CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, July 12, 1994, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Harley Windels, Chairman; Andy Lindquist; Bill Stone; Virginia Partmann; and Malcolm Lee present. APPROVAL OF MINUTES Motion by Lindquist, seconded Lee and unanimously carried to approve the July 5, 19941 minutes as submitted. BID OPENING: '94 TRAFFIC MARKING CONTRACT The Highway Engineer, after having previously advertised for bids, opened the 1994 Traffic Marking Contract bids as follows: A.A.A. Striping Service Co. $ 92,817.05 Rogers, MN 0 Swanston Equipment Companies Fargo, ND $109,085.60 Traffic Marking Services Buffalo, MN $ 96,274.66 The Highway Engineer will provide bid summaries and award recommendations at the July 19, 1994, Board meeting. UTILITY AGREEMENT Motion by Partmann, seconded Lindquist and unanimously carried to authorize the Chairman's signature on a Utility Agreement with Otter Tail Power Company on CSAH Projects S.P. 56-614-09 & 10 at a not-to-exceed figure of $16,233.63 as recommended by the Highway Engineer. AMENDMENT: PHELPS MILL DAM REPAIR GRANT AGREEMENT Motion by Lindquist, seconded Fortmann and unanimously carried to authorize the Chairman's signature on an Amendment to the Phelps Mill Dam Repair Grant Agreement which will extend the time period to September 30, 1994. ELIZABETH TOWNSHIP BRIDGE REPLACEMENT PROJECT Motion by Lee, seconded Lindquist and unanimously carried to authorize the Highway Engineer to proceed with setting the bid opening on the Elizabeth Township Bridge Replacement Project for 1:00 p.m. on August 16, 1994. 0 Otter Tail County Board of Commissioners July 12, 1994 Page 2 TOWNSHIP CULVERT REPLACEMENTS Motion by Stone, seconded Portmann and unanimously carried to authorize the Highway Engineer to proceed with the replacements of culverts in Eastern and Elmo Townships under the established culvert replacement policy. EASTERN TOWNSHIP ROAD Motion by Stone, seconded Lindquist and unanimously carried to approve the request of the Highway Engineer to participate in rebuilding of CSAH 71 where it intersects a specific Eastern Township road at an estimated cost of $1,500. Safety issues were cited as a reason to consider this request. PHELPS MILL PARK: TENDER FOR DAM A motion was offered by Lindquist1 seconded Stone and unanimously carried to transfer the duties of tending the Phelps Mill Dam to the Phelps Mill Park Caretaker with payment for these additional duties to be $60 per month. PLANNING COMMISSION RECOMMENDATIONS Motion by Lindquist, seconded Lee and unanimously carried to approve the following recommendations of the Planning Commission as presented by Tim Griep of the Land & Resource Management Office: Conditional Use: Preliminary Plat: Joseph M. Smith, Pelican Lake Wayne Frazier, et al., Crystal Lake Lyle J. Bring, Lake Lida 11Sunnyside Acres 11 , Gary Schoon1 East Leaf Lake Conditional Use/Preliminary Plat: "Beatty Shores", Wayne Beatty, Little Pine Lake Note: For further information on any of the above Conditional Use/Preliminary Plat Applications, contact the Land & Resource Management Office. EMPTY PESTICIDE CONTAINER COLLECTION REPORT Marie Tysdal, Public Information Officer, reported on the county's empty pesticide container collection held at three locations on July 7-8. Though the collection efforts were praised, concern was expressed by Board members over poor participation of ag chemical dealers. WEST CENTRAL MINNESOTA INITIATIVE FUND Wes Binner, Development Specialist; Lowell Larson, Executive Director; and Roy Larson, Board member of the West Central Minnesota Initiative Fund provided the Board an update of the West Central Minnesota Initiative Fund's activities. 0 0 Otter Tail County Board of Commissioners July 12, 1994 Page 3 PROPERTY TAXES Bob Moe, Assessor, discussed countywide timberland classification increases to 10 percent as well as a number of other classification changes in various assessment districts as changes of real and personal property values for 1994. 