CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, July 5, 1994, at
9:30 a.m. at the Otter Tail County Courthouse with Commissio~ers Harley Windels,
Chairman; Andy Lindquist; Bill Stone; Virginia Partmann; and Malcolm Lee present.
APPROVAL OF MINUTES
Motion by Stone, seconded Lee and unanimously carried to approve the minutes of
June 28, 1994, as submitted.

DRIVER'S LICENSE ACCOMMODATIONS
Motion by Lee, seconded Partmann and unanimously carried to approve leasing the National
Guard Armory for a period of nine days at a total cost of $225.00. The facility will be
used to issue driver's licenses until the new equipment is installed at the Courthouse.
BID OPENING AUTHORIZED
Motion by Lee, seconded Partmann and unanimously carried to authorize the
Highway Engineer to proceed with advertising for bids on S.A.P. 56-653-05 & Etc. for
1:00 p.m. on August 2, 1994.
MAINTENANCE AUTHORIZED
Motion by Partmann, seconded Lindquist and unanimously carried to authorize the
Highway Engineer to proceed with obtaining quotations for the painting of the mill at
Phelps Mill Park. Quotations will include replacement of needed trim boards.
ROADSIDE MOWING CONTRACTS
Motion by Lindquist, seconded Partmann and unanimously carried to authorize the
Chairman's signature on the roadside mowing contracts of Steve's Road Maintenance for
Areas A, B & D and Nick Rohr for Areas C & G.
PAYMENT OF BILLS
Motion by Lee, seconded Partmann and unanimously carried to approve payment of bills per
Attachment A of these minutes.

PAYMENT APPROVED
Motion by Lee, seconded Lindquist and unanimously carried to approve payment to the Soil
Conservation Service, in the amount of $19,528.29, for costs incurred in furnishing
technical assistance in accordance with the Soil Survey Agreement for the period of
April 1, 1994 to June 30, 1994.
FINAL PLAT
Motion by Lindquist, seconded Lee and unanimously carried to approve the final plat of
Pebble Shores First Addition as presented.
EXTENSIONS
Motion by Lindquist, seconded Lee and unanimously carried to approve requests for
extensions to September 1, 1994, of final plats on the following:
Axdahl Beach, Round Lake
Mar Car Acres, South Turtle Lake
Klar-Jo Beach, West Battle Lake
SEWAGE DISPOSAL SYSTEM CLEANERS APPLICATION
Motion by Lee, seconded Partmann and unanimously carried to approve the Application for
Sewage Disposal System Cleaners License of Ketters Septic, Frazee, MN.
Motion by Lee, seconded Lindquist and unanimously carried to approve the Application for
Sewage Disposal System Cleaners License of Art W. Anderson Pumping Service,
Detroit Lakes, MN, for two trucks.
INDIVIDUAL SEWAGE TREATMENT SYSTEM ACT
Bill Kalar, Land & Resource Management Director, provided a fact sheet about the
Individual Sewage Treatment System Act which was signed into law on May 10, 1994. Some
general discussion followed with regard to the difficulty of enforcement.
MISSISSIPPI HEADWATERS BOARD
After discussion with the Land & Resource Management Director, a motion was offered by
Lee, seconded Partmann and unanimously carried to direct Bill Kalar to answer the letter
regarding the Mississippi Headwaters Board. Kalar would indicate in his letter that the
Otter Tail County Board of Commissioners did not feel their involvement on the
Mississippi Headwaters Board would be beneficial to the residents of Otter Tail County.
A copy of our shoreline ordinance would accompany the letter.
RESOLUTION AUTHORIZING CHALLENGE GRANT AGREEMENT
Motion by Lee, seconded Lindquist and unanimously carried the Otter Tail County Board of
Commissioners adopts the following resolution:
WHEREAS, Otter Tail County has a state approved Comprehensive Local Water Plan, covering
more than 50 percent of the county land area, which has been a locally adopted pursuant
to Minnesota Statutes, Sections 103B.311 and 103B.315, which the county has undertaken
to implement; and
WHEREAS, the State of Minnesota, through its Board of Water and Soil Resource, has made
State grant funds available to counties for the accelerated implementation of local

water plans, if a county agrees to provide matching funds or in-kind goods and services;
and
WHEREAS, Otter Tail County has received an offer of in-kind goods and services and
limited funds from the organizations named and in the amounts indicated on the list
attached hereto and marked "Exhibit A," to be used as a match for state challenge grant
funds to be used to accelerate and coordinate water quality monitoring and implement
best management practices in the upper Otter Tail River watershed; and
WHEREAS, Otter Tail County wishes to apply for $55,400.00 in state grant funds and
agrees to provide matching funds and in-kind goods and services in the amount of at
least $60,500.00, obtained through the contributions of organizations and associations,
as listed on Exhibit A.
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners accepts
the offer of funds and in-kind goods and services from the organizations and in the
amounts listed on the attached Exhibit A, to be used as a match for state challenge
grant funds.
BE IT FURTHER RESOLVED that the Chairman of the Board and the Clerk of the Board are
authorized to sign the grant agreement and all other related documents on behalf of
Otter Tail County.

