HomeMy WebLinkAboutBoard of Commissioners - Minutes - 06/21/19940 0 Minutes of the OTTER TAIL COUNTY BOARD OP COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, June 21, 1994 9:30 a.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, June 21, 1994, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Harley Windels, Chairman; Bill Stone; Virginia Partmann; and Malcolm Lee present. Commissioner Andy Lindquist was absent. APPROVAL OP MINUTES Motion by Lee, seconded Partmann and unanimously carried to approve the June 14, 1994, minutes as corrected. ANNUAL COUNTY AGRICULTURAL INSPECTOR'S REPORT FOR 1993 EAST OTTER TAIL COUNTY Motion by Lee, seconded Partmann and unanimously carried to accept the East Otter Tail County Annual County Agricultural Inspector's Report for 1993 as presented by Ken Becker, Ag/Weed Inspector. NOXIOUS WEED APPEAL COMMITTEE Motion by Stone, seconded Partmann and unanimously carried to reappoint the following to serve on the Noxious Weed Appeal Committee pursuant to M.S. 18.83, Subd. 3 (2). Lindquist will represent West Otter Tail and Windels will represent East Otter Tail. Additional membership of the appeal committee will include Donald W. Schroeder of Fergus Falls Township and Alfred Meyer, Henning, to represent both East/West, with Truman Eggum of Dalton to serve as alternate. NOXIOUS WEED APPEALS MEETINGS Motion by Stone, seconded Partmann and unanimously carried to conduct the Noxious Weed Appeal Committee meetings for both East and West Otter Tail County to be held as necessary, on Monday evenings at 7:30 p.m. in the Commissioners' Room of the Otter Tail County Courthouse. EQUIPMENT AUTHORIZED Motion by Partmann, seconded Lee and unanimously carried to authorize Ken Becker, Ag/Weed Inspector, to purchase an answering machine at a cost not to exceed $100. SMALL CITIES GRANT Dennis Christenson, Fergus Falls Housing & Redevelopment Authority, presented for approval the Residential Antidisplacement & Relocation Assistance Plan for Otter Tail County. A motion was offered by Lee, seconded Partmann and unanimously carried to authorize the Chairman to sign the plan as presented. 0 0 () Otter Tail County Board of Commissioners June 21, 1994 Page 2 ADMINISTRATIVE CONTRACT WITH FERGUS FALLS HRA Motion by Partmann, seconded Lee and unanimously carried to authorize the Chairman's signature on the Administrative Contract with Fergus Falls HRA from July 1, 1994 to December 31, 1996. HOUSEHOLD HAZARDOUS WASTE MANAGEMKNT PROGRAM Motion by Partmann, seconded Lee and unanimously carried to authorize the Chairman's signature on the joint household hazardous waste management contracts with Grant, Traverse and Wilkin counties. EQUIPMENT PURCHASE REQUEST Motion by Lee, seconded Stone and unanimously carried to delay action for one week on the request of the Management Information Systems Director to purchase a burster. Brand was authorized to proceed with evaluation of a demonstrator burster and requested to return to the Board with departmental budget figures. Motion by Partmann, seconded Stone and unanimously carried to authorize the MIS Director to proceed with replacement of fourteen uninterrupted power source batteries at a cost of $194 per battery._ 1994 SEWAGE DISPOSAL SYSTEM CLEANERS LICENSE APPLICATIONS Motion by Lee, seconded Partmann and unanimously carried to approve the following 1994 Sewage Disposal System Cleaners License Applications: Badger Sanitary Service, Alexandria, MN A-1 Toilet Rental, Waite Park, MN EXTENSION OF FINAL PLAT Motion by Lee, seconded Stone and unanimously carried to approve a sixty day extension regarding the filing of the final plat of Tanglewood, Little Pelican Lake. COUNTY DRAINAGE DITCH NO. 23 Randy Pope, representative of Interstate Engineering, Inc., provided a detailed report on data gathered for County Drainage Ditch No. 23. Also commenting on the report of the ditch was Department of Natural Resources Hydrologist, Terry Lejcher. After discussing the report, a motion was offered by Partmann, seconded Lee and unanimously carried to order a public hearing for the purpose of public discussion and review of the engineering report prepared by Interstate Engineer, Inc. The public hearing will take place on Tuesday, July 5, 1994, at 7 p.m. at the Otter Tail County Courthouse. COUNTY DRAINAGE DITCH NO. 21 A motion was made by Partmann, seconded Stone and unanimously carried to appoint Howard Geese, Rod Brause and Richard Bergquist as ditch viewers of County Drainage Ditch No. 21 and to proceed under the direction of the Ag/Ditch Inspector, Tiny Holm. DITCH VIEWER TRAINING CERTIFICATION SEMINAR Motion by Partmann, seconded Lee and unanimously carried to authorize the attendance of the Ag/Ditch Inspector and those appointed ditch viewers who are available to attend a certification seminar in Olivia, MN, at an individual registration of $9 (includes meal). 