HomeMy WebLinkAboutBoard of Commissioners - Minutes - 11/22/19940 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Tuesday, November 22, 1994 1:00 p,m, CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, November 22, 1994, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Harley Windels, Chairman; Bill Stone, Virginia Partmann and Andy Lindquist present. APPROVAL OF MINUTES Motion by Partmann, seconded Stone and unanimously carried to approve the minutes of November 15, 1994, as submitted. DITCH NO. 70 Ditch Inspector, Tiny Holm, requested approval to supervise the repair (clean out} of thirty (30) feet of the Ditch 70 system, between the inlet barrel and the clean out barrel. Expenses will be paid out of the Ditch 70 fund which has a current balance of $500. Motion by Lindquist, seconded Partmann and unanimously carried to direct the Ditch Inspector to supervise the above repair with expenses to be paid from the Ditch 70 fund. Cost of repair(s) exceeding $500 will be paid for by the landowners. CONDITIONAL USE PERMIT Motion by Stone, seconded Lee and unanimously carried to refer the matter of the Conditional Use Permit of Saundra Monahan, West Battle Lake, back to the Planning Commission. EXTENSION -FINAL PLAT Motion by Lindquist, seconded Partmann and unanimously carried to approve the extension of the final plat of Marguart Villa, Fish Lake (Section 17 & 20, Dunn Township), to July 31, 1995, as recommended by the Land & Resource Director. LOCAL WATER PLAN UPDATE Land & Resource Director, Bill Kalar, updated board members regarding the county's local water plan. County Attorney, Wally Senyk 1 informed the Board of Minnesota Statute requirements relative to updating the water plan and the recent state mandated areas which need to be added to the local water plan when it is updated. The Board delayed a decision in this matter until their December 7, 1994, board meeting. MCIT DIVIDEND CHECK Auditor, Wayne Stein, reported receipt of the 1993 property/casualty dividend check from Minnesota Counties Insurance Trust in the amount of $921468. LBE PRESENT Commissioner Lee present at 1:24 p.m. 0 0 0 Otter Tail County Board of Commissioners November 22, 1994 Page 2 PAYMENT APPROVED Motion by Partmann, seconded Lindquist and unanimously carried to approve payment to the Fergus Falls Medical Group, in the amount of $144.50, for services provided per Minnesota Statute 609.35. DISTRICT 10A RECOUNT Auditor, Wayne Stein, reported that the District lOA Recount was completed. The Auditor stressed that the recount went very well and praised the Election Judges for an excellent job. PAYMENT APPROVED Motion by Lee, seconded Stone and unanimously carried to approve payment to the Association of Minnesota Counties, in the amount of $11,802, for the 1995 AMC annual membership dues. FUND TRANSFER AND PAYMENT APPROVED Motion by Stone, seconded Lindquist and unanimously carried to approve a transfer from the General Fund to the County Ditch Fund for County Drainage System #21, in the amount of $2,589.24, to cover a payment schedule to be made to the Otter Tail County Highway Department for engineering and maintenance services provided during the period of July 1, 1993 through June 30, 1994. The motion included authorization for payment to the Highway Department for the above services. CERTIFICATE OF CORRECTION TO PLAT -GUTTENBERG SECOND ADDITION Motion by Lee, seconded Lindquist and unanimously carried to accept the following Land Surveyor's Certificate of Correction to the Plat of Guttenberg Second Addition as prepared by James W. Fowlds, Land Surveyor, Minnesota Registration No. 18164: Pursuant to the provision of Minnesota Statutes Section 505.175, James W. Fowlds, Registration No. 18164, the undersigned, a registered land surveyor in and for the State of Minnesota, states: 1. The plat of Guttenberg Second Addition dated June 10, 1991 and filed in the office of the County Recorder for Otter Tail County in Book Q of Plats, Page 552, was prepared by the undersigned. 