HomeMy WebLinkAboutBoard of Commissioners - Minutes - 09/06/19940 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, September 6, 1994 9:30 a.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, September 6, 1994, at 9:31 a.m. at the Otter Tail County Courthouse with Commissioners Harley Windels, Chairman; Bill Stone, and Andy Lindquist present. Commissioners Malcolm Lee and Virginia Partmann were absent. APPROVAL OF MINUTES Motion by Lindquist, seconded by Stone and unanimously carried to approve the August 23, 1994, minutes as submitted. CANVASSING BOARD Motion by Lindquist, seconded by Stone and unanimously carried to nominate Commissioners Lee and Partmann to the 1994 State Primary Election County Canvassing Board. TRANSFER OF LIQUOR LICENSE 0 Motion by Lindquist, seconded by Stone and unanimously carried to approve the transfer of the following licenses issued to the Graystone Lodge for the period of July 1, 1994 through June 30, 1995 from James and Beverly Ellis to Karen Zell effective September 1, 1994: Liquor and Sunday Liquor Off Sale Non-Intoxicating Malt Liquor The above approval is subject to the submission of the original insurance certificate. REQUEST TO REPURCHASE TAX FORFEITED PROPERTY UPON motion made by Stone, seconded by Lindquist and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that WHEREAS, an application to repurchase has been made by Oliver and Marie Truax, former owners of record of the following legally described parcels: 67-000-99-0136-001 Deer Creek Soule's Addn. West 64' of Lot 4, Block 1 67-000-99-0136-900 Deer Creek Soule's Addn East 10' of Lot 4, Block 1 0 0 0 Otter Tail County Board of Commissioners September 6, 1994 Page 2 Said property having forfeited to the State of Minnesota on the 4th day of August, 1994, for nonpayment of the 1990, 1991, 1992, 1993 and 1994 property tax, in the total amount of delinquent taxes, penalties, costs, interest, etc., of $12,195.97. WHEREAS, the applicant's request the Otter Tail County Board of Commissioners to approve the repurchase application subject to the payment in full of all taxes, penalties, costs, interest, etc., by October 15th, 1994. WHEREAS, the total amount required to repurchase this property during the period of September 1, 1994 through September 30, 1994, is $12,274.96 and the total amount required to repurchase this property during the period of October 1, 1994 through October 15, 1994 is $12,354.15. NOW, THEREFORE, BE IT HEREBY RESOLVED, the Otter Tail County Board of Commissioners hereby approves the repurchase of the above tax forfeited properties provided the total amount due is received by the Otter Tail County Auditor no later than October 15, 1994. NOW, THEREFORE, BE IT FURTHER RESOLVED, the Otter Tail County Board of Commissioners hereby approves the repurchase of the above tax forfeited property, and finds the repurchase to be in the best public interest and to relieve undue hardship resulting from the forfeiture. Lot 8 Block 3 Said property having forfeited to the State of Minnesota on the 31st day of August, 1993, for nonpayment of the 1989, property tax, in the total amount of delinquent taxes, penalties, costs, interest, etc. of $2.;-115.55 as of September 30th, 1994. WHEREAS, the applicant's request the Otter Tail County Board of Commissioners to approve the application to repurchase the above described parcel with the following conditions: 7 0 Otter Tail County Board of Commissioners September 6, 1994 Page 3 1. A down payment of $500.00. 2. The balance to be paid in six equal installments plus interest as stated in item 3. With the first installment due on September 30, 1994 and the last installment due by February 28, 1995. 3. Interest will be calculated on the unpaid balance at a annual rate of 10%. The amount of accrued interest will be added to each installment. NOW, THEREFORE, BE IT HEREBY RESOLVED, the Otter Tail County Board of Commissioners hereby approves the repurchase of the above tax forfeited property, under the conditions stated above, and find the repurchase to be in the best public interest and to relieve undue hardship resulting from the forfeiture. Dated: /yFwr??:e:':". /3,, /Q?I/ OTTER TAIL By COUNTY J, OF 0 COMMISSIONERS 1s1 Chairman Attest: BUDGET REVIEW 0 Auditor, Wayne Stein, and Accountant, Mitzi Peterson, distributed a detailed budget review handout. Discussion followed at length regarding the 1995 tax levy, specific budgeted categories, and several tax levy options. Review and recommendation for approval of the Otter Tail County budget will take place at the September 13, 1994, board meeting. () LAZY ACRES DEVELOPMENT PROJECT -MARION LAKE Melvin Klein, Marion Lake Association, presented on behalf of Marion Lake Association members and other interested parties a petition containing 495 signatures requesting the Board of Commissioners to require the developers of the Lazy Acres Development to apply for a new conditional use permit before continuing their work. Commissioner Partmann arrived at 11 a.m. After Mr. Klein's presentation, County Attorney, Wally Senyk, responded to concerns expressed. Mr. Senyk's opinion, based on the language of the Otter Tail County Shoreland Ordinance, is that the Lazy Acres Development situation does not require a new conditional use permit and the developers can operate under a conditional use permit issued to Cal Mielke in 1990. However, an on-site inspection on September 2, 1994, revealed three violations of the Shoreland Management Ordinance identified as follows: 1} cutting of trees in the shore impact zone. 2) A pile of stumps and other debris was cited as a violation of proper disposal. 3) Lack of stabilization. Mr. Klein indicated his concerns regarding the potential violation of the centralized docking requirement. Mr. Kalar indicated that his department had received a copy of the sewage treatment system from the Minnesota Health Department. 