CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, August 23, 199~, at
1:00 p.m. at the Otter Tail County Courthouse with Commissioners Harley Windels,
Chairman; Bill Stone, Virginia Partmann, and Malcolm Lee present. Commissioner
Andy Lindquist was absent.
APPROVAL OF MINUTES
Motion by Stone, seconded Partmann and unanimously carried to approve the
August 16, 1994, minutes as submitted.
SOLID WASTE TRANSFER SITE BID OPENING
At 1:03 p.m., after having previously advertised for bids, Mike Hanan, Solid waste
Director, verified with his office that no other bids had been received. After having
done so, the following bids were opened:
After publicly declaring the first bid, an additional bid was delivered to the
Commissioners' room from the firm of Northern Waste Systems, Wahpeton, ND. It was
determined by the County Attorney that this bid could not be considered.

RESOLUTION FOR THE DESIGNATION OF
THE WEST CENTRAL MINNESOTA INITIATIVE FUND
AS THE REGIONAL ECONOMIC DEVELOPMENT DISTRICT
Upon a motion by Partmann, seconded Lee and unanimously carried the following resolution
for designation of the West Central Minnesota Initiative Fund as the Regional Economic
Development District was adopted:
WHEREAS, it is the intent of Otter Tail County to endorse those activities which will
capture additional resources for its citizens, and,
WHEREAS, designation of a regional Economic Development District is a required step for
eligibility of a region to receive economic development planning funds from the Economic
Development Administration of the U.S. Department of Commerce, and
WHEREAS, the West Central Minnesota Initiative Fund (WCMIF) has operated programs which
support economic development throughout the region which provide evidence that WCMIF
would serve as an effective and appropriate representative of a regional approach to
economic development,
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners of Otter Tail
County, Minnesota, supports the efforts of the West Central Minnesota Initiative Fund to
gain designation by the Economic Development Administration as the regional Economic
Development District for the region serving this county.

RESOLUTION IN SUPPORT OF
1994-95 OVERALL ECONOMIC DEVELOPMENT PLAN UPDATE
FOR WEST CENTRAL MINNESOTA
Upon a motion by Partmann, seconded Lee and unanimously carried the following resolution
in support of 1994-95 Overall Economic Development Plan Update for west central
Minnesota was adopted:
WHEREAS, in 1991, the West Central Minnesota Initiative Fund prepared an Overall
Economic Development Program (OEDP} for the region containing Becker, Clay, Douglas,

Grant, Otter Tail, Pope, Stevens, Traverse, and Wilkin Counties of Minnesota {west
central Minnesota), and
WHEREAS, that OEDP contained background, analysis, economic data, goals and objectives
for the betterment of the region, and
WHEREAS, availability of an approved OEDP and related annual updates are a condition for
qualifying for grants for local economic development projects from the Economic
Development Administration of the U.S. Department of Commerce, and
WHEREAS, the West Central Minnesota Initiative Fund has prepared an annual update of the
regional OEDP for 1994-1995.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners of Otter Tail
County, Minnesota, approves the 1994-95 update of the Overall Economic Development Plan
for west central Minnesota.

MINNESOTA TEAMSTERS PUBLIC AND LAW ENFORCEMENT
EMPLOYEES UNION, LOCAL NO. 320
HUMAN SERVICES PROFESSIONAL UNIT
Motion by Partmann, seconded Lee and unanimously carried to authorize the Chairman to
sign the Labor Agreement between Minnesota Teamsters Public and Law Enforcement
Employees Union, Local No. 320 Human Services Professional Unit and Otter Tail County
from January 1, 1994 through December 31 1 1996.
AMOR TOWNSHIP
CABARET DANCING ORDINANCE
After further conversations with Amor Township officials, the Sheriff, Chief Deputy,
County Attorney and others, a motion was made by Lee, seconded Partmann and unanimously
carried to direct the County Attorney's office to draft a proposed county-wide ordinance
(excludes towns and cities) with regard to regulation of nude dancing through liquor
licensure.
BID AWARD: S.A.P. 56-599-43
Motion by Lee, seconded Stone and unanimously carried to award the bid for
S.A.P. 56-599-43 for Elizabeth Township Bridge Replacement to the lowest bidder as
recommended by the Highway Engineer:

