HomeMy WebLinkAboutBoard of Commissioners - Minutes - 10/11/1994a r1 \,;,,;I 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Tuesday, October 11, 1994 1:00 p.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, October 11, 1994, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Harley Windels, Chairman; Bill Stone, Virginia Partmann, Malcolm Lee, and Andy Lindquist present. APPROVAL OF MINUTES Motion by Partmann, seconded Lee and unanimously carried to approve the October 4, 1994, minutes as submitted. PUBLIC HEARING: PROPOSED COUNTY ORDINANCE TO RESTRICT CONDUCT ON PREMISES LICENSED FOR ALCOHOLIC BEVERAGES Wally Senyk, County Attorney, outlined details of a proposed county ordinance to restrict conduct on premises licensed for alcoholic beverages. He stressed such an ordinance would apply only to premises licensed by the county to serve alcoholic beverages. The Chairman asked for, but did not receive, public comment. He also noted no written comment had been received on the matter. A motion was offered by Partmann, seconded Lindquist and unanimously carried to enact the Otter Tail County Ordinance Restricting Conduct Upon Premises Licensed for Alcoholic Beverages. PLANNING COMMISSION RECOMMENDATIONS Motion by Lee, seconded Partmann and unanimously carried to uphold the approval of the Planning Commission on the following: Preliminary Plat: 11Star Point Estates Second Addition11 , Bud & Virginia Sand, Star Lake Conditional Use Applications: Gilbert Wegscheid, Rush Lake Ken Johnson Estate c/o Helen Foltz, Lake Lizzie Ray/Barbara Huelsman & Maryann Althoff, Pickerel Lake Eugene & Eric Hanson, Star Lake Kenneth Johnson/Donald Dillion, Lake Lizzie Terry Hauger, East Spirit Lake Motion by Stone, seconded Lee and unanimously carried to direct the Planning Commission to order the preparation of an Environmental Assessment Worksheet (EAW) prior to taking action on the Conditional Use Application of Peter Fabian/Gary Bessett, Otter Tail Lake. Motion by Lindquist, seconded Lee and unanimously carried to direct the Planning Commission to proceed with an Environmental Assessment Worksheet Needs Determination with regard to Rainbow Point, Marion Lake. 0 0 0 Otter Tail County Board of Commissioners October 11, 1994 Page 2 DITCH NO. 23 Motion by Lee, seconded Lindquist and unanimously carried to accept the recommendation of the Planning Commission that an Environmental Assessment Worksheet (EAW) is not necessary on Otter Tail County Drainage Ditch No. 23. After discussion with members of the Star Lake Association, the Board indicated they would take no further action on Ditch 23 until word is received from the Department of Natural Resources on whether they will use the 11 cookie cutter 1' approach on the creek/natural channel. DITCH NO. 52 Motion by Partmann, seconded Lee and unanimously carried to direct the Ditch Inspector to obtain written consent of Lauritz Bystol for beaver obstruction removal on Otter Tail County Drainage Ditch No. 52. The Ditch Inspector was also asked to photograph problem area. COPY FEES Wendy Metcalf, County Recorder, indicated she would provide a rate recommendation for the Board's consideration at the next Board meeting. BID AWARD: S.A.P. 56-600-14, GLENDALOUGH STATE PARK ACCESS ROAD Motion by Lee, seconded Lindquist and unanimously carried to award, as recommended by the Highway Engineer, project S.A.P. 56-600-14, Glendalough State Park Access Road to the lowest bidder as follows: Central Specialties, Inc. $148,880.67 Alexandria, MN BID AWARD: S.A.P. 56-631-04 -CULVERT REPLACEMENT & GRADING Motion by Lee 1 seconded Lindquist and unanimously carried to award, as recommended by the Highway Engineer, project S.A.P. 56-631-04, Culvert Replacement & Grading to the lowest bidder as follows: Riley Bros. Construction, Inc. $444,188.66 Morris, MN UNDERGROUND STORAGE TANK REMOVAL Motion by Stone, seconded Lee and unanimously carried to authorize the Highway Engineer to enter into an agreement with West Central Environmental Consultants, Morris, MN, for removal of underground storage tanks at the Vergas Highway Garage and the courthouse locations. Motion by Partmann, seconded Lee and unanimously carried to authorize the Highway Engineer to sign the removal agreements with West Central Environmental Consultants. HIGHWAY CONSTRUCTION CONTRACT Motion by Lee, seconded Partmann and unanimously carried to authorize the chairman's signature on highway construction contracts with Landwehr Construction, Inc., St. Cloud, MN, on project S.A.P. 56-599-25 as awarded. • 0 0 0 Otter Tail County Board of Commissioners October 11, 1994 Page 3 STORM WATER PERMIT Motion by Lindquist, seconded Lee and unanimously carried to approve payment in the amount of $85 to the Minnesota Pollution Control Agency for a Storm Water Permit - Glendalough State Park. STATE HISTORICAL SOCIETY Rick West, Highway Engineer, discussed highway projects along CSAH 3 and CSAH 31. He indicated work is required by the State Historical Society for cultural resource investigations. The Board acknowledged the process described by the Engineer as Phase I and Phase II. West was directed to proceed. COMPUTER SOFTWARE SELECTION COMMITTEE Motion by Lee, seconded Partmann and unanimously carried to accept the recommendation of the Computer Software Selection Committee (Moe/Stein/Andrews) to acquire the Minnesota Counties Computer Cooperative (MCCC) tax software. ELECTION JUDGES: STATE GENERAL ELECTION Motion by Partmann, seconded Lindquist and unanimously carried to approve the appointment of the following individuals as election judges for the November 8, 1994, State General Election: Anne Hanley (DFL) Harold Stanislawski (IR) CANVASSING BOARD APPOINTMENTS Motion by Lee, seconded Lindquist and unanimously carried to appoint Commissioners Partmann and Windels to the 1994 State General Election County Canvassing Board. The Canvassing Board will meet at 8:00 a.m. on Monday, November 14 1 1994. WORK STUDY PROGRAM Motion by Lee 1 seconded Partmann and unanimously carried to approve the continuance of the work study position in the Auditor's office through June 2, 1995. RECYCLING FACILITY Mike Hanan, Solid Waste Director, detailed added costs of the basic concept of system evaluation, design and construction of the recycling facility project being done by Orr Schelon Mayenon & Associates, Inc. (OSM}. A motion was offered by Lee, seconded Partmann and unanimously carried to proceed with Phase III which include the added costs outlined by Hanan totalling $33,230. RECYCLING POSITIONS Motion by Partmann, seconded Lindquist and unanimously carried to direct the Reclassification Committee to determine the classification ranges on the new recycling positions as soon as possible. MINNESOTA COUNTIES RESEARCH FOUNDATION CONTRACT Motion by Lee, seconded Lindquist and unanimously carried to authorize the Chairman's signature on the Agreement to Provide Professional Consulting Services Between Minnesota Counties Research Foundation and Otter Tail County, Minnesota (David M. Griffith & Associates, DMG) for the job classification system, including the development and 0 Q Q otter Tail County Board of Commissioners October 11, 1994 Page 4 evaluation of position descriptions, analysis of the existing pay plan and preparation of a pay equity report. REMODELING PROJECT: NEW YORK MILLS BUILDING Motion by windels, seconded Partmann and unanimously carried to approve Change Order No. E-1, Mark's Electric, Inc. of Detroit Lakes, MN, to add $888. Motion by Lee, seconded Lindquist and unanimously carried to approve Change Order No. G-1, Rapp Construction Inc. of Alexandria, MN, to add $15,775. Motion by Lindquist, seconded Lee and unanimously carried to authorize payment in the amount of $66,150, payable to Rapp Construction, Inc. of Alexandria, MN, as scheduled payment. Motion by Lee, seconded Lindquist and unanimously carried to authorize the Chairman's signature on the following construction contracts, as previously awarded, for the remodeling of the New York Mills building: Rapp Construction, Inc. -General Contractor Alexandria, MN Mark's Electric, Inc. -Electrical Detroit Lakes, MN Grant's Mechanical, Inc. -Mechanical Fargo, ND PAYMENT APPROVED $406,960 $116,400 $6,300 $126,388 Motion by Lee, seconded Partmann and unanimously carried to approve payment of deductible reimbursement to Minnesota Counties Insurance Trust, File No. 1927, in the amount of $1,136.88. Motion by Stone, seconded Lindquist and unanimously carried to approve payment of $37,685 as final assessment for the retirement of Trust I -Workers' Compensation, payable to Minnesota Counties Insurance Trust. SPATIAL MANAGEMENT GROUP, INC. Motion by Lee, seconded Partmann and unanimously carried to approve the estimate/work order of Spatial Management Group, Inc. for the digital quad maps covering Otter Tail County to be acquired from MnDOT; convert the digital maps to ARC/Info coverages for the entire county with coverages suitable for use in a county GIS data base, etc. The cost estimate is $3,000, the county will be billed for actual work done on an hourly basis. AERIAL MAPPING Motion by Lindquist, seconded Lee and unanimously carried to approve payment to Horizons, Inc., Minnetonka, MN", for professional aerial survey services for a portion of Otter Tail County, detailed as follows: Aerial Photography Digital Planimetric Mapping $1,800 $6,960 ' • J ---.--:r .c,oard of Commissioners uctober 11, 1994 Page 5 ADJOURNMENT At 4:21 p.m., Chairman Windels declared the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m., Tuesday, October 18, 1994.