2. The legal description of the plat is hereby corrected as follows: That part of Reserve Number 1, GUTTENBERG ADDITION, also known as GUTTENBURG ADDITION, and also known as GUTTENBERG or GUTTENBURG to Fergus Falls, Minnesota according to the plat on file in the office of the County Recorder, Otter Tail County, Minnesota, described as follows: commencing at the iron monument at the Southwest corner of said Reserve Number 1; thence South 62 degrees 34 minutes 37 seconds East, assumed bearing along the southwesterly line of said Reserve Number 1, a distance of 206.11 feet to an iron pipe monument, the point of beginning of the tract to be described; thence continuing South 62 degrees 34 minutes 37 seconds East 469.79 feet along the Southwesterly line of said Reserve Number 1 to an iron pipe monument; thence North 08 degrees 31 minutes 23 seconds East 381.83 feet to an iron pipe monument on the Easterly extension of the South line of that tract of land recorded in Book 385 of 0 0 Otter Tail County Board of Commissioners November 22, 1994 Page 3 Deeds on Page 189 in said County Recorder's Office; thence North 85 degrees 59 minutes 03 seconds West 403.99 feet along the Easterly extension and along the monumented South line of that tract of land recorded in said Book 385 of Deeds on Page 189 to an iron pipe monument; thence South 20 degrees 25 minutes 45 seconds West 202.26 feet to the point of beginning containing 2.85 acres more or less. Subject to easements, restrictions or reservations of record, if any. The reference to Guttenberg Addition in the original plat was actually to the subdivision plat of Guttenburg or Guttenberg. OTTER TAIL COUNTY BOARD OF COMMISSIONERS TRUTH IN TAXATION Auditor, Wayne Stein, provided several tax capacity rate handouts. Assessor, Bob Moe, provided a letter on the 1995 Proposed Property Taxes explaining factors which effect property tax increases and/or decreases. The Board directed the Assessor to make this letter available at the Truth in Taxation meeting {December 13, 1994, at 7:30 p.m. in Commissioners' Room) and to publish this letter in newspapers throughout Otter Tail County. ENGINEERING SERVICES -TOWNSHIP PROJECTS Highway Engineer, Rick West, recommended that the Otter Tail County Highway Department not perform design or construction services (specifically grading or staking) for townships in the future. Commissioner Lee requested the Highway Engineer to provide a written recommendation and return to the Board. CONTRACT APPROVED Motion by Lee, seconded Partmann and unanimously carried to authorize the Chairman's signature on the contract for Glendalough State Park Access Road, S.A.P. 56-600-14. LOW FREQUENCY CHANNEL Motion by Stone, seconded Lee and unanimously carried to authorize the Highway Engineer to purchase a low frequency channel for flaggers and/or survey crew workers while directing traffic, at a cost of $150, payable to the Federal Communications Commission. • 0 Otter Tail County Board of Commissioners November 22, 1994 Page 4 RECYCLING CENTER FACILITY Solid Waste Director, Mike Hanan, appeared at the request of Board members to discuss the large amount of recyclable materials stored on the grounds of the Recycling Center in Fergus Falls. Hanan explained that the situation should improve with a change in staff to take place after the first of the year and additional space currently being added. Board members directed Larry Krohn, County Coordinator, to write a letter to STS Coordinator, Al Keller, requesting help at the recycling facility from the Sentence-To- Service (STS) crew to alleviate the current backlog of recyclables at the center. PAYMENT APPROVED Motion by Lee, seconded Partmann and unanimously carried to approve Change Order No. G-2, in the amount of $914, to Rapp Construction of Alexandria, for the remodeling of the New York Mills building. Motion by Lee, seconded Stone and unanimously carried to approve Change Order No. M-1, in the amount of $2,565, to Grant's Mechanical, Inc. of Fargo, for the remodeling of the New York Mills building. TOLL-FREE NUMBER REQUEST County Coordinator, Larry Krohn, presented a request made by the City of Perham for a toll-free number to be installed at the Otter Tail County Courthouse in Fergus Falls. Krohn explained that a toll-free 800 number would not be feasible at this time because of the number of trunk lines which currently service the courthouse. The incoming calls o automatically default to a trunk line that is not busy. CORRESPONDENCE ACKNOWLEDGED Chairman Windels acknowledged a letter received from Mr. Walter Morton Jr. praising county employees for courteous service he had received. The Chairman requested that the letter be placed in the employee lounge. ADJOURNMENT At 4:15 p.m., Chairman Windels declared the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. on Wednesday, December 7, 1994.
