyor, now deceased.
2. That said plat contains the following errors and omissions to wit:

indefinite and uncertain. The call along said shore of Lake Lida was omitted from the
legal description on said plat. The call along the south line of said Section 23, the

Auditor Wayne Stein provided a copy of a letter from the Minnesota Department of
Revenue, Property Tax Division, regarding the estimated percentage increase in 1995
Property Tax.
ERHARD'S GROVE TOWNSHIP PROPOSED TAX LEVY
(\uditor Stein noted that the township line on the Truth in Taxation statements for this
~ar was in error in that the proposed levy which the township_ certified was
significantly high. The corrections will be reflected on the tax statem8nts when they
are mailed.
ROTHSAY TAX LEVY
Corrected statements have been mailed to the City of Rothsay which1 as explained by
Auditor Stein, were necessary due to the certified proposed levy being too low.
SOLID WASTE AGREEMENT
Motion by Lee, seconded Stone and unanimously carried to approve the execution of the
Solid Waste Transfer Services Agreement between Otter Tail County and Steve 1 s
Sanitation subject to his approval of final form and signature by a representative of
Steve's Sanitation. Senyk stated that the agreement is nearly complete and requires
only a few amendments. The agreement covers hauling from three sites; Battle Lake,
Henning1 and the Northeast Landfill.
