OTTER TAIL COUNTY BOARD OF COMMISSIONERS
Otter Tail County Courthouse
Tuesday, November 15, 1994

CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, November 15, 1994, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Harley Windels,
Chairman; Bill Stone, Malcolm Lee, and Andy Lindquist present.
APPROVAL OF MINUTES
Motion by Lee, seconded Stone and unanimously carried to approve the minutes of
November 8, 1994, as submitted.
EAW -BLYBERG'S POINT
The Land & Resource Director reported that he received information for an EAW for
Blyberg's Point as ordered by the County Board. Motion by Lee, seconded Lindquist and
unanimously carried to authorize the Land & Resource Director to review the information
received for completeness and accuracy.
Upon motion by Lee, seconded Lindquist and unanimously carried, following publication in
the 11 EQB Monitor", the Planning Commission is directed to review the EAW (Environmental
Assessment Worksheet) and any comments received in order to determine the need for an
EIS (Environmental Impact Statement).
FACILITIES STUDY
Maintenance Supervisor, Rick Sytsma, requested approval of two facility proposals for
professional services of Yeater, Hennings, Ruff, Shultz, Rokke, Welch Architects and
Planners for; 1) a Mechanical Systems Analysis for Otter Tail County facilities and 2) a
Comprehensive Facilities Study.
Motion by Windels, seconded Stone and unanimously carried to approve both proposals with
authorization to proceed as soon as possible with the Mechanical Systems Analysis as
recommended by the Building Committee.
INDIRECT COST ALLOCATION PLAN
Motion by Lee, seconded Lindquist and unanimously carried to authorize the Chairman to
sign a two year contract with the Minnesota Counties Research Foundation, for the
completion of the County's Indirect Cost Allocation Plan for the 1994 and 1995 fiscal
years, subject to the approval of the County Attorney. The fee per year is based on
population and would be $9,800 or a total of $19,600 for the two year period. The
Indirect cost Allocation Plan is prepared by David M. Griffith & Associates.
PAYMENT -ELECTION JUDGES
Motion by Lindquist, seconded Lee and unanimously carried to approve payment to the
following individuals for serving as election judges on the County's Absentee Ballot
Board for the State Primary and/or General Election:

PUBLISHING REQUIREMENTS
Motion by Stone, seconded Lindquist and unanimously carried to authorize the
county Auditor to advertise for bids for the county's 1995 printing and publishing
requirements.
OLD TAX ROLLS
Motion by Stone, seconded Lee and unanimously carried to authorize the Auditor to
dispose of old tax rolls within legal limits, pursuing the possibility of transferring
these records to the Historical Society or the State Archives.
LIQUOR LICENSE
Motion by Lindquist, seconded Lee and unanimously carried to approve the following
application for license, subject to the approval of the County Attorney:

LAND SURVEYORS CERTIFICATE OF CORRECTION TO PLAT
PLEASURE PARK
Motion by Lee 1 seconded Lindquist and unanimously carried to accept the following Land
Surveyor's Certificate of Correction to the plat of Pleasure Park as prepared by Terry
Lee Anderson, Land Surveyor, Minnesota Registration Number 14676:
Pursuant to provisions of Chapter 472, Laws of Minnesota, 1955, and Chapter 505.173
through 505.177, Laws of Minnesota, Terry Lee Anderson, the undersigned, a Registered
Land Surveyor in the State of Minnesota declares as follows:
(1) The subdivision plat of PLEASURE PARK was prepared by Martin Aalberg, a
Registered Land Surveyor of whom is deceased.
(2) The subdivision plat of PLEASURE PARK was filed on July 13, 1912 in the office
of the County Recorder in and for Otter Tail County, Minnesota and was
recorded in Book M of Plats on Page 25.
(3) That said subdivision plat of PLEASURE PARK contains errors, omissions or
defects in the following particulars to wit:
(4) A strip of land along the shoreline of Otter Tail Lake was undefined. The
surveyors plat shows a solid line an undefined distance up from the actual
shoreline as to the southerly line of the lots. However the legal description
on the dedication portion calls out this line as the shoreline of Otter Tail
Lake.
(5) It was the obvious intent of the original surveyor to include said strip of
land along the shoreline as a part of the plat. The line as surveyed was to
identify only the direction of the sidelines of the lots.

{6) The outside boundaries of PLEASURE PARK are to be extended to the shoreline of
Otter Tail Lake.
(7) The sidelines of all lots are to be extended to terminate on the shoreline of
Otter Tail Lake.

PREMISE PERMIT APPLICATION
Upon a motion by Lee, seconded Lindquist and unanimously carried the following
resolution was adopted:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling
Control Board; and
WHEREAS, the Dent Lions Club, Dent, MN, has made an application to the Gambling Control
Board for a premise permit to conduct lawful gambling at Ye Olde School House Bar and
Grill in Friberg Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not
issue a permit unless they receive a resolution from the Otter Tail County Board of
Commissioners approving the permit; and
WHEREAS 1 the Otter Tail County Board of Commissioners is aware of no reason to oppose
the conduct of lawful gambling by the Dent Lions Club, Dent, MN, at Ye Olde School House
Bar and Grill in Friberg Township of Otter Tail County.
NOW, THEREFORE BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
approves the conduct of lawful gambling by the Dent Lions Club, Dent, MN, at Ye Olde
School House Bar and Grill in Friberg Township of Otter Tail County, provided that the
application meets all the necessary criteria for the licenses and permits required by
the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided
to the Town Board of Friberg Township by sending them a copy of this resolution.

PREMISE PERMIT APPLICATION
Upon a motion by Lee, seconded Lindquist and unanimously carried the following
resolution was adopted:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling
Control Board; and
WHEREAS, the Dent Lions Club, Dent, MN, has made an application to the Gambling Control
Board for a premise permit to conduct lawful gambling at the Weetown Pantry and Pub in
Friberg Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not
issue a permit unless they receive a resolution from the Otter Tail County Board of
Commissioners approving the permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose

CORRESPONDENCE ACKNOWLEDGED
Chairman Windels acknowledged correspondence received from the Board of Water and Soil
Resources (BWSR) and Isanti County.
ALLIANCE FOR QUALITY LIVING
Extension Educator, Harold Stanislawski, provided handouts and updated the board
relative to the Alliance for Quality Living group. Lengthy discussion followed
regarding feedlot regulation and Land Use Ordinances.

DAIRY RETENTION & ENHANCEMENT LEADERSHIP
Dairy Retention & Enhancement Leadership Task Force members, Allan Schroeder,
Ken Herbenson, Mark Helland, and Harold Stanislawski appeared before the Board to
provide information on the Dairy Industry Business Retention and Enhancement Strategies
Program in Otter Tail County. Discussion revolved around the loss of farms and
reduction of milk production in the dairy industry within Otter Tail County. The task
force members will be conducting a survey with dairy farmers in the county and report
back to the Board with their conclusions.
FINAL PAYMENT -PHELPS MILL DAM REPAIR PROJECT
Motion by Partmann, seconded Lindquist and unanimously carried to approve final payment
of $27,228.21 to Barbarossa and Sons, Inc. for the Phelps Mill Dam Repair Project.
APPROVAL OF BILLS
Motion by Stone, seconded Partmann and unanimously carried to approve the following
bills per Attachment A.
ADJOURNMENT
At 12:15 p.m., Chairman Windels declared the meeting of the Otter Tail County Board of
Commissioners adjourned until 1:00 p.m. Tuesday, November 22, 1994.