1995 ASSESSMENTS be at other A motion was made by Partmann, seconded Lee and unanimously carried to authorize the Assessor to contract with local assessors and/or qualified private individuals to assess townships and cities as needed. RECLASSIFICATIONS Diane Thorson, Kevin Newborg and Chuck Kitzman, members of the Reclassification Committee, discussed reclassification requests their committee has received from several department heads. It was the concensus of the Board for the committee to freeze all requests for reclassification until the new classification system is in place. LICENSE APPLICATIONS A motion was made by Lee, seconded Portmann and unanimously carried to approve the following application: Hidden Acres Resort Set-up Permit Craig Ronning Vergas, MN COUNTY DRAINAGE DITCH NO, 23 Motion by Portmann, seconded Lee and unanimously carried to approve the transfer of $5,100 from the General Fund to the County Ditch Fund for County Drainage System #23. Motion by Lee, seconded Stone and unanimously carried to approve payment, in the amount of $5,100.00, to Interstate Engineering, Inc., for County Drainage System #23 engineering services completed as per the contract dated December 15, 1993. POSTAL VERIFICATION CARDS Motion by Portmann, seconded Stone and unanimously carried to approve an agreement between Otter Tail County and the InterTechnologies Group of the Department of Administration through the Office of the Secretary of State for the production and mailing of Postal Verification Cards for the period of August 1, 1994 through June 30, 1995. Otter Tail County will be billed quarterly at a cost of 23 cents per Postal Verification Card. APPLICATION FOR EXEMPTION FROM LAWFUL GAMBLING LICENSE Commissioner Lee expressed no objection to an Exemption From Application by the Fergus Falls Chapter of Ducks Unlimited. for August 31, 1994, at Elks Point in Dane Prairie Township. REQUEST FOR FORGIVENESS Lawful Gambling License The activity is scheduled Motion by Portmann, seconded Stone and unanimously carried to deny the request from Homestead Building Supplies for abatement of interest and cost in the amount of $79.74 according to statute and established policy. 0 0 0 Otter Tail County Board of Commissioners July 12, 1994 Page 4 GRAVEL PIT Motion by Stone, seconded Lee and unanimously carried to authorize the County Auditor to proceed with the advertising of bids for the public sale of the following described gravel pit: Township 131 N. Range 38 W. Section ll (Effington Township) Beginning at a point 233' West and 16.5' South of the East Quarter corner of Section ll Township 131 N Range 38 w, thence West 200', thence South 300', thence East 200', thence North 300' to point of beginning, containing 1.38 acres more or less. Motion by Partmann, seconded Stone and unanimously carried to authorize the County Attorney to prepare appropriate documents to clear Otter Tail County's interest in the following: That tract or parcel of land described as follows: Beginning at a point 33' North of the Southwest corner of the Northeast Quarter of Section 19 Township 133 N Range 42 W thence 200' North, thence 359.7' East, thence 200' South, thence 359.7' West to the point of beginning, containing 1.25 acres more or less, that same being in Lot 6 according to the government survey thereof, the same to be used as a gravel pit and the gravel to be used only for road purposes. The gravel is not to be taken from a greater depth than one foot below road grade and when County has taken all gravel on said premises to said depth land is to revert back and belong to granters herein. That tract or parcel of land described as follows: Beginning at a point 33' East and 441.7' North of the SW corner of the NEl/4 of Section 19, Township 133 N, Range 42 W, running thence 208.7' North, thence 208.7' East, thence 208.7' South, thence 208.7' West to the point of beginning, containing one acre more or less. That tract or parcel of land described as follows: Beginning 33' East and 233' north of the southwest corner of the Northeast quarter, Section 19, township 133 N, Range 42 W, running thence 208.7' North, thence 208.7' East, thence 208.7' South thence 208.7' west to the point of beginning containing l acre more or less. Provided that the gravel pit to be constructed or used, if any be used, shall not be more than one foot below road grade, and no gravel is to be removed except for road purposes, or used for other purposes. When the County or its officers shall have ceased.to use the above described land for the purposes and uses aforesaid the title to said land shall revert to the parties of the first part their heirs and assignees.