Upon a motion by Lee,
resolution was adopted:
S.A.P. 56-599-43 RESOLUTION
seconded Partmann and unanimously carried 1 the following
WHEREAS, the County of Otter Tail has applied to the Commissioner of Transportation for
a Grant from the Minnesota State Transportation Fund for the Construction/Reconstruction
of Township Bridge No. 97438 (Project No. S.A.P. 56-599-43) over the Pelican River and,
WHEREAS, the amount of the grant has been determined to be $10,866.30 by reason of the
lowest responsible bid.
NOW, THEREFORE, BE IT RESOLVED, that the County of Otter Tail does hereby affirm that
any cost of the bridge in excess of the grant will be appropriated from the funds
available to the County of Otter Tail, and that any grant monies appropriated for the
bridge, but not required, based on the final estimate, shall be returned to the
Minnesota State Transportation Fund.

CITY OF DALTON REQUEST
Motion by Stone and seconded Lee to proceed to grant three acres of land, located on the
north side of Highway 12 and the west side of Dalton, to the City of Dalton for their
economic development purposes. After discussion, the motion was withdrawn. A motion
was then offered by Partmann, seconded Windels and unanimously carried to table this
matter pending further information.

Motion by Portrnann, seconded Lee and unanimously carried to authorize the Chairman's
signature on the following contracts as approved by the County Attorney and requested by
the Highway Engineer:

Replacement & Grading for 1:00 p.m. on September 27, 1994.

FINAL PAYMENT
Motion by Partmann, seconded Lee and unanimously carried to approve payment to
H.V. Johnston Culvert Company, St. Paul, MN, in the amount of $26,672.41, as awarded on
April 5, 1994.
LAND SURVEYOR'S CERTIFICATE OF CORRECTION TO PLAT
Name of Plat: WHITE SANDS ESTATES
Motion by Lee, seconded Partmann and unanimously carried to approve the following land
surveyor's certificate to plat.
Pursuant to the provision of Chapter 505.175, Laws of Minnesota, 1957, David A.
Anderson, Registration No. 13620, the undersigned, a Registered Land Surveyor in and for
the State of Minnesota, declares as follows:
1. That the plat of WHITE SANDS ESTATES, dated January 23, 1981, and filed on May 27,
1981 in the office of the County Recorder, Otter Tail County, Minnesota, in Book Q
of Plats, Page 368, was prepared by Kermit T. Bjorgum, Registered Land Surveyor,
Minnesota registration #3548, now deceased.
2. That said plat contains the following incorrect label to wit:
The plat lays just inside the west border of Government Lot 2, Section 5, Township
133, Range 40, of Otter Tail County, Minnesota. The plat incorrectly labels the
west border of Government Lot 2, the 11 EAST LINE OF GOV'T LOT 2".

Motion by Portmann, seconded Lee and unanimously carried to approve prepayment, in the
amount of $268.34, to Mills Fleet Farm for four 30x50' poly tarps with payment to be
made from the Solid Waste Fund.

ASSESSMENT CERTIFIED
Motion by Lee, seconded Fortmann and unanimously carried to certify the assessment of
the following abatement costs per M.S. Chapter 145A.04 on the payable 1995 tax rolls:

DITCH VIEWERS
Motion by Partmann, seconded Lee and unanimously carried to authorize the payment of
mileage at the rate of $.28/mile round-trip from the ditch viewer's residence while
serving as an Otter Tail County Ditch Viewer. Ditch Viewers will receive meals provided
from the Law Enforcement kitchen as appropriate while providing ditch viewing services.
TAX FORFEITED LAND
Motion by Lee, seconded Portrnann and unanimously carried to authorize the Auditor to
proceed with advertising for bids for the demolition of specific tax forfeited property
located in the City of Pelican Rapids.
OTTER TAIL COUNTY DRAINAGE DITCH NO. 23
William Peterson, Attorney, has petitioned the Minnesota Environmental Quality Board on
behalf of his client, requesting that an Environmental Assessment Worksheet and an
Environmental Impact Statement be prepared for the proposal to repair Otter Tail County
Drainage Ditch No. 23.
A decision with regard to the repair of Ditch 23 was suspended pending notification to
the county from the Minnesota Environmental Quality Board.
ADJOURNMENT
At 4:03 p.m., Chairman Windels declared the meeting of the Otter Tail County Board of
Commissioners adjourned until 9:30 a.m.1 Tuesday, September 6 1 1994.