RECESS CALLED
At 2:05 p.m., Chairman Windels recessed the meeting of the Otter Tail County Board of
Commissioners until 7:00 p.m. for the public hearing on Otter Tail County Drainage
Ditch No. 23.
BOARD RECONVENES
The Otter Tail County Board of Commissioners reconvened at 7:00 p.m. to review with the
public the engineering report prepared by Interstate Engineering, Inc. and to receive
public comment regarding the engineers proposed repairs to County Drainage System
No. 23.
PUBLIC HEARING: ENGINEERING REPORT ON COUNTY DRAINAGE SYSTEM NO. 23
The following county staff were in attendance:

Chairman Windels called upon the County Attorney to state the purpose of the public
hearing. Wally Senyk, County Attorney, indicated that the purpose of the public hearing
was to provide the public with an overview of the engineer's report and to provide the
public with an opportunity to ask questions and to comment on the report and the
proposed repairs. Mr. Senyk indicated that since the original petition for repair did
not contain the signatures of at least 26% of the affected property owners the County
Board of Commissioners would have to determine that the proposed repairs are in the best
public interest of the affected properties before they could order a repair of County
Drainage System No. 23.
Chairman Windels called upon Randy Pope, a representative of Interstate Engineering,
Inc., to provide those in attendance with an overview of the engineering report that had
been prepared by Interstate Engineering, Inc. Mr. Pope provided a very detailed
overview of the history of the drainage system, the current conditions of the drainage
system, the proposed repairs and repair areas and the cost estimate. A copy of the
engineer's report is on file in the County Auditor's office and is available for public
inspection. After Mr. Pope's presentation Chairman Windels opened the meeting to the
public for questions regarding the engineer's report. Both Chairman Windels and County
Attorney Senyk informed those in attendance that Interstate Engineering, Inc. had been
engaged to determine how the drainage system functioned at the time of its construction
and what would now be required to make the drainage system function as it was originally
constructed.
Chairman Windels called upon Terry Lejcher, Area Hydrologist with the Department of
Natural Resources for his comments regarding the engineer's report and to answer
questions from the public. Mr. Lejcher indicated that Mr. Pope had discussed the
engineer's report with him and that he had no disagreements with the report. Mr.
Lejcher provided both historic and current information regarding the water elevations of
Dead Lake and Star Lake. Mr. Lejcher also defined, for those in attendance, the
ordinary high water level. Mr. Lejcher indicated some very conservative estimates,
based on many assumptions, as to how each lake would be affected if the drainage system
is repaired. Mr. Lejcher indicated two proposed repair areas would require permits from
the Department of Natural Resources. Mr. Lejcher addressed the natural channel between
Star Lake and Dead Lake. He provided information as to who could work in the channel
area and what type of work could be done in the channel area, with a permit, that might
increase the flow capacity of the channel.
Chairman Windels opened the meeting for public comment. Many individuals asked
questions of Mr. Pope, Mr. Lejcher, and Mr. Senyk and many individuals provided public
comments to the County Board of Commissioners regarding County Drainage System No. 23.
The full text of the meeting is contained on tape which will be on file in the County
Auditor1 s office for ninety days. The following is a summary of the ideas, questions,
concerns and comments that were shared at the hearing:
1. There was much discussion regarding the size of the culvert that will be placed
under the township road if the drainage system is repaired. The engineer's
report proposed a 48 11 round culvert. Mr. Pope indicated that the information
contained in the report was based on the size of the culvert under County
Road No. 35 and was included for informational purposes and was not an absolute
requirement. Mr. Lejcher proposed a 36 11 arch pipe. A 36 11 arch pipe has a
width of 44" and a height of 27 11 •

2. It was understood that the proposed cost, not including the installment of the
culvert under the township road, would be approximately $8,000.
3. Concern was expressed regarding how difficult it might be to install the
culvert under the township road and how much that project might cost.
4. Concern was expressed that the repairs to the drainage system may have damaging
affects to other township roads affected by this drainage system.
s. Concerns were expressed regarding the effect beaver dams have on the drainage
system.
6. There was a concern expressed regarding the quality of the water that would
flow through the drainage system. It was mentioned that the drainage system
flows through a wetlands area that would serve as a very good filtering system
to protect Dead Lake.
7. There was a discussion regarding the location of lake gauges.
8. There was a discussion regarding the maintenance of the natural chan,.nel as
opposed to repairing the drainage system. It was mentioned that the drainage
system is the shortest distance between Star Lake and Dead Lake. It was also
mentioned that it may be more cost effective to repair and maintain the
drainage system then it would be to maintain the natural channel.
9. A concern was expressed that if the drainage system is repaired, what guarantee
do the property owners have that it will be maintained in the future. It was
indicated that an annual inspection of the drainage system is required.
10. A question was asked why Big McDonald Lake and Round Lake were allowed to dump
their excess water into Star Lake.
11. There was a discussion regarding who is the drainage ditch authority and who
will pay for the costs of the drainage system repairs.
12. Many individuals expressed concern over the continued loss of their property
due to the rising water level and the effect the increased water level is
having on their septic systems.
13. Some individuals indicated that the repairs should not be done and that nature
should be allowed to run its course. They pointed out that over the course of
history there are periods of both high and low water elevations.
14. The need to redetermine the benefits of the drainage system was also discussed.

ADJOURNMENT
With no additional comments or concerns being expressed, Chairman Windels indicated that
the County Board of Commissioners would review the information presented and would make
their decision at the July 19th, 1994 Board of Commissioners meeting. At 9:25 p.m.,
Chairman Windels declared the public hearing adjourned. The next regularly scheduled
meeting of the Otter Tail County Board of Commissioners is set for 1:00 p.m. on Tuesday,
July 12, 1994.
