OTTER TAIL COUNTY BOARD OF COMMISSIONERS
Otter Tail County Courthouse
Tuesday, November 1, 1994
9:30 a.m.
CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, November 1, 1994, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Harley Windels,
Chairmani Bill Stone, Virginia Partmann, Malcolm Lee, and Andy Lindquist present.
APPROVAL OF MINUTES
Motion by Lee, seconded Lindquist and unanimously carried to approve the
October 25, 1994, minutes as submitted.
SEWAGE DISPOSAL INSTALLERS LICENSE APPLICATION
Motion by Lee, seconded Partmann and unanimously carried to approve the following
Application for Sewage Disposal Installers License:
Lake Construction, John Lake
RAINBOW POINT, MARION LAKE
EAW NEEDS DETERMINATION
Discussion took place with several individuals prior to the Board taking action on
on an Environmental Assessment Worksheet Needs Determination regarding Rainbow Point, a
cluster development on Marion Lake. Those individuals providing input included:
Bill Kalar, Land & Resource Director; Wally Senyk and Barb Hanson, County Attorneys;
Tom Hammers, developer; John Menze, attorney for developer; and Harold Jelleberg,
representative of Marion Lake Association and Marion Lake property owners.
Motion by Partmann, seconded Lee and carried, with Stone opposed, to accept the
recommendation of the Planning Commission that an Environmental Assessment Worksheet on
Rainbow Point Development be completed as outlined in the Planning Commission Findings,
dated October 27, 1994, under the heading RECOMMENDATION.
BOARD POLICY SET
Motion by Partmann, seconded Lee and unanimously carried that future Environmental
Assessment Worksheet discussions will follow these guidelines and be adopted as policy:
1) Discussion will address only new material not previously discussed.
2) Attorney comment may not exceed five minutes.
3) Cluster development philosophy and lecture will not take place.
OTTER TAIL COUNTY DRAINAGE DITCH NO. 70
Tiny Holm, Ditch Inspector, discussed Otter Tail County Drainage Ditch No. 70. He
outlined the difficulty with regard to the original ditch design indicating that there
is no evidence that this ditch was constructed in accordance with the design. Concern

over jurisdiction, costs, etc. were also discussed at length. The County Attorney was
directed to prepare a letter to be sent to those property owners who had petitioned for
repair outlining the process and potential expenses. The intent of the letter was to
allow those petitioners to withdraw their signature, should they desire, after they are
made aware of the process and expense.
DETENTION OFFICER ELIGIBILITY LIST
Motion by Lindquist, seconded Lee and unanimously carried to authorize the Detention
Facility Administrator to proceed with re-establishment of an eligibility list for
Detention Officer/Dispatcher positions. Lt. Halvorson will work with the Coordinator's
office on this endeavor.
PROPERTY APPRAISAL SERVICE AGREEMENTS
Motion by Lee, seconded Partmann and unanimously carried to authorize the Chairman's
signature on the following Property Appraisal Service Agreements:
Gary Eckley -St. Olaf, Aastad Townships
Scott Sampson -Orwell, Western Townships
Anthony Vigen -Erhards Grove, Carlisle Townships
BOARD OF COMMISSIONERS' MEETING DATE CHANGE
Motion by Lee, seconded Stone and unanimously carried to change the meeting of the
Otter Tail County Board of Commissioners scheduled for 9:30 a.m. on Tuesday, December 6 1
1994, to 9:30 a.m. on Wednesday, December 7, 1994. The change is to accommodate the
Annual Association of Minnesota Counties meeting.
COMMUNITY PARTNERS
Motion by Lee, seconded Partmann and unanimously carried to authorize payment of $8,384
to Lake Region Community Partners. Such payment is part of a 2:1 match. In this case,
the Regional Treatment Center's employees' union contributed $4,192.
CLOSED TO PUBLIC
At ll:00 a.rn., Chairman Windels declared the meeting of the Otter Tail County Board of
Commissioners' closed to the public for the purpose of evaluating the performance of
Virginia Rustad, Court Administrator, subject to its authority pursuant to M.S. 471.705,
Subd. ld (d). A summary report of conclusions regarding the evaluation will be provided
at the November 8, 1994, County Board meeting.
RECONVENED
At 1:00 p.m., the Otter Tail County Board reconvened after concluding the closed session
at 11:50 a.m. and taking a lunch break. When the meeting reconvened all members
present.
APPROVAL TO PAY BILLS
Motion by Stone, seconded Lee and unanimously carried to approve payment of bills per
Attachment A of these minutes.
ELMO STATE WILDLIFE AREA ACQUISITION
After discussion with DNR Area Wildlife Manager, Doug Wells, regarding an earlier
request by the DNR for certification of land for the Elmo State Wildlife Area, the Board

requested Commissioner Stone work with Wells and the sportsmen's club{s)
to resolve the tax disparity issue associated with this acquisition.
COPS AHEAD GRANT

Motion by Partmann, seconded Lindquist and carried, with Lee opposed, to authorize the
Sheriff to apply for Community Oriented Policing Services Accelerated Hiring, Education
and Deployment Grant (COPS AHEAD) as presented by Sheriff Gary Nelson and Chief Deputy
Mark Morris.
INTRODUCTION TO BOARD
Larry ''Budn Nornes introduced himself as an Independent Republican candidate for
District l0A.
RECESS
At 2:00 p.m., Chairman Windels called for a ten minute recess. At 2:10 p.m., the
meeting of the Otter Tail County Board of Commissioners reconvened with all
Commissioners present.
EXTENSION COMMITTEE MEETING
Motion by Stone, seconded Partmann and unanimously carried to authorize Commissioner Lee
to attend an upcoming Extension Committee meeting slated for November 10, 1994.
ADJOURNMENT
At 2:15 p.m., Chairman Windels declared the meeting of the Otter Tail County Board of
Commissioners adjourned until 1:00 p.m. on Tuesday, November 8, 1994.