0 Q Otter Tail County Board of Commissioners Jui-ie 21, 1994 Page 3 COUNTY SAFETY PROGRAM & FUNDING Tim Hunt, Safety & Emergency Services Director, along with Mary Barthel, Executive Liaison & Qualified JSA, provided a summary of the county's safety program. An update of the emergency services program was also provided by Hunt. OSHA PAYMENT Motion by Lee, seconded Partmann and unanimously carried to authorize payment up to $1,705, payable to the Minnesota Department of Labor & Industry, the result of an OSHA reinspection. BILLS APPROVED Motion by Partmann, seconded Stone and unanimously carried to approve the payment of bills per Attachment A of these minutes. BID OPENING: S.A.P. 56-675-22 After having previously advertised for bids on Project S.A.P. 56-675-22, the Highway Engineer and Assistant Highway Engineer opened the following bids: Kern & Tabery, Inc. Wadena, MN Mark Sand & Gravel Co. Fergus Falls, MN Starry Construction Co., Inc. Alexandria, MN Tri City Paving Little Falls, MN $723,034.41 $732,589.63 $634,892.07 $730,856.40 A summary and recommendation for bid award will be given by the Highway Engineer at the next board meeting. ROAD RECONSTRUCTION PROJECTS: LAND MONUMENTS After discussion with the Highway Engineer, a motion was offered by Lee, seconded Partmann and unanimously carried to begin the procedure on highway reconstruction projects to re-establish and certify section corners and quarter corners. The motion also requested the Highway Engineer to draft a proposed amendment to the Subdivision Ordinance wherein the same responsibility would be placed on land developers. PARADE REQUESTS Motion by Windels, seconded Stone and unanimously carried to approve the following parade requests contingent upon the Sheriff's approval: Perham Turtle Fest, June 25, 1994 Urbank, June 26, 1994 Also approved in the motion was a request for Miller Bicycle Shop and the Perham Chamber of Commerce to hold a bike race on June 26, 1994, in conjunction with the Turtle Fest, along designated routes contingent upon approval of the Sheriff, and that Otter Tail County would be held harmless in reference to potential liability. a 0 Otter Tail County Board of Commissioners June 21, 1994 Page 4 PHELPS MILL FESTIVAL Chairman Windels appointed Commissioner Stone to serve as the alternate County Board member on the Phelps Mill Committee. HIGHWAY CONSTRUCTION CONTRACT Motion by Stone, seconded Lee and unanimously carried to approve the Chairman's signature on the highway construction contract for Seasonal Supply of Hot Mix Bituminous as awarded on April 12, 1994 to Wadena Asphalt, Inc., Wadena, MN. HIGHWAY DEPARTMENT: PURCHASE ORDER POLICY Motion Stone, seconded Lee and unanimously carried to approve the request of the Highway Engineer to amend the purchase order policy for purchase of $5,000 and above for the Highway Department. PAYMENT APPROVED Motion by Partmann, seconded Lee and unanimously carried to approve payment to Brian Jorgenson Construction, in the amount of $9,491.00, for services provided per the contract awarded by the Otter Tail County Board of Commissioners on Aprils, 1994. The same motion went on to approve payment to Brian Jorgenson Construction, in the amount of $203.87, for additional work at Phelps Mill Park on the mill, the house and the garage. Motion by Lee, Fergus Electric, County Park. seconded Partmann and unanimously carried to approve payment to in the amount of $453.53, for services provided at the Phelps Mill DITCH VIEWERS Motion by Lee, seconded Stone and unanimously carried, to approve the standard per diem payment policy and mileage reimbursement to those individuals attending the ditch viewer training sessions. TAX FORFEITURE SALES RESOLUTION Motion by Partmann, seconded Lee and unanimously carried, the following resolution was adopted: BE IT RESOLVED, by the Board of County Commissioners of Otter Tail County, Minnesota, that all parcels of tax-forfeited land included on the attached list have been classified as nonconservation land; that the basic sale price of each parcel included on the attached list, which is on file with the County Auditor, be approved and authorization for a public sale of this land be granted, pursuant to M.S. 282; that the sale will be held at 10:00 a.m. on Wednesday, August 3, 1994, by the Otter Tail County Auditor at the Otter Tail County Commissioners' Room in the Otter Tail County Courthouse, for not less than the basic sale price; and that all sales shall be for full cash payment per the terms set forth in the Notice of Public Sale of Tax Forfeited Lands. Tysdal was commended by Countryman and Wiley for her efforts with regard to county recycling and solid waste education. LABOR AGREEMENT Motion by Partmann, seconded Lee and unanimously carried to approve and authorize the Chairman's signature on the labor agreement between the county and the Minnesota Teamsters Public and Law Enforcement Employees Union, Local No. 320 -Social Services Support Specialists Unit from January 1, 1994 through December 31, 1996. MEMBERSHIP APPROVED Motion by Portmann, seconded Lee and unanimously carried to approve payment of $250 for associate membership with West Central Educational Cooperative Services Unit (ECSU) for contract purchasing privileges during 1994-95. WEST CENTRAL MINNESOTA INITIATIVE FUND RESOLUTION Upon a motion by Lee, seconded Partmann and unanimously carried the following resolution of support was adopted: WHEREAS, the Economic Development Adminstration of the United States Department of Commerce (EDA) has encouraged the West Central Minnesota Initiative Fund to assist businesses that have been hurt by the rain and flooding of 1993; and WHEREAS, the West Central Minnesota Initiative Fund will be submitting a grant application to the EDA to assist in the capitalization of a $1,000,000 revolving loan fund for that purpose. NOW THEREFORE BE IT RESOLVED, that the Otter Tail County Board of Commissioners of Otter Tail County, Minnesota, does hereby indicate its support for the application of the West Central Minnesota Initiative Fund to EDA for the above mentioned purposes. S. 4 71. 7 05, Subd. ld. ( d) . The performances evaluated were Tom Fawcett, Social Services Director, and Rick Sytsma, Building Maintenance Supervisor. A summary report of performance conclusions will be provided at the next regular Board meeting. ADJOURNMENT At 4:20 p.m. Chairman Windels adjourned the meeting of the Otter Tail County Board of Commissioners.