0 Q Otter Tail County Board of Commissioners September 6, 1994 Page 4 The Chairman then called on several citizens wishing to express their concerns. Kermit Larson, Perham, asked for a comprehensive plan as to how violations will be rectified. Richard Kotschevar, Marion Lake, expressed concern for native trees along the shoreline. The developers stated that they intend to correct any violations and wish to work within the parameters of the permit. The developers submitted a draft final plan of this project to the Land & Resource Director, Bill Kalar, immediately preceding this meeting. The Chairman directed Mr. Kalar to review this new information and return to the board at the September 13, 1994, regular County Board meeting. RECESS CALLED At 12:03 p.m., Chairman Windels recessed the meeting of the Otter Tail County Board of Commissioners. The Board of Commissioners reconvened at 1:18 p.m. with Commissioners Harley Windels, Chairman; Bill Stone, and Virginia Partmann present and Commissioners Malcolm Lee and Andy Lindquist absent. APPROVAL TO PAY BILLS Motion by Stone, seconded by Partmann and unanimously carried to authorize the payment of bills and claims per Attachment A of these minutes. SOLID WASTE TRANSFER SITES Mike Hanan, Solid Waste Director, will recommend bid awards for the transfer facilities at the September 13 1 1994 regular board meeting. Hanan expressed a desire to accompany the Commissioners on a tour of the Northeast and Fergus Falls Landfills to view the progress and changes in the process of building the transfer sites. A tentative date of October 4, 1994 has been set. FLUORESCENT LAMP TUBE COLLECTION The Solid Waste Director informed the board of a fluorescent lamp tube recycling collection occurring September 14 & 15, 1994, as follows: 09/14/94 11 a.m. -2 p.m. Henning County Garage 09/14/94 4 p.m. -7 p.m. Perham RecYcling Center 09/15/94 11 a.m. -2 p.m. Pelican Rapids County Garage 09/15/94 4 p.m. -7 p.m. Fergus Falls County Garage The program is a cooperative effort between Otter Tail Power, Lake Region Electric and the Otter Tail County Solid Waste Department. PCA -MOTOR VEHICLE SALVAGE FACILITIES Solid Waste Director, Mike Hanan, informed the board of a letter he received from the Pollution Control Agency regarding regulation of motor vehicle salvage facilities. After some discussion, the Chairman directed the Solid Waste Director to draft a list of questions to the PCA in response to this letter. EAW -ENVIRONMENTAL ASSESSMENT WORKSHEET Motion by Partmann, seconded by Stone, and unanimously carried to require the preparation of an Environmental Assessment Worksheet {EAW) for 11 Blyberg's Point", Douglas Haugen, property located in Part of Government Lots 3, 4 and 5, Section 17, Township 137, Range 42, Dunn Township, Bass Lake as recommended by the Planning Commission. 0 Otter Tail County Board of Commissioners September 6, 1994 Page 5 APPROVAL -FINAL PLATS Motion by Portmann, seconded by Stone and unanimously carried to approve the following final plats: Sunnyside Acres, East Leaf Lake, Leaf Lake Township Starland Shores, Star Lake, Star Lake Township Replat of Tanglewood1 Little Pelican Lake, Dunn Township Klar-Jo Beach, West Battle Lake, Clitherall Township FEDERAL WATER BANK PROGRAM Bill Kalar, on behalf of Sandra Giese, Agricultural Soil & Conservation Service, explained that the funding for the Federal Water Bank program may be eliminated. Motion by Stone, seconded by Partmann and unanimously carried supporting the continued funding of the Federal Water Bank program. BRIDGE REPLACEMENT PROGRAM RESOLUTION Highway Engineer, Rick West, distributed copies of the bridge replacement plan to board members. UPON a motion by Stone, seconded by Partmann and unanimously carried the following Bridge Replacement Program resolution was adopted: WHEREAS, Otter Tail County did hold a public hearing on August 25, long range bridge replacement plan, and 1994, to consider a WHEREAS, the adoption of a future bridge replacement plan has been determined to be beneficial. NOW, THEREFORE, IT IS RESOLVED, that the "1994 Otter Tail County Bridge Replacement Plan" dated September 6, 1994, as prepared by the County Engineer, is the 1994 Long Range Bridge Replacement Plan for Otter Tail County. BE IT FURTHER RESOLVED, that the proposed construction date on any project can be changed to accommodate the available funding and construction requirements. Adopted this 6th day of September, 1994. Dated: /4pt;ml,w 14 {ff¥ OTTER SSIONERS By Attest: () Otter Tail County September 6, 1994 Page 6 Board of Commissioners PHELPS MILL -ELECTRICAL & TREE TRIMMING SERVICES Motion by Partmann, seconded by Stone and unanimously carried to authorize the Highway Engineer to proceed with adding electrical service to the north end of Phelps Mill and to hire a professional tree service to trim trees with large dead limbs at approximate costs of $1,500 and $600 respectively. CITY OF DALTON REQUEST Motion by Stone, seconded by Partmann and unanimously carried to grant three acres of land, located on the north side of Highway 12 and the west side of Dalton, to the City of Dalton for their economic development purposes. MONARCH BUTTERFLY Gary Johnson, Battle Lake, showed the Commissioners a monarch caterpillar and cocoon and expressed concern for the milkweed plant which the butterfly feeds on. Commissioner Partmann suggested that Mr. Johnson unite some people and appeal to the State of Minnesota to take the milkweed plant off of the noxious weed list. BUILDERS' RISK INSURANCE Motion by Windels, seconded by Portmann and unanimously carried to approve payment to Meadowbrook Insurance Group, in the amount of $l,OOO, for builders' risk insurance for the New York Mills building construction period effective August 15, 1994 through February 15, 1995.
